OF THE CITY OF DOWNEY
APRIL 13, 1970
The City Council of the City of Downey held a regular meeting at 7:30 p.m.,
April 13, 1970, in the Council Chamber of the Downey City Hall, Mayor Scott E. Temple
presiding.

Reverend Mark Gress, Downey United Methodi-t. Church, delivered the invocation,
followed by a flag presentation ceremony of the Camp_ Fir- Girls, Inc. who led the
Flag Salute, Mayor Temple commended this group and congratulations were extended for
their 60th Anniversary since the founding of the Camp Fire Girls organization,
Mayor Temple announced that this -meeting will be the Last evening meeting he
will preside over as well as the last meeting to be attended by City Manager Oren L. King,
who will be retiring April 30th,

584, 8348 Vista Del Rio Avenue (Vista Del Rio Frontage), He inquired of the City Clerk
if she had the necessary affidavits of posting, to which she responded in the affirmative,
He inquired if there were any written protes a on the matter, to which she replied she
had none, The Director of Public Works. reported on this project and stated a total of
cash assessment for this project, including interest, collection costs, to be collected
over a three year period, is $262,96, He recommended Council confirm the assessments,
The Mayor inquired if there faas anyone present who wished to protest the matter and there
was no response.

she had none, The Director of Public Works reported on this project and stated that
the total assessment, including interest and collection costs to be collected over a
ten year period, is $967.03. He recommended Council confirmthe assessments,

Mayor Temple opened the public hearing on Downey Improvement Project No, 597,
Sites 1 through 6 (S, S. Project No. 176). He inquired of the City Clerk if she had
the necessary affidavits of posting, to which she responded in the affirmative. He
inquired if there were any written protests on the matter, to which she replied she
had none, The Director of Public Works reported on the locations of the proposed im-
provements and reported that assessments of $150. to $600. will be made in three annual
installments; payments of assessments of $600 or more will be made in ten annual install-
ments, He recommended Council confirm the assessments. The Mayor inquired if there
was anyone present who wished to protest the matter and there was no response.

following vote to accept the report of the Director of Public Works.

none. The Director of Public Works reported on this project and stated the total assess-
ment, including interest for three years and collection costs, is $604.71, and recommended

10833 Paramount Boulevard, (S, S, Project No, 191), He inquired of the City Clerk if
she had the necessary affidavits of posting, to which she responded in the affirmative.
He inquired if there were any written protests on the matter, to which she replied in
the negative, The Director of Public Works reported on the location of the improvements
proposed under this project. He stated this work will be included in the Paramount Blvd,
improvement (Cash Contract #SS-191), and recommended that he be authorized to proceed
with the construction of the required improvements in the event the property owners do
not voluntarily contribute their share of the improvement costs, Mayor inquired if there
was anyone present who wished to protest the matter and there was no response.

Mayor Temple opened the public hearing on appeal to the decision of the Planning
Commission on Zone Exception Case #924, 7447 East Firestone Blvd „ denial of request to
establish, operate, and maintain a cocktail lounge within three hundred feet (3001) of a
residential zone, The Mayor inquired of the City Clerk if she had the required affidavits
of notice of hearing, to which she responded in the affirmative, Ordered received and
filed, The Mayor inquired if the City Clerk had received any correspondence regarding
the appeal, and she replied she had not.
Director of Planning William Coggin reported on the factual data in this case as consider-
ed by the Planning Commission at its hearing held March 4, 1970,
The appellant, Mr, George Smyrniotis, 7447 E. Firestone Blvd,, Downey, appeared before
the City Council and stated that he had been in. the restaurant business for the last
twenty (20)years, operating in Long Beach, Seal Beach, and the Bay Area, He stated
the sale of liquor in his restaurant in Downey which he acquired in December, 1969,
would be an asset as a secondary item in the operation of his restaurant as is the case
in other restaurants in Downey which serve better food and cater to banquets,
Mr. Smyrniotis stated that the previous owner reported he had applied for and received
in 1966 permission to sell Liquor at this location and a request for an extension of one
year was also granted. He stated he was not aware of the Ordinance which does not permit
the sale of liquor within 300 ft, of a residential ;_one until after he had acquired the
restaurant, He said the actual physical entrance to this restaurant is more than 300 ft,
from the residential property and is separated with a concrete wall 5161, in height, Mr,

