RESOLUTION NO. 13-7448 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING A PURCHASE AND SALE AGREEMENT BETWEEN STOCKTON WEST LANE PARTNERS AND THE CITY OF DOWNEY FOR PROPERTY LOCATED AT 9778 AND 9788 FIRESTONE BOULEVARD IN THE CITY OF DOWNEY WHEREAS, the Cities of Downey and Norwalk entered into a cooperative agreement on February 25, 2003 for the replacement of the Firestone Boulevard Bridge at the San Gabriel River (“Project”), designating Norwalk as the lead agency on the Project and confirming the Cities’ intent of sharing the costs of the Project equally; and WHEREAS, on February 26, 2013, the City Council granted authority to the City Manager and Assistant City Manager to negotiate with Stockton West Lane Partners (“Sellef’), owner of the property located at 9778 and 9788 Firestone Boulevard (“Property”), and two other property owners within the City for the purchase of easements required for the Project; and WHEREAS, due to the need to realign the sidewalk on the south side of Firestone Boulevard to transition into and line up with the proposed bridge, the acquisition of property interests, consisting of slope and temporary construction easements, from Seller will be necessary; and WHEREAS, a property appraisal for the proposed real property interests in the Property has been completed, based on which the just compensation amount for said property interests is $30,000; and WHEREAS, the City has negotiated a purchase and sale agreement (“Agreement”) with Seller to obtain said property interests for an amount not to exceed $30,000; and WHEREAS, seller has agreed to the sale of said property interests at the appraised just compensation amount of $30,000 and has signed the Agreement; and WHEREAS, the City Council has determined that approval of the Agreement and the sale transaction contemplated thereby, are in the best interest of the City and the public health, safety and welfare NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Downey hereby (i) approves the Agreement, a copy of which attached hereto as Exhibit “A” and is on file with the City Clerk, (ii) if applicable, authorizes and directs the City Manager to make final changes to the Agreement consistent with the City Council’s direction, and (iii) authorizes and directs the Mayor to execute the final Agreement and any other documents and agreements necessary to complete the sale transaction contemplated by the Agreement. SECTION 2. The City Council of the City of Downey hereby determines that the acquisition of said property interests is exempt from the California Environmental Quality Act (CEQA) under Section 15301 of the CEQA Guidelines, as an existing facility.
