He inquired of the City Clerk if he had the Affidavit of Posting of Notice and Affidavit of Mailing, to which the City Clerk responded in the affirmative. It was moved by Councilman Temple, seconded by Councilman Morton, and so ordered to receive and file the Affidavits. Mayor Winton inquired of the City Clerk if he had received any written protests or objections against the improvements, and the City Clerk replied he had not. Public Works Director Spindel reported the property owners have requested construc- tion of curb, gutter, paving and driveways on Orizaba Street under Chapter 27 proceedings, and he recommended the work be authorized. It was moved by Councilman Morton, seconded by Councilman Temple, and so ordered to accept the report of the City Engineer, Mayor Winton inquired if there was anyone present who wished to speak in protest to Downey Improvement Project No. 637, and there was no response. Public Works Director Spindel explained it was not intended for 72/18 to be included in the public hearing. He said the title of the Resolution is correct. He said the Planning Director should be included in the group that was approved in addition to the Director of Public Works. Public Works Director Spindel explained improvements were required under a Chapter 27 case in 1965, and this has been an annual request since that time, inasmuch as the pro- perty owner has had difficulty in selling or redeveloping the property. He said the asphalt driveways are in good enough condition to last another year. It was moved by Councilman Temple, seconded by Councilman DiLoreto, and passed by the following vote to grant a one year extension of time to install concrete driveway approaches at 9041 and 9049 East Imperial Highway, Downey. Council Minutes 12/26/72 -3- City Manager Thompson commented that although it is not indicated in the letter, the parking lot expansion is a budgeted item, being paid for out of the Hospital's operating budget. He said if the Council desires to approve the addition, he will recommend that the Hospital review this matter with the City 'Traffic Department. Mayor Winton concurred that the traffic flow from the Hospital onto City streets should be considered by the Traffic Committee and, he said, recommendations should be made by Staff and 'Traffic Committee to the Hospital. It was moved by Councilman Morton, seconded by Councilman Jennings, and passed by the following vote to approve the request of the Downey Community Hospital regarding Addition to Parking Spaces, subject to review by the Traffic Committee. Temple stated that many cars were not stopping at the stop sign, inasmuch as the sign is difficult to see, He said there has been, do-s;ble the accidents in the five years since the sign was installed, Councilman viortoti remarked that due to the speeding problem on Rives, the stop sign was put in for the safety of Furman Park, Discussion followed, Councilman Mortoa said he would be in agreement to removing the stop signs if the safety of Furman Park is not jeopardized, and the sign removal would become the responsi- bility of Cou-cilznan Temple, Councilman Temple stated he would accept the responsibility. AYES: 5 Councilmen: Jennings, Morton, DiLoreto, Temple, Winton NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Following a summation of bids, it was moved by Councilman Temple, seconded by Councilman Morton, and passed by the following vote to award Cash Contract #322, Alley Improvements, Well Site No. 8, to Crowell and Larson, the lowest and best bidder, in the amount of the unit prices bid, and to reject all other bids. AYES: 5 Councilmen: Jennings, Morton, DiLoreto, Temple, Winton NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Cash Contract #303, Unit 1, Downey Rio Hondo Golf Course Driving Range Structure Public Works Director Spindel commented on the request for time extension and extra work involved. He said the contractor is asking for an extension of 25 days due to a delay caused by the closing up of the sub -contractor by the Internal Revenue Service, before the steel could be delivered. Mr. Spindel stated that in going over the work schedule, it was discovered that from the time the contractor was notified of the closing of the sub -contractor to the approval of another sub -contractor by the City Council, 19 days had expired, and that is the reason for the request for time extension. City Attorney Sorensen said by the language contained in the specifications, the City Council has the power to determine that the project was delayed beyond the control of the contractor and to grant the extension of time. Councilman Jennings stated he would not consider this the proper time to accept the improvements if the improvements are not completed. He referred to brush mats which will have to be replaced and asked if accepting the improvements would release the contractorvs bond. Mr. Spindel replied the contractor's bond includes a guarantee for all the improve- ments for one year after acceptance. He explained that the brush mats were torn up over the weekend and will be replaced by the contractor. Public Works Director Spindel stated a fine mix was used, and anything finer would not be structurally sound. He referred to an incident that occurred after the asphalt was placed, causing erosion and settlement. Mr. Spindel said the contractor repaired the damage. It was noted that this matter was discussed and reviewed at budget time and was held up due to the fact that an agreement could not be reached at that time. It was moved by Councilman Jennings, seconded by Councilman Temple, and passed by the following vote to approve Increase in Salary for Director of Finance, effective January 1, 1973, as recommended. AYES: 5 Councilmen: Jennings, Morton, DiLoreto, Temple, Winton NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None ORAL COMMUNICATIONS Councilman Jennings referred to a memorandum he and Mayor Pro Tem Morton submitted to the City Council dated November 27, 1972, regarding the Revised General Plan, which presented in open Council meeting and taken under submission. He requested Council vote on adoption of the General Plan. Mayor Winton commented on the changes that will effect District 1 as a result of the Century Freeway. He referred to a color coded map that he presented to the Planning Department, Planning Commission, and City Council showing land use as well as Land zoning. Mayor Winton stated the Commission considered only two items in its Council Minutes 12/26/72 -8- recommendations; that he met with the Planning Director and City Manager to indicate the areas for consideration; and the final recommendation back from the Commission failed to consider all of the areas he had submitted for consideration„ He said if the General Plan is adopted it will be incomplete and will not cover in detail all that District 1 needs. Councilman Morton inquired if there would be any legal objections to adopting the proposed Revised General Plan, excluding District 1. City Attorney Sorensen replied that the Council could adopt an amendment to the existing General Plan, showing the areas the Council wants to adopt. He said, however, he would not exclude District 1, but he would suggest changing the proposed map to show -- that which the Council wishes to adopt. Discussion followed. Mr. Sorensen commented the Council should direct Staff to bring back an appropriate resolution and copy of the plan to be adopted. It was moved by Councilman Morton to have a Resolution on the Revised General Plan placed on the agenda for the next City Council meeting. He requested that the resolu- tion be prepared in draft form and submitted to each Councilman prior to the next meeting for review. Councilman DiLoreto stated that he and Councilman Temple were assigned to work with the Apartment House Survey Committee. He said the Committee has had meetings, and he would not be prepared to vote on the General Plan until such time as the Committee has tendered its recommendation to the City Council. Councilman DiLoreto commented that a report should be forthcoming within 90 days. Discussion ensued. Councilman Morton stated the General Plan needs to be adopted, inasmuch as the citizens have a right to know what the future growth is to be in Downey, and he referred to the length of time this matter has been before the Council. He referred to the patchwork Left by contractors after putting in new developments and stated that the City ends up repairing the patchwork.
