PRESENT: Councilmen: Winton, Ferris, Morton, Jennings, Corbin ABSENT: Councilmen: None ALSO PRESENT: Charles W. 'Thompson, City Manager Donald B. Robison, Assistant City Manager Royal M. Sorensen, City Attorney Robert L. Shand, Director of Finance William A. Goggin, Director of Planning Ray Lake, Director of Building b Safety Jim Ruth, Director of Parks d Recreation Robert W. Gain, Fire Chief Loren D. Morgan, Police Chief Robert Coates, Water Superintendent H. L. Henriksen, City Engineer Ellen C. Davis, City Clerk Judy McDonnell, Executive Secretary Dr, Marvin Jackson, Pastor, Grace Baptist Church, delivered the invocation, followed by the Flag Salute led by Charles W. Thompson, City Manager. Mayor Corbin read Resolution of California Municipal Business Tax Association commending Terry Middlebrooke, who presided at a Workshop on "Objective of the Highway Carriers. Association; Value of Outside Inspectors; and Data Processing Aids the Field Inspector". Mayor Corbin declared this is the time and place for the public hearing on the General Plan and General Plan Map which was continued from the regular meeting of the City Council held November 24, 1970. He inquired of the City Clerk if she had received any further correspondence on the matter, and she replied she had not. William A. Goggin, Director of Planning, reported that this is the third meeting on the hearing of the General Plan and General Plan Map. He stated he had received no further correspondence. The Mayor inquired if there was anyone present who wished to speak in favor or in opposition to this matter, Realtor Bill Sweet, 9047 Florence Avenue, representing Mr. Herbert Schaeffer, owner of a lot located at 9637 Lakewood Boulevard, appeared before the City Council and spoke in opposition to the proposed zoning of R-2 on this property. He requested Council to consider the zoning of C-3. In reply to a question by Councilman Morton, Mr. Goggin stated that the case pre- sented by Mr. Bill Sweet was included in reports to the City Council on presentations made at the hearing held November 9th. The Mayor inquired if there was anyone else present who wished to speak regarding the General Plan and General Plan Map. No response. It was moved by Councilman Winton, seconded by Councilman Morton, and passed by the following vote to continue the hearing on the General Plan and General Plan Map to 7:30 p.m., January 11, 1971. Goggin, Director of Planning, displayed a map outlining the area involved and the surrounding properties. He stated there has been nv opposition to this matter. He described the development of the area, The Mayor inquired if there was anyone present who wished to speak for or against Zone Change Case 4119, Mr, Roger Muir, Lanco Engineering Company, 17430 So. Prairie, Torrance, California, appeared before the City Council and stated he represented the applicant in this case. He stated he was present to answer any questions the Council may wish to ask. The Mayor inquired if there was anyone else present who wished to speak to the matter. No response. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE ZONING MAP ADOPTED BY SECTION 9107 OF THE DOWNEY MUNICIPAL CODE (PLANNING RESOLUTION NO. 131 - ZONE CHANGE CASE NO. 119) The Ordinance was read by title only. AYES: 5 Councilmen: Winton, Ferris, Morton, Jennings, Corbin NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None RESOLUTION NO. 2486 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING ANNEXATION OF CERTAIN AREAS TO THE DOWNEY CITY LIGHTING DISTRICT AND TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO THOSE STREET LIGHTING FIXTURES LOCATED ON STREETS AND PUBLIC PLACES WITHIN THOSE AREAS UNTIL JANUARY 31, 1983 (ANNEXATIONS 70/25 THROUGH 70/37) The Resolution was read by title only. It was moved by Councilman Morton, seconded by Councilman Winton, and so ordered to waive further reading, Council Minutes 12/14/70 -2- It was moved by Councilman Morton, seconded by Councilman Winton, and passed by the following vote to adopt Resolution No. 2486, AYES: 5 Councilmen: Winton, Ferris, Morton, Jennings, Corbin NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None It was moved by Councilman Winton, seconded by Councilman Jennings, and so ordered to approve the Minutes of the City Council Meetings of November 9, 1970 and November 24, 1970 as written, Councilman Ferris reported on the meetings which he had attended of the Committee of Mayors of Cities in Los Angeles County for the purpose of discussing in detail the fiscal crises that have visited almost all cities in the State. The Committee, he stated, addressed itself to the major issues which created the problems, one of which was the action of the Board of Supervisors to grant Mid -Year Salary Increases to personnel of the Sheriff's Department and the County Fire Department. He reported on a Resolution adopted by the City of Burbank, protesting the high County Tax Rate and urging the Los Angeles County Division of the League of California Cities to persuade State Legislature to provide funds for State mandated programs and recommended that the City Clerk prepare a similar resolution for adoption by the Downey City Council at the December 22nd meeting, The City Clerk was so directed. Communication from Downey Water Board regarding the formation of a Citywide Water f.Ls It was moved by Councilman Winton, seconded by Councilman Ferris, and so ordered to hold the matter over for study and the setting of a definite date and time for a joint meeting of the City Council and the Water Board. Communication from the Post Office Department on new Anti -obscenity Program. Ordered filed. Communication from R. F. Holste, 7519 Laura Street, Downey, requesting improvement of Laura Street. No action, Communication from Southeast Mosquito Abatement District requesting that the City Council take an action on the appointment of a member of the Board of Trustees of this District for the term beginning January 2, 1971. Councilman Ferris reported on the activities of this organization and stated that Councilman Morton, who is presently representing the City of Downey on this Board, is currently serving as Secretary. It was moved by Councilman Ferris, seconded