Smyrniotis, referring to problems encountered during the operation of a restaurant
at this location under a previous owner, stated he belived the denial of his request was
based in part on Ctha't;. 'an3 he took exception to the opinion that these problems
would continue under his ownership. He further commented that more than fifteen similar
requests were granted since 1965 in the City of Downey.
Mr. Smyrniotis answered questions directed to him by the City Council relative to
the request.
The Mayor inquired if there was anyone present who wished to speak in favor of
the matter. No response. He inquired if there was anyone who wished to speak in oppo-
sition. No response.
It was moved by Councilman Winton, seconded by Councilman Ferris and so ordered to
close the hearing on appeal of Zone Exception Case #924.
The City Attorney advised that the question before the Council and the one to
which it should address its attention is whether sufficient evidence was presented to the
Planning Commission and the City Council to justify an exception to the Zoning Ordinance,
and the real issue is whether the City Council should deviate from the terms of the Ordin-
ance and permit the establishment of the subject use closer than 300 ft. from residential
property.
Following discussion by the City Council, it was moved by Councilman Ferris,
seconded by Councilman Corbin.and passed by the following vote that the appeal to Zone
Exception Caste #924 be denied and that the action of the PLanding Commission be upheld.

It was moved by Councilman Corbin, seconded by Councilman Winton and so ordered
to approve Minutes of the Council meeting of March 24, 1970, as corrected.
There being no objection, the matter of the Pomering Tract Water Association was
considerndby the City Council at this time. The Director of Public Works recommended the
approval of the Agreement with the Pomering Tract Water Association and authorization for
the Mayor to sign the Agreement. He reported that signed letters of consent had been
received from all property owners in this tract approving the proposal set forth in a
letter from the City Water Department dated November 10, 1969. He stated this was also
approved by the Water Board at its meeting on April 6, 1970. Mr. Spindel further reported
that this action will greatly alleviate an area of extreme low water pressure.
Mr. Thomas Bataglia, Secretary of the Board of Directors of the Pomering Tract
Water Association appeared before the City Council and recommended their approval of
this action.

following vote to authorize the Mayor to sign the Agreement with the Pomering Tract Water
Association and to authorize the following transfer of funds:

Letter from Cecil W. Sutton, Jr., dated April 1, 1970, concerning Zone Exception
Case No(a 922. It was moved by Councilman Morton, seconded by Councilman Ferris and so
ordered to set the hearing on the appeal of Zone Exception Case No. 922 for the regular
meeting of the City Council at 7:30 p.m., May 11, 1970.
It was moved by Councilman Corbin, seconded by Councilman Winton and passed by
the following vote to approve final payment to the Architect, A. C. Martin S Associates,
in the amount of $12,622.53 for services rendered on the Downey Community Hospital Con-
struction project.

authorize the Director of Public Works to make the presentation for the City of Downey
at the Design Hearing on Route #105 Freeway,
Communication from Byron T. White, Chairman of the Parking Place Commission, re-
signing ffom this position. It was moved by Mayor Temple, seconded by Councilman Winton
and so ordered to accept Mr. White's resignation from the Parking Place Commission with
regrets and prepare a proper plaque in recognition of his services to the City of Downey.
Recommendation of the Acting Director of the Water Department, Ervin Spindel, for
approval of retention of the firm of Lampman & Associates for a reservoir study, at a
cost not to exceed $6,000.

TO A RECREATION FACILITY

4. Confirm appointment of members of the Joint Powers Authority.
5. Acquisition of property.
6. Lease between the Joint Powers Authority and the City to be authorized by an
Ordinance adopted by the City Council.
In response to a question by Councilman Morton., the City Attorney stated that the
term "Authority" is synonymous with the term "Commission" as set forth on Page 3 of the
Joint Powers Agreement.

of March 24, 1970, for additional information regarding assessment of liquidated damages,

before the City Council and reported regarding the problems which delayed the completion
of this project and presented a letter from Cutler -Hammer of Los Angeles, substantiating

City Manager Oren King reported on request from Downey Businessmen's Association
for permission to conduct a Sidewalk Sale in the near future on Downey Avenue and on
Firestone Boulevard. The matter was referred to the City Manager for study and report
inasmuch as Firestone Blvd. is a State highway,
City Manager reported regarding the Bank of America annex building which has been
vacated. He reported that Downey has received permission to use this building for stor-
age purposes of Downey Theatre equipment,
ORAL COMMUNICATIONS
Mayor Temple read a communication from Eugene R. Erickson, Administrator of Rancho
Los Amigos Hospital, commending the City Manager, Oren Kites for the cooperation received
from all City Departments under his direction and expressing his best wishes for a
successful retirement.
On the recommendation of Councilman Winton., the matter of Hospital Authority
member, Mr. Demos Shakarian, was referred to Mayor Temple for investigation.
Councilman Winton reported on expenses in connection with mailouts and survey
regarding the ik105 Freeway. He presented to the City Council his report on meeting with
the State Division of Highways Engineers in Sacramento, on April 7, 1970, regarding the
Freeway Agreement; copies of his report were distributed to the City Council,
