MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
SEPTEMBER 28, 1971
The City Council of the City of Downey held a regular meeting at 8:00 a.m.,
September 28, 1971, in the Council Chamber of the Downey City Hall, Mayor Joseph G.
Ferris presiding.

"Stephen G. Skinner, Jr., was born, July 13, 1901 in Wichita, Kansas, and passed
away September 19th of this year in Fallbrook. During the early years of his
residency in this City, he was a land developer and was in property management.
He was one of the early leaders for the movement to incorporate our City from
the early 19501s.
In the School District, he served as a Trustee on the Alameda School Board from
1954 to 1956 and served on the County Committee for School District Re -organization
in 1955 and 1956, and was Vice Chairman of that Committee one year. From 1959
to 1960 he was Vice Chairman of the Committee for Unification of the Downey's
then five School Districts, and he was called to serve on the first Board of
Trustees of the Unified District from September 1960 to November 1961.
In the cultural area, he was Chairman of our Downey Symphonic Society in 1961
and was in our Civic Organizations. He was one of the original members of the
Downey Planning Commission, serving from December 28, 1956 to October 16, 1961,
at which time he resigned in order to accept the appointment as Councilman of
the 1st District of the Downey City Council. His appointment to the City
Council was on October 14, 1961, and as a member of the Council he served as
Downey's seventh Mayor, serving from October 14, 1963 to April 21, 1964. He
moved to Fallbrook shortly after his retirement from the City Council."
(There was a pause for a moment of silence.)
Dr. Coe concluded the Eulogy with a Prayer: "0' Father and God of all mankind,
we express our deep gratitude for the life of Stephen Skinner whose memory we
pause to honor this morning. We recall 01 God his faithful service to his
community as a Leader of our citizens by his several years of devoted service
on the Governing Body of our Great City. We're grateful for his wisdom, for
the consecration and fairness which he displayed in his Community Service. May
the flame of his Community Pride which he held so high be continually upheld by
us as a memorial to him. We realize 0' Lord how much his graciousness, his
smile, his friendly persuasive manner, brought joy to the hearts of many. From
his example we have learned the art of living peaceably with all men; he has
taught us how to put service above self. Comfort his loved ones and his friends
with the assurance that now he dwells with You. Reward him generously for his
loyalty as a Citizen, as a Patriot, and as a Devoted Servant to his City and
his Nation. Let the memory of his leadership and the effects of his service
stand as a living memorial and visible monument now and forever. For this we
ask in Jesus name, Amen."
The Flag Salute was led by Councilman Winton.
Mayor Ferris declared that this is the time and place for the public hearing on
Downey City Lighting District Annexation 71/14 through 71/27. He inquired of the City
Clerk if she had the Affidavit of Posting Notice and the Affidavit of Publication, to
which she responded in the affirmative.

receive and file the Affidavits.
Mayor Ferris inquired of the City Clerk if she had received any written protests,
and she replied she had not.
Mayor Ferris inquired if there was anyone present who wished to speak in protest to
the matter, and there was no response.

close the hearing on Downey City Lighting District Annexation 71/14 through 71/27.
RESOLUTION NO. 2593
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING ANNEXATION OF CERTAIN AREAS TO THE DOWNEY CITY
LIGHTING DISTRICT AND TO MAINTAIN AND FURNISH ELECTRICAL
CURRENT TO THOSE STREET LIGHTING FIXTURES LOCATED ON
STREETS AND PUBLIC PLACES WITHIN THAT AREA UNTIL
JANUARY 31, 1983 (ANNEXATION 71/14 THROUGH 71/27)

Responding to a question by Councilman Winton, the City Engineer stated the hours
are being changed to better fit the street sweeping schedule. He said there is ample

Councilman Morton stated he was under the impression there was a procedure set up
whereby the Mayor would review the Payroll Warrants with regard to overtime, part time
help, etc. He inquired if the Warrants were being presented to the Mayor for that
purpose.
Mayor Ferris responded that he has been receiving the Warrants and every two months
he reviews the comp time and overtime.

