OF THE CITY OF DOWNEY
JULY 13, 1970
The City Council of the City of Downey held a regular meeting, at 7:30 p.m., July 13,
1970, in the Council Chamber of the Downey City Hall, Mayor Ben ID Corbin presiding.

Reverend Marvin Jackson, Grace Baptist Church, delivered the invocation, followed
by the Flag Salute led by Councilman Jennings.
The City Manager introduced Mr. Metin Ozkinay, an official of the Turkish Govern-
ment, who is making a study of Local government in Los Angeles County,
Councilman Ferris introduced students of Downey's Sister City, Guadalajara, Mexico.
Mayor Corbin welcomed the students and expressed hope that they would have a chance to
visit Disneyland and enjoy their visit,
Mayor Corbin presented service awards to City employees and extended the apprecia-
tion of the City Council to the following for their service to the City.

Mayor Corbin presented a Ten -Year Service Award to Mr. William Greene, Planning
Commission Member, and Five -Year Service Awards to Mr, Cliff Heimforth and Mr, Vale
Baker, Water Board Members, and extended the appreciation of the City Council for their
community service.
Mayor Corbin opened the public hearing on Downey City LightinDistrict, Annexation
70/21 Bixler Avenue. He inquired of the City Clerk if she had the required Affidavit of
Publication, to which she responded in the affirmative. He inquired if she had received
any written protests, and she replied she had not,
The Director of Public Works reported that this lighting district involves the
mounting of 7,000 lumen mercury vapor luminaires on existing wood poles; therefore,
there will be no installation cost and this district will be annexed to Zone #1 at $,20
per $100. assessed valuation for maintenance and operation.
It was moved by Councilman Winton, seconded by Councilman Ferris, and so ordered to
accept the report of the Director of Public Works,

of this improvement, and there was no response. He inquired if there was anyone present
who wished to speak in favor, and there was no response.

stallation of an Edi.son-owned Marbelite underground street Lighting system along

The Director of Public Works reported that the total amount to be collected over a
ten-year period is $1,029,83, which amount includes interest and collection costs,

105 Freeway. Ordered filed,
Communication from Traffic Committee, confirming its recommendation for Sunday
parking restriction of 1 hour between 6:00 a.m. and 2:00 p.m. on three frontages of Our
Lady of Perpetual Help Church, also recommending in addition that parking be prohibited
on the Downey Avenue frontage from. 2:00 a.m. to 6:00 a.m.
It was moved by Councilman Ferris and seconded by Councilman Jennings to approve the
parking restrictions as recommended by the Traffic Committee.

ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING THE DOWNEY MUNICIPAL CODE BY ADDING CHAPTER 1D TO
ARTICLE VI ESTABLISHING A UTILITY USERS TAX AND PROVIDING
FOR THE COLLECTION THEREOF, PENALTY FOR NONPAYMENT,
REMEDIES AND ENFORCEMENT

by Councilman Morton, and so ordered to waive further reading.
The Mayor declared a recess at 8:25 p.m, The Meeting resumed at 8:45 a,m, with all
Councilmen present.
City Attorney Sorensen commented relative to suggested exemptions to be made 4 part
of the Utility Tax Ordinance, He stated that representatives from the Gas Company have
requested there be included a clause under the gas users tax to provide that gas used
for pumping water would be exempt.
On the matter of exemptions, Councilman Morton requested a proposed addition under
Section 6195, a new Section C, with the present Section C numbered Section D, the sub*
stance of which would be: "Applications for refund may be submitted to the City Council.
for consideration in cases involving extreme hardship, such as cases involving retirees
or senior citizens on fixed incomes; however, the City Council reserves the right to
approve or deny any such request."
City Attorney Sorensen requested that he be permitted to investigate the matter
prior to the City Council taking an action to include such a provision in the proposed
Ordinance.
Mr. Kenneth Miller, 7336 Cleargrove Drive, Downey, appeared before the City Council
and read a report on his analysis of water rates paid by apartment house owners and
those paid by owners of single residences. He recommended investigation of sources of
revenue other than a Utility Tax, to include a tax on apartment houses,
City Manager, Charles Thompson, commented relative to studies which have been in
progress by the City for some time on possible sources of additional revenue, a report
on which will be forthcoming when these studies have been completed.
Mrs. Brining, 9200 Brookshire, spoke in rebuttal to the comments of Mr. Miller re-
garding the levying of additional tax on apartment houses,
Mr. Rufus McKinney, representing the Gas Company, requested that certain language
be included in the Ordinance to provide for administering and enforcing the utility tax
by the Utility Companies so they may be assured that payments of remittances by the
Utility Companies will be based on the historic payment factor of customers and they
will not be placed in the position of being required to pay such tax in advance of
collection. Referring to Section 6184, Paragraph (d) of the Ordinance, which excludes
from taxation the charges for electricity used in the production or distribution of
water, Mr. McKinney requested that similar provisions be made for the Gas Company when
the source of energy is used for similar purposes,
Mr. Francis Hart, 9643 Cedartree Road, spoke with reference to hardships which
would be created if handicapped persons or families of the physically handicapped would
be required to pay a utility tax,

The City Manager reported on. letter from O'Melveny & Myers regarding question of
water rights in the acquisition of the Rio Hondo Golf Course
The City Manager commented on the Report of the Director of Public Works of all pro-
jects under design or scheduled during the fiscal year 1969-70,

Councilman Winton commended City Manager Thompson on his negotiations with the City
Employees and the manner in which he has taken over the management of the City, with the
cooperation of the City Department Heads. He commended the Director of Public Works for
keeping the Council apprised of the status of projects throughout the City.
Councilman Ferris congratulated the Department Heads and City Manager Pro Tem
Robison for their cooperation during the period the City Council was in the process of
selecting a new City Manager.
Chief Robinson, speaking on behalf of the Police Department, thanked the City
Council and the City Manager for the consideration given to all of the City Employees
during their recent negotiations.
Mr. Wendell Wiser, 10921 Paramount Blvd., expressed his pleasure over the considera-
tion given by the City Council to City Employees by the adoption of the Resolutions
covering increased wages and other benefits.
There being no further business to come before the City Council, the meeting was
adjourned at 10:40 p.m.
