MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
NOVEMBER 9, 1970
The City Council of the City of Downey held a regular meeting at 7:30 p.m.,
November 9, 1970, in the Council Chamber of the Downey City Hall, Mayor Ben 'D Corbin
presiding.

Dr. Austin Coe, Pastor Downey Memorial Christian Church, delivered the invocation,
followed by the Flag Salute led by Councilman Winton.
Dr. Austin Coe appeared before the City Council and spoke in behalf of the Downey
Rotary Club. He stated the Mayor has proclaimed this week as "Four -Way Test Week". He
presented a desk plaque to each member of the City Council as a reminder of the meaning
of the Four -Way Test. Meaning: Is it the truth? Is it fair to all concerned? Will it
build good will and better friendships? Will it be better for all concerned? Desk
plaques were also provided for City Department Heads.
Mr. Boris Golokow, 10001 Pescadero, South Gate, appeared before the City Council
and presented his poems on the Apollo 8, 10, 11, 12 andl3. Copies of some of these are
on display at the Smithsonian Institute. He read "Weekend on the Moon" relating to the
landing on the Moon of Apollo 11. Mayor Corbin accepted Mr. Golokow's presentations to
the City.
Mayor Corbin declared that this is the time and place for the public hearing on the
General Plan. He inquired of the City Clerk if she had the Affidavit of Publication of
Notice of Hearing, to which she responded in the affirmative.
It was moved by Councilman Ferris, seconded by Councilman Winton, and so ordered to
file the Affidavit.
Mayor Corbin inquired of the City Clerk if she had received any written corres-
pondence on the matter, and she responded that she had received a communication from the
Downey Chamber of Commerce, copies of which had been provided the City Council. Ordered
filed.
The Mayor stated that to expedite matters, the City Council will first hear the
presentation of the Director of Planning. Following this, all persons present wishing
to be heard will be called. He asked those persons who wish to speak to fill out a card
giving name, address, and organized group affiliation, if any. Those persons
representing organized groups will be heard first, then individual citizens will be
heard. He stated this is not a hearing on the zoning ordinance and questions concerning

zoning will be referred to the Staff for clarification at a later time. Statements
concerning modification of the General Plan and General Plan Map will be taken under
submission for study and review to be presented at a later meeting for final
determination.
William A. Goggin, Director of Planning, reported on the revised General Plan,
comprised of two component parts - General Plan and General Plan Map. The Map was dis-
played and Mr. Goggin identified the areas in which changes were proposed.
Mr. William B. Cole, General Manager, Downey Chamber of Commerce, appeared before
the City Council and referred to their letter of November 3rd relative to the proposed

