JUNE 8, 1970
The City Council of the City of Downey held a regular meeting at 7:30 p.m., June 8,
1970, in the Council Chamber of the Downey City Hall, Mayor Ben 'D Corbin presiding.

Rabbi Martin B. Ryback, Temple Ner Tamid, delivered the invocation, followed by the
Flag Salute Led by Councilman Jennings,
Mr. William Stickel, City Maintenance employee, appeared before the City Council
and expressed appreciation to the City Council and City Manager for the 60-day leave of
absence, which was granted to him following a heart attack suffered by him in December
of 1969. The 60-day leave following his hospitalization, he stated, enabled him to
recover without the pressures of financial difficulties. Mr. Stickel returned to work
on May 18, 1970.
Dr. Ralph Christensen, spokesman for the Downey Shrine Club, appeared before the
City Council, He stated he had had the privilege of representing the City of Downey at
the Shrine Ceremonial in San Diego and also recently in Las Vegas. Dr. Christensen pre-
-- sented to the Mayor a neckerchief to which was attached an insignia bearing the official
seal of the City of Downey. He introduced the President of the Downey Shrine Club,
Noble Thomas Linden, and Noble John Pyle of the Club.
It was moved by Councilman Morton, seconded by Councilman Winton, and so ordered to
approve the Minutes of the City Council meeting of May 26, 1970.
Communication from County of Los Angeles Road Department regarding Aid to Cities
money for 1970-71. Ordered filed.
Communication from Chairman of Downey Christmas Parade Committee requesting
permission to appear before the City Council to explain request for additional funds for
this year's parade. Ordered filed.
Communication from. Martin I Jackson, attorney, regarding vehicles picked up at
12511 Birchdale and impounded. No action.
Communication from City of La Mirada enclosing Resolution regarding beautification
of railroad rights of way. It was moved by Councilman Morton, seconded by Councilman
Ferris, and so ordered to refer this letter to the City Beautification Committee.
It was moved by Councilman Winton, seconded by Councilman Ferris, and passed by the
- following vote that the Ordinance regarding speed limit, Gardendale Street and Foster
Road, Lakewood Boulevard to East City limit, which was introduced at the City Council
meeting of May 26, be taken under submission until the next City Council meeting.

RESOLUTION NO. 2396
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING THE DIRECTOR OF PUBLIC WORKS TO MAKE A REPORT
PURSUANT TO THE STREET LIGHTING ACT OF 1919 (ANNEXA-
TIONS 70/15 AND 70/23)

by Councilman Ferris, and so ordered to waive further reading.

The Director of Public Works reported that Annexation 70/15 will involve the
installation of 43 35,000 lumen mercury vapor lights at an estimated total installation
cost of $23,500.00, He reported that Annexation 70/23 will involve the installation of
15 lumen mercury vapor lights at an estimated total operation cost of $1,228.80.
Installation cost paid directly by owner per Lot Split No, 526 requirement.

following vote to accept the report of the Director of Public Works.

The City Manager presented Co -sponsored Agreements between the City and the Downey
Children's Theatre, Inc., the Downey Junior Athletic Association, and the Downey
Symphonic Society for the 1970-71 fiscal year, as approved by the Downey Parks and
Recreation Commission. It was moved by Councilman Winton, seconded by Councilman
Ferris, and passed by the following vote to take the matter of these Co -sponsored
Agreements under submission.

The City Manager presented memorandum from the Director of Parks and Recreation

Councilman Morton, prior to voting aye on the matter, referred to the Memorandum of
May 26, 1970 from the Director of Parks and Recreation regarding funding of properties
to be acquired for park purposes from the State.
On recommendation of the City Manager, it was moved by Councilman Ferris, seconded
by Councilman Winton, and passed by the following vote to authorize the Title Insurance
and Trust Company to issue a Clear Title Policy for acquisition of Rio Hondo Golf Course
property, in conformance with the customary Joint Powers financing policy.

In response to a question by the Director of Finance, and on the advice of the City
Attorney, the City Council directed that payment of $889.62 covering cost of items on
Change Order #64 be withheld pending analysis of all change orders to date on the Downey
Theatre Project,

Appeal, Zone Exception Case #922, Cecil W. Sutton, Jr., 10065 Newville Ave.
(Under submission)
Councilman Morton reported that his review of this case, and investigation by the
City Attorney relative to the business being conducted by the applicant under the classi-
fication of "Home Occupation" and the alterations made to the garage, have revealed that
there is evidence of a violation of the zone as well as evidence that modifications to
the garage have been made by the applicant since his purchase of the property. He stated
he had also received a report from the Traffic Engineer which indicates it would be
almost impossible to use the southern portion of the garage for the storage of an
automobile. He recommended the applicant be notified of the zone violation and that he
be given notice to restore the north side of the garage for automobile storage, as well
as to replace the garage door. In order to provide storage space for a second
automobile, Councilman Morton recommended that studies be made by the Planning Department
and advice given to the applicant on the construction of a carport which would be
attached to the main structure, but not to the existing rear structure, permitting an
encroachment into the side yard setback.

following vote to refer the matter of appeal of Zone Exception Case #922 back to the
Planning Commission for report and recommendations.

The Mayor declared a recess at 8:55 p.m. The Meeting resumed at 9:10 p.m. with all
Councilmen present,
There being no objections, the matter of Appeal, Zone Exception Case #931, Edward
DiLoreto, 8547 Imperial Highway, was continued under submission pending report from the
Planning Commission,
It was moved by Councilman Winton, seconded by Councilman Ferris, and passed by the
following vote to confirm the following appointments to the Rio Hondo Golf Course Joint
Powers Authority and to withhold appointment of District #1 member of the Authority
until following effective date of citizenship of Mr. Norman Horney:

The City Attorney advised that the person responsible for notifying the Joint
Powers Authority of the meeting which has been set for June 15 should so notify them of
the meeting, setting the time prior to the time set for the Adjourned City Council
Meeting of that date, to give them the opportunity to have an organizational meeting, to
approve the proposed Lease between the City and the Joint Powers Authority, and to
approve the Resolution relative to Bonds and Indenture, The lease can then be presented
to the City Council and if approved, the Ordinance may be introduced and have its first
reading, and the City Council may adopt the Resolution approving the Bond Indenture, At
the following meeting, June 23rd, the Ordinance approving the Lease may have its second
reading and be adopted; the effective date of the Ordinance will be 30 days thereafter.
There being no further business to come before the City Council, the Meeting was
adjourned at 9:20 p.m. to 5:30 p.m. Monday, June 15, 1970, in the Council Chamber of the
Downey City Hall,
