Morton presiding. PRESENT: Councilmen: Corbin, Temple, Ferris, Winton, Morton ALSO PRESENT: Oren L. King, City Manager Robert W. Gain, Fire Chief Ivan A. Robinson, Chief of Police Ray Lake, Director of Building and Safety William A. Goggin, Director of Planning James Ruth, Director of Parks and Recreation Robert L. Shand, Director of Finance Ervin Spindel, Director of Public Works Lee Leavitt, City Engineer Walter Wanke, Director of Water Department Ruth Miller, City Librarian Donald B. Robison, Assistant to the City Manager Alberta Pfeiffer, City Clerk -Treasurer Katherine Holtzclaw, Secretary Reverend Austin Coe of the Downey Memorial Christian Church delivered the invocation. Mayor Morton presented a commendation to Mr. Caesar Mattei for outstanding community service in connection with the youth in Downey, particularly with the Downey Youth Band. The Mayor stated that he has seen the band grow into something of which to be very proud; it not only performs in marches but also renders classical music as well. Mr. Mattei and his wife have devoted nearly 100% of their time to the young people, financing the work themselves. The Mayor stated that the City Council wishes to extend its congratulations and expression to Mr. Mattei that he is the type of citizen Downey is proud to have. Councilman Corbin stated he could not say enough in praising Mr. Mattei as he has done a terrific job to his knowledge for the last thirty-five years. Councilman Temple concurred with the statements made by Councilman Corbin and further commended Mr. Mattei for his continued youthful attitude in his work with the Youth Band. Mr. Mattei accepted the plaque with thanks, stating that working for the youth is a rewarding experience in itself, and that it was his wish in life to continue working with youth always. Chief Ivan Robinson reported on the continuing education program of the Downey Police officers and the Delinquency Control Institute which Lt. Joe Guthrie had recently com- pleted at the University of Southern California. Maybr__Morton presented to Lt. Joe Guthrie from the University of Southern California, certificate of training and congratulated Lt. Guthrie, stating that the City would profit from this type of training. It was moved by Councilman Temple, seconded by Councilman Corbin and so ordered that the minutes of the meeting of May 13, 1968, be approved as corrected. The City Clerk presented the following correspondence: A memorandum from the City Manager reminding City Council of the hospital inspection trip immediately to follow the City Council Meeting at approximately 10:30 A.M. Ordered filed. A letter from Mr. Richard Van Matre, President of the Downey Tennis Club, expressing appreciation for prompt action for the proposdd tennis courts to be built at Furman Park was ordered received and filed. Council Meeting - 5/28/68 -1- 3193 A letter from Mrs. Jack Berger, Downey Museum of Art, relative to Art Unlimited Week from June 2 through June 9, 1968, and thanking Council for its support of the museum during the past years was ordered received and filed. A letter from Mr. Demos Shakarian, Reliance Drive -In Dairies, relative to request for relief of certain conditions required of him by Zone Exception #758 for the con- struction of curbs, gutters and paveouts along the frontage of Lexington Road. Mr. Goggin, Director of Planning, reported that this problem was resolved at the last Planning Com- mission meeting. The letter was ordered received and filed. i A letter from William P. Wilson, Attorney on behalf of Dr. and Mrs. Vracin appealing the Planning Commission decision on Zone Exception Case #790, northwest corner of Tweedy Lane and Suva Street. It was.,moyed by Councilman Corbin, seconded by Councilman Temple and so ordered that a:,.: public hearing be set -for 7:30 P.M., June 10, 1968, in the Council Chamber of the Downey City Hall, on Zone Exception Case #790 which was appealed. A letter from Mr. M. Minami of the Bank of Tokyo relative to interest rates on public deposits. The Mayor directed the City Manager to acknowledge the letter with thanks for their interest in the City of Downey. Letters from the American Petrofina Exploration Company outlining complaints of damage from citizens during a recent exploration survey and manner in which the claims were handled, along with notices of change of address of American Petrofina. Ordered filed. The City Manager reported that testings of American Petrofina Exploration Company have been completed along Paramount Boulevard through an agreement with the City of Pico Rivera. A letter from Mrs. Marian Welch commending the Fire Department for emergency service rendered to her husband recently in an attempt to save his life was ordered received and filed. I A letter from the Southern California Rapid Transit District relative to adjourned meeting date to June 6, 1968, 8:45 P.M., at the Rodger Young Auditorium was ordered filed. A letter from the Downey Junior Chamber of Commerce with operating statement for the fourth quarter of 1966-67 and the first, second, third and fourth quarters 1967-68. Ordered received and filed. A letter from the City Manager to Albert C. Martin and Associates relative to the Architect's presentation of color plans for the Downey Community Hospital. Since the Architect was not present at this time, the report was postponed until, later in the Council Meeting. A letter from the American Petrofina Exploration company relative to laying seismograph cables and detectors along Paramount Boulevard was reported on by Mr. King as the work having been completed. Ordered received and filed. A letter from Sid Davis Productions regarding remake of a film, "Alcohol is Dynamite". After inquiry from City Council as to inv6lvement of the Police Department, that it would involve 2 to 3 hours only of police time, it was moved by Councilman Temple, seconded by Councilman Winton and so ordered that authority be granted for the Police Department to participate in filming of "Alcohol is Dynamite" within the City of Downey. A letter