by Councilman Winton, and passed by the following vote to re -appoint Councilman Thomas H. Morton as member of the Board of Trustees of the Southeast Mosquito Abatement District for a two-year term of office effective January 2, 1971, AYES: 4 Councilmen: Winton, Ferris, Jennings, Corbin NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None ABSTAIN: 1 Councilmen: Morton Councilman Morton expressed his appreciation to the City Council for the privilege of representing the City of Downey on the Board of Trustees of the Southeast Mosquito Abatement District. He stated a tremendous amount of technical data is researched by this group which involves 27 cities. He commented regarding legislation on the use of DDT and stated that DDT has not been used in this District for the past 8 or 9 years. Communication from the City of Bell Gardens enclosing copy of their Resolution providing for Mutual Aid of the Police Department Services. Ordered received as a matter of record. Councilman Morton recommended that the City Administrator of the City of Bell Gardens be advised that the City of Downey has no objections to that City being one of the Mutual Aid Cities in Law Enforcement. So ordered. Communication from Harold J. Ostly, Los Angeles County Treasurer and Tax Collector, regarding change in policy regarding amount to be paid by Public Agencies for tax deeded properties. Councilman Winton suggested that the City of Downey protest the action of the Board of Supervisors because the Cities were not notified that such action was to be considered. Councilman Ferris also recommended that this action be protested. Communication from Division of Highways regarding acquisition of property at 12849 Faust Avenue, Downey, prior to a freeway agreement. Ordered filed. Council Minutes 12/14/70 -3- 5 Communication from the City of Torrance, enclosing copy of Resolution requesting the League of California Cities and the Member Cities in Los Angeles County and State and National Legislators to approve the program of utilizing surplus military aircraft in fighting forest fires. Ordered filed. Communication from Mrs. Albert V. Dougherty, 3500 W. 118 P1., Inglewood, protesting Lot Cleaning, 9509 Casanes St., Downey, by the Los Angeles County Health Department. City Engineer, Harald Henriksen., reported this was an error on the part of the County Health Department as the Department of Public Works is responsible for lot cleaning and has been cleaning the Lot and the charge is shown on the tax bill. He stated Mr. Dougherty has been so informed. Communication from California Regional Water Quality Control Board enclosing Resolution implementing Section 13266 of California Water Code. City Manager, Charles Thompson, reported that in essence the effect of this resolution would be the City relinquishing some control over building permits for subdivisions involving five units or more and could be in conflict with certain provisions of Downey's Ordinance governing subdivisions. On the City Manager's recommendation, a committee composed of Councilmen Morton and Winton and the City Manager was appointed by the Mayor to study the subject resolution. Communication from Cities of Arcadia, Monterey Park and Hawthorne enclosing Resolutions regarding Action of League of California Cities re Report of Urban Problems Committee. Councilman Ferris reported that inasmuch as many cities were not in attend- ance at the November 5, 1970 meeting of the Los Angeles County Division of the League of California Cities when action was taken on the subject committee report, numerous cities have adopted similar resolutions and the matter will be reconsidered at the January 7th meeting. On the recommendation of Councilman Morton, Ordinance adding Chapter 6 to Article VII of Downey Municipal Code relating to Assessment Districts as amended was held over for later action. Ordinance relating to Noise was taken under submission. Councilman Jennings re- quested the City Attorney to amend the Ordinance by adding a paragraph to prohibit the use of sirens and whistles on ambulances in the City of Downey. The Mayor declared a recess at 8:30 p.m. The Meeting resumed at 8:40 p.m. with all members of the City Council in attendance. RESOLUTION NO. 2487 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING THE VACATION OF CERTAIN WATER PIPELINE EASEMENT LYING SOUTHERLY OF LOT 298 AND A PORTION OF LOT 299 OF TRACT NO, 8960 COMMONLY KNOWN AS 7900 EIGHTH STREET The Resolution was read by title only. He commented regarding the responsibility of local governments to call on State Representatives and Representatives in Congress and the Senate calling their attention to the great numbers of young people who were encouraged for the past twenty years to enter into professions and 'become experts in the field of space and related occupations and are now unemployed because they have no other background. Keays, who has served as Marshal since July 1, 1962 in the law enforcement service of the County of Los Angeles. It was moved by Councilman Winton, seconded by Councilman Ferris, and so ordered that an appropriate resolution honoring Marshal Keays be prepared and presented to the City Council for adoption at its next regular meeting, Councilman Winton commented relative to the report of the Traffic Committee regarding the traffic signal at Bellflower Blvd. and Daleno He requested that this matter be referred back to the Traffic Committee for a more thorough report as the major problem at this signal is the exit of cars from the Taco Stand on the corner which causes the signal to change. Councilman Winton stated that he would be available in his office all day following the City Council Meeting of December 22nd to meet with any citizens who come in relative to the proposed General Plan and General Plan Map, Councilman Winton spoke regarding the need to make available to citizens general information on matters which appear on the agendas of City Council Meetings. He read a suggested procedure for making this information available at the Library. He also suggested that following the meeting to be held in Sacramento regarding the freeway route that the City Council return and settle the issue.
