PRESENT: Council Members: Mario A. Guerra Mayor Fernando Vasquez Mayor Pro Tem Luis H. Marquez Alex Saab ALSO PRESENT: Gilbert Livas, City Manager John Oskoui, Assistant City Manager Yvette M. Abich Garcia, City Attorney Adria M. Parks & Recreation Director The Invocation was delivered by Dn. Mario A. Guerra, Mayor. The Flag Salute was led by Mayor Pro Tern Vasquez. CITY COUNCIL MEMBER ANNOUNCEMENTS; REQUESTS FOR FUTURE AGENDA ITEMS; CONFERENCE /MEETING REPORTS Mayor Pro Tern Vasquez thanked his colleagues for participating in the "Walk to School" event, noting he participated at Gallatin Elementary. He attended The Stay Gallery one year anniversary event, and the ribbon cutting event for the Telegraph Road Median Reconstruction, a joint project between the City of Downey and the City of Pico Rivera. He advised he attended the Downey Youth Commission first annual meeting last week and noted he is excited to see what the Commission brings forward to the Council. He stated last week he attended a Workforce Investment Board Meeting and appointed one person from the City of Downey. One additional appointee is needed and if anyone is interested to please contact the City Clerk's Office. He advised he attended an Affordable Care Act event last week, partnered with Congresswoman Garcia at the Barbara J. Riley Center. Council Member Saab welcomed Downey Chamber of Commerce Director Jeannie Wood, Soroptimist President Blanca Rochin, and his wife Giggy and son Dominic. He encouraged the public to visit the Stay Gallery's exhibit, "Bones of Steel," which is taking place through mid - November. He advised of the following events: Friends of the Downey City Library Open House and Market Place; Downey's Holiday Home Decorating Contest; Tree Lighting event at City Hall, December 9; Chamber of Commerce Christmas Parade, December 8 at 1 p.m.; the Chamber of Commerce Chili Cook -off, November 11, at the Elks Club; and, the Pumpkin Patch event, October 31 at Apollo Park. He recognized and introduced the Downey Youth Commissioners in attendance. Council Member Saab advised the Downey Civic Theatre Usage Grant application deadline for non - profit groups is this Friday, October 25, and City Council /Successor Agency Minutes - October 22, 2013 1 encouraged groups to apply. Lastly, the Downey Museum of Art is submitting their proposal for the use of the building at Furman Park and requested staff review the proposal and return to City Council with options at the next meeting. Council Member Brossmer commented on the tragic loss of Dodi Soza, Downey High School student, and thanked the Police Department for their assistance. He reported that this past Saturday he and his son participated in the Keep Downey Beautiful clean -up with over 58 people in attendance, noting it was very well organized. He reported attending a Downtown Subcommittee Meeting, and advised of the upcoming David R. Gafin Dog Park dedication on Saturday, October 26, at Rio San Gabriel. Mayor Guerra stated there have been a lot of positive things going on, such as the joint venture of the Telegraph Road Median Reconstruction Project with Pico Rivera to the Columbia Memorial Space Center Subcommittee Meeting this morning. He advised that a few weeks ago the Subcommittee met with the president of the San Diego Space and Air Museum to give the City feedback, and ideas and today the Subcommittee met regarding the new Inspiration Building. He reported that the Downtown Subcommittee met recently, noting the Downtown has come a long way and there are new exciting things coming. He reported attending a Healthy Downey Partners Meeting last week, thanking the partners for their amazing work such as the "Walk to School," event and suggested this event continue the first Monday of every month. He reported the City of Downey has four County Headquarters, one of them being the County Library System; however, the City of Downey has its own City Library. He commented on the recently released City of Downey Library Annual Report, citing statistics and accomplishments from the report. He thanked the library volunteers and Ms. Shannon DeLong for her work as the City Librarian. He reported that on the Downey's radio show last night Warren High School Athletic Director Russ Heicke reminded us what athletics mean to a high school. Even though Warren High School is having a down year in Football, it is excelling in other sports with 3 CIF Championships in the last year and a half, 24 Varsity sports, and 86 coaches, and promotes Character Counts by pursing, "Victory with Honor." Mayor Guerra commented on the passing of Dodi Soza, and the support from the student leadership of Warren High School. On Saturday thousands of Downey students met outside Downey High School to mourn Dodi Soza with an impromptu celebration of his life. Lastly, Mayor Guerra stated that the City often receives complaints about the swap meets at Downey and Warren High Schools. The swap meets are run by the schools and not the City, and the money raised is for the students. Last week, 19 parking and four jaywalking citations were issued. The City understands that it impacts the neighborhoods and the City tries to minimize the impact, but it is a School District function that benefits the students. PUBLIC HEARING: None. NON - AGENDA PUBLIC COMMENT: This item was taken out of order. Mayor Guerra opened non - agenda public comment at 7:00 p.m. Having