MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
JANUARY 8, 1973
The City Council of the City of Downey held a regular meeting at 7:30 p.m,
January 8, 1973, in the Council Chambers of the Downey City Hall, Mayor
Winton presiding.,

The Invocation was delivered by Councilman Morton, followed by the Flag Salute
led by Councilman Temple.
Mayor Winton declared that this is the time and place for the public hearing on
Appeal, Zone Exception Case No, 1088, 10326-40 Dovmey Avenue, He inquired of the
City Clerk if he had the Affidavit of Publication, to which the City Clerk responded
in the affirmative,
Planning Director Goggin reported the applicant has requested a 35-unit condo-
minium development. He said two parking spaces will be provided per unit, as well as
parking for guests. Mr. Coggin stated after continued hearings on the matter, the
Planning Commission approved the request,
Mayor Winton inquired of the City Clerk if he had received any correspondence on
this matter, The City Clerk read a letter which had been received from Willis R.
Hanes and Mercedes C. Hanes, who are in favor of the proposed development.
It was moved by Councilman Jennings, seconded by Councilman Temple, and so ordered
to receive and file the correspondence,
Mayor Winton inquired if there was anyone present who wished to speak in favor of
Appeal, Zone Exception Case No, 1088, 10326-40 Downey Avenue,
Mr. Frank Casdia, Attorney, 10243 Paramount Blvd,, Downey, representing the
appellant, Dr, Ralph O'Brien, referred to 140 replies received in response to a letter
sent out by Dr, O'Brien regarding the proposed condominium, Mr. Gasdia stated he had
not had enough time to properly prepare a presentation, and he requested that this
matter be continued.
It was moved by Councilman DiLoreto and seconded by Councilman Temple to grant a
30-day continuance to Mr. Casdia, as representative of the appellant, in order to
properly prepare a presentation. before the City Council.
Mr, Jack Robinson, 8555 Gainford St„ Downey, spoke in opposition to the
continuance. He referred to the continued hearings before the Planning Commission and
stated he has gone to great expense to prepare a presentation for this hearing and
spent many countless hours on this matter,

Mayor Winton inquired if there was anyone present who wished to speak in favor of
the appeal.

Mayor Winton. asked Mr. Goggin to explain the difference between an apartment,
condominium, and townhouse, Mr. Goggin stated an apartment development is for rental
purposes; a condominium is private ownership where a person would buy air space to
his unit, with the lard owned by the tenants in common; and a townhouse is private
ownership, where a person would buy the unit and land underneath, with the surrounding
land owned by the tenants in common.
Councilman DiLoreto asked Mr. Coggin to describe what is on the property to be
cleared for the condominium development, Mr. Goggin explained there are two properties
involved, each containing a single family residence. He pointed out that St. Marks
school has been using a rear portion of one of the properties for recreational pur-
poses, which was granted sometime back under a zone exception for land use.
Mayor Winton inquired, if there was anyone present who wished to speak in opposi-
tion of the appeal,
Mr, Jack Robinson, 8555 Gainford St„ stated he represents himself and Mr, Bill
Lehman, He explained the project application was for a condominium townhouse develop-
ment to be owned by 35 individual citizens. Mr, Robinson reviewed this matter as it
was presented to the Planning Commission and commented on other projects he has built
in the City, which have upgraded the areas in which they were built. He presented
- various drawings of the condominium project, showing elevations and ground layout,
including garage and parking spaces, and referred to his discussions with Dr. O'Brien
regarding objections to the project. Mr. Robinson spoke regarding a traffic study on
"Downey Avenue, He said the school has not voiced any objections to the proposed pro-
ject. He introduced Mr. Williamson of the L.A. County Air Pollution Control District.
Mr. John Williamson, 10348 Pico Vista Rd., spoke regarding the traffic pattern
on Downey Avenue; traffic pollution emission control statistics; traffic dispersion
data; and a comparison of traffic control systems in and out of condominium.
developments. He said based on published data, this development will not have an
adverse effect on air quality of this particular area.
Speaking to the Environmental Impact Report, Mr. Robinson stated the proposed
project will not create a sewer problem, nor will it create a traffic problem,
Councilman Morton stated he has received a telephone call from Dr. Christensen,
whose daughter attends St. Mark's school, and Dr. Christensen wishes to go on record
as being in favor of the development,
Mr. Goggin reported that under Zone Exception Case #742 on September 20, 1967, a
zone exception was granted to St. Mark's school for use of the rear portion of the
subject property for recreational purposes. He said the zone exception expired on
September 20, 1968.
Mr. Harry Boand, 10340 Downey Ave., speaking in opposition to the appeal, said
the Church Board at St, Mark's had taken a vote and had no objections to the proposed
function for the use of the Land adjacent to the school.
Mayor Winton declared a recess at 9:45 p.m. The meeting resumed at 9:58 p.m. with
all Councilmen present.

