Morton presiding. PRESENT: Councilmen; Corbin, Temple, Ferris, Winton, Morton ALSO PRESENT: Oren L. King, City Manager Royal M. Sorensen, City Attorney Ivan A. Robison, Assistant to the City Manager Alberta Pfeiffer, City Clerk -Treasurer Katherine Holtzclaw, Executive Secretary Councilman Scott Temple delivered the invocation in the absence of the scheduled minister. The City Clerk noted a correction in the minutes of the June 10, 1968 minutes: Page 9, paragraph 3, first sentence should read: "Mr. Sorensen responded that the entire com- mittee would vote." It was moved by Councilman Temple, seconded by Councilman Corbin and so ordered that the minutes of the June 10, 1968, meeting be approved as corrected. Mr. Thomas Webber, from the Workmen's Compensation Insurance Commission presented a refund check .to the City of Downey in the amount of $40,697.34 and commended the City of Downey on its low rate of casualties which made them eligible for the large refund. Mr. Webber stated that some cities' refund checks were so small, they were sent through the mail; however, with one the size of Downey's he wishes to make a per- sonal presentation and commendation. The City Manager commended the Department Heads and their staffs for an excellent job in contributing toward earning the sizeable refund through employee safety programs. The City Clerk presented the following corres-pondence: A letter from Mr. Hollis Peavey, Chairman of the Water Board, extending an invita- tion to City Council for a tour of the City water facilities the evening of Monday, July lst. The tour will leave at 6 p.m. from the City Council Chambers and will take approximately two hours. The Mayor noted that the letter requested an R.S.V.P. and that he would not be able to attend as he has a legal matter out of town, however, Mayor Pro TRmpore Temple stated---tha-t he planned to attend. A letter from Mr. and Mrs. Charles A. Taber, commending the Fire Department for their efforts in expelling smoke from their home with a minimum of damage. Ordered received and filed. A letter from Mr. John J. Gottes, South Gate City Attorney, relative to prisoner ''� care agreement with the City of South Gate. The only revision for the 1968-69 agree- ment is the hourly rate for matron care for female prisoners which is increased from $2.40 to $2.55 per hour. It was moved by Councilman Temple, seconded by Councilman Corbin and passed by the following vote to authorize the Mayor to sign the agreement with the City of South Gate for prisoner care for 1968-69. AYES: 5 Councilmen: Corbin, Temple, Ferris, Winton, Morton NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Council Minutes -- 6/25/68 - 1 - 3221 A memorandum and Zero Defects Bulletin from Mr. Robert Chalmers, Public Works Zero Defects Chairman. The City Manager commended the Public Works Department for their en- thusiasm and success in the "Zero Defects Program." Mayor Morton presented a certificate to Battalion Chief Ed Wood of the Fire Depart- ment, offered by the Bureau of Industrial Education after fulfilling all the require- ments of the 32-hour course in Tests and Measurements. Mayor Morton congratulated Battalion Chief Wood for earning the certificate. •-- Chief Gain stated the purpose of the class m" to evaluate their training program, so that the men get the maximum value out of it and they can readjust if necessary to improve the training program. Chief Gain stated he noticed quite an increase in efficiency since Chief Wood has taken over. Further, that this is another step in the service training program to increase efficiency in the entire Fire Department. A memorandum from the City Manager relative to remodeling the City Hall main doors. Mr. King reported that if City Council agreed to approve the installation, the doors recommended were of double k" tempered solar plate glass with panic hardware and alum- inum frames both at the main entrance and the Second Street Police entrance at a cost of approximately $2,000. It was moved by Councilman Temple, seconded by Councilman Winton and passed by the following vote to authorize calling for bids for the installation of double k" tempered solar plate glass doors as outlined by the City Manager, both at the main en- trance and the Second Street Police entrance of Downey City Hall. Kesselring, Vice President of Flight Operations of Los Angeles Airways, Inc.. relative to sound abatement procedures. Councilman Winton related that he had met with Mr. Kesselring and the City Manager, and outlined the methods and procedures they had agreed upon to keep the noise level down. Councilman Winton also stated he wished to thank the Press for their help and make