MAY 11, 1970
The City Council of the City of Downey held a regular meeting at 7:30 p.m., May
11, 1970, in the Council Chamber of the Downey City Hall, Mayor Ben 'D Corbin presiding.

Reverend Vernon Jacobs, Christ Lutheran Church, delivered the invocation, followed
by Flag Salute led by the Girl Scouts of America.
With the assistance of the Director of Public Works, Mayor Corbin presented to Mrs.
Zoe Carmical, the award for Public Works Employee of the Year. The Mayor and Mr. Spindel
congratulated Mrs. Carmical for her outstanding achievements and expressed appreciation
for the excellent work she has been doing in the Department of Public Works.
Mr. Cecil Ricks, Jr., Attorney for Gerald Stevens, former Downey Police Officer,
appeared before the City Council, requesting that the new City Manager, Charles W. Thomp-
son, review the case and the findings of the Personnel Advisory Board with reference to
the termination of Officer Stevens on September 17, 1969, and render a decision on the
matter prior to June 24, 1970, the date of Mr. Stevens' 35ae birthday. Following discuss-
ion on the matter, the City Manager stated he would review the case and meet with Mr.
Stevens' attorney within the next few days.
Mayor Corbin stated that this was the time and place for the public hearing on appeal
to Zone Exception Case No. 925, James Miller, 9460 True Avenue, Downey. He inquired of
the City Clerk if she had the necessary affidavits of publication, to which she responded
in the affirmative. He inquired of her if she had any correspondence on the matter and
she advised that she had a letter of protest from Mr. L. P. Leavitt, 9724 Blandwood St.,
Downey, copies of which were distributed to the members of the City Council. Ordered
received and filed.
The Director of Planning reported on the factual data of this case. He stated the
request was to establish, operate, and maintain a drilling site for exploratory drilling
for oil and gas and for production of such products if discovered in paying quantities, in
an R-1, 5000 residential zone. The Planning Commission, he stated, heard the case on d
March 18, 1970, and the request was denied.
Mr. William P. Wilson, Attorney, 10901 Paramount Boulevard, appeared before the
Council on behalf of the applicant, requesting that the City Council recommend approval
of the request of the applicant. He stated that the arguments in opposition were un-
founded and that the proposed use of this property would not be detrimental to the public
health, safety,comfoxt,,convenience & gee'neral we.lfare'of the -community. He stated that, in
fact, the use proposed by the applicant would be an improvement to the area. He added
that the conditions which would be imposed by the Planning Commission for such zone ex-
ception would eliminate any objectionable features.
Mr. E. L. Boyce, 1901 Avenue of the Stars, Los Angeles, responded to questions of
the Councilmen regarding the noise level of the proposed use. He stated that the noise
level would be no greater than the Freeway noise..which is presently existing in this area.
In response to questions of Councilman Morton, Mr. Wilson explained that the exploratory
phase of this project would involve possibly 12 people. On completion of that, if it
develops that it will be a long-range project, the operation would require only supervisory
personnel. In response to questions of Council, Mr. Wilson stated that the process of
moving the equipment and materials to the site would take from 3 to 4 weeks. The explora-
tory phase of this project would take approximately 6 months. The Director of Planning,
replying to questions of the City Council regarding requirements of the Fire Department
for permanent installation, stated that conditions would be imposed by the planning Com-
mission if an exception were approved for permanent installation.

