Agrmnt w-South Gate Rea Traffic Signal at Paramount Blvd & GardendaleAGENDA MEMO APPROVED BY CITY MANAGER DATE: February 11, 2014 TO: Mayor and Members of the City Council FROM: Office of the City Manager By: John Oskoui, P.E., Director of Public Works SUBJECT: COOPERATIVE FUNDING AGREEMENT WITH T E CITY OF SOUTH GATE FOR THE UPGRADING OF THE TRAFFIC SIGNAL AT THE INTERSECTION OF PARAMOUNT BOULEVARD AT GARDENDALE STREET RECOMMENDATION: That the City Council authorize the Mayor to execute a cooperative agreement with the City of South Gate for the upgrading of the traffic signal at the intersection of Paramount Boulevard at Gardendale Street. BACKGROUND: The City is proposing to expand the city's traffic signal communications system along Paramount Boulevard between Lubec Street and Gardendale Street as well as upgrade the existing traffic signals at six intersections along the aforementioned portion of Paramount Boulevard through the Paramount Boulevard Traffic Signal Communication System and Upgrade Project. The upgrading of the existing traffic signal at the Paramount Boulevard at Gardendale Street intersection is included in this project. The City was previously awarded a federal grant in the amount of $719,921 for the Paramount Boulevard Traffic Signal Communication System and Upgrade Project. The City Council awarded the construction for the Paramount Boulevard Traffic Signal Communications System and Upgrade Project to Select Electric, Inc. on January 14, 2014. Based on the contract award amount, the estimated cost of completing the project, including the design and preparation of plans, specifications and estimate; advertisement, bidding and award, construction, inspection and contract administration, is $1,498,115. The portion of the cost of the Paramount Boulevard Traffic Signal Communication System and Upgrade Project which will not be covered by the federal funds, or the project local match, is estimated to be $778,194. The project local match will be the City's responsibility. Based on the scope of work related to the upgrading of the existing traffic signal at the Paramount Boulevard at Gardendale Street intersection, which includes the upgrading of all existing traffic signal equipment (i.e., conduits, pull boxes, wiring, poles, pole foundations, vehicle and pedestrian indications, safety lights, etc.), the replacement of the existing vehicle detection with video detection cameras and the installation of fiber optic communications, the estimated cost of the work to be completed at this intersection is approximately 10.8% of the entire estimated cost of the Paramount Boulevard Traffic Signal Communication and Upgrade Project. CITY OF DOWNEY, CALIFORNIA Mayor and Members of the City Council Cooperative Funding Agreement - Traffic Signal Upgrade at Intersection of Paramount Boulevard at Gardendale Street February 11, 2014 Page 2 Therefore, the estimated portion of the local match for the Paramount Boulevard Traffic Signal Communication and Upgrade Project related to the proposed traffic signal upgrade at the Paramount Boulevard at Gardendale Street intersection is $84,202. Given that 50% of the Paramount Boulevard at Gardendale Street intersection is physically located in both the cities of Downey and South Gate, both cities will consequently be responsible for 50% of the cost of the local match, or $42,101, related to the proposed improvements at this intersection. 916DOI•Y•9[d►E The execution of the attached cooperative funding agreement (see Exhibit "A ") between the cities of Downey and South Gate will allow for the City of South Gate to reimburse the City of Downey for its share ($42,101) of the local match for the proposed traffic signal upgrade at the Paramount Boulevard at Gardendale Street intersection. The City of Downey will invoice the City of South Gate for its share of the local match at the conclusion of the project. The Paramount Boulevard at Gardendale Street intersection is shown on the attached Project Location Map (see Exhibit "B "). At the January 28, 2014 City Council meeting, the City Council continued the subject item to the February 11, 2014 City Council meeting and directed staff to research the possibility of incorporating a dynamic Light- Emitting Diode (LED) lane use control or turn restriction sign, similar to the sign currently used by the City of South Gate at the Firestone Boulevard at Garfield Avenue intersection. Staff has subsequently researched incorporating said device as part of the proposed upgrading of the traffic signal at this intersection and has concluded the following: The LED traffic sign at the Firestone Boulevard at Garfield