from Mr. Caesar Mattei, Director of the Downey Youth Band, with budget request for 1968T69 was taken under submission for budget study. A letter from Mr. Iry Phelan, President of the Downey Historical Society, regarding use of the former City Water Department offices on Second Street by the Society. It was moved by Councilman Temple, sedonded'by Councilman Ferris and so ordered to refer the Downey Historical Society's request for use of the former City Water Depart- ment offices to the City Manager for further study and a report to City Council. The Mayor designated Councilman Temple as chairman of the committee to work on the abdve matter with the City Manager. Council Meeting - 5/28/68 -2- 3194 A letter: -from Ethel M. DonaldsDn, Treasurer of the Downey Historical Society with a request for budget funds for 1968-69 for the Downey Historical Society was referred to the Budget Study. A letter from Mr, Charles E. Cordell, President of the San Diego 200th Anniversary relative to sending a bell to San Diego to help celebrate the event. It was moved by Councilman Ferris, seconded by Councilman Temple and so ordered that Councilman Ferris, while in San Diego this week end, inquire about the details of .� the San Diego 200th Anniversary and report to Council. Letters from Avis Rent-A-Car and the Hertz Corporation relative to establishment of rent -a -car agencies at the Heliport. Mayor Morton appointed Councilman Winton to work with the City Manager on a further study on rent -a -car agencies at the Heliport and bring a recommendation back to the City Council. A claim from Pacific Telephone Company for damages arising from damaged cable by equipment belonging to Strecker Construction Company while performing work for the City of Downey on a storm drain project. It was moved by Councilman Temple, seconded by Councilman Corbin and passed by the following vote that the complaint be denied and referred to the City's insurance carrier. AYES: 5 Councilmen: Corbin, Temple, Ferris, Winton, Morton NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None A memorandum from Chief Robinson to the City Manager relative to Sky Knight Patrol demonstration for the City Council, with copy of Joint Powers Agreement for helicopter patrol service attached which agreement had been authorized for execution by the City at the May 13, 1968, Council Meeting. Chief Robinson reported on the demonstration arrangements for City Council members Department Heads and Mr. Oren King, as well as sworn personnel of the Police Department. ^1 The demonstrations are scheduled for June 5 and 6, with June 6 from 4:00 to 5:00 P.M. being set aside for City Councilmen. Chief Robinson reported on ground observers in police cars who will be working together with the Sky Patrol in the air. There will be ten observers in the Downey area; 5 in the Norwalk -Whittier area and 5 in Los Angeles County, Cities of Commerce, Bell Gardens and Downey in police cars, acquainting them with the geographical areas and the performance of the helicopter. The area directly across the street from the City Hall will serve as a landing and take -off field. Mayor Morton directed the Fire Chief to arrange to have emergency equipment standing by during the take -offs and landings of the helicopter. Letters from German -American Welfare Society; City Marager to German -American Welfare Society; and the German Consul Friedrich Fechner relative to hospital care for Dieter Schmitz -Engel at Rancho Los Amigos. The City Manager reported that the City Attorney has prepared the agreement for care of Dieter Schmitz -Engle and that the ,$27,000 has been deposited to the Bank in Los Angeles; however, contact with Rancho Los Amigos Hospital shows that they anticipate the minimum cost to be approximately $40,000.00. The Mayor stated that when they met with the representative here, they were advised that the German Government would underwrite this matter and guarantee the full amount, At that time, the Mayor stated he suggested that the Consulate supply a letter to that effect, however no letter has been received to date. Councilman Corbin showed concern over the City's being held liable for the remainder of the expense in the event it was found that Dieter Schmitz-Engel's hospitalization would be much longer and expensive than originally anticipated and agreed upon. Councilman Winton stated he would like to confirm that the Consul General is in possession of the consent of the German Authority to cover the cost of the rehabilitation which exceeds the amount already deposited with the City. Council Meeting - 5/28/68 -3- 3195 After discussion on the responsibility of additional cost, it was moved by Councilman Temple, seconded by Councilman Winton and so ordered that the matter be taken under submission, each Coundlman being given a copy of the contract; also that a three -party agreement be required, with the signature of the German Consul, authoriting assurance of any additional money needed in the event the hospitalization should be extended. A letter from Mrs. James Knox, Chairman of the Library Advisory Board reporting that the Library Board had voted to recommend to the City Council that the Chamber of Commerce building on the southeast corner of the City Hall complex be vacated in order to allow for expansion of the existing library building. The matter was taken under submission for further study. Councilman Winton expressed his desire to have some research data to substantiate the need for expansion of the library facility. The Mayor stated that the matter of presentation of color plans for the Downey Community Hospital would be presented at this time as the Architect was now present. Mr. Jot Floyd, Architect for A. C. Martin and Associates, reported on the progress of the work to date on the hospital. He stated that the work has reached the stage where the type and color for internal finishes, wall fabrics, floor coverings, etc. can be selected. Mr. Lloyd stated he has been working closely with Mr. Glenn Jones and the hospital staff in