Others speaking in favor of the zone exception were: Mr. Joseph A. Davis, 9556
Gallatin Road; Mr. Francis Hart,9643 Cedartree Road; Mr. Alex Theres, 10311 South Mattock
Avenue; Mr. Robert Johnson,7945 3rd Street.
Some arguments presented in favor of the zone exception were that it would improve
the esthetic values of the property; that the property as it exists is not satisfactory
for residential uses; that a successful operation would result in revenues to the City,
thus decreasing the residential property tax.
Mr. Ed Cole, 9458 Pico Vista presented a petition in opposition to the requested
zone exception, which, he stated, was signed by 119 persons in the surrounding area.
It was moved by Councilman Ferris, seconded by Councilman Winton, and so ordered to accept
the petition as a part of the record of this case.
- The following persons spoke in opposition to the zone exception: Mr. Ed Cole,
9458 Pico Vista; Mr. Stewart Maclean, 9808 Lesterford Avenue; Mr. Herbert Brown, 9325
Dalewood Avenue; Mr. Elwin Vincent, 9428 Pico Vista Road.
Some of the arguments presented in opposition were the noise factor; the necessity
for trucks to bring in materials and equipment on True Avenue, the only access road to the
property; the fire hazard of such a project; that the property could easily be developed
for R-1, 5000 residential use; the odors and pollution of the air; the unsightly tower
that would be visible to the neighborhood for the period of the exploratory phase.
Statements in rebuttal were made by Mr. Wilson. He stated that his presentation
had brought out information which should prove that there was no basis for the arguments
presented at this hearing.
Following discussion on the matter, it was moved by Councilman Morton, seconded by
Councilman Ferris, and passed by the following vote to deny the appeal and uphold the
decision of the Planning Commission on Zone Exception Case No. 925.

Mayor declared a recess at 9:20 p.m. The meeting resumed at 9:30 p.m., all members
of the Council being present.
Mayor Corbin announced that this is the time -and place for the hearing on Appeal
to the Decision of the Planning Commission in Zone Exception Case No. 922, Cecil W. Sutton,
Jr., 10065 Newville Avenue. The Planning Commission denied the request of the applicant
to establish and maintain a single carport attached to the main building with a side yard
setback of six inches from the northerly property line, and to connect said carport to the
former garage that has a three foot side yard setback.
The Mayor inquired of the City Clerk if she had the required affidavits of publica-
tion, to which she responded in the affirmative. He inquired if she had received any
correspondence on the matter and she replied that she had received a letter of protest
from Mrs. Henry R. Clark, 10038 South Newville Avaiue, copies of which were distributed
to the members of the City Council.
The Director of Planning, William Goggin, reported on the factual data in this
case. He stated that the original 2-car garage had been converted to a business office
which the Department,interprets to be a violation of the Zoning Ordinance in that when
it was converted there was no supplemental garage or car ports provided on the property.
The conversion of the garage, he stated, was accomplished without the benefit of a build-
ing permit and is, therefore, an illegal structure. He stated that the applicant contends
his business is a "home occupation" under the Zoning Ordinance, but after investigation,
it is the Department's opinion that it is a "full business" and does not come within the
category of "home occupation".
The Mayor inquired if there was anyone present who wished to speak in favor of the
case and Mr. Cecil Sutton, Jr., appearedbefore the Council. He presented a resume of
correspondence and events leading to the filing of the requested zone exception. Referr-
ing to the nature of his business, Mr. Sutton stated his Federal Income Tax forms will
substantitate that he had no employees; charges to the contrary were untrue. He present-
ed a petition which he stated indicated that 80% of the property owners within the 500 ft.
radius are in favor of the zone exception.
It was moved by Councilman Winton, seconded by Councilman Ferris and so ordered to
accept the petition as a part of the record of this case.
The Mayor inquired if there was anyone who wished to ,speak in opposition to this
case. Mrs. Nina Haskell, 10060 Newville Avenue, appeared before the Council. She stated
she was in opposition to the use of the property for business purposes, that it was detri-
mental to the surrounding area. Mrs. Haskell further stated that at the time Mr. Sutton
purchased the home the existing partitions were not a part of the structure. She present-
ed a petition signed by residents in the area opposing the zone exception. It was moved
by Councilman Winton, seconded by Councilman Ferris and so ordered to accept the petition