a public thanks to Los Angeles Airways for their cooperation. A memorandum from James D. Ruth, Director of Parks and Recreation, relative to the proposed park at Dinwiddie and Rio Hondo Drive. Mr. Ruth reported that at the re- quest of Councilman Ferris, a questionnaire was sent to approximately 300 residents and that he had a 35% response to the affirmative that the land be developed into a park. A memorandum from James Ruth, Director of Parks and Recreation relative to naming of a new park at the subdivision tract at Stewart & Gray Road (Rolling Greens). Mr. Ruth reported that the Park and Recreation Commission had reviewed the proposal at a meeting and submitted a letter stating they had no preference, that they thought naming the park after Councilman Temple was very appropriate. Mayor Morton, explained to Councilmen Ferris and Winton, the details leading to the recommendation, bringing them up to date on the proposal to name the park after Councilman Temple. These recommendations had been made at previous Council meetings. Councilman Ferris commended Councilman Temple for the admiration of the youth of the City toward him. Councilman Corbin pointed out that Councilman Temple was on the first Park and Recreation Committee before Downey was incorporated. It was moved by Councilman Ferris, seconded by Councilman Corbin and passed by the following vote to name the half -acre part site in the Rolling Greens Tract #26653 subdivision at Stewart and Gray Road, "Temple Park." AYES: 4 Councilmen: Corbin, Ferris, Winton, Morton NOES: 0 Councilmen: None ABSTAIN: 1 Councilmen: Temple Councilman Temple thanked City Council for being honored in having a park named for him. Council Minutes -- 6/25/68 - 2 - 6122 A memorandum from Ervin Spindel, Director of Public Works relative to removal of peach trees at 13027 Adenmoor Avenue. Mr. Spindel reported that the property owner had been notified that a Tree Removal Contract is to be presented to City Council after July 1, 1968, and that the tree in question would be included in the contract. Since there have been reports of other peach tree problems in the same area, Councilman Winton recommended that the street sweeper notify the Director of Public,Works the addresses he could not properly clean because of excess peaches, and that the De- partment could expedite the detail further. A memorandum from the Director of Public Works relative to sidewalk and parkway obstructions at Woodruff and Muller. Mr. Spindel reported that the ivy problem has been solved with the construction of sidewalks at two locations on Woodruff Avenue. He further stated that sidewalks are in the process of being installed at two other locations, and that he believed upon completion of that construction, there will be enough sidewalks to permit Chapter 27 proceedings on the remainder of the block. It was moved by Councilman Temple, seconded by Councilman Ferris and so ordered that a study be undertaken of clearing parkways at least 3 feet from the curbline to allow children enough room to walk to school without walking in the street. A memorandum from Mr. Spindel relative to inquiry from Councilman Winton re- questing value of property at Priscilla and Clark for a proposed neighborhood park. Mr. Spindel reported in detail on the findings of the valuation of the Van Ruiten property which is 1.49 acres valued in the neighborhood of between $50,000 and $55,000; that if the property is developed, it would be necessary to dedicate 19' on the north ,side for additional street right of way in order to put in fill street improvements. After discussion regarding the proposed development of this property, a preliminary ^ study made by Mr. Ruth for Councilman Winton, and the Park and Recreation Commission's recommendations, Mr. Ruth stated that the Park and Recreation Commission has not made a recommendation on this matter yet as they have not met; however, this item is on their agenda for their next meeting scheduled for Tuesday, July 2nd. After discussion regarding Councilman Winton's study of this matter, in that he has been in contact with Mr. Van Ruiten who no longer resides in Downey, the Mayor qpp-ointed Councilman Winton to work in behalf of the City Council in conjunction with the Park and Recreation Commission on the Van Ruiten matter; depending upon the report and recommendation Tuesday night of the Park and Recreation Commission. If the Park and Recreation Commission feel a contact should be made, Councilman Winton was authorized to communicate further with Mr. Van Ruiten.and report back to City Council. A memorandum from Mr. Ervin Spindel, Director of Public Works, relative to street improvement