Mayor Winton welcomed Sister Mary Stephen and the Eighth grade class from St. Raymond's Catholic School to observe Government in Action. With the assistance of Director of Public Works Ervin Spindel and Janice Morton, Miss Public Works, Mayor Winton presented Zero Defects Quarterly Awards to Coleman Akin, Field Service Man, and Charles Taylor, Maintenance Man. Communication from County Board of Supervisors regarding Undergrounding of Utilities: ''.paramount Boulevard, Seventh Street to Florence Avenue (Underground District #4). No fiction. Communication from Service Realty requesting hearing on Appeal, Zone Exception Case #1051, 11118 Woodruff Avenue. It was moved by Councilman Jennings and seconded by Councilman DiLoreto to set a hearing on Appeal, Zone Exception Case 01051, 11118 Woodruff Avenue, for 7:30 p.m., May 8, 1972, in the Council Chamber of the Downey City Hall. After Council discussion, it was moved by Councilman Jennings, seconded by Councilman DiLoreto, and passed by the following vote to amend the previous motion and set a hearing on Appeal, Zone Exception Case #1051, 11118 Woodruff Avenue, for 7:30 p.m., June 12, 1972, in the Council Chamber of the Downey City Hall. No action. Communication from Downey Chamber of Commerce regarding Quarterly Report, January 1 - March 31, 1972. Councilman Jennings stated he had made a previous request that the Chamber of Commerce add another item to its report on how many people it has actively interviewed for the Chamber. Mayor Winton requested the next quarterly report to show information relative to the industrial committee, what its activities have been, and the progress it is making. Mayor Winton welcomed Mr. Malley and a class from the Selaco Junior High School campus to observe Government in Action. Council Minutes 4/25/72 -1- I-q Communication from Congressman Del Clawson regarding Downey Resolution #2666, Urging Adoption of Revenue Sharing. No action. Communication of Mitters Industries, Inc., requesting hearing on Appeal, Zone Exception Case #1054, 12230 Paramount Blvd. It was moved by Councilman Jennings, seconded by Councilman Temple, and passed by the following vote to set a hearing on Appeal, Zone Exception Case #1054, 12230 Paramount Blvd., for 7:30 p.m., June 12, 1972, in the Council Chamber of the Downey City Hall. AYES: 4 Councilmen: Jennings, DiLoreto, Temple, Winton NOES: 0 Councilmen: None ABSENT: 1 Councilmen: Morton Police Chief Morgan reported that the proposed Ordinance Relating to Massage Parlors is a regulatory ordinance to govern issuance of permits by the Police Department. City Manager Thompson referred to a companion ordinance to amend the Business License Code which would establish a business license for massage parlors. Discussion followed regarding the purpose of a regulatory ordinance and the effect f an ordinance amending the Business License Code. Councilman Jennings inquired hether or not the existing facilities such as gymnasiums, etc., would fall into the same category as the proposed ordinance. City Attorney Sorensen cited provisions of Section 6204 of the Downey Municipal Code as to the classification of Business License Fee applicable to the primary business instead of ancillary business. He said the annual operating cost will be $1,702.80, and the Tax Rate per $100 assessed value of land and improvements for Zone III is 26C. RESOLUTION NO. 2679 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING ITS INTENTION TO ANNEX CERTAIN AREAS TO THE DOWNEY CITY LIGHTING DISTRICT AND TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO STREET LIGHTING FIXTURES ON THE STREETS AND PUBLIC PLACES WITHIN THOSE AREAS UNTIL JANUARY 31, 1983 (ANNEXATION 72/1 THROUGH 72/11) Council Minutes 4/25/72 -3- The Resolution was read by title only. He explained that in an Undergrounding District such as his there is no cost to the City other than administrative costs. He said the General telephone Company and Edison Company pay for the undergrounding in the highway and the property owners are assessed for the conversion of their facilities. RESOLUTION NO. 2680 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING ITS INTENTION TO ESTABLISH AN UNDERGROUND UTILITY DISTRICT ALONG PARAMOUNT BOULEVARD BETWEEN SEVENTH STREET AND FLORENCE AVENUE, AND CAUSING ALL SPECIFIED UTILITIES THEREIN TO BE RELOCATED UNDERGROUND (DISTRICT NO. 4) The Resolution was read by title only. Mayor Winton commented that his reason for encouraging adoption of this Resolution Ls to possibly generate interest on the part of the citizens of our City to expand this 'program on a broader basis. Councilman DiLoreto also commented on the far-reaching effect such„a Resolution could possibly have in relation to International Law. He commended Mayor Winton for implementing this step toward eventual recognition of the fact that greater strides are being taken toward assuring proper consideration for prisoners of war. AYES: 4 Councilmen: Jennings, DiLoreto, Temple, Winton NOES: 0 Councilmen: None ABSENT: 1 Councilmen: Morton Cash Contract #309, Tree Removal at Various Locations Responding to a question by Councilman Temple, Director of Public Works Ervin Spindel explained that the tree removals were requested by property owners. He said the trees have been either uprooting the curbs and gutters or are diseased and dying. Mr. Spindel stated further that the removed trees will be replaced with the large 15 gallon trees. It was moved by Councilman Jennings, seconded by Councilman