as part of the record in this case.
The Mayor inquired if there was anyone else present who wished to speak in opposition
to the case and there was no response.
Mr. Phillip Poppler, 223 Pacific Avenue, Long Beach, Attorney for the applicant,
spoke in rebuttal. He stated that the business of Mr. Sutton was a home occupation and
that it brought no traffic into the area. Referring to statements of the opposition re-
garding foot traffic, he stated Mr. Sutton was active in many youth organizations which
resulted in many visits from members of these groups. He further stated that Mr. Sutton's
business was computerized and all business is conducted by mail with the exception of
presentations to various youth organizations. He stated that at the Planning Commission
hearing, evidence was brought to light that this building was constructed prior to incor-
poration of the City and was built according to the requirements of the County Ordinance.
Mr. James R. Wells, 10238 Chaney Avenue, Downey, presented modified plans of the
proposed carport. He stated that it was his opinion that the 3 ft. setback is legal and
should not require a zone exception.
Mr. Michael Burke, 8514 Stewart d Gray Road,also spoke in rebuttal to statements
of opposition and stated he did not think it would bring any noticeable foot traffic to
the area.
Mr. Sutton stated that he had installed panelling in the garage without the issu-
ance of a building permit as he did not understand at the time that this was a requirement.
In reply to Mr. Morton's question as to whether there was a room in the garage at the time
he purchased the property, Mr. Sutton stated there was not. He stated there was a 2-car
garage door which he had removed.
Asked if he had employed help in the conduct of his business, Mr. Sutton stated
that he had at one time employed a person part-time but that he has employed no one since
1968.
Following further questions concerning improvements made after purchase of the
property, it was moved by Councilman Ferris, seconded by Councilman Morton and so ordered
to close the hearing on this case.
Councilman Morton asked why the Planning Department approved a home occupation
permit and later notified Mr. Sutton he was in violation of the home occupation section
of the Code, to which Mr. Goggin, Planning Director, replied that when an applicant files
for a home occupation business License, it is assumed that his statements are valid regard-
ing conformance to the Zoning Code, but after investigating Mr. Sutton's property, it was
determined that there was a violation. Mr. Coggin further stated that the Planning Depart-
ment did not challenge the veracity of his statement that the garage had been converted
prior to purchase and that it was not until well into the Planning Commission public hear-
ing that Mr. Sutton stated he had made the conversions after purchase. Following further
discussion on the matter, it was moved by Councilman Morton, seconded by Councilman Ferris
and passed by the following vote to take the matter under submission and request a written
opinion from the City Attorney, and in addition, that the matter be referred to the City
Traffic Engineer for a report regarding the turning radius, further that the previous
owner be contacted to determine the alterations made to the structure prior to sale of
the property to Mr. Sutton.

Mayor Corbin opened the public hearing on Appeal to the decision of the Planning
Commission on Zone Exception Case No. 931, request to establish, operate, and maintain
a two (2) story, 10,500 square foot general and professional office building twenty-seven
ft. (271) in height with off-street parking for twenty-two (22) automobiles, modification
of the front yard setback to five feet (51), trash storage in the front yard setback;
elimination of the required landscaping in the parking area and signs as permitted in the
C-H zone; property located in an R-1-5000 zone.
The Mayor inquired of the City Clerk if she had the required affidavits of publica-
tion, to which she responded in the affirmative. He inquired if she had received any
correspondence on the matter and she stated she had received a letter of protest from C.
Larry Hoag, who owns an apartment at 8547 Imperial Highway, approximately 100 feet from
the subject property.
The Director of Planning reported on the factual data in this case. He stated that
the property in question is presently zoned R-1-5000, but is proposed to be developed to
R-3 uses and the property to the east and west of the subject property is developed to R-3,
apartment house development.
The Mayor inquired if there was anyone present who wished to speak in favor of the
matter, and the following persons presented arguments in favor of the request: H. Lee
Trafford, Attorney, 11017 Paramount Boulevard; Mrs. Diane Boggs, 8629 Meadow Road;
Robert Garstang, 10436 Chaney Avenue; Mrs. Betty Kilpatrick, 8607 Meadow Road; Mr. Edward
DiLoreto, 10402 Rives Road, Downey.