no one come forward, non - agenda public comment was closed. PRESENTATIONS Mayor Guerra's Healthy Downey weight was 245 pounds. Mayor Guerra presented a Proclamation to the Downey Rotary Club and President Velasco and proclaimed October 24, 2013, as World Polio Day. Mayor Guerra presented a Proclamation to Soroptimist President Blanca Rochin and Past - President Giggi Saab and proclaimed October as Breast Cancer Awareness Month. City Council /Successor Agency Minutes - October 22, 2013 Arturo Nevarez, from Southern California Resource Services for Independent Living, presented a plaque to Mayor Guerra in recognition of National Disability Awareness Month. Mayor Guerra read the Proclamation and proclaimed October 20 -26, 2013, as Freedom from Workplace Bullies Week. Mayor Guerra read the Proclamation and proclaimed November 10 -16, 2013, as National Elevator Escalator Safety Awareness Week. Mayor Guerra read the Proclamation in recognition of Veterans Day, November 11, 2013. CONSENT CALENDAR ITEMS REMOVED 3. Council Member Saab stated he pulled this item because he had a question: the report indicates there would be 20 accounts with no time restrictions. He asked how those are determined. Community Development Director Saeki stated the 20 accounts are not for employees and are assigned by the IT Department. They are for use by either consultants conducting presentations in the City or for larger meetings, such as Council Meetings. Mayor Guerra asked how far is the radius. Mr. Saeki advised it will provide access to all three floors of City Hall, including the Council Chambers. He stated he is not sure how far outside of City Hall boundaries. There will be routers on each floor and one additional for Council Chambers because of the construction of the building. Mayor Guerra asked if there is there a possibility to connect wifi between the City Library and City Hall. Mr. Saeki stated he can connect to the Library's wifi from his office, but it is a weak signal. With the current configuration there will be some connection into the public areas outside of City Hall; however, the proposal did not include wifi outside of City Hall. City Council /Successor Agency Minutes - October 22, 2013 Council Member Saab confirmed that the phone accounts at Library and City Hall are independent of each other. Mr. Saeki stated infrastructure adjustments are required at the City Library, which were not required at City Hall. Once the installation is complete, the same service provider will be providing wifi at both City Hall and the City Library. If approved tonight, installation should happen at the same time, as the Library contract was previously approved. Council Member Brossmer stated this is a start then the City can look to expand. He stated he appreciates the installation at the City Library and City Hall and then we can look at doing the Civic Center and then expand from there. Mayor Pro Tern Vasquez asked what is the download and upload speed. Mr. Saeki advised it is 50MB for downloading; 5MB for uploading; a lot of bandwidth is needed. Mayor Pro Tern Vasquez reconfirmed that the 20 users would not count towards staff or during a City Council meeting. Mr. Saeki stated the program is structured for everyone to receive 2 free hours. Once the two hours is up, the wifi will remain free to those who are existing Time Warner subscribers. For those who are not, there is a $2.95 an hour fee. If you log -in as one of the 20 accounts, it will bypass those requirements. It was moved by Council Member Brossmer, seconded by Council Member Saab and unanimously carried to approve staff's recommendation. 6. POSSESSION AND USE OF ILLEGAL FIREWORKS: Police. A. ADOPTED RESOLUTION NO. 13- 7450, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE ADMINISTRATIVE FINE SCHEDULE FOR VIOLATIONS OF THE DOWNEY MUNICIPAL CODE TO ADD FINES FOR FIREWORK VIOLATIONS. B. AUTHORIZED CITY STAFF TO INCREASE PRE - INDEPENDENCE DAY FIREWORK SAFETY AND ENFORCEMENT EDUCATION IN THE FORM OF FLYERS, MAILERS, AND BILLBOARD SIGNAGE; C. APPROVED OVERTIME FUNDING AS RECOMMENDED HEREIN TO SIGNIFICANTLY INCREASE THE SIZE OF THE FIREWORKS ENFORCEMENT DETAIL. Mayor Guerra stated he had serious concerns last Fourth of July with people lighting illegal fireworks. The City cannot do much about legal fireworks; however, what the City can do is try to increase enforcement and penalties for illegal fireworks. Included in this motion is a recommendation to increase advertising in an attempt to minimize risk and advertise it is expensive to be caught with illegal fireworks: $2,000 for first citation; $2,500 for the second; and, $3,000 for every citation afterwards. Last year, there were 30 citations issued for illegal fireworks; 13 citations for other infractions, for a total 43 citations. Council Member Saab thanked Chief Charles for the report and asked what is the consequence to a parent if a juvenile is caught with illegal fireworks. City Council /Successor Agency Minutes - October 22, 2013 Chief Charles stated generally when a juvenile is cited administratively or in violation of the Health and Safety Code, it falls under the parent's responsibility. It does not have to be specified in the resolution. City Attorney Abich Garcia stated she agrees with Chief Charles's assessment. Mayor Pro Tern Vasquez thanked the Mayor for bringing this forward and Chief Charles for providing the report. He stated