information showing estimates on the cost of the following projects: Alley south of Firestone Boulevard between Wiley -Burke and Pomering; cost of constructing curb, gutter, and paving on Firestone Place between Old River School Road and Pomering Road; Street lighting.on Firestone Place between Old River School Road and Pomering Road. Ordered received and filed. A petition relative to paveout on Devenir Avenue. Mr. Spindel reported that the property owners have contleacted to have the area between the gutter tip and the exist- ing.pavirig paved at their own expense, however, there is a grade differential, and they are asking the City to cap the street over their new paveout. Mr. Spindel further re- ported that the actual lip of the gutter is higher than the paving that they are attempting to join. The estimated cost of the City's portion would be $8,000. including that portion between Devenir and Brock Avenue. There is theproblemthat the majority of the owners on the block are proceeding with the work and there may be one or two who do not. If so, the City would probably be compelled to resort to Chapter 27 pro- ceedings to fill in .these few areas before the cap work. Councilman Temple related his sympathetic feelings towards the property owners who were conscientous in their efforts to maintain the streets. He further stated that there was a fine line where the property owners' responsibility towards public streets begins and ends, and thinks the City should attempt to set up some sort of help on this problem, at least a nominal budget to give people more help towards paveouts and street improve- ments. Councilman Temple concurred with the request and stated that he hoped it could be done in other parts of the City. Council Minutes -- 6/25/68 - 3 - 3223 Mayor Morton inquired if this capping would help drainage toward elimination of standing water and the Director of Public Works responded that it would not only help drainag_e,.but alsoallow the street sweeper to do a better job as it is difficult to sweep the street with a strip of dirt between the paving and the gutter. Councilman Winton also showed concern over the same problem in his District. It was moved by Councilman Temple, seconded by Councilman Wintonandso ordered that a study be made of the feasibility of the City's setting up a nominal budget to give more help to property owners toward pave -outs and street improvements and report back to Council. A report from the Los Angeles County Health Department regarding -fly abatement .at -Long.'s Dairy, 8627 Rosecrans, Paramount Councilman Winton reported on his meeting with the dairy owners and a field trip to the dairy. He further related that the last inspection showed the area to be clean and that the dairy owners were cooperative and agreed to continue the inspections with reports to the City Manager and Councilman Winton. A letter from Standard Oil Company accompanied by various letters of recommendations from other cities relative to the request for a vibroseis survey in the City of Downey on Lakewood Boulevard. Mayor Morton wished to point out that three surveys have already been conducted in his District and that if it was the wish of City Council to allow the survey, he would rec"end that it start at Gardendale Street to Cecilia or Fifth Street, and not pick up until after Gallatin Road, so that the residents between Fifth Street and Gallatin Road will not be subjected to this survey again. Councilman Temple explained the geological standpoint of the Oil Companies that conducted the surveys and further explained that each Oil Company makes its own survey due to competitive reasons. It was moved by Councilman Temple, seconded by Councilman Winton and passed by the following vote that the request of Standard Oil Company for a vibroseis survey be granted with the stipulation that it exclude the residential area between Cecilia or Fifth Street and Gallatin Road, and also publish Mr. Gulen's phone numb (as a repre- sentative of Standard Oil Company) in the event residents wish to contact the Company during _the survey. It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered that a public hearing be set on the appeal to Zone Exception Case No. 784, (T. R.