Mr. Trafford presented a rendering of the proposed professional building. He present-
ed a map showing Imperial Highway on which he stated that 32,000 vehicles traverse daily.
He pointed to sites on Imperial Highway which have been developed to R-3 uses and those
developed to commercial uses. He stated that the development of this lot to R-3 uses would
have economic Limits, as it could be developed with an apartment of probably only 6 to 8
units. Such development he stated would be sub -standard compared to adjacent development
and would invite a low quality of tenants. He referred to the present parking problems on
Imperial Highway which he stated would be increased if more apartment buildings are estab-
lished in this area.
Mr. Trafford requested the City Council to consider a deviation from the develop-
ment of this area as proposed under the .Master Plan as further: development to R-3 uses
would result in over -saturation of apartment houses.
Others speaking in favor stated there was a need for additional professional ser-
vices in the area; they were in opposition to the establishment of more apartment houses
in the area, bringing in transient -type residents, and more parking problems, and it was
their opinion that the proposed development to a professional building as shown on the
rendering presented with architecture compatible with adjacent buildings would be an asset
to this area.
The Mayor inquired if there was anyone present who wished to speak in opposition to
the matter. There was no response.
It was moved by Councilman Winton, seconded by Councilman Ferris and so ordered to
close the hearing on the Appeal of Zone Exception Case No. 931.
Councilman Winton read a prepared statement regarding the development of District
No. 1, the southeast section of the City. He requested a mdratorium on the development
of District No. 1 until such time as the Master Plan is revised.
It was moved by Councilman Winton, and seconded by Councilman Corbin to take Zone
Exception Case No. 931 under submission until the Master Plan of Zoning is revised, and
that it be revised no later than December 14, 1970.

Councilman Morton stated he would abstain from voting on this matter as Mr. DiLoreto
was a contributor to his campaign for re-election to the City Council.
It was moved by Councilman Winton to deny the appeal on Zone Exception Case No. 931
and refer the matter to the Planning Commission.

It was moved by Councilman Ferris and seconded by Councilman Jennings to reverse
the decision of the Planning Commission and refer the matter of Zone Exception No.-931 to
the Planning Commission for report and recommendations.

The Mayor declared a recess at 12:05 a.m. The meeting was resumed at 12:15 a.m.
with a roll call vote, all members of the Council being present.
Mayor Corbin opened the public hearing on Downey City Lighting District Annexation
70/14 - Pomering Road. He inquired of the City Clerk if she had the necessary affidavits
of posting of notices, to which she responded in the affirmative. The Mayor inquired if
'she had received any letter of protest and she replied that she had not.
The Director of Public Works reported that this Lighting District Annexation will
involve the installation of 7,000 lumen mercury vapor luminaires. The percentage of
property owners signing the petition was 79%. The total cost of installation will be
$444.
It was moved by Councilman Winton, seconded by Councilman Ferris and so ordered to
accept the report of the Director of Public Works.
The Mayor inquired if there was anyone present who wished to speak in protest
to the matter. There was no response.

Letter from State Department of Public Works advising of apportionment of $82,925.
to the City of Downey as their share in allocation of Federal TOPICS Program for the
1970-71 fiscal year. Ordered received and filed.
At the request of theapplicant, it was moved by Councilman Winton, seconded by
Councilman Ferris and so ordered to withhold action onthe adoption of Ordinance regarding
Zone Change Case No. 117, Demos Shakarian, 10002-30 Imperial Highway, until the next
Council meeting.
RESOLUTION NO. 2390
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY FINDING AND
DETERMINING THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY REQUIRE THE

Councilman Winton reported regarding the untimely death of Mrs. Cora Rowe, his
appointee to the Library Advisory Board. He said that rarely does one have the oppor-
tunity to work with a person as willing to serve the City as Mrs. Rowe. He stated Mrs.
Rowe has served as Vice Chairman and Chairman of the Library Advisory Board since her
appointment on October 14, 1968, and that her pleasant personality and good advice will
be missed.

following vote that a room in the proposed addition to the Library be named in honor of
Mrs. Cora Rowe.

Mr. Wendell Wiser, 10921 Paramount Boulevard, appeared before the City Council. He
commented relative to the action taken by the City Council at the regular meeting held
April 281h regarding curtailing of funds to the Downey Museum of Art.
Mr. Wiser spoke regarding the County taking over three of the North American Rock-
well buildings and he stated he objected to removing this property from the tax rolls.
Mr. Wiser also commended Mr. William Goggin Planning Director, for his honest
and faithful service to the City in upholding the laws that the City Council has given
him.
There being no further business before the City Council, the meeting was adjourned
at 1:30 a.m.
