SEPTEMBER 13, 1971
The City Council of the City of Downey held a regular meeting at 7:30 p.m.,
September 13, 1971, in the Council Chamber of the Downey City Hall, Mayor Pro Tempore
Donald H. Winton presiding.

Reverend David Foster, Downey Free Methodist Church, delivered the invocation,
followed by the Flag Salute led by Councilman Morton.
Mayor Pro Tem Winton declared that this is the time and place for the following
public hearings, which were continued from the regular meeting of August 24, 1971:

In response to a question by Councilman Morton regarding whether the Ordinances
cover isolated problems in residential areas where properties are not kept up or main-
tained, the Dirrector of Building d Safety reported the problem should be covered by the
Ordinance Relating to Rehabilitation of Buildings and Property, item D-3 on this meeting's
agenda.
Mayor Pro Tom Winton said the Resolution adopting express findings of the Uniform
Building Codes must be adopted prior to action on the proposed Ordinances.

Mayor Pro Tem Winton declared that this is the time and place for the public hearing
on Appeal, Zone Exception Case #1014, 11531 Downey Avenue. He inquired of the City Clerk
if she had the Affidavit of Publication, to which she responded in the affirmative.
The Director of Planning, William Goggin, reported the request applies to the Downey
YMCA building which is zoned R-1 5000. He said the property to the south is zoned R-3,
to the north R-1, and to the east R-2. Mr. Coggin stated the request is to establish and
maintain an 87 square foot interior lighted pole sign 21 feet in height adjacent to the
front property line along Downey Avenue, and after consideration by the Planning
Commission, the sign was approved with considerably less area. He said the applicant has
submitted a modified sign for consideration which has been approved by the Planning
Department.

Mayor Pro Tem Winton inquired of the City Clerk if she had received any corres-
pondence on the matter, and she replied she had not.
Councilman Morton stated that as a matter of record he is presently serving on the
Board of Members of the YMCA and will not participate in this matter.
Mayor Pro Tem Winton inquired if there was anyone present who wished to speak i.h
favor of the matter.
Mr. Willis Haynes, 8050 Florence Ave., speaking in favor of the matter stated the
alternate plan is acceptable to both parties.
Mayor Pro Tem Winton inquired if there was anyone present who wished to speak in
opposition to the matter, and there was no response.

Acting City Attorney Newton stated it would be appropriate for the Planning Depart-
ment to describe the compromise that has been worked out with the applicant, and if
acceptable the compromise can be approved by the City Council, which can be modification
of the action of the Planning Commission. He said the Code requires that the matter be
referred back to the Planning Commission for report back to Council as to their agreement
or disagreement with the action of the Council.
After discussion on the matter, it was stated by Acting City Attorney Newton that
Section 9132.17 of the Downey Municipal Code requires Council action be by three members
of the Council and, therefore, it is only possible to refer the matter back to the
Planning Commission at the present time as only two Council members will be voting on
the matter.

Mayor Pro Tem Winton declared that this is the time and place for the public hearing
on Appeal, Zone Exception Case #1013, 7221-7317 Florence Avenue. He inquired of the
City Clerk if she had the Affidavit of Publication, to which she responded in the
affirmative.
The Director of Planning, William Goggin, stated the request is to establish and
maintain a two-story 96-unit apartment dwelling with off-street parking for 192
automobiles, a two -level parking structure at the rear of the lot, modification of
building setbacks and recreation facilities on adjacent property zoned R-1. He said the
public hearing was held July 21st and continued to August 4th, at which time the Planning
Commission approved the request subject to certain conditions, and the appeal pertains
to several of the conditions. He said the conditions objected to by the applicant are
the 9--foot height on the parking wall structure, a requirement of 20 feet between all
buildings, and not being permitted to have patio slabs in the front yard along Florence
Avenue.
Mayor Pro Tern Winton inquired of the City Clerk if she had received any correspon-
dence on the matter, and she replied she had not.
Mayor Pro 'Tem Winton inquired if there was anyone present who wished to speak in
favor of the matter.
Mr. Leslie Olson of Olson Surveying Service, 10022 Tristan, representing the
applicant, requested a continuance of the matter to a time when the Mayor will be pre-
sent, inasmuch as the property is in the Mayor's district.

opposition to the matter,
Mr. John Moeller, 7300 Dinsdale Street, spoke in opposition to the continuance of
the hearing. He requested that he be notified of the definite date of of continuance.

following vote to continue the hearing on Appeal, Zone Exception Case #1013, to.7:30 p.m.,
October 11, 1971.

