MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
JUNE 23, 1970
The City Council of the City of Downey held a regular meeting at 8:00 a.m., June 23,
1970, in the Council Chamber of the Downey City Hall, Mayor Ben 'D Corbin presiding.

Reverend Mark Gress, United Methodist Church, delivered the invocation, followed by
the.Flae Salute led by Councilman Ferris.
Mrs. Richard Smith, Immediate Past President of the Women's Club of Downey, presented
the Mayor and Director of Parks and Recreation with a Silver Service, a gift for the new
Downey Theatre from the Women's Club of Downey.
With the assistance of Police Chief Ivan A. Robinson, the Mayor presented Detective
Donald Bray with Advance Police Officers Standards and Training Certificate. The Mayor
and Chief of Police congratulated Detective Bray for this achievement, which is comparable
to a Bachelor's Degree from an accredited college or university.
It was moved by Councilman Winton, seconded by Councilman Ferris, and so ordered to
approve the Minutes of the City Council Meetings of June 8th and June 15th, 1970.
Communication from State Board of Equalization regarding RID Transactions and Use
Tax. Ordered filed.
Communication from City of West Covina enclosing copy of their Resolution requesti
that the Los Angeles County Board of Supervisors reconsider their midrveai salary adius
meets. It was moved by Councilman Winton, seconded by Councilman Ferris, and passed by
the following vote that the City Clerk prepare a similar resolution for adoption by the
City Council of Downey.

Communication from KABC Radio regarding Rebuttal to Editorial Isla Vista. Ordered

Communication from Public Utilities Commission regarding Hearing, General Telephone
Rate Increase. Ordered filed.
Communication from the Director of Public Works regarding status of Cash Contract
#SS-191 Paramount Boulevard Brookmill to Seventh. In response to a question by
Councilman Ferris, the City Engineer reported that the work was temporarily halted by the
contractor due to the Edison Company not having been able to get its poles moved out of
the way as scheduled. He said they are now in the process of being removed and the
cables are being energized. It is anticipated that the work will resume the week of the
29th and the contract is expected to be completed four weeks from that time. Councilman
Winton requested that Edison Company be given sufficient time to assure there will be no
problems with the underground circuits.
Communication from Mr. Patrick D. McCallum, Chairman of Downey Christmas Parade
Committee, requesting that he be permitted to appear before the City Council at this
meeting to speak on the matter of the 1970-71 Budget. There being no objections, Mayor
Corbin permitted Mr. McCallum to make his presentation.

Mr. Patrick McCallum presented the City with a Perma Plaque of the 1969 Downey Rose
Float and the Trophy from the Parade. He explained that this year will be Downey's 20th
Annual Christmas Parade and that the 1969 Parade was the first one that was televised.
Mr. McCallum compared the 1968 parade to the 1969 parade; the increase in number of
entries - 120 in 1968 and 200 in 1969; bands increased in number from 7 to 18. The budget
was $8,900.00 in 1969, of which the City contributed $1,300.00. It is expected that due
to the publicity received last year when the Downey Parade was televised, there will be a
greater attendance in 1970. The 1970 Parade Budget is estimated at $11,350.00, and the
Parade Committee is requesting that the City of Downey increase their contribution to
$7,500.00.
Mr. Leslie V. Olson, President of the Downey Chamber of Commerce, appeared before the
City Council and read his communication of June 18th which had been distributed to the
City Council, requesting a contract with the City of Downey for "non-member services" and
the amount of $5,000.00 annually, beginning with the fiscal year July 1, 1970. The
services were described as telephone inquiries, inquiries requiring written response and
walk-in inquiries, "items of a public service nature".
Communication from Coca-Cola Bottling Co. of L.A. regarding increase in water rates.

Communication from Downey Rose Float Association regarding 1971 Tournament of Roses
Parade. It was moved by Councilman Winton, seconded by Councilman Jennings, and passed
by the following vote that $500.00 be allocated from General Government Account No.
09100--331.1, Miscellaneous, for entry fee for the 1971 Pasadena Tournament of Roses
Parade.

Mrs. V. B. Mulley, Chairman of the Legislative Study Committee, appeared before the
City Council and presented a report on their investigations of possible new sources of
revenue, namely Tippler's Tax, Utility Users' Tax and Property Tax. She introduced Mrs.
F. D. Campbell and Mrs. Gasdia, members of this Committee. Mrs. Mulley thanked Mrs,
Howard Hansen and Mrs. Dianne Boggs, and Mr, Bill Cole of the Downey Chamber of Commerce
for their assistance in the compilation of information for the report.
Mrs. Mulley requested a clarification as to the duties and functions of this
Committee which was originally established as a Tax and Revenue Committee and is now
classified as Legislative Study Committee. She requested that they be given a charter
giving this information, that they be extended cooperation of the Finance Committee or
those responsible for looking at the budget, also that they be furnished with budget
requests from each department, information on what was allocated, as well as expenditures.
Councilman Ferris expressed the appreciation of the City Council for their efforts
in preparing the report. He requested that the Legislative Study Committee prepare a
report on their recommendations for a program for future years and recommended general
responsibilities.
Mayor Corbin declared this was the time and place for the public hearing on the
Cry of Downey Annual Budget for the fiscal year 1970-71. He inquired of the City Clerk
if she had the required affidavit of publication of notice of hearing, to which she re-
sponded in the affirmative.

