OF THE CITY OF DOWNEY
MARCH 24, 1970
The City Council of the City of Downey held a regular meeting at 8:00 a.m.,
March 24, 1970, in the Council Chamber of the Downey City Hall, Mayor Scott E. Temple
presiding.

Reverend John B. Toay, First Presbyterian Church of Downey, delivered the -invo-
cation, followed by the Flag Salute led by Councilman Joseph Ferris.
Mayor Scott E. Temple announced that the City Council has set aside this day to
honor Mr. Caesar Mattei, a resident of Downey for thirty years, whose varied community
services have made Downey a better place to live. He expressed the appreciation of the
City Council for a job well done.
Councilman Morton and Ferris and Mayor Pro-tem Ben 'D Corbin also praised Mr.
Mattei for his contributions to the City of Downey as well as the youth of the City,
which included among many other community efforts his service as Director of the Downey
Youth Band, Member of the Board of Directors of the Downey Symphonic Society and
Member of the Library Advisory Board.
City Manager Oren King, Chief of Police Ivan Robinson and Mr. Jim Ruth, Director
of Parks & Recreation Department added their praises to Mr. Mattei and expressed their
sincere appreciation to him and Mrs. Mattei for their long years of community service.
Mayor Scott E. Temple presented a Commendation to Mr. Caesar Mattei signed by
all members of the Downey City Council.
Mrs. Jordan Phillips, Downey Symphonic Society, read a Resolution of the Assembly
Rules Committee of the California Legislature which was signed by Speaker of the Assembly,
Bob Monagan, and transmitted by Assemblyman Carley Porter, honoring Mr. Caesar Mattei.
Mr. Mattei accepted the awards of the City Council and the Assembly Rules Committee
and expressed his appreciation to the Mayor, City Council, City Manager and Staff as well
as to the many persons who were in attendance at this meeting to honor him.
The Mayor opened public hearing on Downey City Lighting District Annexations 70/3
through 70/11. He inquired of the City Clerk'if she had the required Affidavits of Pub-
lication, to which she responded in theaffirmative. He inquired if she had received any
written protests and she replied she had none.
The Director of Public Works reported on the locations to be included in these
annexations. He reported the annual operation cost will be $2,062; 1969-70 tax rates for
Zone 1, $0.20 per $100. assessed valuation; Zone 3, $0.10 per $100. assessed valuation.
Mayor Temple inquired if there was anyone present who wished to protest the matter.
No response. He inquired if there was anyone present who wished to speak fbr the matter.

It was moved by Councilman Corbin, seconded by Councilman Winton, and so ordered
to close the hearing on Downey City Lighting District Annexations 70/3 through 70/11.
RESOLUTION NO. 2362
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING
ANNEXATION ON CERTAIN AREAS TO THE DOWNEY CITY LIGHTING DISTRICT
AND TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO THOSE STREET
FIXTURES LOCATED ON STREETS AND PUBLIC PLACES WITHIN THOSE AREAS
UNTIL JANUARY 31, 1983 (ANNEXATIQNS 70/3 THROUGH 70/11).

Communication from the Division of Highways advising of Design Public Hearing on
0105 Freeway to be held on April 22, 1970, in the Downey Sr. High School Gymnasium.
On the recommendation of Councilman Winton, it was so ordered that the City Manager direct
a letter to Mr. T. R. Lammers, Deputy District Engineer, Division of Highways, requesting
that if attendance at the April 22nd meeting is too large for everyone to be heard, or
accommodated, a second hearing be scheduled.
Communication from Diehl, Evans and Company, Certified Public Accountants, relative
to request of City Manager Oren King for audit as of April 30, 1970, the date of his re-
tirement. Following discussion by City Council regarding the scheduled audit for June
30, 1970, which is only 60 days following the date of Mr. King's retirement, it was agreed
that this would suffice and no action was taken.
Communication from U. S. Department of Justice, Assistant Attorney General, acknow-
ledging receipt of Resolution No. 2343 adopted by the City Council of Downey, authoriz-
ing the Attorney General to represent Downey in an action against certain automobile
manufacturers. Ordered filed.
Report by City Manager Pro-tem Don Robison on the Legislative Tax Conference,
sponsored by the California State Chamber of Commerce, March 10, 1970, in Sacramento.

Notice from Pacific Telephone d Telegraph Company regarding application filed with
the Public Utilities Commission for authority to change rates. Ordered filed.
Request from Patrick D. McCallum, 1970 Christmas Parade Chairman, requesting

Communication from Purchasing Agent concerning Purchase Contract No. 169, Drapes
for Downey Theatre. Following summation of bids, it was moved by Councilman Ferris,
seconded by Councilman Corbin, and passed by the following vote to authorize expenditure
of funds for purchase of drapes for Downey Theatre, and award contract for same to FABCO
of Los Angeles, the lowest and best bidder, in the amount of the bid submitted and reject
all other bids.