Mayor Pro Tem Winton declared that this is the time and place for the public hearing
on Vacation of Horton Lane in the Rancho Los Amigos County Hospital. He inquired of the
City Clerk if she had the Affidavit of Posting of Notice and Affidavit of Publication, to
which she responded in the affirmative.
H. J. Henriksen, City Engineer, reported the County plans a large development at the
Rancho Los Amigos Hospital on the south side of Imperial Highway between Old River School
Road and Rives Avenue. He said the plans have been designed, the roadway is going to be
depressed under Horton Lane and, therefore, the City has no need for Horton Lane as it
now exists.

dence on the matter, and she replied she had not.

PROPERTY

Communication from California Regional Water Quality Control Board - Los Angeles
Region commending Downey Police Department for cooperation in Destruction of Firearms by
hammermill or similar device rather than disposal of firearms and other weapons at sea.

Mayor Pro Tem Winton reported he had received a communication from the Mayor of the
City of Monrovia requesting that the City of Downey concur with their action to petition
for an amendment to the Charter of Los Angeles County on which the Board of Supervisors
based their action approving Pay increases for Fire and Police personnel. Mayor Pro Tem
Winton stated he will refer this matter to the Mayor when he returns from Guadalajara
and would distribute copies of the communication to the members of the City Council.
Mayor Pro Tem Winton reported on communication from Committee -Unity for Lynwood, to
Highway Action Coalition, Washington, D. C., regarding use of Highway Trust Fund Moneys
for construction of Freeways. He stated copies would be submitted to each Councilman,
Mayor Pro Tem Winton reported on communication from Cerritos College requesting the
City of Downey assign two custodians to be employed under the provisions of the Emergency
Employment Act. No action.
ORDINANCE NO. 405
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING SECTIONS 6407 AND 6407.1 OF THE DOWNEY
MUNICIPAL CODE WHICH SAID SECTIONS RELATE TO PERMIT
FEES

ORDINANCE NO. 406

AMENDING THE DOWNEY MUNICIPAL CODE BY AMENDING SECTION
3186(h), ORDINANCE NO. 262, RELATING TO RESTRICTED SPEED
LIMITS
The Ordinance was read by title only. It was moved by Councilman Hollis, seconded
by Councilman Morton, and so ordered to waive further reading.
It was recommended by Councilman Morton that the speed limit on Stewart & Gray Road
from Firestone to Lakewood be posted at 40 m.p.h. rather than 35, inasmuch as it is a
wide street.
The City Engineer explained that the Traffic Committee discussed the matter, and it
is their recommendation that the speed limit be posted at 35 m.p.h. in view of the fact
that the rest of the street has the same speed Limit and at such time as traffic studies
are completed,to come back to the City Council for further consideration.
After discussion on the matter, it was moved by Councilman Morton, seconded by
Councilman Hollis, and passed by the following vote to adopt Ordinance No. 406.

Councilman Morton requested the Traffic Committee study the traffic problem on Rives
Avenue, south of Firestone Boulevard. He stated there was indication a study was going
to be made of the traffic flow on Stewart & Gray and he feels the traffic pattern on
Rives is ancillary to it and should be part of that study.

