The City Council of the City of Downey held a regular meeting at 8:00 a.m.,
November 24, 1970, in the Council Chamber of the Downey City Hall, Mayor Ben 'D Corbin
presiding.

Councilman Jennings delivered the invocation, followed by the Flag Salute led by
Councilman Ferris.
With the assistance of the Director of Public Works, Mayor Corbin presented
Department of Public Works Quarterly Defects Awards to the following employees:

The Mayor declared this is the time and place for the public hearing on the General
Plan and General Plan Map which was continued to this time and place from the Regular
Meeting of the City Council held November 9, 1970.
Mr. William Goggin, Director of Planning, reported that reports on presentations
made by interested persons at the Regular Meeting of November 9th were in the process of
being prepared and would be ready later in the week. He stated that there are no further
reports from the Planning Staff at this time.
The Mayor inquired if there was anyone present to speak in favor or in opposition to
the General Plan and General Plan Map.
Councilman Morton stated that he would like to add one more area to those now being
studied by the Planning Staff for review of the proposed zoning - the northwest corner of
Cherokee Drive and Lakewood Boulevard. He stated he would like an evaluation of a C-H
zone for this property as opposed to the presently proposed apartment house use. Mr.
Goggin stated he would prepare a report on this.
Mr. Wendell Wiser, 10921 Paramount Boulevard, stated he would like to re -affirm the
position of his clients as presented at the Regular Meeting of November 9th.
The Mayor inquired if there was anyone else present who wished to speak regarding the
General Plan and General Plan Map. No response.
It was moved by Councilman Ferris, seconded by Councilman Winton, and passed by the
following vote to continue the hearing on the General Plan and General Plan Map to
7:30 p.m., December 14, 1970.

The Director of Public Works reported on communication from Bruce I. Winther, 12063
Paramount Boulevard, protesting assessment for lot cleaning at 8030 Devenir Street. He
stated the owner of record on the assessment rolls was properly notified.

At the request of Councilman Morton, report of the Director of Public Works regarding
the widening of Fifth Street was held over pending a survey by the Department of Public
Works on the number of property owners in favor and those against the widening of Fifth
Street.

AMENDING THE DOWNEY MUNICIPAL CODE BY ADDING THERETO

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ADDING CHAPTER 6 CONSISTING OF SECTIONS 7600 THROUGH
7613 TO ARTICLE VII OF THE DOWNEY MUNICIPAL CODE, WHICH
SAID CHAPTER RELATES TO ASSESSMENT DISTRICTS
(Introduced November 9, 1970)
Councilman Morton spoke relative to the intent of the Council on the introduction of
this Ordinance. To clarify its intent, he recommended the Ordinance be amended to
include a section on policy substantially as follows:
"It is the stated policy of the City Council that the provisions of this Ordinance
shall only be used under emergent conditions where so specifically determined by the City
Council and where affected citizens have been properly notified; and, further, that in
all other cases, the City Council will continue to follow the practice and policy of
following the mandate of citizens through the use of properly circulated petitions."
In response to a question by Councilman Jennings, the City Attorney advised that the
subject Ordinance does not provide for acquisition of right-of-way.
Councilman Winton stated that the Ordinance is intended to streamline the procedures
for the establishment of assessment districts. He said this Ordinance is not an all -
empowering act being forced upon them without their consent.
The Mayor inquired if there was anyone present who wished to speak for or against
the Ordinance.
Mr. James G. Allen, Jr., 9015 Manzanar Avenue, Downey, appeared before the City
Council. He expressed his appreciation for Councilman Morton's recommendation for an
addition to the Ordinance. He opposed the adoption of this Ordinance which he stated
would eliminate the requirement for a simple majority of property owners to sign a
petition for improvements prior to the requirement for all owners to share in the cost.
He quoted from an article in the November 9 issue of Southeast News which stated the
Ordinance would enable the forcing of property owners to put in improvements such as
sewers, curbs, gutters, sidewalks and lighting when such improvements were required for
public safety and health; and no mention being made of "public or private convenience".
Mr. Allen continued, referring to a meeting held several months ago by Councilman
Morton and City Officials with the residents in the area in which he lived at which
meeting questionnaires were completed by the residents present which indicated the
simple majority were not in favor of the improvements proposed. He requested the City
Council to postpone their vote on the adoption of the Ordinance until the residents of
this area and other similar areas can be represented.
Councilman Morton responded to Mr. Allen's comments, indicating that he had
communicated with the residents of the area under discussion, advising them that the