Avenue intersection in the city of South Gate was installed at this intersection due to an unexpected condition at the intersection involving the part -time U -turn restriction in the eastbound direction. This intersection accommodates two left turn lanes in the eastbound direction and U -turns are allowed only during specific times. Therefore, in order to provide a safer operation at the intersection, the "optional movement lane control LED signs" have been installed at this intersection. However, in the case of the intersection at Paramount Boulevard and Gardendale Street, all approaches have only one left turn lane. Left turns and U- turns are permissive and not protected, and, more importantly, the operation of the left turn /U -turn remains the same. Moreover, the volume of traffic and turn movements is much less than the volumes at the intersection of Firestone Boulevard and Garfield Avenue. Exhibit "C" includes photos of the 'optional movement lane control LED sign" at the Firestone Boulevard at Garfield Avenue intersection and also shows the existing conditions at the Paramount Boulevard Mayor and Members of the City Council Cooperative Funding Agreement - Traffic Signal Upgrade at Intersection of Paramount Boulevard at Gardendale Street February 11, 2014 Page 3 at Gardendale Street intersection. The City of South Gate has indicated that they are not in support of the installation of the LED lane use control /turn restriction sign. • The installation of this sign at the subject intersection could potentially lead to motorist confusion and potential liability exposure. Furthermore, the California Manual for Uniform Traffic Control Devices (CAMUTCD) states the following: "On signalized approaches where through lanes that become mandatory turn lanes, multiple — lane turns that include shared lanes for through and turning movements, or other lane use regulations are present that would be unexpected by unfamiliar road users, overhead lane control signs should be installed at the signalized location over the appropriate lanes or projections thereof and in advance of the intersection over the appropriate lanes." Based on the above information and as for the safe operation of the intersection of Paramount Boulevard and Gardendale Street is concerned, the installation of LED lane use control signs is not warranted or required. However, the City Council may want to consider installing such signs at this intersection for aesthetic reasons. In that case, it should be noted that this particular intersection is similar to the 109 other signalized intersections within the City which will continue to operate with their existing standard signs in place. The cost of installing the LED land use control signs at the intersection of Paramount Boulevard at Gardendale Street will be about $10,000. However, in the future, when designing upgrades to traffic signals at other locations in the City, staff will consider the application of LED lane use control /turn restriction signs, and, if warranted, will install them to create safer conditions at these intersections. Additionally, it should be noted that other advanced technological features will be incorporated in the design of the proposed traffic signal upgrade at the Paramount Boulevard at Gardendale Street intersection, including LED traffic signal indications and safety lights, fiberoptic communications and LED pedestrian countdown indications. These features are described more in detail as follows: LED traffic signal indications — In lieu of the traditional "red ", "yellow" and "green" incandescent traffic signal indications, the public agencies adopted the use of LED indications in the early 2000's. The LED version of the indications consumes far less energy (15 -25 watts as opposed to 120 -140 watts), and last longer (up to Mayor and Members of the City Council Cooperative Funding Agreement - Traffic Signal Upgrade at Intersection of Paramount Boulevard at Gardendale Street February 11, 2014 Page 4 100,000 hours) than the traditional incandescent version. LED Safety Lights — Currently, safety lights at signalized intersections typically consist of high pressure sodium lights to illuminate the intersection. More recently, agencies have begun using LED traffic safety lights to provide illumination for safety purposes at signalized intersections. The LED safety lights are brighter and consume far less energy than the sodium vapor safety lights. The City previously installed LED safety lights at the Woodruff Avenue at Washburn Road and Imperial Highway at Columbia Way intersections through traffic signal upgrades completed recently at these