Mayor Winton inquired if the appellant wished to speak in rebuttal.
Mr„ Gasdia, representing the appellant, commented that many members of the Board
of Trustees of St, Mark's Church are present as individual members of the congregation,
as residents of the City,, and they object to the proposed development. He spoke in
rebuttal to the traffic studies made on Downey Avenue, Mr, Gasdia reviewed the
Environmental Impact Report and stated there will be an effect on the environment, on
the children.

by the following vote to close the hearing on Appeal, Zone Exception Case No, 1088,

Councilman Temple commented he is in agreement that this is a good development,
however, he does not agree that this area should be zoned R-3. He questioned th.e need
for R-3 in place of R-1 and the possibility of poor planning with mixture of R-3 and
R-1 in the vicinity of Lexington Rd, and Downey Ave, Councilman Temple recommended the
area be zoned R-1,
Councilman Morton expressed his appreciation. to Councilman Temple for his comments,
to „?embers of the audience for their appearance, and commented on the fine manner in
which this case was presented to the City Council, He remarked on the General Plan
studies in tl9is area and the rest of District 4; Councilman Morton stated he is
impressed with the proposed development on. Downey Avenue, He said he feels the project
will not have an impact on the area,
Councilman DiLoreto commented on the merits of Mr. Robinson's developments in the
City and stated an adequate Environmental Impact Report was submitted in this case. He
said he would be in favor of improving an undeveloped piece of property, however, he
_ does not consider removalof homes tlatare not deteriorating as upgrading an area,

the following vote to approve the findings of Environmental Impact Report #72-15, as
amended,

Planning Director Coggin reported the property is located on the northeast corner
of Brookshire and. Imperial„ that the property is zoned R-1, however, it is proposed for
R-3. He said the request is to establish and maintain a 3000 sq, ft, grocery store
with 17 parking spaces and a 42 sq.ft, sign on the front of the building, Mr. Goggin
stated the applicant dial not submit an. Environmental Impact Report ur_til the day before
the Planning Commission meeting; that the Planning Department was unable to review it
and submit a recommendation to the Commission,

Mayor Winton inquired of the City Clerk if he had received any correspondence on
this matter. The City Clerk read letters from C. Larry Hoag and L. Eugene Pickett,
both in opposition to the zone exception.
It was moved by Councilman Jennings, seconded by Councilman DiLoreto, and so
ordered to receive and file the correspondence.
Mayor Winton inquired if there was anyone present who wished to speak in favor of
the appeal.
Mr. Michael Betor, 8346 Gainford St., Downey, the applicant, presented two pictures
to the City Council, showing the property as it now is and how it is proposed. He read
five modifications and reviewed preparation of the Environmental Impact Report (EIR).
Mr. Betor claimed the Planning Commission did not read the EIR. He referred to a peti-
tion presented to the CommlSsiot, signed by 350 persons in the area. He reviewed his
problems with tenants and pointed out that vacancy problems exist with nearby apartments.
Mr. Betor commented on the convenience of a store at this location. He answered questions
of the City Council and explained he would be operating the store himself; that the
business would not be a chain store operation.
Mayor Winton inquired if there was anyone present who wished to speak in opposition,
and there was no response.
Mr. Betor stated that 98 percent of the names on the petition are in favor of a store
at this location and that the store will be a convenience to residents in the area.
It was moved by Councilman Jennings, seconded by Councilman DiLoreto, and passed by
the following vote to close the hearing on Appeal, Zone Exception Case No. 1096, 8509-13
Imperial Highway and 12580 Brookshire Avenue.

