OF THE CITY OF DOWNEY
FEBRUARY 24, 1970
The City Council of the City of Downey held a regular meeting at 8:00 a.m.,
February 24, 1970, in the Council Chamber of the Downey City Hall, Mayor Scott E. Temple
presiding.

Director of Building & Safety, Ray Lake, delivered the invocationfollowed by the
Flag Salute led by Councilman Ben Corbin.
Mayor Scott Temple introduced Mr. Mark Allen, Acting City Attorney.
Mr. Bill Burkle and Mr. Frank. Bratun of the Downey $ertoma Club presented bronze'
plaques of the Declaration of Independence and the Bill of Rig is to t e City Council.
Mayor Temple read a communication from Mr. Don Souza, Honorary Member of the Downey Sertoma
Club, advising that the plaques were two of a set of seven to be presented to the City
Council.
Mayor Temple opened the public 'hearing on Lot Cleaning Program, 1970 season, to
hear protests. He inquired of the City Clerk if she had the required Affidavit of
Mailing of Notices, to which she responded in the affirmative. He inquired if the City
Clerk had received any written protests and she replied she had not. The Director of
Public Works reported that this program will involve approximately 400 lots. He recom-
mended that the City Council order the work to be performed in accordance with City
ordinance and State law and authorize engaging a Local contractor to perform the work.
Further, that $15,000 be appropriated from Unappropriated Reserves to Account No.
09990--10103. The Mayor inquired if there was anyone present who wished to speak in
opposition to this Lot Cleaning Program, and there was no response.
It was moved by Councilman Winton, seconded by Councilman Corbin and soordered
to close the hearing.
It was moved by Councilman Winton, seconded by Councilman Corbin and passed by
the following vote to order the work under Lot Cleaning Program, 1970 Season, as recom-
mended by the Director of Public Works, to authorize engaging a local contractor to per-
form the work, and to appropriate $15,000, from Unappropriated Reserves to Account No.
09990--10103.

It was moved by Councilman Corbin, seconded by Councilman Winton and so ordered
to approve the Minutes of the City Council meeting of February 9, 1970.
Mayor Temple reported on the appointment of Mr. Charles Thompson, of Wymoning,
Michigan, as the new City Manager.
Communication from the Downey Symphonic Society, Inc., requesting $1,000.
additional operating funds for the fiscal year . Director of Parks & Recreation,
Jim Ruth, reported on the progress made by this organization since budget time, as well
as increased cost for this program due mainly to the increase in wages for musicians.
Following discussion by the Council, it was moved by Councilman Morton, seconded by
Councilman Winton, and passed by the following vote to approve appropriation in the
amount of $1,000. additional operating funds for the fiscal year 1969-70.

Councilman Winton requested that more personal contacts be made with the young
people in the high school bands in the City in an effort to include more of Downey's
youth in this program.
Report from Russell Reynolds, Purchasing Agent, on the cost reduction of Xerox
Copiers and the signing of a contract which eliminates the Xerox Company basic monthly
machine use charge which will result in a savings of approximately $1,070. annually.
Report from Director of Public Works on Three -Year Capital Improvement Projects,
General Fund. Referred to Budget Study Committee,