intersections. Fiberoptic Communications — In the past, traffic signal communication systems consisted of communications infrastructure with copper wiring. More recently, fiberoptic communications have been used by public agencies. Fiberoptic Communications infrastructure consists of a series of small glass fiber tubes bundled into one larger cable and convey pulses of light through tubes in order to transmit data from point "A" to point "B ". The advantage of fiberoptic communications is the much higher bandwidth which can be provided as opposed to copper wiring, which involves the flow of electrons in order to transmit data. By comparison, copper wiring provides far less bandwidth for the same size communications cable as fiberoptic technology provides. Pedestrian Countdown Indications - These devices are similar to conventional pedestrian indications used at signalized intersections with the exception that the countdown indication features a countdown timer which is displayed along with the "flashing hand" symbol during the "flashing don't walk" interval of the traffic signal cycle. The countdown timer enhances pedestrian safety at signalized intersections by encouraging the pedestrian to use better judgment when deciding whether or not to cross the street during the "flashing don't walk" interval by informing the pedestrian of how much time remains during this portion of the traffic signal cycle. A photo of a pedestrian countdown indication is included in Exhibit "D ". FINANCIAL IMPACT: The estimated cost of the Paramount Boulevard Traffic Signal Communication and Upgrade Project is, as previously stated, $1,498,115. Currently, $1,327,870 is programmed in the FY 2013 -14 Capital Improvement Program to fund this project. The funding sources consist of the $719,921 federal grant, $367,949 in Proposition C Local Return and $240,000 in Measure R Local Return funds in account Nos. 26 -1 -6590, 54- 1 -6590 and 56 -1 -6590, respectively. $189,224 was previously budgeted and expended between fiscal years 2007 -08 and 2012 -13 toward the design phase of the project for a total all -years project budget of $1,517,094. The same funding sources will apply in the Mayor and Members of the City Council Cooperative Funding Agreement - Traffic Signal Upgrade at Intersection of Paramount Boulevard at Gardendale Street February 11, 2014 Page 5 same proportionate amounts to the proposed traffic signal upgrade at the Paramount Boulevard at Gardendale Street intersection. WITNESSETH: WHEREAS, DOWNEY was awarded a federal grant in the amount of $719,921 for traffic signal communications and upgrades along Paramount Boulevard within its city limits between Telegraph Road and Gardendale Street; and WHEREAS, the PROJECT will be completed as part of same traffic signal communications and upgrades to be implemented along Paramount Boulevard; and WHEREAS, the City boundary between DOWNEY and SOUTH GATE coincides with the Gardendale Street centerline; and WHEREAS, the PROJECT will be of mutual benefit to both DOWNEY and SOUTH GATE by enhancing traffic safety and decreasing maintenance costs at said intersection; and WHEREAS, DOWNEY and SOUTH GATE are desirous of cooperating in the development and construction of the improvements to be completed under the PROJECT; and WHEREAS, the total estimated cost of the traffic signal communications and upgrades to be completed along Paramount Boulevard is One - Million Four- Hundred Ninety -Eight Thousand One - Hundred Fifteen Dollars ($1,498,115), which includes, but is not limited to, the design and preparation of complete plans, specifications and estimate; advertisement, bidding and award; construction, inspection and contract administration for the contemplated improvements in accordance with the Public Contract Code; and NVHEREAS, the total remaining cost, or local match, of the traffic signal communications and upgrades to be completed along Paramount Boulevard, minus the federal funds, is Seven-Hundred-Seventy-Eight Thousand One - Hundred Ninety -Four Dollars ($778,194); and N\'HEREAS, the portion of said local match related to the cost of the PROJECT oc . . Exhibit Ilk' Cooperative Funding Agreemetyt . , PROJECT local match, is proportional to the estimated cost of completing the traffic signalization improvements at the Paramount Boulevard at Gardendale Street intersection relative to the entire cost of the traffic signal communications and upgrades to be. completed along Paramount; or Eighty -Four Thousand Two - Hundred Two Dollars ($84,202) or roughly 10,8% of the local match of the traffic signal communications and upgrades to be completed along Paramount