Mayor Winton reviewed the background relative to Mr. Betor's request for use of the
property. He compared use of the north side of Imperial for apartments versus the south
side developed with multitude of small businesses. Mayor Winton said he feels there is
Tittle or no reason to build more apartme-.t in this particular area. He said as indica-
ted by the appellant, there are numerous apartment vacancies in the area. Mayor Winton
commented on the rate of pedestrian accidents because of people crossing Imperial to
reach a store. He stated any type of development would be an improvement over the
existing structures on the property, and the appeal would not be a detriment to the City.
Mayor Winton said the Commissioner from District 1 had not raised any objection to the
appeal, nor had he felt it would be bad for the district he represents as Planning
Commissioner.
It was moved by Mayor Winton, seconded by Councilman Jennings, and passed by the
following vote that Appeal, Zone Exception Case No. 1096, 8509-13 Imperial Highway and
12580 Brookshire Avenue, be granted; the Planning Commission decision be overruled; the
matter sent back to the Planning Commission for recommendation and report; and that the
Cormnission review the Environmental Impact Report and report back to Council.
Mr. Coggin commented on the detrimental effects to nearby apartments of having a
store on the subject property. He mentioned adoption of the zoning ordinance, wherein
there be no mixed land uses relative to commercial and residential applications.
Discussion ensued regarding establishing restrictions.
Councilman DiLoreto stated what is being dealt with in this case is Imperial High-
way, He said any decision should be based on what the land can be best used for and
consideration should be given to what is best for the City.

Mr. Goggin requested that the applicant revise the Environmental Impact Report
because it is unsatisfactory. Mayor Winton called for streamlining the procedures
for filing Environmental Impact Reports by applicants.

Discussion followed regarding the processing of Mr. Betor's EIR. Mayor Winton re-
quested Mr. Betor to file another Report with the Planning Commission within the very
near future,

to approve the Minutes of the City Council meeting of December 26, 1972.

Communication from Southern California Water Company regarding Application to
:Increase Water Rates in Central Basin District,
Public Works Director Spindel distributed to the Council copies of a Water Rate
Comparison made by the City of Downey Water Division.
There 'being no objections, the Public Works Department was requested to prepare a,
resolution in opposition to the proposed rate increase. It was suggested by Councilman
Jennings that the City protest the rate increase at the time of the hearing before the
Public Utilities Commission,
Communication from Mrs, Norma Fergus regarding Appeal of Environmental Impact

Acting City Attorney Newton commented that the zone exception in this matter was
approved prior to December 5, 1972, He said, therefore, the project would be exempt
from. the requirement of an Environmental Impact Report pursuant to Assembly Bill 889
and Section 21,169 of the Public Resources Code,
The City Clerk was directed to notify Mrs. Fergus that on advice of Counsel there
would be no appeal on this matter.