Storm Drain Project No, 6350, Unit 1, Line B, Telegraph Road
H. J. Henriksen, City Engineer, reported this is a continuation of the storm drain
which was previously installed in Telegraph Road up to the intersection at Serapis. He
said funds have been found within the Los Angeles County Flood Control District to
continue the storm drain to Lakewood Boulevard, He stated the extension is approximately
175 feet in length and the City of Downey will attain seven catch basins, Mr. Henriksen
said the cost of the project is $136,000 and does not require City funds, and the con-
struction is anticipated to start in November of this year,

$527.50, annual operating cost for seven lights is $361.20; the first year cost is $0.46

Responding to questions by Councilman Morton, the City Engineer stated the resolu-
tion only covers the overpass and not the barrier. He said the City contacted the
Division of Highways and they informed the City that they are still investigating that
problem. The City Engineer stated further that communication has been received from the
School District and that they approve of the new location of the overcrossing.
Councilman Morton reported he had received many calls from residents in his District
specifically concerned with the problem of the barriers and for that reason would request
the matter be taken under submission. No objections; so ordered.
James Ruth, Director of Parks & Recreation, reported the Park & Recreation Commission
reviewed a list of names submitted for Naming a park on Brookshire Avenue. He said it is
their feeling to keep in the practice of naming a park after the street on which it is
located to help identify the park and help people get to the facility. He said it is the
Park & Recreation Commission's recommendation to name the park Brookshire Avenue Park,
and second and third choices are submitted for Council's consideration.
Mayor Pro Tem Winton stated it is his wish to select a combination name of Brookshire
Children's Park since the park is a children°s park for the use of smaller children.

name the park on Brookshire Avenue, "Brookshire Children's Park."

CITY MANAGER'S REPORT
City Manager Charles W. Thompson reported on a Resolution from the City of Gardena
regarding Sales Tax Formula Revision which was referred to him for review. He said it
is recommended that the City Council go on record as opposing the Sales Tax Formula
Revision and adopt a resolution to that effect.

City Manager Charles W. Thompson reported on a new Library Copy Service - Accounting
System. He said this has to do with setting up an account that had been handled on a
revolving account basis which has been reviewed by his office and the Finance Department,
and it is recommended that this account be established to fully explain in the City
accounts the revenues received from the Xerox copying service in the Library. He said
this should be part of the budget.

Manager on this matter which he had not received.

The City Manager reported a survey was made regarding the position of Records
Analyst, Police Department. He said it is his recommendation that the title of Technical
Services Supervisor be used at the salary level of Sergeant, and this position would re-
place the position of Sergeant in the Police Department.
It was moved by Councilman Morton and so ordered to take the matter of Records
Analyst, Police Department, under submission, inasmuch as he and Councilman Jennings are
presently in the process of reviewing the matter and have not completed their evaluation.
Regarding the 105 Freeway Agreement and Performance Agreement, the City Manager
reported there are certain changes in both documents, and that a detailed report on those
clarifications and amendments has been submitted for information purposes.
The City Manager reported on Agreements between the City and Downey Unified School
District with regard to the Heliport lease and lease of the School District property on
Third Street for parking purposes. He said the agreements have been reviewed by the
County Counsel and City Attorney's office and are submitted for Council's approval, Mr.
Thompson stated the only matter not resolved is the question of lighting at the
recreational area at the Heliport site to be used in conjunction with the Central High
School. He said the City has previously approved these agreements with the lighting
provisions.

following vote to Re -affirm the position of the City Council regarding the Agreements
between the City of Downey and the Downey Unified School District covering the Lease to
the School District of the Heliport Site and lease to the City by the School District of
property on Third Street for parking purposes.

City Manager Thompson reported the final Application for Full Funding in regard to
the Emergency Employment Act of 1971 is prepared,, and it is requested the City Council
authorize the Mayor to execute same for transmittal to the Department of Labor.

following vote that the Mayor be authorized to execute the documents required for
application for Full Funding under the Emergency Employment Act of 1971 and that the
documents be held for his signature when he returns from Guadalajara.

ORAL COMMUNICATIONS
Police Chief Morgan stated it was his pleasure to present to the City and the
Director of Finance a check in the sum of $16,515.45 which covers reimbursement claims
for Police training completed as of June 30, 1971 from the Police Officers Standards and
Training Commission.
Mayor Pro Tem Winton inquired if there was amyone present who wished to address the
City Council, and there was no response.
There being, no further business to come before the City Council, the Meeting was
adjourned at 9:30 p.m.