Councilman Winton recommended that the City Manager see that a night watchman is
employed by the contractor on the Theatre until completion date. So ordered.
Resolution of the City Council of the City of E1 Segundo regarding beautification
of railroad rights of way in urban areas. Referred to City Beautification Committee.
Resolution No. 2785 of the City Council of the City of Covina urging reconsideration
of the Board of Supervisors regarding mid —year salary adjustments for Personnel of the
Sheriff's Department and County Fire Department. Ordered received and filed.
Communication from Board of Supervisors relative to their action taken to oppose
Senate Bill 38 regarding allocation of gasoline tax money.

Communication from Rancho Los Amigos Hospital commending the Fire Chief and the
City Fire Department for their excellent response in a recent emergency and expressing
their sincere appreciation. Ordered filed.
Communication from Mayor of the City of Covina relative to the recent hearing
on law enforcement contract rates and the meeting to be held on April 7, 1970. Following
report by Mayor Pro-tem Corbin regarding the recent hearing held on March 17, 1970, the
Mayor requested that members of the Council who could attend, to be at the Hall of
Administration in Los Angeles at 9:30 a.m, on April 7th.
Communication from El Segundo Woman's Club regarding their resolution urging award-
ing of the B-1 Strategic Aircraft Contract to the best qualified Southern California
company. Mr. Virgil Thompson, Aircraft Engineer of North American Rockwell, Downey,
speaking on this matter stated that anything the City Council could to encourage grant-
ing of this contract to a Southern California company would be appreciated as it would
help to stabilize employment in the aircraft and space industries in this area. Follow-
ing discussion on the matter, the Mayor stated he would direct a communication to the
proper agencies in Washington, D. C., urging that the contract for the B-1 Strategic
Aircraft be awarded to a Southern California company and referring to the provisions
for giving consideration to areas in which there is an approaching economic crisis as a
result of a labor surplus.
City Manager Oren L. King referred to a communication from the League of California
Cities regarding membership in the Town Affiliation Association, annual dues $200. The
matter was held to be referred to budget study sessions.
City Manager Oren L. King reported on the communication from Frank J. Beckner
relative to the purchase offer of Mr. Evert Cummings for three lots on LaVilla Street,
a part of the old Hospital site, and requesting the return of deposit check in the
amount of $3,077.50.
It was moved by Councilman Corbin, seconded by Councilman Ferris and passed by
the following vote to return to Mr. Beckner the deposit being held by the City, with a
letter thanking them for their purchase offer.

authorize the Director of Finance to issue warrants in the amount of $28,000.to Z. C.
Vedsted; $41,650. to A. C. Jacobson $ H. L. Jacobson; and $99,000. to Grace Bertrand,
for property at 9530-36 Firestone Boulevard, 9538 Firestone Boulevard, and 9560 Firestone
Boulevard, respectively, and authorize the following transfer of funds:

Councilman Morton stated that Council should continue to press for an overpass at
the western end of Stewart S Gray Road over to South Gate.
Mayor declared a recess at 9:35 a.m. The meeting was called to order at 9:50 a.m.,
all members of the City Council being present.

Councilman Corbin and passed by the following vote to change Paragraph 4 of the Offer
and Agreement to Convey Land for Road Purposes, property at 9560 Firestone Boulevard,

Sidewalk Matching Fund Project No. 316, Southwest corner of Old River School Rd.
and Firestone Blvd. Communication from Charles F. Pendleton, Attorney, requesting this
matter be set for a later date.
It was moved by Councilman Corbin, seconded by Councilman Ferris and so ordered
to schedule the matter of Sidewalk Matching Fund Project No. 316 (Wilbur Logan) for the
Council meeting of April 13, 1970.
It was moved by Councilman Ferris, Seconded by Councilman Corbin and passed by the
following vote to authorize the use of vacated access rights in Tract No. 27904 (Peacock
property, Paramount Boulevard) subject to applicant obtaining a zone exception approval
for the proposed development or the issuance of building permits in conformance with
the Downey Municipal Code.
On the recommendation of the Planning Commission it was moved by Councilman Winton,
seconded by Councilman Corbin and passed by the following vote to approve access rights
for driveway purposes for property located at 8431 Puritan Street, with the following
conditions:
1. That a public street agreement shall be signed by the property owner for the
future installation of street lights.
2. The applicant shall assume full costs of reconstructing the existing re-
taining wall and driveway apron.
3. That a paved driveway and parking apron shall be. constructed for parking
accessory vehicles prior to using the approved driveway.
4. If the new parking area is to be used in lieu of the existing required garage,
there shallbe constructed a two -car garage to the standards of the Department
of Building and Safety and the curb depression on Puritan shall be replaced
with curbs and gutters and the front 20 feet of the existing driveway shall
be removed and landscaped.
Further, the City Council agrees that applicant must pay his proportionate
share of the cost in constructing curbs, gutters, and sidewalks in comparison to the
costs required of other property owners requesting similar access rights on
property adjacent to Brookshire Avenue in the immediate area.