SERVICE DEPOSIT REFUNDS

RESOLUTION NO. 2760
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ADOPTING A GENERAL PLAN AND GENERAL PLAN MAP
The Resolution was read by title only, It was moved by Councilman Jennings,
seconded by Councilman Temple, and so ordered to waive further reading.
It was moved by Councilman Jennings, seconded by Councilman Morton, and passed by
the following vote to adopt Resolution No, 2760.
Councilman Jennings commented regarding adoption of the General Plan, adoption of a
zoning Ordinance, and preparation of a new Comprehensive Zoning Map, and he estimated
the amount of time necessary for completion would be two years, including zoning map and
overlays.
Councilman Temple inquired regarding proposed R-4 zoning in District One near the
San Gabriel River, Councilman Morton explained that the area is on the north side of
Imperial Highway next to the River and was studied by Mayor Winton. He said at the
suggestion of the Mayor R-4 was proposed,
Mayor Winton. commented that the study was conducted as requested by the property
wner for Planning Commission consideration.,
Councilman Temple discussed proposed zoning for properties in District Three on
Lubec Street, between Tweedy and Paramount. He said he cannot see the purpose for ex-
tending R-2 zoning onto Lubec and would request the zoning remain R-1.
Referring to Tweedy Lane between Florence and Lubec, Councilman Temple suggested
R-2 zoning with. .an overlay from the apartment house on the west side of the street north
to the single family homes facing Dacosta St, He requested that the area on the map
showing commercial on the east side of 'Tweedy be reduced to conform to existing land
use of the Save -On Drug Store.
Councilman Temple proposed R-2 zoning with an overlay for the southeast corner of
Downey Ave.. and Lexington. Rd, Councilman Morton stated he had no objections.
Councilman Morton commented that the City will be in the zone exception business,
pending finalization of a zoning map. He said any zone exceptions for apartment house
development in the City may be governed by recommendations brought forward by the
Apartment House Survey Committee.
Councilman Morton requested that the Mayor redesignate Councilman Jennings and
himself to assure that the work is carried out on the General Plan, particularly in
accordance with the memo previously submitted.
Referring to Page 2, Section 4 of the Resolution pertaining to the Apartment
)use Survey Committee, Councilman Morton requested that the last three words, "final
'solution adoption" be changed to "final ordinance adoption". The change was noted.

City Manager Thompson explained the project was proposed two years ago. He said
the problem has been that vehicles with greater height have been struck by branches of
trees along this street, and legal claims have resulted against the City.

Report on Los Coyotes Water Renovation Plant Interceptor Sewer
Councilman Jennings requested Council support in preventing the construction of a
proposed 81-inch sewer line, which he said meanders through the residential district
across the City. He suggested that the sewer line be routed to Gardendale Street and
then proceed through the City.
Public Works Director Spindel explained other routes were considered. He said,
however, the route down Paramount to Gardendale was not satisfactory, inasmuch as the
grade on Gardendale is low and the sewer is a gravity sewer.
Mayor Winton recommended that Councilman Morton, as the future representative of the
Los Angeles County Sanitation District, and Councilman Jennings, as the future alterna-

City Manager Thompson reported on Proposed Annexation and De -,Annexation of Property
between the City of Downey and the City of Norwalk, He said the proposal is to move the
Downey boundary line on Cecilia Street to the center of the street, down to the center
line of the San Gabriel channel, and then south to the Bellflower City limits. Mr.
Thompson stated services could be more easily handled by the City of Downey if the
corporation line were in the middle of the street.
After discussion and at the request of Councilman Morton, the matter was taken under
submission.
CITY MANAGER'S REPORT
City Manager Thompson reported 1972 Reclassification and Salary Inequity Study.
He said as a result of negotiations with employee associations and subsequent studies, he
.is making the following recommendations: (1) That the Secretary -Stenographer in the
Building & Safety Department be reclassified to Senior Secretary -Stenographer at 1/2 step
increase, or 2-3/4 percent; (2) A 5-1/2 percent increase for Communications Operator; and
(3) Reclassification of Librarian position, along with cancellation of two Senior
Librarian positions. He presented the following Resolution for adoption.

SAFETY, LIBRARY AND POLICE DEPARTMENTS
The Resolution was read by title only. It was moved by Councilman Jennings,
seconded by Councilman Temple, and so ordered to waive further reading.