Mayor Temple presented to Jo Jo Starbuck, Kenneth Shelley, and Larry Dusich,
of Downey, plaques honoring them for the awards takenin the U. S. National Figure Ice
Skating_ Championship Contest in Tulsa, Oklahoma. Larry Dusich accepted plaque on behalf
of his partner and expressed his appreciation to the City Council for their recognition.
He also stated it is his plan to continue with skating and to enter the Kennedy Memor-
ial Championships in Lake Placid, New York,
Communication from Downey Traffic Committee on their findings regarding the
installation of traffic signals at Lakewood Blvd and Stonewood Place, which indicated
it would not be advisable to install signals at this time. The Director of Public
Works reported that the Traffic Committee will continue to study this intersection to
see if the traffic builds up sufficiently to warrant the signals. Communication ordered
received and filed,
Legislative Bullets, dated February 13, 1970, from the League of California Cities
concerning A. B. #4:30, Disclosure of Assets. It was moved by Council Ferris, seconded
by Councilman Corbin and so ordered that the City Council lend its support to this
legislation.. A hearing on. this will be held on. February 26 by the Assembly Committee
on Governmental Organization.. The. Mayor stated that a telegram in support of A. B.
#430 will be sent today, Councilman Ferris recommended the staff bring back a report
to Council on S. B. #54, Rock Festivals, Attorney Allen explained A.B. #242, Municipal
Liability, advising that this legislation would make public entities liable for in-
juries, caused by a dangerous condition of property, arising subsequent to construction
or improvem.en't thereof.
Communication from Councilman .Joe Ferris to Mr. William Troy, accepting his resig-
nation from the Health d Sanitation. Committee and recommended that a commendation be
prepared to be presen.ted to Mr. Troy at the next evening Council meeting. Council
accepted Mr. Troy°s resignation with regrets,
City Manager Oren King cosenented concerning calls he had received from various
members of Boards and Committees objecting to the requirement to file Statement of
Financial. Disclosure.
Communication from Downey Firemen's Association expressing appreciation to the
City Manager for his efforts in the adoption of the Widows and Orphans amendment to the
Retirement Contract, Ordered received and filed.
Communication from. Marvin Elliot, 574 Hillgreen Drive, Beverly Hills, President,
Advance House Sales, Inc., objecting to the requirement that he remove the fence on
Planett Avenue (Tract #2723 - Lot 23), constructed inthe public right-of-way. Mr.
Elliot appeared before the Council objecting to this requirement.. The Director of Pub-
lic Works and the City Engineer reported on this matter and recommended denial of Mr.
Elliot"s request. In response to questions of the Council, the Director of Public Works
reported that the fence was constructed without a permit, that it is a hazard, and
since it is Located in. the public right-of-way the City would be liable for any
damages.
It was moved by Councilman Corbin, seconded by Councilman Winton and passed by
the following vote to order the removal of the fence on Planett Avenue (Tract #2723 -
Lot 23).

Communication from Downey Chamber of Commerce enclosing their resolution suggest-'
ing the City Council delay appointment of City Manager until following the election on
April 14, 1970, Councilman. Corbin recommended that the Council take no action on this
communication, He stated that as elected representatives, it is the responsibility of
the City Council to conduct the business of the City, Councilman Ferris and Councilman
Winton both tormented concerning the efforts of the City Council in cooperation with
the Personnel Advisory Board and the City Manager Pro-tem. in the selection of the City
Manager,
Petition. dated February 10, 1970, submitted by Mrs, S, W. Peppmuller of 9118
Ratliffe Street, Downey, regarding the #L05 Freeway, Mrs, Peppmuller appeared before
the Council and requested that the petition be made a matter of record and that the
majority of signatures obtained on the petition are those of property owners on the
Route #105 Freeway. Councilman Winton stated his willingness to meet with the property
owners in District #1 concerning the 010.5 Freeway, On the recommendation of Councilman
Ferris, the Mayor directed that the subject petition be received and made a part of the
Century Freeway file.
City Manager Oren. King reported on the recommendation of the Parking Place Com-
mission to negotiate with the owner of ob e property at 8338 2:nd Street (south side of
Second Street between. Downey and Dolan Avena_e6) 3:nder the Ci,ty's appraisal, for acquisi
tion of this property-, for parking spaces. Following discussion by the Council, it was
moved by Councilman Winton that the matter be taken under submission for a report from
the Parking Place Commission, Sob -Committee on. Elevation d Double Deck. Parking, No
second,

to authorize the City Manager to proceed with the investigation and bring back to the
City Council the recommendation of the Seb-Committee of the Parking Place Commission,
Councilman Winton requested that the Secretary for the Parking Place Commission be in-
structed to record the votes as taken,