revisions of the General Plan. Referring to the recommendation added on Page 10 calling
for a "Design Review Board", he suggested that the City Council seek further clarification
as to composition, powers and relationship to the Planning Commission of this Board before
considering its inclusion in the General Plan,
Mr. Walter C. Hong, representing Mr. W. Schaeffer, owner of a lot at 9637 Lakewood
Boulevard, and Edon Property, Inc., at 9701 Lakewood Boulevard, appeared before the City
Council and requested that these two lots be re -zoned for commercial use.
Mr. Gale Eagleton, attorney, 10002 Flower Street, Bellflower, representing the
Andrews Family, owners of 34 acres on the north side of Firestone,west of 01d River School
Road, and approximately 11 acres on the south side of Firestone, spoke in opposition to
the proposed re -zoning of the property on the north side of Firestone to Commercial. He
stated the owners are willing to work with the City for a planned development in the area,
but requested consideration of a transitional situation wherein light M-1 uses such as
the body and fender shops in conjunction with the automobile sales development presently
in the area be permitted to continue. Mr. Eagleton presented a map outlining the present
development in this area, It was moved by Councilman Winton, seconded by Councilman
Ferris, and so ordered to receive the map.
Mr. Sherman Griselle, 10932 Hasty Avenue, previous Planning Director for the City of
Downey, commended the Planning Commission and Planning Staff for developing the revised
General Plan which he stated is a good plan and a sound plan that deserves the support of
all of the citizens and the City Council. He spoke in favor of the Design Review Board
which he stated is necessary to maintain the quality of life and quality of living which
he came to this City in 1960 to enjoy.
Mr. Dale Ingraham, P. 0. Box 229, E1 Monte, appeared before the City Council and
stated that he represents Mr. Ralph Garland and Mr. Bob Lewis, owners of the property
between Studebaker Road and the #605 Freeway and the Santa Ana transitional road south
of Florence Avenue. Mr. Ingraham spoke in favor of a planned development for this area
which would not preclude a mixture of uses such as commercial and multiple dwellings and
stated his clients would in the near future present a planned development proposal for
the entire parcel.
Mr. Gene V. Dobbs, 16332 South Thorson, Compton, stated that he owns three lots on
Paramount Boulevard, south of Imperial Highway, at 12938 Paramount Boulevard. He stated
that he purchased the property as C-3 property and proposed to develop it with C-3 uses.
He registered his opposition to re -zoning the property for R-3 uses.
Mr. Booker Everett, 12166 South Julius Avenue, appeared before the City Council and
stated that he owns the property at 11741 Bellflower Boulevard. He opposed the possible
re -zoning to R-2.
Mr. Larry Davis, 12817 South Downey Avenue, appeared before the City Council and
stated that he represents Miss Sue E. Davis and William V. Davis, who own property on
Paramount Boulevard near Imperial Highway. The property is presently zoned as "C", and
he opposed a zone change to "R".
Beverly Farrell, 8132 Gardendale Boulevard, Paramount, appeared before the City
Council and stated that she owns three lots at 13006 Paramount Boulevard. The property
is presently zoned for C-3 unlimited, and she opposed a change to R-4.
Mr. Wendell Wiser, 10921 Paramount Boulevard, appeared before the City Council and
stated that he represents the owners of property on the southwest corner of Brookmill
and Paramount, and on Imperial Highway adjoining the River. He stated the owner of the
property at Brookmill and Paramount Boulevard strongly opposed the proposed change from
R-2 to R-1 uses. Representing the owner of property on Imperial Highway adjoining the
River, he registered opposition to the development of this area for M-1 uses which he
stated would retard any development in the next two or three years.
Councilman Morton presented a letter from Mr. Maurice L. McAlister, President of
Downey Savings d Loan Association, which was read by the City Clerk. Mr. McAlister
registered his opposition to further extension of apartment house zoning and proposed
the deletion of some existing or proposed apartment zoning on Florence Avenue because of
density and traffic conditions which presently exist as a result of this type of
development.
Councilman Morton requested that the presentations made at this hearing be numbered
in sequence and that they be reviewed by the Staff and recommendations and report on
each will be furnished the City Council for their review. He stated the matter of Fifth

Street widening will be taken up later in the meeting but recommended that anyone who
wished to speak regarding the proposed R-3 for this area do so at this time.
Councilman Winton reported that he received correspondence from his constituents
regarding property facing Imperial Highway involving approximately four homes zoned R-1.
He stated they are requesting consideration of a change to Commercial.
It was moved by Councilman Morton, seconded by Councilman Winton, and so ordered to
continue the General Plan Hearing to 8:00 a.m., November 24, 1970.
Mayor Corbin declared that this is the time and place for the public hearings on
Downey Improvement Projects No. 609 through No. 612 Gardendale Street. He inquired of
the City Clerk if she had the Affidavits of Posting and Mailing of Notice of Cost, to
which she responded in the affirmative.
It was moved by Councilman Winton, seconded by Councilman Ferris, and so ordered to
receive and file the Affidavits.
Mayor Corbin inquired of the City Clerk if she had received any written correspondence
on the matters, and she replied she had not.