Following a summation of bids, it was moved by Councilman Morton, seconded by Mayor
Ferris, And passed by the following vote to award Cash Contract #270 Little Lake Road,
in the amount of the unit prices bid, to Silveri & Ruiz Construction Co, of Fullerton,
the lowest and best bidder, for completion of street and storm drain improvements, and
waive the bid bond irregularity, subject to the condition that the Contractor will provide
the required bonds.

Sidewalk
Matching Funds
Responding to Councilman. Morton's question regarding the City's policy to pay part
of sidewalk installation where it has been required by zone exception, the City Engineer
stated the application for Matching Funds for property at 9202 Elm Vista Drive, M.F. #77,
was received prior to the hearing on Zone Exception Case #1018, which was approved by
Council Minutes 9/28/71 -5-

the Planning Commission on August 18, 1971, and the construction of sidewalks was one
of the conditions of approval.
It was moved by Councilman Winton to take the matter of Sidewalk Matching Funds
under submission. No second.
It was moved by Councilman Morton, seconded by Councilman Winton, and passed by the
following vote to approve Sidewalk Matching Funds for the following locations, authorize
the expenditure of $300, from the Street and Sidewalk Fund for a right-ofPway exchange,
and to hold the matter of Matching Funds for sidewalk construction at 9202 Elm Vista
Drive for further study,

Right -of -Way Exchange, 12621 Clark Avenue
City Engineer H. J. Henriksen reported that after sidewalks have been installed the
City will provide permanent weed abatement in the parkway. He said this ties in with
the Century Freeway whereby the City will acquire the right-of-way for the widening of
Clark Avenue,
At the request of Councilman Winton, the matter was held under submission until the
next City Council meeting,
Planning Commission Report on Appeal, Zone Exception Case 4k1p14, 11531 Downey Avenue
Mayor Ferris indicated since there are only three members of the City Council
present at this meeting, two of whom would not vote on this matter, that the Report on
Appeal, Zone Exception Case #101y, be held for a full Council attendance.
Councilman Winton stated he was not in attendance at the time this case was presented
and at the last Council meeting it was indicated that an agreement had been reached.
Therefore, he would not be in a position to vote on this matter.
Comments were made by Councilman Morton relative to the fact that the report does
not indicate whether or not the agreement has been accepted,
Assistant Director of Planning Francis Carter stated the agreement was arrived at
with the Director of Planning and that the Planning Commission did not agree with the
compromise,
Councilman Morton stated the original appeal was not heard by the City Council
inasmuch as it was indicated a compromise had been reached, He said the question now
is whether the YMCA still wishes to present the appeal to the City Council,

following vote to set a hearing on. Appeal, Zone Exception Case #1014, 11531 Downey
Avenue, for 7:30 p.m., October 11, 1971, in the Council Chamber of the Downey City Hall,