Temple, and passed by the following vote to approve the specifications and grant authority to advertise for bids on Cash Contract #309, Tree Removal at Various Locations. He said the existing sewer will not be removed because it is not a public sewer. Mr. Spindel answered questions of the City Council regarding possibility of assessing property owners. AYES: 4 Councilmen: Jennings, DiLoreto, Temple, Winton NOES: 0 Councilmen: None ABSENT: 1 Councilmen: Morton Cash Contract #297, Unit 2, Miscellaneous Repairs Director of Public Works reported that any trees causing damage to curbs, gutters and sidewalks have been or will be removed, and that the estimated cost of repairs is $35,000 on a unit price contract. It was moved by Councilman Jennings, seconded by Councilman Temple, and passed by the following vote to approve plans and specifications and grant authority to advertise for bids on Cash Contract #297, Unit 2, Miscellaneous Repairs. Pavement and Resurfacing Councilman Jennings inquired who paid for existing paving after curb and gutters had been put in. The Director of Public Works replied that the paving was paid by matching funds between the City and the property owners. It was moved by Councilman Jennings, seconded by Councilman Temple, and passed by the following vote to approve plans and specifications and grant authority to advertise for bids on Cash Contract #310, Yankey Street West of Rives Avenue; Horley Avenue North of Yankey St. A.C. Pavement and Resurfacing. AYES: 4 Councilmen: Jennings, DiLoreto, Temple, Winton NOES: 0 Councilmen: None ABSENT: 1 Councilmen: Morton Subject to advice of the City Attorney, Councilman Temple stated he is an employee of Union Oil Company, that Sully Miller Contracting Company is owned by Union Oil, and he would, therefore, abstain from voting on Cash Contract #SS-263, Old River School Road. Following a summation of bids, it was moved by Councilman Jennings, seconded by Councilman DiLoreto, and passed by the following vote to award Cash Contract #SS-263, Old River School Road, in the amount of the unit prices bid, to Sully Miller Contracting Company, the lowest and best bidder, for completion of street improvements. AYES: 3 Councilmen: Jennings, DiLoreto, Winton NOES: 0 Councilmen: None ABSENT: 1 Councilmen: Morton ABSTAIN: 1 Councilmen: Temple Following a summation of bids, it was moved by Councilman Jennings, seconded by Councilman Temple, and passed by the following vote to award Cash Contract #SS-266, Old River School Road at Quill Drive, Traffic Signal Installation, to Steiny and Company, the lowest and best bidder. AYES: 4 Councilmen: Jennings, DiLoreto, Temple, Winton NOES: 0 Councilmen: None ABSENT: 1 Councilmen: Morton City Manager Thompson reported on Cash Contract #306, Dgwney Rio Hondo Golf Course Banquet Room Air Conditioning. He said the new air conditioning system is necessary to correct problem at Golf Course Club House. Mr. Thompson stated the bids received were broken down into the amount for the air conditioning units plus installation, and the low bid received was from Diamond Air Conditioning in the amount of $8497. He said the air conditioning units would be paid for by the concessionaire in the amount of $4653. Mr, Thompson recommended holding award of contract pending receipt of a written agreement from the concessionaire to pay the $4653. Director of Parks d Recreation James Ruth said a letter has just been received from the concessionaire agreeing to the Low bid price, and his agreement is contingent on the Council Minutes 4/25/72 -6- progress of the work. Mr. Ruth stated that when the units are received they will be billed directly to the concessionaire and paid for, and that the concessionaire has indicated he will forward a check to the City for the full amount. Councilman Jennings inquired as to the type of units bid. Mr. Spindel responded the units are for gas heat and electric cooling. Councilman DiLoreto said he was under the impression that when the franchise was granted the franchise holder would change to an air conditioning system and pay for same. He stated it appears the City is going to underwrite a responsibility of the. concessionaire. City Manager Thompson explained that the Concession Agreement between the City and Concessionaire indicates that the inside of the building shall be the responsibility of the' concessionaire and the outside, or the grounds, will be the responsibility of the City: That the concessionaire will maintain, repair and replace existing facilities and equipment within the building. He said the concessionaire was to keep in good condition the existing air cooler but would not be held responsible for the installation.of air conditioning. Mayor Winton interjected that extensive repairs are necessary on the existing cool- ing system and that the system has reached the point of no return. It was moved by Councilman Jennings, seconded by Councilman Temple, and passed by the following vote to authorize the City Manager to enter into a contract with the low bidder on Cash Contract #306, Downey Rio Hondo Golf Course Banquet Room Air Conditioning, if and when he is satisfied that the concessionaire's share will be forthcoming or has been received. AYES: 4 Councilmen: Jennings, DiLoreto, Temple, Winton NOES: 0 Councilmen: None ABSENT: 1 Councilmen: Morton Councilman Jennings requested the Director of Public Works to bring back an esti- mate of what it would cost to raise the Civic Center sign three feet.