Mr, Thompson commented that Public Works employee, Keith. Rasmussen, passed away on
the morning of January 1st.. He said Mr. Rasmussen was one of the original employees in
the Public Works Department and would have received his 15-year pin at the Council meet-
ing of December 26, had he been able to attend. Mr. Thompson requested the Council
adjourn the meeting in memory of Mr. Rasmussen.
Public Works Director Spindel distributed to the Council the 1973 Weed Abatement
Schedule for information only.
ORAL COMMUNICATIONS
Councilman Temple requested that future dedication ceremonies on City projects be
held on Saturdays to allow for more citizen participation,
Councilman Morton expressed his appreciation to Planning Director Coggin for the
work of the Planning Department and Planning Commission for their work on the General
Plan, He commented that the bulk of the work was done by the Planning Department, and
he asked that Mr. Goggin convey to the rest of the Planning Staff the appreciation of
the City Council.
Mayor Winton declared a recess at 12:35 a.m. The meeting resumed at 12:43 a.m.
with all Councilmen present.
Mayor Winton expressed appreciation to his wife and family for their support during
the past year he has served as Mayor. He offered his thanks to all of the City Council
and City Staff for the opportunity to have served as Mayor. Mayor Winton spoke regarding
the rotating basis by which each Councilman has an opportunity to serve as Mayor and
stated it has been a good system that brings balance to the City.

Mayor Winton presented a plaque to each member of the City Council, as a commemora-
tive gesture, and expressed his appreciation for the confidence that was placed in him
during his term as Mayor,
Mayor Winton announced his resignation as Mayor of the City of Downey,
City Clerk Robert Shand assumed the roll as chairman of the City Council meeting,
He declared the office of Mayor open,
It was moved by Councilman Jennings and seconded by Councilman Temple to elect
Councilman Thomas H, Morton as Mayor of the City of Downey,
Mr, Shand inquired if there were any further nominations for Mayor, and there was
no response,
It was moved by Councilman Winton, seconded by Councilman Jennings, and so ordered
to close the nominations for Mayor.

Mayor Morton expressed his gratitude to the City Council for electing him as Mayor
for the coming year and said he accepts the responsibility and the challenge,
Mayor Morton. complimented Councilman Winton on his achievements as Mayor and said
Councilman Winton has set a good pace that the rest of the City Council will have to
measure up to, Mayor Morton presented to Councilman Winton a corsage for Mrs. Winton in
appreciation for serving as the first lady of the City of Downey for 1972.
On behalf of the citizens of Downey and the City Council, Mayor Morton presented a
plaque to Councilman. Winton, commending him for serving this past year as Mayor. He
commented that Councilman Winton served as the City°s 20th Mayor, Mayor Morton further
presented to Councilman Winton a Certificate of Election as Mayor of the City of Downey.
Councilmen Jennings, DiLoreto and 'Temple complimented Councilman Winton on his term
as Mayor and said it has been a pleasure to work with him,
Mayor Morton declared the position of Mayor Pro Tempore open,
It was moved by Councilman Temple and seconded by Councilman DiLoreto to elect
Councilman Richard M. Jennings as Mayor Pro Tempore of the City of Downey.
Mayor Morton inquired if there were any further nominations for Mayor Pro Tempore,
and there was no response,

JANUARY 8, 1973
At the City Council Meeting of January 23, 1973, Councilman Temple requested that
the following be made a part of the City Council Meeting of January 8, 1973. This in-
sertion is a part of Page 1 and would become the third paragraph for the public hearing
on Appeal, Zone Exception Case No. 1088, 10326-40 Downey Avenue.
"Councilman Temple stated he is a member of the church to the south of
the property involved and inquired if this would preclude him from voting
on the matter, Acting City Attorney Newton explained that although a mem-
ber of the church has filed the appeal, the appeal is.not on behalf of the
church itself. He said, therefore, Councilman Temple would not be precluded
from voting on this matter.
