OF THE CITY OF DOWNEY
FEBRUARY 22, 1972
The City Council of the City of Downey held a regular meeting at 8:00 a.m.,
February 22, 1972, in the Council Chamber of the Downey City Hall, Mayor Donald H. Winton
presiding.

Councilman Morton delivered the invocation, followed by the Flag Salute led by
Councilman Jennings.
With the assistance of Police Chief Morgan, Mayor Winton presented a POST Advanced
Certificate to Police Officer Michael Westray.
Mayor Winton indicated a total of 51 letters has been received from Downey citizens,
requesting City Council consideration on the Ordinance relating to Building and Property
Rehabilitation,, and are on Lile in the Mayor's Office for Couhcil peru'sa1. "There being
no objections, it was so ordered that the letters be made a part of these Minutes by
reference thereto.

following vote to approve plans and specifications and grant authority to advertise for
bids on Cash Contract #SS-253 - Traffic Signal Installation - Stewart & Gray Road and
Patton Road.
Councilman Jennings inquired if the traffic signal will eliminate the need for a
crossing guard. Police Chief Morgan responded that it is the practice where there is an
automated signal not to have a crossing guard.

Cash Contract #SS-265 - Downey Cemetery Sidewalks - N/E Corner Gardendale St. and
Lakewood Blvd.
Mayor Winton commended the Public Works Department and Forestry Division for carry-
ing through on this project.
In response to a question by Councilman Jennings, Director of Public Works Ervin
Spindel stated the cemetery contributed one-half the cost of the improvements.
It was moved by Councilman Morton, seconded by Councilman Jennings, and passed by
the following vote to accept the improvements completed under Cash Contract #SS-265 -
Downey Cemetery Sidewalks - N/t Comer Gardendale St. and Lakewood BiF1., and approve extra items of work.

the unit prices bid for the alternate bid, to Vernon Paving Company of the City of
Industry, the lowest and best bidder, for construction of street improvements, and waive
the bid bond irregularity.

It was moved by Councilman Jennings and seconded by Councilman Hollis to approve
Sidewalk Matching Funds for sidewalk construction.
Discussion was held on the need for a policy change regarding matching funds on
commercial property. Mayor Winton stated he would vote "no" on matching funds when
commercial property is included. He said sidewalk matching funds were intended to
encourage the homeowner to put in sidewalks for the use of children to and from school
and pedestrian use.

Director of Public Works Ervin Spindel commented that although M.F. #104, North side
of Firestone Boulevard east of West City limits, is commercial property, it can never be
developed, and the property owner has requested sidewalk matching funds.
After further discussion, it was moved by Councilman Hollis, seconded by Councilman
Jennings, and passed by the following vote to amend the motion to approve Sidewalk
Matching Funds for sidewalk construction at the following locations, excluding M.F. #105,
7117-7201 Firestone Blvd., and M.F. #106, 12367 Woodruff Ave.:

Director of Public Works Ervin Spindel stated the policy on sidewalk matching
funds will be rewritten and resubmitted for the next City Council Meeting.
Councilman Morton said the policy was revised in July 1969, and the previous
revision was in April 1967, which he feels is more apropos.
Mayor Winton stated the policy should include that all commercial property considered
for sidewalk matching funds should be thoroughly reviewed by the Public Works Department
and that the City Council be fully informed as to whether the sidewalks are to be utilized
for use to and from school, or for commercial purposes.

City Manager Charles W. Thompson said there is no City Manager's Report for this
Meeting.
ORAL COMMUNICATIONS
Mayor Winton reported that a meeting has been scheduled for this evening in the east
wing of the Council Chambers with a citizens committee for the purpose of discussing the
Ordinance relating to Building and Property Rehabilitation.
It was requested by Mayor Winton that when this City Council Meeting is adjourned
that it be adjourned to 7:30 p.m., February 28, 1972, at the Downey Elementary School
Cafetorium. He further requested City Council approval of a procedure, whereby the
entrance to the Cafetorium will be determined by City Council vote for the purpose of
providing sign -in sheets for those attending, so they can sign their names and addresses.
Mayor Winton said in regard to the seating arrangements, he would request a procedure
whereby only Downey residents will be allowed, with the exception of one or two members
of the C.O.R.L. group. He said after the Downey residents have been seated, then there
should be a procedure to allow seating for non-residents. He inquired of the City
Attorney if there is any illegality to reserving seats for Downey residents.
Acting City Attorney Mark Allen said he does not see any problem in reserving seats
for the purpose of permitting Downey residents to enter the meeting first and not allow-
ing others to enter until after the people that reside in the City have entered. He
stated, however, it should be done before the meeting to the extent that everyone will
be permitted to be in by the time the meeting starts, inasmuch as persons who are not
residents of the City but who own property in Downey or have other interests have a
right to attend the Council Meeting. Mr. Allen said he does not believe that people
can be required to sign in as a condition to attending a Council Meeting. He referred
to a San Diego Ordinance and an amendment to the Ralph M. Brown Act which was expressly
amended to exclude requiring as a condition of attendance at the meeting the signing in
and giving of a name. Mr. Allen stated he could see no reason why the room couldn't be
opened 10 minutes before the meeting for residents of the City, and five minutes before
the meeting for others.
Mayor Winton stated that the normal procedure will be followed to allow Downey
residents to have the first seats and requiring people who wish to speak to state their
name and address, Responding to questions by Councilman Jennings, Mayor Winton said
inasmuch as principally Downey residents have requested the Meeting, he would like to
give them the first privilege to speak.
Mr. Wendell Wiser, 10921 Paramount Blvd., commended Councilman Jennings for his vote
on the Widening of Seventh Street.
