Public Works Director Spindel reported representatives of the Public Works Department
and Building Department have talked to Mr. Socquet; that he has been given an extension
of time; and Mr, Socquet has stated he will clean the Lot, Mr, Spindel requested that
authority be granted. to the Public Works Department, under provisions of Section 5300 of
"re Downey Municipal Code, to clean the lot in the event Mr. Socquet does not do so.
Discussion followed,
It was moved by Councilman Jennings, seconded by Councilman Temple, and passed by
the following vote to grant a 15-day extension for total completion of the backyard
cleanup at 13159 Verdura, and that the Department of Public Works be authorized to pro-
ceed with the cleaning should the property owner not do so.

Council Minutes 8/2.2/72 -1-
Comm:.';,icatio from Ray T. Lake, Director of Building S Safety, requesting a Hearing
on Revocation, Certificate of Occupanc , 8100 Nance Street,
Mr. Lake stated when the first building was erected in 1963 Mr. Governale, the pro-
perty owner, was granted temporary occupancy until such time as he completed the street
improvements. He said Mr. Governale did not complete the paving on that building or on
the second buildi,g, completed in 1969, as required under Section 8100 of the Downey
Municipal Code, Mr. Lake stated Mr. Governale has requested and been granted several
extensions of time by the City to complete the street improvements, and the work has
never been done.
Public Works Director Spi:<d.el spoke regarding Mr. Governale°s attempts to unsuccess-
fully obtain signatures on a petition in favor of forming an assessment district. He
stated :Mr, Governale was required to file a Faithful Performance Bond for the paving at
the first building, however, in order to get the bond acted upon, it would be necessary
to file suit against the bonding company, and he referred to the Court costs that would
be involved, Mr. Spindel said many promises have been made by Mr. Governale to put in
the improvements, however, the work has never been done,
Mr. Spind.el answered questions of the City Council. He said Mr. Governale applied
for and received authority for sidewalk and paving matching funds at the second building,
with the condition that the paving at the first building be completed, however, he did
not take advantage of the matching funds.
Discussion followed.
It was moved by Councilman Jennings, seconded by Councilman Temple, and passed by
the following vote that the previous granting of matching funds for sidewalks and paving
at 8100 Na-.ace Street be revoked, and no further application for such funds be accepted.

Communication from Citizens Health and Sanitation Committee regarding Rubbish
-contracts.
Mayor Winton requested that the members of the Health and Sanitation Committee be
-provided with copies of the .Assembly Bill introduced by Assemblyman Fenton relating to
Solid Waste Disposal, a portion of which requires Local management of all rubbish
disposal.
Discussion followed regarding the Health and Sanitation Committee's recommendation
for certified year-end audits from the rubbish contractors, and the City Council stressed
a. desire for information in this regard. There being no objections, the matter was taken
under submission

RESOLUTION NO. 2717
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
SETTING THE PROPERTY TAX RATE FOR FISCAL YEAR 1972-73
The Resolution was read by title only. It was moved by Councilman Jennings,
seconded by Councilman Temple, and so ordered to waive further reading.
Responding to a question by Councilman Jennings regarding a breakdown of the tax
rate, City Manager Thompson stated the tax rate of $0.54 on each $100 assessed valuation
includes $0.29 for the General Fund and $0.25 for Park & Recreation. Councilman
Jennings requested staff, and particularly the Park & Recreation and Finance Departments,
that the City no longer discuss the tax rate as being two separate taxes; that it be just
a general property tax of $0.54.

RESOLUTION NO. 2718
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
SETTING THE PROPERTY TAX RATES OF THE LIGHTING DISTRICTS
FOR FISCAL YEAR 1972-73
The Resolution was read by title only. It was moved by Councilman Jennings,
seconded by Councilman 'Temple, and so ordered to waive further reading.
City Manager Thompson and Public Works Director Spindel answered questions of
Councilman .Jennings regarding comb-ining all the lighting districts into one. It was
explained that each district is based on the type of lighting used, and standards would
have to be set so that everyone would get equal lighting for equal payments. Mr.
Spindel stated the reason the Downey County Lighting District rate is low is that many
areas in the district have no lights,
City Attorney Sorensen advised that the City Council would have to hold the
necessary public hearings to combine all of the lighting districts.