it is the responsibility of City Council to keep the City safe; noting that one home caught on fire last year. He suggested the Downey Youth Commission help publicize the safety for Fourth of July and celebrate responsibly. Council Member Saab stated that he understand the only way to end illegal fireworks is to eradicate all fireworks. He asked as part of the education campaign, would it be possible to place scrolling electronic signs at the City's entry points. Council Member Marquez asked for those who violate the law, how is the City collecting the fees; what is the process. Chief Charles advised that the Department of Finance has a process in place, and if not collected it will go to collections. City Attorney Abich Garcia stated the City amended the administrative fine schedule and will issue administrative citations which is an alternative to criminal prosecution. The City could pursue criminal prosecution, but the easy cost - effective way of citing someone and collecting a fine is through the administrative citation process. It does not require the City to pay an attorney and prosecute for a misdemeanor. It is a quick way of citing violators without having to engage the court system. It was moved by Council Member Saab, seconded by Council Member Marquez and unanimously carried to adopt the resolution and approve staff's recommendation. 8. ADOPTED RESOLUTION NO. 13 -7452, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING A MASTER EQUIPMENT LEASE PURCHASE AGREEMENT FOR THE LEASE PURCHASE OF CERTAIN FIRE DEPARTMENT EQUIPMENT: Fire. Mayor Guerra requested the Fire Chief provide a quick briefing on this item. Chief Croom stated this report is approving the purchasing of two new ambulances; it is two separate leases, both favorable, for a total of four vehicles. It was moved by Mayor Guerra, seconded by Council Member Brossmer and unanimously approved to adopt the resolution. 12. ADOPT THE REVISIONS TO THE GREEN TASK FORCE BYLAWS: Community Development. Council Member Saab stated he would like to add that if a member misses five excused or unexcused absences in one calendar year, a member is removed. If someone does not show up to eight out of ten meetings a year, as an excused absence, there is a lack of participation on their part. He stated he believes there needs to be more accountability. Mayor Guerra stated he felt the frustration from one of his Green Task Force members from not having more meetings due to a lack of quorum. He also would like the Commissions and Committees to return to Council more frequently and provide a report on some of the challenges and receive an update. City Council /Successor Agency Minutes - October 22, 2013 City Attorney Abich Garcia confirmed the Council wants to add five absences in a 12 -month period. It was moved by Council Member Brossmer, seconded by Council Member Saab, and unanimously carried to adopt the revisions to the Green Task Force Bylaws as recommended and include in Section 4, "five absences in a 12 -month period." ADMINISTRATIVE REPORTS 14. PROVIDED STAFF WITH DIRECTION REGARDING THE FUTURE USE OF ARTS IN PUBLIC PLACES FUNDS: Community Development. This item was taken out of order. Brian Saeki, Community Development Director, provided the staff report noting the report request the City Council_ provide direction for the future use of the City's Art in Public Places funds. Mr. Saeki reviewed the recommendation to paint 10 power boxes: two on the railroad right -of -way at Firestone Blvd., and Old River School Road; eight at the entrances to the City along Paramount Blvd., Florence Ave., and Firestone Blvd.; and, two in the Downtown area. The second recommendation is to paint a mural in the breezeway of the Downtown area, north of The Stay Gallery, and install other pieces of more physical artwork similar to the bronze artwork at Porto's. It is recommended the City Council move forward with the first two options to paint the power boxes and the public breezeway in the Downtown area. If it is the desire of the City Council, staff is asking the Council approve and authorize the City Manager to enter into an agreement with Hartzog and Grabill, Inc., in an amount not to exceed $20,000. Mr. Saeki reviewed examples of previous artwork on power boxes. Council Member Brossmer asked what is the amount the City has in the Art in Public Funds account. Mr. Saeki stated there is approximately $40,000 in the fund. When developers pay fees into the account, the developer can choose to do the artwork themselves or donate it to the account; some are still undetermined. Mayor Guerra stated the power boxes that the City painted a couple years ago have never been vandalized and is a proven result to prevent graffiti in other communities. It has taken two years to receive permission from Union Pacific to paint the two power boxes on the railroad right -of -way. He stated he has an issue with the mural and its location. There is no visibility of this wall for the City to spend $12,000. If there is a wall mural on Firestone Blvd., there is more visibility. He suggested other alternatives such as the northeast corner, or painting 10 additional power boxes. He stated he would like to see local artists come up with ideas for that alley and he would rather see 20 power boxes painted instead of 10. Council Member Saab asked if local artists were contacted to see if there was any interest. Mr. Saeki stated