Boulevard; NOW, T HEREFORE, in consideration of the mutual promises, covenants, and conditions herein contained, the parties agree as follows: A. DOWNEY shall be responsible for providing all design and construction engineering necessary to complete the PROJECT. This shall include but not be limited to the following: design and preparation of complete plans, specifications and estimate; advertisement, bidding and award; construction, inspection and contract administration for the contemplated improvements in.accordance with the Public Contracts Code. B. SOUTH GATE shall compensate DOWNEY for its share (50 %) of the PROJECT local match, or Forty -Two Thousand One - Hundred One Dollars ($42,101). C. DOWNEY and SOUTH GATE have appropriated sufficient funds in their respective Capital Improvement Program budgets for Fiscal Year 2013 -14 for the modification of the traffic signal at the intersection of Paramount Boulevard at Gardendale Street to enhance safety and decrease maintenance costs at said intersection, under the PROJECT. D. DOWNEY and SOUTH GATE hereby approve the scope, design and estimated cost of the PROJECT. E. DOWNEY and SOUTH GATE agree to be responsible for maintenance of the improvements constructed and DOWNEY will continue to bill SOUTH GATE for 50% of the maintenance cost per the traffic signal maintenance agreement between DOWNEY and its traffic signal maintenance contractor. F. SOUTH GATE shall pay to DOWNEY an amount equal to fifty percent (50 %) of the total project costs upon contract completion, and final acceptance of the PROJECT by DOWNEY. G. DOWNEY agrees to protect, defend and indemnify SOUTH GATE against any claims, liabilities or judgements arising from DOWNEY's actions or inactions in carrying out its responsibility under this Agreement. SOUTH GATE agrees to protect, defend and indemnify DOWNEY against any claims, liabilities or judgments arising from SOUTH GATE's actions or inactions in carrying out its responsibility under this Agreement. H. DOWNEY shall require Consultant and Contractor to protect, indemnify and defend SOUTH GATE in the manner that DOWNEY is indemnified in the contract documents. DOWNEY shall require Consultant and Contractor to name both DOWNEY and SOUTH GATE as additional insureds on all required insurance under the contract documents. I. The parties of this Agreement are the City of Downey, a municipal corporation and charter city, having its principal office at 1 1 111 Brookshire Avenue, Downey, CA 90241 and the City of South' Gate, a municipal corporation, having its principal office at 8650 California Avenue, South Gate, CA 90280. J. The representatives of the respective parties who are primarily responsible for the administration of this Agreement, and to whom formal notices, demands and communications shall be given, are as follows:: The principal representative of the City of Downey shall be: John Oskoui, P.E. Director of Public Works /City Engineer 8650 California Avenue South Gate, CA 90280 (323) 563 -9512 K. : This Agreement shall be effective upon execution by DO WNEY and SOUTH GATE and shall continue in full force and effect until June 30, 2014, unless extended by written amendment by the parties hereto. Notwithstanding this Section J, if the construction is in progress on June 30, 2014, the Agreement shall continue in effect until project completion. Further, the obligations and promises of the parties set forth in Sections D, E, F, and G of this Agreement shall survive the termination of this Agreement. L. Disputes . regarding the interpretation or application of any provisions of this Agreement shall, to the extent reasonably feasible, be resolved through good faith negotiations between the parties. If any action at law or in equity is brought to enforce or interpret any provisions of this Agreement, the prevailing party in such action shall be entitled to reasonable attorneys' fees, costs and necessary disbursements, in addition to such other relief as may be sought and awarded. M. This Agreement supersedes all prior proposals, agreements and understandings between the parties and may not be modified or terminated orally, and no modification, termination or attempted waiver of any of the provisions hereof shall be binding unless in writing and signed by both parties. N. This Agreement is covered by the laws of the State of California. Any action must be filed in the Superior or Municipal Court of the Southeast Judicial District, California. IN WITNESS THEREOF, the parties hereto have accepted, made, and executed this Agreement upon the terms, conditions, and provisions above stated, the day and year first above written.