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ADDING, A SECTION ON TEMPORARY REPLACEMENT AND CLARIFYING
VACATION ACCUMULATION IN THE PERSONNEL MANUAL
The Resolution was read by title only. It was moved by Councilman Jennings,
seconded by Councilman Temple, and so ordered to waive further reading.
City Manager Thompson reported on the changes that were made in the Resolution:
One extends the vacation accumulation to 28 days; and the other is a change in the total
__length of vacation time allowed.
Regarding Section 2, paragraph 3., Mayor Winton stated he does not feel a supervisor
should be given authority to prohibit an employee from taking a vacation in any 12-month
period, City Manager Thompson explained a supervisor would not be given the authority
to deprive an employee from taking a vacation. He said the section would provide for an
extension of the maximum vacation time accrued by an employee in the event a supervisor
has asked the employee to work during his scheduled vacation due to a particular problem.
Discussion followed. Mr. Thompson answered questions of the City Council.

no misuse of supervisory authority.

Public Works Director Spindel reported on the contract for grading on Cash Contract
. Wilderness Park, which was advertised on a unit price basis for time and
materials for different types of equipment used, labor, overhead and profit. He said the
___bids received were adjusted in order to get a valid comparison, and he recommended that
ontract be awarded to Maness Excavating d Grading, Inc., the Low bidder.
Mr. Spindel answered questions of the City Council. He said even though the
contractor's low bid estimate of $16,000 would change, depending on the amount of time
and equipment used to complete the grading, the City would maintain control so that the
costs would probably not exceed an estimated total of $25,000 for the work.
City -Attorney Sorensen explained the City Council would not be authorizing a
specific amount --it would be awarding the bid based on unit prices, or daily rates, and
the amount could exceed $25,000 if it took longer to do the work, unless a maximum amount
were set.

Cash Contract #SS-266, Old River School Road at Quill Drive, Traffic Signal
Public Works Director Spindel explained that the City has received a rebate on the
'ost of the project, which was shared one-half with the County. He said the cost for
re -ramping the curbs for use by wheel chairs is approximately $600, which was paid for
entirely by the City. Mr. Spindel explained further it has been determined by legal
opinion that wheel chair ramps do not have to be put in on all new construction, but are
to be put in where considered necessary,

Mayor Winton declared a recess at 9.20 a.m. The meeting resumed at 9:35 a.m. with
Councilmex^ Jennings, Temple, Winton present; Councilmen Morton, DiLoreto absent,
Dr. John Abbey, Chairman, of the Long Range Planning Committee and Planning Task
Force of the Downey Community Hospital reported on Proposed expansion of the hospital,
He said the first phase of the expansion. will include the addition of a two-story tower
for an enlarged lobby and gift shop, auditorium, conference rooms, and dining facility.
Dr. Abbey stated $95,000 has been donated from the medical staff, Hospital Auxiliary,
and Friends of Downey, and the balance would be $105,000 in order to complete the addi-

additional beds, Dr, Abbey stated additional beds are especially needed. He answered
questions of the City Council regarding the future plans for expansion.
Councilman Jennings stated it is vital that a community hospital keep abreast of
_the needs of the community. He said because the City is Liable for the hospital revenue
,onds, he would request the matter be taken under submission until the next City Council
ieeting when a full Council will be present,
There being no objections, the proposed expansion of the Downey Community Hospital
was taken -under submission for the next City Council meeting,

Councilman Temple commented that he has been working on the proposed Routes for
Bicycle Paths through the City of Downey, and he will be going door-to-door circulating
a questionnaire among residents along the proposed route, seeking their opinion with
regard to Limiting parking on certain streets,
At the request of Councilman Jennings, a meeting of the Golf Course Committee was
scheduled immediately following the Council meeting, with a meeting of the Budget
Finance Committee to follow,
There being no further business to come before the City Council, the meeting was
adjourned at 9.50 a.m.,