approve the Minutes of the City Council Meeting of October 12, 1970 with correction as
follows:
Page 2, third paragraph, Appeal, Zone Exception Case #951: "It was moved by
Councilman Jennings, seconded by Councilman Ferris, and passed by the following
vote to approve Zone Exception Case #951 with the six conditions as outlined,
with Condition #3 modified to read as follows: The Applicant shall sign an
agreement for the future installation of sidewalks at such time as 50% of the
property owners on Samoline Avenue have requirements for installing sidewalks
on Samoline Avenue, or when there is a proposed assessment district for the
installation of sidewalks on Samoline Avenue.";
and to approve the Minutes of the City Council Meeting of October 27, 1970 as written.
Communication from Downey Chamber of Commerce regarding Christmas Lighting.
Mr. George Zehnder, President, Downey Chamber of Commerce, appeared before the City
Council and read the communication recommending the City Council's approval for alloca-
tion of funds for Christmas Lighting in the Downtown Area. It was the suggestion of the
Downey Chamber of Commerce that consideration be given to the elimination of the four
"Seasons Greetings" signs, concentrating on the street light standard decorations which
would reduce the City's participation by approximately $1,000.
Mr. Russell G. Lamkin, 7417 Third Street, Downey, appeared before the City Council
and spoke in favor of the City's participation in Christmas Lighting for the downtown
area.
It was moved by Councilman Jennings, seconded by Councilman Ferris, and so ordered
to re -open for discussion and action the request from the Downtown Downey Business
Association for Christmas Lighting which was denied by the City Council at its regular
meeting of October 12, 1970, and give consideration to the recommendation of the Downey
Chamber of Commerce.

Councilman Ferris stated that in view of past practices of the City Council regard-
ing this matter and the fact that the Downtown Downey Business Association represents
merchants in the Central Business District which accommodates the Christmas Parade, until
such time as a program is established to include merchants in the outlying areas, he
would recommend an approval of the request along the lines as recommended by the Downey
Chamber of Commerce.
Councilman Winton spoke in opposition to expenditure of funds for a 4-block area
and stated he does not believe the City Council can justify such an expenditure unless it
would include other business areas in the City. He said the City Council should
re-examine their values relative to this expenditure which amounts to approximately
_.. $1,000. a block using as justification the Christmas Parade which lasts about one hour
each year.
--- Mayor Corbin stated it would be impossible to participate in Christmas Lighting for
the entire City, and inasmuch as Downey Avenue is considered the Downtown Business
Section and for the past forty years has had Christmas Lighting, he recommended the City
Council approve lighting either for the one area or none.
It was moved by Councilman Jennings, seconded by Councilman Ferris, and passed by
the following vote to approve the expenditure for Christmas Lighting in the Downtown
Business Area in the amount of $2,750. eliminating the "Seasons Greetings" signs at the
four gateways to the City, the contract for the lighting to be negotiated by the Downey
Chamber of Commerce, and to authorize the following transfer of funds:

Communication from Nelson and Ruth Treloar, 8523 Fifth Street, Downey, request to
appear before Council regarding widening of Fifth Street.
Mrs. Nelson Treloar appeared before the City Council and spoke in opposition to the
widening of Fifth Street. She stated that the widening of one block will not alleviate
traffic congestion and that it will be inviting additional and more rapid traffic. Other
reasons for her opposition were that widening of this street would make it more difficult
to get in and out of driveways and that it would reduce home values.
It was moved by Councilman Morton, seconded by Councilman Ferris, and passed by the
following vote to take the matter of Widening of Fifth Street under submission for
further study and analysis of statements in opposition.

Director of Planning, William Coggin, presented a plot plan and elevation for

on which the City Council approved Zone Exception Case #931.
Following a review of the plot plan and elevation, it was moved by Councilman
Winton, seconded by Councilman Ferris, and passed by the following vote that the appli-
cant in Zone Exception Case #931, Mr. Edward DiLoreto, be notified that the plot plan and
elevation submitted on November 9th are substantially different from those on which they
based their decision of August 10, 1970, and that development of the subject property

purpose of this Ordinance is to minimize the cost of forming an assessment district by
eliminating some of the administrative work and it would permit the City Council to let
contracts in the same manner as it does other Public Works contracts. He further stated
that the City Council presently has the authority under California Laws to override pro-
tests and the adoption of this Ordinance would not be giving the City Council authority
it does not already possess regarding overriding protests.

