HomeMy WebLinkAboutTract Map 64754 Stewart Gray DATE: March 13, 2007 TO: Mayor and Members of the City Council FROM: Office of the City Manager By: Desi Alvarez, Director of Public Works SUBJECT: TRACT MAP NO. 64754 (7714, 7722 AND 7724 STEWART & GRAY ROAD) RECOMMENDATION: That the City Council adopt: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE FINAL SUBDIVISION MAP OF TRACT MAP NO. 64754 (7714, 7722 AND 7724 STEWART & GRAY ROAD) BY APPROVING AN AGREEMENT WITH THE SUBDIVIDER AND ACCEPTING A SUBDIVISION IMPROVEMENT PERFORMANCE BOND AS SURETY. DISCUSSION: The California Subdivision Map Act requires that a tentative and final Map be prepared for any subdivision creating five or more residential lots (e.g. condominiums). Tract Map No. 64754 combines two lots into a 32,346 square-foot (sf) lot for the purpose of constructing a 12-unit condominium complex (Formerly three single family residences). The subject property is located at 7714, 7722 and 7724 Stewart & Gray Road, west of Rives Avenue (See Exhibit “A”). The property is presently zoned R-3-O (Medium Density Multiple-Family Residential Ownership). In its immediate vicinity, there presently exist single family residences. Section 9114.02 of the Downey Municipal Code (DMC) states “The R-3 Zone is intended to provide for the development of medium density multiple-family residential living areas compatible with the neighborhood environment and outdoor recreation potential of the community. Such areas are envisioned as being so located and designed to be complementary to adjacent activities at the same time provide suitable space for those who prefer and/or need multiple-family living quarters.” The City has reviewed the project application and made the necessary recommendations for consideration by the Planning Commission. On July 19, 2006, the Planning Commission adopted Resolution No. 2449 and approved Tentative Tract Map No. 64754 to combine two lots into one lot for the purpose of developing a 12-unit condominium complex, after hearing testimonies made by those present. Resolution No. 2449 also contained the necessary public works and safety improvements as conditions of approval; the improvements generally include installation of street lights, parkway trees, sidewalk, fire hydrant, etc. TRACT MAP MARCH 13, 2007 PAGE 2 At the same meeting, the Commission adopted Resolution No. 2450 approving Zone Variance No. 05-129 to Section 9140 and 9115 of the Downey Municipal Code for variable height requirements and encroachment into the required rear yard setback area for the properties located at 7714, 7722 and 7724 Stewart & Gray Road. On February 21, 2007, the Planning Commission reviewed the final map and recommended that the City Council approve Final Tract Map No. 64754. Attached is a resolution approving the final subdivision map, an agreement for construction of subdivision improvements, a vicinity map, a copy of the subdivision improvement performance bond, a covenant and agreement regarding on site storm water retention, a cost estimate of said improvements, together with a copy of the tract map showing the area which is being subdivided under Tract Map No. 64754. The final map has been checked and found to be technically correct, in conformance with the tentative subdivision map, and in compliance with local codes and requirements. The developer has executed the attached agreement and provided surety to guarantee the construction of the required off-site improvements (e.g. streetlights, street trees, sidewalk, fire hydrant, etc.). In a minute action, on February 21, 2007, the Planning Commission recommended that the City Council approve Final Tract Map No. 64754. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE FINAL SUBDIVISION MAP OF TRACT MAP NO. 64754 (7714, 7722 AND 7724 STEWART & GRAY ROAD), BY APPROVING AN AGREEMENT WITH THE SUBDIVIDER AND ACCEPTING A SUBDIVISION IMPROVEMENT PERFORMANCE BOND AS SURETY. THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. There is herewith submitted to the City Council by the owner and subdivider thereof, a final subdivision map of Tract Map No. 64754, approved by the Planning Commission and by the City Engineer. SECTION 2. There is herewith submitted to the City Council a proposed contract between the City of Downey and the owners of said property for the construction of certain improvements within said subdivision. SECTION 3. The above-described contract is accompanied by a subdivision improvement performance bond as surety for faithful performance of the terms and conditions of said contract and for labor and materials. SECTION 4. The City Council of the city of Downey does hereby order: a) That the subdivision map of Tract Map No. 64754 submitted to this meeting, be and the same, is hereby approved; b) That the Mayor of the City of Downey is hereby authorized to execute the proposed contract between the City and said agents, and the same, is hereby approved; c) That the subdivision improvement performance bond on file as surety presented for faithful performance of the terms and conditions of said contract and for labor and materials, be and the same, are hereby accepted. SECTION 5. The City Clerk shall certify to the adoption of this Resolution and forward two (2) certified copies of this Resolution to the Director of Public Works of the County of Los Angeles.
