HomeMy WebLinkAboutMinutes-06-28-71-Adjourned MeetingMINUTES OF THE CITY COUNCIL OF THE CITY OF DOWNEY ADJOURNED MEETING - JUNE 28, 1971 The City Council of the City of Downey held an Adjourned Meeting at 5:00 p.m., June 28, 1971, in the Council Chamber of the Downey City Hall, Mayor Joseph G. Ferris presiding. PRESENT: Councilmen: Morton, Winton, Jennings, Hollis, Ferris ABSENT: Councilmen: None ALSO PRESENT: Charles W. Thompson, City Manager Donald B. Robison, Assistant City Manager Robert L. Shand, Director of Finance Don Warren, Deputy Fire Chief Ellen C. Davis, City Clerk Mayor Ferris stated that the purpose of this Adjourned Meeting is to conclude budget considerations for the 1971-72 fiscal year. Councilman Hollis delivered the invocation, followed by the Flag Salute led by Councilman Winton. Mayor Ferris stated the City Manager was requested to study the effects of Senate Bill 249 which forces cities and their employees to pay increased retirement costs to the Public Employees' Retirement System. He said the City Council's position is that although they favor the improvement of the retirement plan within the City of Downey, they are opposed to the provisions of Senate Bill 249 being mandated upon the City of Downey. City Manager Charles Thompson reported he had made a review and analysis of the impact of all available alternatives under Senate Bill 249 and the cost of each over a 20-year period. He said after checking with Sacramento, he found that the first year's requirements as provided in the Bill would not be on a strict interest basis, but on an actuary basis, which would mean that the total cost for the deferment would be in the neighborhood of four to five thousand dollars. He stated he would, therefore, recommend to the City Council that the alternative of a 29-year deferment on the first year's current service requirements be the option of the City of Downey. He said this would allow the City to continue the next year with payments as they would have been if Senate Bill 249 had not passed, leaving the option at a future date to pay off any prior year's service liability and, if need be, to reduce the rate. RESOLUTION NO. 2564 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY REQUESTING THE BOARD OF ADMINISTRATION OF THE PUBLIC EMPLOYEES' RETIREMENT SYSTEM TO GRANT A ONE-YEAR DEFERMENT OF CURRENT RETIREMENT RATE AND APPROVING AN AMENDMENT TO THE CONTRACT BETWEEN THE BOARD OF ADMINISTRATION OF THE PUBLIC EMPLOYEES' RETIREMENT SYSTEM AND THE CITY OF DOWNEY TO EFFECT SUCH DEFERMENT The Resolution was read by title only. It was moved by Councilman Winton, seconded by Councilman Jennings, and so ordered to waive further reading. It was moved by Councilman Winton, seconded by Councilman Jennings, and passed by the following vote to adopt Resolution No. 2564. AYES: 5 Councilmen: Morton, Winton, Jennings, Hollis, Ferris NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Mayor Ferris requested that the following statement be made a matter of record in these Minutes: Senate Bill 249 has been passed by the California State Legislature requiring that all cities be included in this program regardless of the wishes of such cities. Council Minutes 6/28/71 -1- The City Council is not opposed to improving the retirement contract with the State Public Employees' Retirement System on their own volition, but are strongly opposed to State Legislation which forces cities and their employees to pay increased retirement costs. As an independent Charter City, the City Council believes this Bill violates the Home Rule provisions of the California State Constitution. It was moved by Councilman Jennings, seconded by Councilman Morton, and passed by the following vote that all payments which are made under the compulsion of Senate Bill 249 by the City of Downey be made under protest. AYES: 5 Councilmen: Morton, Winton, Jennings, Hollis, Ferris NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None The City Manager reported that the Director of Parks & Recreation had transferred the Maintenance Supervisor of that department to the Golf Course to fill the position of Golf Course Superintendent, which was vacant due to the resignation of the previous Superintendent whose salary schedule designation was 17. The salary schedule designation of the Maintenance Supervisor is 19. He recommended a change from 17 to 19 for Golf Course Superintendent. RESOLUTION NO. 2565 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY RELATING TO GOLF COURSE SUPERINTENDENT The Resolution was read by title only. It was moved by Councilman Jennings, seconded by Councilman Hollis, and so ordered to waive further reading. It was moved by Councilman Jennings, seconded by Councilman Hollis, and passed by the following vote to adopt Resolution No. 2565. AYES: 5 Councilmen: Morton, Winton, Jennings, Hollis, Ferris NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Mayor Ferris congratulated City Manager Charles Thompson, the Staff and representa- tives of the Employee Associations for concluding their negotiations in a forthright and speedy manner, It was moved by Councilman Morton, seconded by Mayor Ferris, and passed by the following vote that all capital outlay equipment item purchases in the amount of $500. or more be brought before the City Council prior to any commitment, and any full-time employee vacancies to be filled be brought before the City Council for prior approval. AYES: 5 Councilmen: Morton, Winton, Jennings, Hollis, Ferris NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None On behalf of the City Council, Councilman Morton expressed appreciation to Mayor Ferris, Councilman Jennings, and City Manager Thompson for the long hours spent on the budget in their in-depth study and analysis provided to the City Council. Councilman Winton concurred with the remarks of Councilman Morton and thanked Councilman Jennings for his rapid reports back to the City Council on budget studies. It was moved by Councilman Winton, seconded by Mayor Ferris, and passed by the following vote that Councilmen Morton and Jennings be an on -going committee during this fiscal year to set projects for the next year's budget. AYES: 5 Councilmen: Morton, Winton, Jennings, Hollis, Ferris NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Prior to voting on the motion, Councilman Jennings stated he appreciated the oppor- tunity to work on the budget this year enabling him to become familiar with the procedures of the City Council Minutes 6/28/71 -2- Councilman Hollis stated that now that the budget is out of the way, he believed the City Council should proceed with the General Plan. Councilman Winton requested recommendations from each Councilman concerning the General Plan and an overview of the problems of each councilmanic district.