The City Manager stated that the budget proposed at this time does not include any
new personnel. This is due to the lack of financial reserve. He further stated that
the present status of the City's reserves is mainly the result of the necessity for the
City to provide the first year's debt requirements on the Hospital which was not a
budgeted item and which amounted to well over $300,000. He stated it is not known at
this time whether or not there will be an additional requirement for the City to meet
any of the debt service requirements for the Hospital for the coming year, which would
amount to approximately $395,000. This amount, again, is not budgeted, and should the
need arise, revenues at this time would not be sufficient to meet the need. Inflation-
ary trends and revenues not sufficient to meet projected requirements for reserve in
the General Fund have placed the City's General Fund in a most difficult position. The
City is now faced with salary improvements and adjustments which must be met.
Mr. Thompson recommended for immediate adoption some provision for new revenues.
His specific recommendation was the adoption of a Utility Tax of five per cent (5%)
level as soon as possible. If adopted and implemented prior to the beginning of the
second quarter of this fiscal year, this should result in additional revenues of approxi-
mately $750,000. to the General Fund. This amount, together with recommended adjustments
in service charges and fees amounting to $60,000., would provide additional revenue in
excess of $800,000. which, he stated, should be sufficient to allow some reserve for the
City and would provide a safety margin in the General Fund,
Mayor Corbin inquired if there was anyone present who wished to speak on the matter.
Mr. Kenneth J. Miller, 7336 Cleargrove Drive, Downey, appeared before the City
Council and requested that the City Council re -consider the matter of adopting a Utility
Tax which, he stated, would place the burden on the home owners and renters. He
recommended that the City Council look to special interest investment groups doing
business as landlords in the City. Mr. Miller presented a copy of his statement to the
City Clerk. A copy of the statement is on file in the City Clerk's Office.
The Mayor inquired if there was anyone present who wished to speak on the matter.
There was no response.

following vote to close the hearing on the Annual Budget 1970-71.

GOLF COURSE
The City Attorney advised that the Downey Recreation Facilities Lease and Resolution
relating to the Rio Hondo Golf Course has been changed with reference to the date of
commencement of the rental obligation. He recommended that the City Council take no
action on adoption of the Ordinance approving the Lease and Resolution which was intro-
duced at the Adjourned Meeting of the City Countil held on June 15, 1970. A new Ordinance
relating to the Golf Course was presented for introduction.

The City Engineer reported on the location and type of lights in the areas included

The City Manager presented an analysis from the Director of Building and Safety
covering Change Orders on the Downey Theatre, amounting to $230,952.95. The matter was
referred to the City Attorney for a report 'back to the City Council on the Architect's
responsibility.
The City Manager presented a request from the Director of Public Works for extended
sick leave for Mr, Juan Hernandez, Maintenance Leadman with the Water Department.
Following discussion by the City Council, it was moved by Councilman Ferris,

extended sick leave for Mr. Juan Hernandez under submission for a survey of policies

The City Manager reported on memorandum from the DiV6rtor of Public Works regarding
the Baseball Diamond Lighting at Downey High School, installation of which is scheduled
for June 23rd, culminating a two-year project in cooperation with the Downey Unified
School District. Dedication ceremonies are scheduled for Wednesday, July 1st.
The City Manager reported that preparations have been made for re -advertising the
Old Downey Community Hospital property for sale, requesting bids for the entire property,
or by parcel, advertising to commence on July 9th.

ORAL COMMUNICATIONS
Mr. Kenneth Miller, 7336 Cleargrove, Downey, appeared before the City Council and
requested to go on record protesting the budget hearing at this meeting. He stated that
there were violations of the City Charter in that the preliminary budget available in
the City Clerk's office for review by the public was incomplete. Mr. Miller presented a
copy of a survey which he conducted on Land, use and tax. He requested a copy of the
budget as submitted at this meeting, and a copy was delivered to him.
It was clarified by the City Council that the preliminary budget which was presented
to the City Council at the Regular Meeting of May 26th at which meeting the public hear-
ing on the budget was set for June 23rd was in a preliminary form and this was made a
matter of record at that meeting. The City Council directed the City Manager and the
City Clerk to provide Mr. Miller with copies of all information relative to the budget
that is available.
The City Manager commented briefly on the 1970-71 proposed budget which is equal to
or less than the 1969-70 'budget. He referred to the inflationary trends over the past
several years and reported that the City of Downey compared to other communities in this
area provides services which have been copied by other communities with fewer employees
per thousand population, fewer employees per square mile, and with less expenditure per
capita.
Chief of Police Ivan Robinson reported regarding conflict of dates on the dedication
of the Downev High School Baseball Diamond Lighting and the Retirement Dinner which has
been planned for Captain Roger Harmon who has been with the City of Downey for the past
thirteen years and in law enforcement for the past thirty-one years. Both events are
scheduled for Wednesday, July lst.
Mr. William Cole, General Manager of the Downey Chamber of Commerce, requested the
Mayor consider proclaiming July 20th as "Moon Landing Day," commemorating the moon land-
ing of the Apollo on July 20, 1969.
Mr. Kenneth Miller appeared again before the City Council and stated he would
prepare a report on the .inadequacies of the Downey City Library for presentation to the
Council.
There being no further business to come before the City Council, the meeting was
adjourned at 11:00 a.m, to 5:30 p.m. Tuesday, June 30, 1970, in the Council Chamber of
the Downey City Hall.