Referring to the immediate preceding action, Councilman Morton stated 'if- a saferty
light is 'iristalled that it should be done in accordance with previous policy or at the
expense of the City.
On the recommendation of City Attorney Sorensen, it was moved by Councilman Ferris,
seconded by Councilman Morton and passed by the following vote to retain the services of
Mr. Kenton Krogstad, Attorney, a resident of Downey, as a Special Counsel representing the
Chief of Police in the presentation of a case to the Personnel Board at a fee of $250.
per diem, which will include the necessary preparation and investigation work.

Mayor Temple reported on a memorandum from Dr. Arnold Finch, Downey Unified School
District, relative to the proposed route of the #105 Freeway and read a communication from
Mr. John Legarra, State Highway Engineer, acknowledging a letter from Mayor Temple trans-
mitting a copy of Resolution 196970-13 of the Downey Board of Education urging considera-
tion of re-routing of the freeway along the southern boundaries of the City and a depressed
freeway plan.
It was moved by Councilman Ferris and seconded by Councilman Corbin to adopt the
southern route as an alternate plan of the #105 Freeway, based on certain concessions such
as a depressed freeway, a differential rate and such other items to be negotiated with
the assistance of our State Legislators prior to the signing of the final street closing
agreement, and that the Director of Public Works be directed to prepare an overlay on the
present drawing of this route to modify it at its easterly end to parallel Foster Road
rather than veer north at Woodruff which would create a major pocket of homes, a police
and fire hazard and a potential blight area.
Councilman Morton commented that the southerly route was considered by the City
Council in the early days of the development of the freeway route; however, inasmuch as
the Downey Unified School District has now agreed that this southerly route would be more
adaptable to their purposes and has reaffirmed this position at their most recent meeting,
he would recommend that the City Council move on this motion to adopt and to support the
southern route of the #105 Freeway through the City of Downey.

City Manager Oren L. King reported reported on the proposed use of the Trenery
Building (hospital site). It was moved by Councilman Morton, seconded by Councilman Ferris
and so ordered to authorize the City Manager to meet with Mr. Glenn Jones, Administrator
of the Downey Community Hospital, relative to proposed uses of the Trenery Building which
will include parks and recreational purposes, civil defense emergency hospital, and
office uses.
Mrs. Frances Robbins, Manager of a children's nursery at 8103 E. 3rd Street,
appeared before the City Council and requested relief from the requirement for three
additional parking spaces required under the present Zoning Ordinance, and permission
to use parking available in an adjacent Parking District to comply with this requirement.
It was moved by Councilman Morton, seconded by Councilman Corbin and passed by the
following vote to refer the matter of required parking spaces at 8103 E. 3rd Street, to
the Parking Place Commission for report back to the Council.
Mr. Wendell Wiser, 10921 Paramount Boulevard, appeared before the Council and in-
troduced Mr. Paul J. Riccoban. Candidate for the office of member of the City Council,
District #4.
Mr. Perry Klinefelter, 9422 Parrot Avenue, appeared before the City Council and
- urged that the City Council take any action possible to encourage the awarding of con-
tract for the B-1 Strategic Aircraft to avoid the possibility of an unemployment situation
and the loss to the community of trained personnel.
At the request of the City Manager, Mayor Pro-tem Don Robison, Mayor Temple stated
he would direct a letter to Mrs. James Ellsworth, volunteer worker for Youth Employment
Service, who has beenramed Citizen of the Year by the Downey Jr. Women's Club.
Chief of Police Ivan Robinson, reported on the recent graduation of recruits and
advised that Bruce Robert. McConnell had been awarded by Sheriff Peter Pitchess and the
Board of Supervisors, a special certificate as the oustanding candidate in his class, and
a 2 inch Cobra revolver was presented to him. He reported also that Ronald Dean was

a close runnerup for this honor.
Councilman Corbin introduced Mr. Virgil Thompson, candidate for the office of
member of the City Council, District #2, and Mr. Bob Corwin, Candidate for the office
of member of the Assembly, 38th Assembly District.
Mayor Temple stated that for the past 13 years the City Council of the City of
Downey has worked without salary. He requested the City Manager to investigate the
feasibility of some type of a token retirment annuity, or pension plan, that could be
made available to the members of the City Council as is the practice in private industry.
There being no further business to come before the City Council, the meeting was
adjourned at 10:30 a.m.
