HomeMy WebLinkAboutMinutes-09-23-71-Public Hearing-Street Closing AgreementPUBLIC HEARING BEFORE THE CITY COUNCIL OF THE CITY OF DOWNEY ON A STREET CLOSING AGREEMENT FOR THE PROPOSED ROUTE #105 (CENTURY-NORWALK) FREEWAY CONSTRUCTION SEPTEMBER 23, 1971 The City Council of the City of Downey held a Public Hearing on a Street Closing Agreement for the Proposed Route #105 (Century -Norwalk) Freeway Construction at 7:30 p.m., September 23, 1971, in the Gymnasium of the Downey Senior High School, 11040 Brookshire Avenue, Downey, California, Mayor Joseph G. Quinn, Senior Right -of -Way Agent For the Press Mr. Harry Polgar, Call -Enterprise Arlene Sherer, Press Telegram John Boyd, Southeast News Mayor Ferris stated that this is the time and place for the Public Hearing being held in accordance with the provisions of Section 100.22 of the State of California Streets and Highways Code. He said the hearing is concerning the Freeway Agreement for the closing of streets, and other matters in the City of Downey along the adopted route of the 105 Freeway. Mayor Ferris introduced members of the City Government, School Government, State Government, and Press members. Mayor Ferris outlined the procedure for this public hearing. He stated the Freeway Route would be presented by the Director of Public Works, and the major points of the Freeway and Performance Agreements would be presented by the City Manager, after which there would be a short intermission. He requested that during the intermission property owners in the City of Downey or Downey citizens who wished to either ask questions or speak, fill out the appropriate cards. He asked that those persons who wished to make comments from the floor limit their comments to two minutes, and that no one speak more than once until all who had requested to speak had done so. The Director of Public Works, Ervin Spindel, presented slides showing the overall Freeway alignment and the Freeway in detail. City Manager Charles Thompson stated that the maps displayed are a part of the Freeway Agreements, and in addition to the maps, there will be a Performance Agreement. He reviewed the major points of the provisions of the Agreements as follows: 1. A depressed or below -ground level freeway. 2. Nine streets to remain open across the Freeway: Gardendale, Barlin Ave., Lakewood Blvd., Hanwell Ave., Clark Ave., Ardis Ave., se Bellflower Blvd., Dunrobin, and Woodruff Ave. In addition, Brookshire Ave. would be extended southerly to form a one-way frontage road system to join Downey Avenue in the City of Paramount. 3. Street damage resulting from construction of the Freeway to be repaired by the State. 4. The State will not re -rent dwellings acquired for right-of-way except to those persons in occupancy at the time of the acquisition. 5. The State will demolish all buildings within 120 days after acquisition of title or vacation by occupants. 6. The State will maintain cleared property in clean and sanitary condi- tion, including dust control measures. 7. The State will establish a local right-of-way office within the City of Downey close to the Freeway area. 8. The State will expedite property purchases, relocation assistance, and differential interest claims, and reimburse all eligible persons in accordance with AB 2888 which provides for certain retroactive pay- ments, going back to January. 9. The State agrees to purchase all properties in total where the remaining parcel would result in a lot of less than minimum requirements of the Downey Municipal Code. 10. The State will make available to the City portions of non -operating right-of-way at a nominal lease figure. 11. The State will assist the City in acquiring additional area for a park north of the Freeway, west of Woodruff, at the option of the City. 12. The State will have its contractors and all subcontractors abide by all City Ordinances affecting public peace, health, safety, and welfare. 13. The State will plan its construction projects so there will be no Lag between contracts, allowing for completion by the deadline presently set for October 1, 1977. 14. The State agrees that landscaping of the Freeway through the City of Downey will commence one year following completion of the Freeway. 15. If the Freeway is not completed, or if it is deleted, the State will give the City of Downey right of first refusal to obtain all parcels of right-of-way acquired or purchased, for public purposes. 16. The State agrees the following construction items in conjunction with the Freeway will be completed: (a) Concrete block walls in lieu of chain -link fences along the right-of-way. (b) Pedestrian fencing on all Freeway overcrossings. (c) Traffic signals at intersections of Barlin Avenue and Gardendale Street. (d) A signal interconnect between all traffic signals constructed in connection with the Freeway and the nearest adjacent signals. (e) Storm drain on the north side of the Freeway from Woodruff to the San Gabriel River of sufficient capacity for future expansion northerly by the City of Downey. (f) Widening of Clark Avenue from the north side of the Freeway to Imperial Highway. 17. The State agrees to contribute and provide for consultant services in the approximate amount of $40,000. to assist the City in its planning of the area around the Freeway corridor.