wishes of the majority would be respected. Since that time, he stated, residents on
fixed incomes who had previously been opposed to the improvements have communicated with
him stating they would be in favor of the improvements if that problem could be resolved.
Councilman Morton stated the intent of his recommended addition to the Ordinance was to
assure that the policy of the City Council to follow the wishes of the majority would
continue.
City Attorney Sorensen, clarifying the intent of the Ordinance, stated the present
law as it applies to Chartered Cities allows City Councils by a 4/5 vote to order this
type of work done on determination of "public convenience and necessity"; the Improvement
Act of 1911 under which most of Downey's assessment districts are conducted, does not
require a petition, but it has been the policy of the City Council to circulate one. He
further stated that primarily the purpose of the Ordinance as drafted was to provide a
simplified measure of procedure on small jobs in an effort to reduce the administrative
cost that it would be necessary to charge against the project.
It was moved by Councilman Ferris to return the Ordinance to the City Attorney for
inclusion of a section along the lines outlined by Councilman Morton to be returned to
the City Council for introduction.
Mrs. Betty Kenley, 9028 Manzanar Avenue, appeared before the City Council and spoke
in opposition to adoption of the Ordinance, stating that the Ordinance would take away
the requirement for a majority of property owners to sign the petition for improvements.
She quoted from Section 14, Article I, of the State Constitution.
City Attorney Sorensen stated the Section quoted by Mrs. Kenley related to condemna-
tion proceedings. In further response to questions by Mrs. Kenley, Mr. Sorensen stated
there is a provision in the Streets and Highways Code referred to as "Majority Protest
and Debt Limitation Act of 1931" which provides that if there are protests by more than
50% of the owners of property to be assessed, the project shall be abandoned; however,
under the Constitution a Chartered City by a 4/5 vote has the right to waive or eliminate
the requirement of that debt limit act proceeding. The Ordinance, he stated, does not
change that portion of the Law.
Following further comments by Mrs. Kenley and on request of the City Council, the
Director of Public Works related an example of saving of costs on an assessment district
under the proposed Ordinance: On a small project on which the cost of improvement was
estimated at $300., using the formal 1911 Act procedure, the legal and bond fees would
amount to $950. On the same project, under the provisions of the proposed Ordinance,
administrative costs would be 35% of the improvement costs or approximately $100. He
stated the Ordinance is proposed to save cost to property owners and is intended to be
used only on small projects that the City can afford to finance.
Mr. Wendell Wiser, 10921 Paramount Boulevard, stated when he commended the City
Council at the last meeting for their action taken on the proposed Ordinance he was not
aware that the City Council presently had the right to take the actions referred to at
this meeting. He requested that an action be taken on Councilman Morton's recommenda-
tion without further delay.
The Council Meeting was interrupted for the Mayor's introduction of Miss Rhona
Weinberg, sponsored by the Department of Public Works, who was selected as "Miss Downey"
for 1970-71.
The motion of Councilman Joseph Ferris on the amendment to the proposed Ordinance
was seconded by Councilman Winton and passed by the following vote:

Following a summation of bids, it was moved by Councilman Jennings, seconded by

School Road to Westerly City Limits, to C. I. d F., Inc., of Bell Gardens, the lowest
and best bidder, in the amount of the unit prices bid, and reject all other bids.

Contract #SS-250, Old River School Road at Dinwiddie Street and Rives Avenue at Yankev
Street, and reject all other bids.

1970 Storm Drain Bond Issue - Consulting Engineering Services.
The Director of Public Works stated that each City is responsible for preparation of
plans for drains within its boundaries. Fees for engineering services are fixed, and a
City has the option of doing the work itself or hire consultants to prepare plans. He
recommended the firm of Koebig & Koebig, Inc.

Councilman Jennings stated he had studied the six proposals submitted and
recommended hiring the firm of Koebig & Koebig, Inc.

City Manager Thompson reported on the Annual Group Life & Health Insurance Contract
negotiated by Mr. Lee Cranmer, Jr. of the Pacific Group Agency with Blue Cross which
would become effective January 1, 1970 if approved.
Mr. Lee Cranmer, Jr. explained the coverage proposed in the new contract which
would increase Hospitalization from 180 days to 365 days. He answered questions of the
City Council.

CITY MANAGER'S REPORT
City Manager Thompson reported on the resume prepared by the Director of Building
and Safety regarding Architect's responsibility for Change Orders on the Downey Theatre.

Report of Fire Chief Gain regarding Resolution of City of Long Beach regarding use

Councilman Jennings reported that the 14th Birthday Celebration of the City of Downey
will be held at the Downey Theatre on December loth at 7:00 p.m.
Councilman Winton recommended a review of the Sidewalk Matching Fund Policy on
commercial properties.
Councilman Winton reported regarding the Traffic Signal at Dalen St. and Bellflower
Blvd., which he stated has been a conducive factor in the dumping of commercial traffic
into the residential area as people are avoiding the Imperial and Bellflower signal.

Director of Planning Goggin reported on a tour of Flood Ranch Redevelopment in
Santa Fe Springs to be conducted by the Southeast Area Planning Council on November 30th
and invited the City Council to tour this development.
The Director of Planning, William Goggin, inquired if the City Council would like a
study session prior to the next session on the General Plan.
Park and Recreation Superintendent, Hollis Stewart, reported on the open house to be
held by Marmac's, Concessionaire at the Rio Hondo Golf Course.
Mr. Bruce I. Winther, 12063 Paramount Blvd., spoke regarding assessment on his tax
bill for lot cleaning at 8030 Devenir Street, and stated he had received no notice prior
to the lot cleaning. The Director of Public Works reported that the notice was sent to
the owner listed on the latest Assessor's Rolls which was the previous owner.
There being no further business to come before the City Council, the Meeting was
adjourned at 11:35 p.m.