Communication of February 20, 1970, from Sack E. Robinson, Developer, commending
the Downey Fire Department for actions taken in the fire which occurred at the apart-
ments under construction on Downey Avenue, between 5th & 6th Streets, on February 14°n.
Councilman Morton commended the Fire Department for its outstanding efforts which re-
sulted in suppressing this fire before extensive damage was done. He also commended the
Police Department for its fine response in setting up command posts and blocking the
area to permit the Fire Department to extinguish this fire in a minimum time.
Mayor Temple reported on a communication received from Miss Barbara A. Kovacs
whose attendance as the 23rd Congressional District's Representative to attend "A`,
Presidential Classroom for Young Americans" under the sponsorship of the City of -Downey
was approved by the City Council on 11 25 69. Miss Kovacs reported she had been success-
ful in obtaining donations from several organizations amounting to $140. 'toward trans-
portation costs for her attendance at this session, which will be $226. She requested
an additional $86. still needed for transportation.

Mayor Temple reported on an unsigned letter regarding toll charge required for
telephone calls made to Long Beach, Referred to City Manager to contact the Telephone

Mayor Temple reported on letter of February 3, 1970, from Robert B. Carleson,
Chief Deputy Director of State Department of Public Works, conveying the appreciation
of Governor Reagan for being apprised of City of Downey Resolution No. 2341 regarding
the #105 Freeway.
Mayor Temple reported on communication from David Pierson, President of the
League of California Cities regarding the appointment of a "Quiet City" Committee and
questionnaire to be completed. Referred to City Manager,

this matter, the City Council authorize employment of the Manager of Green Rivers Country
Club as Consultant.

Robinson for additional. personnel necessary to keep the Department up to full staff
during the process of training new officers.

the Annual Report, He commended the City Manager Pro-tem, Don Robison; Purchasing Agent,

Mrs, P. Schreyer, 792.0 Leeds Street, Downey, appeared before the City Council and
protested adoption of City of Downey Ordinance No, 373, specifically with reference to the
amendment of Section. 1.011.0 relating to prohibiting animals in. the parks un.less pursuant
to lawful. permit issued by the Director, Following her presentation, and a report by the
Director of Parks & Recreation, the matter was referred to the Parks & Recreation
Commission for study,
Mayor Temple acknowledged the presence of Mr, .James Stamps, Mr. Maurice McAlister
and Mr, Harold Sm.i.th, and expressed the appreciation of the City Council for working
with the City in the acgais:i.tion of the Rio Hondo Golf Course,
Mr, Stanley Fisher, 8331 Luxor Street, appeared before the City Council and pro-
posed that the City Council be placed on a four -meeting per month basis at $300. per
month,
Mr, Wendell Wiser, 10921 Paramount Blvd, appeared before the City Council and
expressed his disappointment that the new City Manager was not selected from the Staff
of City Hall, He stated he is in agreement with the City Council that Downey has the
finest Fire Department. in the United States,
Mayor Temple requested that the meeting be adjourned in memory of Mr. Walter
Wanke, Director of the Water Department, who passed away suddenly a few days ago,
Councilman Morton. and City Manager Oren. King spoke in praise of Mr. Wanke in his man-
agement of the Water Department, Mr. King stated that Mr. Wanke took over a difficult
assignment when he was appointed the Director of the Water Department in 1964 and
proved to be the most objective administrator he has worked with. He said it will be
very difficult to replace him,
Director of Planing Department, Bill Coggin, reported that the Marketing Div.
of the Edison. Company is selling telephone poles and placing them on parking lots.
He said this raises a question of aesthetics and inteference of residential properties

He said he had contacted the representatives and they said if the City objected to
this practice, that they should be notified.

to notify the Marketing Division of Edison Company to cease and desist the practice
of selling telephone poles for installation on parking lots and locations which create
a problem of aesthetics and intefere with residential properties.