yes, informally, there is some interest; however, in an attempt not to jeopardize the workmanship, we asked the consultant to provide a quote. She stated she is willing to work with local artists on the project. Council Member Saab stated that local artist, Tom Lakin, expressed interest. He stated he understands that the branding is close to completion, and spending that amount of money for that particular breezeway may not be the best choice; however, I would not mind reaching out to the artist who painted the mural of the City; it would be great there. Council Member Brossmer stated there are two items for consideration: the location and /or the costs. The location is not preferred because it is not visible, so does the Council want it somewhere else or something less expensive at that location. City Council /Successor Agency Minutes - October 22, 2013 7 Mayor Guerra stated he would like to paint more power boxes with the money and direct staff to work with local artists on the City mural. He is advocating for a contract without a mural and adding more power boxes in other parts of the City. Council Member Saab stated that he would be in favor of approving what we have now — 10 power boxes and revisit this item at a later date. The Council does not have to spend $12,000 now. Mayor Guerra stated the painted power boxes beautify the City, and take care of graffiti. He would like to discuss the locations, as he is not in favor of the locations selected. Mr. Saeki stated the philosophy of having the boxes at each entrance to the City would welcome people to Downey, coupled with the monument signs would be a nice entry into the community. Mr. Saeki stated the 10 can go anywhere the Council chooses. Council- Member- Saab- stated he would hate to deplete the account and asked if it is cheaper to do more than just 10 power boxes at one time; will a larger quantity lower the price. Mr. Saeki responded no. Mayor Guerra stated there are several upcoming development projects coming that would replenish the account. Mayor Pro Tern Vasquez asked if there is a theme to the power boxes as entry points and stated he would like there to be some consistency. He stated he would like to spend the money in the Downtown area it is the City's walking area and add an economic engine component to it. Mayor Guerra stated the power boxes on Old River School Rd /Firestone Blvd. are eyesores. He would like the Council to consider those two power boxes. He stated he doe not think we should spend $12,000 on the mural right now; he would like to do the entire downtown, not just Downey Ave. Mayor Pro Tern Vasquez stated he is open to the two power boxes in the noted area, but does not want to see additional power boxes painted along the Union Pacific railway. He also requested different forms of art such as a fountain or a gathering area where people could spend time in the Downtown area. Mayor Guerra asked if Council agrees to approve the 10 power boxes; 2 at location mentioned; the other 8 to be determined with a theme, and staff return with other locations Downtown. Mr. Livas clarified the recommendation stating, if the Council agrees, the City will paint 10 power boxes, do not contract for the mural, concentrate art in the Downtown area, and look at other medians of art such as statues, tiles, interpretive pieces, etc. Council Member Saab stated he would like staff to reach out to local artists and return to Council with recommendations. Mayor Guerra stated the recommendation is to paint 10 power boxes, 2 at the noted location; the location of the other eight to be determined; and, return to Council with further recommendations with other artwork in the Downtown area. Council Member Brossmer stated he would like to explore other artwork options and no more power boxes. Mayor Pro Vasquez asked staff to consider decorative bike racks. City Council /Successor Agency Minutes - October 22, 2013 8 It was moved by Mayor Guerra, seconded by Council Member Brossmer, and unanimously carried to paint 10 power boxes, 2 at a fixed location (railroad right -of -way), the location of the other eight to be determined but conceptually to be in the Downtown Specific Plan, with a theme. The City Council gave direction to staff to research other forms of artwork for the Downtown area, including murals and bike racks, and to work with local artists. 15. RESIGNATION OF COUNCIL MEMBER ALEX SAAB FROM BIKE AD -HOC COMMITTEE AND CONSIDERATION OF ANOTHER COUNCIL MEMBER TO SERVE ON THIS COMMITTEE: Council Member Saab. This item was taken out of order. Council Member Saab stated he believe the Bike AdHoc Committee would best be served by those on the Healthy Downey Committee; either Mayor Guerra or Mayor Pro Tern Vasquez. Mayor Guerra stated he was willing to be on the Committee. It was moved by Council Member Saab, seconded by Council Member Brossmer to have Mayor Guerra and Mayor Pro Tern Vasquez serve on the Bike AdHoc Committee. RECESS /RECONVENE Mayor Guerra recessed the meeting at 8:07 p.m. At 8:09 p.m., Mayor Guerra reconvened the City Council Meeting, with Council Member Saab excused. The City Council unanimously agreed to continue Items #13 and #16 to the next meeting. 13. AUTHORIZATION TO BEGIN FORMALIZING NEIGHBORHOOD IDENTITY /BRANDING EFFORTS: Administration. 16. CONSIDERATION OF A COMMUNITY ADVOCATE PUBLIC INFORMATION OFFICER POSITION: Mayor Guerra. STAFF MEMBER COMMENTS: None.