In clarification of his "Aye" vote, Councilman Morton stated that inasmuch as he is
on the Board of Managers at the YMCA he will refrain from making a decision in this
matter. Mayor Ferris requested the record reflect the same statement in his behalf.
Rio Hondo/Los Angeles Rivers Beautification/Recreation Report
At the request of Mayor Ferris the matter was held pending further review and pre-
liminary estimate of costs,
Request to Waive Parkirg Requirements - Russell's Bike Shop, 8027 E. Firestone Blvd,
Mayor Ferris stated the Parking Place Commission reviewed this matter at their
September 22nd meeting, and it was their decision to recommend to the City Council the
parking modification request subject to the following conditions. He said he had no
objection to the first condition but questioned conditions 2 and 3.
1. The property owner shall file a covenant for maintenance of the building and
its uses with the Los Angeles County Recorder and a copy with the Parking
Place Commission, stating that in the event the storage and/or warehouse
addition is used for retail commercial purposes, additional off-street
parking shall be provided to the standards of the Downey Municipal Code for
such proposed use.
2. The property owner shall file an agreement that he will not protest future
acquisition and improvement of property in the Parking District; and
3. The property owner shall improve the southerly half of the alley to City
standards including the concrete gutter.
The Assistant Director of Planning Francis Carter reported a property owner has a
right to go to the City Council, when the property is located in the Parking Assessment
District, for modification, either of the spaces or the fees involved, He said for every
space that is short the City Council has the right to charge a $2500. fee. Mr. Carter
stated the property owner will not be permitted to construct a building unless the
parking problem is solved.
In response to a question by Councilman Winton regarding Condition #3, which calls
for improvement of the southerly half of the alley, Mr. Carter replied that Section 8100
of the Downey Municipal Code states that any improvement on commercial property, if the
public right-of-way is not improved, must be done as part of the overall construction
project, and it includes alleys as well as streets, He said the northerly half of the
alley will be improved when the property to the north is developed.
The City Engineer stated the alley has been improved up to the bike shop.
On the recommendation of Mayor Ferris, the matter was taken under submission until
the next City Council meeting.
Councilman Morton stated that the Agreement Establishing ReciRrocal Use of
Facilities between the City of Downey and the Downey Unified School District was pre-
sented to the last meeting of the City -School Recreation Committee of which he is a
member in behalf of the City Council, and it was the unanimous decision of the Committee
to recommend approval of the agreement. He said the agreement is exactly as it was last
year and no changes are recommended,
It was moved by Mayor Ferris, seconded by Councilman Winton, and passed by the
following vote to approve the Agreement Establishing Reciprocal Use of Facilities.

ORAL COMMUNICATIONS
In order to avoid duplication, it was recommended by Councilman Winton that the
plans attached to item G-2-e on the Agenda, Depression of Imperial Highway at Rancho Los
Amigos Hospital, be retained for use at the next City Council meeting.
Councilman Morton, speaking in behalf of the City Council, extended sympathy to
Councilman Giles Hollis and family in regard to his son's injury.

Councilman Morton stated that he is the only remaining active Councilman who had
the privilege of serving with Past Mayor, Stephen Go Skinner, He said Mr. Skinner had a
tremendous amount of common sense and deep insight, he loved his Community very deeply
and initiated many programs, Councilman Morton stated that during his own term as Mayor
in 1965, the Downey Historical Society was established and that it was an idea of Mr.
Skinner who deserves all of the credit for that organization's existence, He said Mr.
Skinner put his heart in his Community in order to make it a better place in which to
live, and as a fellow Councilman serving with him, Councilman Morton said it was a
pleasure to have known Mr, Skinner,
Mayor Ferris stated that the comments of Councilman Morton regarding Past Mayor,
Stephen G. Skinner, reflects the feelings of the entire City Council,
Mrs, Betty Kenley, 9028 Manzarar, spoke in protest to the manner in which the
Ordinance relating to Parkway Obstructions was introduced and adopted. She said that,
after reading the Ordinance, it appears the cost of the annual tree trimming and tree
removal is shifted to the homeowner,
The City Engineer replied that the Ordinance does not shift the cost to the home-
owner. He said the tree trimming is maintained by the City, and what the Ordinance does
is to clarify what is presently in effect, the current Ordinance being difficult to
enforce,
Mayor Ferris reported that the current Ordinance provides there can be no obstruction
in the parkway, and the new Ordinance would make an obstruction permissible with the
permission of the Director of Public Works and Chief of Police,
Councilman Winton suggested that any questions Mrs, Kenley might have relative to
Ordinances be in the way of a written communication and her questions could be answered
in the same manner,
Mr, Wendell Wiser, 10921 Paramount Blvd „ spoke relative to the adoption of the
Ordinance relating to Parkway Obstructions, He said it is a landmark piece of legisla-
tion which he has been Looking forward to for approximately ten years.
There being no further business to come before the City Council, the meeting was
adjourned at 9.00 a.m.