CITY MANAGER'S REPORT
Charles W. Thompson, City Manager, reported on the Downey Theatre. He stated that
all items have been resolved, and the amount of $989.06 will complete payment to the
contractor. He said a final report on the Architect's responsibility as to change
orders will finalize the project.
The Director of Public Works reported regarding construction of Sidewalks on
Wiley Burke Avenue between Quinn Street and Irwingrove Drive.
It was moved by Councilman Ferris, seconded by Councilman Winton, and passed by the
following vote to authorize the Director of Public Works to institute Chapter 27
Proceedings for construction of sidewalks on Wiley Burke between Quinn Street and
Irwingrove Drive, and to set the hearing for December 14, 1970. (*See later action re

ORAL COMMUNICATIONS
Jim Ruth, Director of Parks d Recreation, stated the Veterans Day Memorial Committee
has extended an invitation to attend the Veterans Day Memorial Program. Congressman Del
Clawson will be the key -note speaker.
Referring to hearing set for December 14th for Sidewalks on Wiley Burke Avenue, the
Director of Public Works stated with the requirement of the 30-day informal notice, the
hearing should be set for January 9, 1971.
It was moved by Councilman Ferris, seconded by Councilman Winton, and passed by the
following vote to amend the motion on this matter and set the hearing on Sidewalks,
Wiley Burke Avenue between Quinn Street and Irwingrove Drive, for January 9, 1971.

Mike Ritchey, 8543 Farm Street, appeared before the City Council and stated that he
had received his water bill which included a 5% Utility Users Tax. He inquired about
deducting the Utility Tax and paying the difference to the water department, and if he
should make a mistake, would his water be turned off.
Director of Finance, Robert Shand,replied that the correct computation would be to
divide the total amount of the current water bill by 105% and subtract that from the
total amount of the water bill. He said if an error was made, Mr. Ritchey's water would
not be shut off.
Mr. Wendell Wiser, 10921 Paramount Boulevard, appeared before the City Council and
commended the City Council for introducing the Ordinance relating to assessment districts,
which he stated was long overdue. He commented regarding widening of Fifth Street.
Mr. Kenneth Miller, 7336 Cleargrove Drive, appeared before the City Council, and
referring to his verbal presentation of September 22, 1970 on the Utility Tax Ordinance
he stated the City Council requested he submit his presentation in writing. He asked
for Council's opinion on this presentation. There was no comment.
In reply to an inquiry of Mr. Earl Berry, 8536 Eucalyptus Street, the City Attorney
stated that there is a section in the Utility Users Tax Ordinance which provides for
some relief under certain conditions.
City Manager Thompson presented a request for Parade Permit from the Downey
Christmas Parade Committee and stated the parade will start south of Florence Avenue on
Downey Avenue and take the same route as last year.
In response to a comment by Councilman Ferris regarding local youth groups who were
not permitted to march in the 1969 Christmas Parade, Mr. Thompson stated that he had
discussed the matter with the Chairman of the Christmas Parade Committee who had advised
him that due to the parade last year having been televised, a deadline for entries was
set and those groups who did not meet the deadline were not permitted to have an entry.

It was moved by Mayor Corbin, seconded by Councilman Jennings, and passed by the
following vote to approve the Christmas Parade route as presented.

It was moved by Councilman Ferris to obtain a report from the officials of the
Parade Committee within a week on entrance requirements.
In response to a question by Councilman Winton, the City Manager stated that the
Press has carried information on the regulations applying to Exemptions from payment of
the Utility Users Tax. He stated there is a need to publicize this matter more, and he
will try to have more articles published and plans to have a meeting with the Senior
Citizens groups to explain these provisions of the Ordinance. Councilman Winton suggested
that the next issue of the Communicator include information on the provisions for
exemptions of this tax.
Councilman Ferris stated there was a motion on the floor. The motion to obtain a
report on Parade entry requirements was seconded by Councilman Winton and passed by the
following vote.

Councilman Morton called attention to the clean-up following the 1969 Christmas
Parade and stated that in areas where there were no curbs and gutters, the streets were
not adequately cleaned. He stated that there was much debris left on Lawns. He requested
the City Manager to set up a program to police the area following this year's parade.
There being no further business to come before the City Council, the meeting was
adjourned at 10:50 p.m.