-Masterson) Farm Street and Paramount Boulevard at 7:30 p.m., August 12, 1968, in the Council Chamber of the Downey City Hall. A letter from Diehl, Evans and Company reporting on the audit covering the quarter ended March 31, 1968. Ordered received and filed. A legal claim from Mrs. Ruth Suto.rius, 8542 Tenth Street, Downey. It was moved by Councilman Temple, seconded by Councilman Corbin and so ordered that the claim of Mrs. Ruth Sutorius be denied and referred to the City!s Insurance Carrier. Council Minutes -- 6/25/68 - 4 - i;224 Mayor Morton stated he brought information from the Mayors' Conference held recently in Chicago which he felt may be of interest to the other Councilmen. It will be available in the Mayor's Office. The Mayor stated the City Attorney had indicated Council could now consider _the resolution regarrdin& the request of All American Home Center for a reduction of park- ing spaces which was earlier taken under submission for the City Attorney's review. City Attorney Sorensen stated he had reviewed the matter during the recess of Council and that the number of off-street parking spaces should be shown as 79 spaces reduced to 78 with the elimination of one for the temporary building_, and that the time limit for the temporary building..is to be for two years. It was moved by Councilman Corbin, seconded by Councilman Temple and passed by the following vote to adopt the Resolution (No. 2091) with the designation of 79 parking spaces reduced to 78; and a two year limit be placed for the temporary building. Cost of the work to be performed would be charged against the property and shown on the tax bill. Councilman Ferris questioned if the applicable sections of the Sanitation Code have been complied with at this point; especially, if the residents had been notified that they had a right to appeal to the City Council within 10 days of receipt of the notice. Mr. Spindel related that the first letter sent to the -property owners in February did show this; however, the second notice did not. Mr. Spindel further stated the property owners have another three weeks to clean the lots after the second notice is sent, as the Department of Public Works would not proceed for this length of time, and he had hoped the owners would do the work themselves. Councilman Winton directed Mr. Spindel to investigate the easement running north and south on Ratliffe Avenue, whether it belongs to the Southern California Edison Company or the City of Downey, for cleaning up and maintenance. The Director of Public Works stated he would look into the matter. Councilman Winton wished to commend the various Department Heads for their cooperation in the last month in solving the many problems which arose. Some of the committees are being combined, and it is the intent of City Council that the Councilmen are helping to augment the scope of the work of each of the committees so as to make them more effective. Mayor Morton gave a few highlights on the Mayors' Conference he recently attended in Chicago. Mayor Morton related the efforts put forth in the restoration and beautification of the downtown area on Downey Avenue, and further stated he would like to see the same concerted effort gone into the various districts to see that the citizens through- out the City receive their proportionate share of the improvements as have been indi- cated in the downtown area. With City Council approval, it was the Mayor's wish to set up a study committee comprised of Councilmen Scott Temple and Donald Winton, to study areas and inform people that the City Council definitely is here to work with ,-� them in beautification, such things as paveouts, sidewalks, safety lighting, etc., and that these things could be brought before City Council for direct action. Both Councilmen Temple and Winton were glad to accept the appointment. It was so ordered that the study committee as recommended by the Mayor be appointed. The Mayor reported on a Park and Recreation Program the Birmingham area is now using called a "vest pocket park program." These are small areas approximately 100 x 100' or 200 x 200' in size, particularly in areas where youngsters do not have proximity to school or park programs. There are such areas in south Downey, triangular in size, that could be used for these "vest pocket parks," where women could bring their youngsters to play. The Mayor suggested these areas be studied and presented back to City Council. Mayor Morton also stated that a great deal of attention and money has been expended on the business area of the City, and suggested that a study be made of the residential areas for an additional impact of improvement for consideration, and he appointed Councilmen Temple and Winton to study this program. The Mayor also mentioned a "back to basics" study and suggested that a job opportunity in the City Council and Mayor's Office for the Summer be authorized to assist in this type of study; that a student employed in such manner could do most of the leg work, provide some liaison, and study the guidelines as proposed in the program suggested, as well as on other programs.