reviewing the selections and would like the final scrutiny of the City Council for their concurrence. He stated that the external coloring was the same as shown on the rendering. Charts of color combinations and related reasons for choice of certain colors and fabrics was explained by Mr. Tom Mason of the architectural firm. It was pointed out that selection of colors is made to enhance the architect's design, taking into con- sideration the materials used so that a harmonious package can be obtained with consistencies of proportionate areas throughout the entire hospital. Fabrics and colors have been chosen for.pasier maintenance, also. Mr. Mason displayed seven different colors of paint for the total facility, various colors for the different sections of the hospital, vinyl wall colors, colors used for wider image of corridors (with warmer colors to be used on the eas& side, cooler colors on the west side that would have the afternoon sun). Reverend Cogswell, President of the Downey Community Hospital Foundation, advised that the members of that Board had approved the color plans, as had the Hospital Board, according to advice from Mr. Glenn Jones, Hospital Administrator. It was moved by Councilman Temple, seconded by Councilman Winton and so ordered that the Traffic Request No. 685 be held for more study to be made this summer during the peak -use of this park facility. It was moved by Councilman Temple and -seconded by Councilman Corbin to authorize Chapter 27 proceedings for Downey Improvement Project 578; 8103 Conrad Street, Montgomery Street frontage only. Mr. Spindel explained the proceedings used by the Department of Public Works in con- tacting citizens when Chapter 27 Proceedings are initiated. Councilman Temple directed the Director of Public Works -to have the occupant of this address contacted personally, and if he is unavailable-; to follow up with a letter. Mr. Spindel replied that he would comply with the request. Mayor Morton called for the vote on the motion. R. Huntting Company and A. C. McClurg in the Library's previous relationship with them, using as an example the fact that -she had checked purchase orders as far back as -November-, - 1967, one with an -order- of-$183, and to date, only $93. worth of this order has been re- ceived, leaving the balance still outstanding. Because of the unsatisfactory-performa-nce in the past with regard to the two low bidders, it was recommended that the services of Baker & Taylor be considered for the 1968-69 fiscal year. It was moved by Councilman -Winton, seconded by Councilman Temple and passed by the following vote that the firm of Baker & Taylor of Reno, Nevada be awarded the bid with the stipulation that more enforcement be a-pplied in -order to receive the books that have been ordered, all other bids be rejected, informing the low bidder of the reason for rejection of their bid. Chief Robinson reported on the requirements of the new police van requested for the Police Department. It was found that the Ford Econoline Van met the requirements better than the Chevrolet, as outlined by the Police Department, in four of the important areas; i.e., wheelbase, interior paneling, heavy duty battery and 3-speed transmission, as compared to the 2-speed of Chevrolet. It was moved by Councilman Temple, seconded by Councilman Ferris and passed by - the following. .vote to authorize the purchase of the Ford Econoline Super -Van from Downey Auto Center in the net delivered amount of $2,898.50 for the Ford Econoline Super Van and grant permission to retain the old G.M.C. Van for special use, and reject all other bids. Mrs. Christensen also read the Code of Ethics for all city employees, as follows: "As a City Employee, I believe in the City I work for, ever mindful of the publics interest. I will endeavor to perform my duties with dignity, integrity, and loyalty. I will be thoughtful in my criticism and liberal with my praise, reflecting neither malice nor ill will. I will constantly strive to work with my fellow employees to keep alive the spirit of cooperation, rather than compe- tition. I will uphold and defend the ideals of my community, recognizing the duties of my office as a symbol of public faith." The City Manager presented the 1968-69 preliminary budget with the aid of charts for visual reference, including anticipated revenues, departmental budgets, revenue funds, and Capital Improvement funds. Mr. Walter Wanke, Director of the Water Department, was commended and congratulated - for his efforts in becoming a registered professional engineer in Industrial Engineering in the State of California. The City Manager reported on a five-year City Hall remodeling schedule. The suggested program was prepared by Don Robison, Assistant to the City Manager, and sub- mitted for Council study. It was moved by Councilman Temple, seconded by Councilman Winton and so ordered that the date of July 1, 1968, from 2:30 to 5:30 p.m. be approved for holding Open House to celebrate the Tenth Anniversary of the establishment of the Downey City Library. The City Manager -reported that-regar-4-ing Cash -Contract #212, slurry seal in various parts of the City, it has been found that the tonnage of slurry seal required to complete the job as shown on the plans and specifications was underestimated by b-etween 20% and- 25%. Therefore, in order to complete all the areas -which were shown on the plans, it will be necessary to provide additional funds in the amount of $3000. since the con- tractor is being paid -by -the --ton-. The City Manager reported on the undergroundin& utility meeting held by the League on Thursday, May 2nd. An ordinance was passed by the City of Downey on March 28, 1968, and became effective April 26, 1968, establishing regulations and procedures for the removal of overhead utility facilities and the installation of underground Utility District Mr. King further reported that the next step in the procedure, to obtain the $92,300. allocated for the City of Downey is to appoint an Undergrounding Utilities Committee to submit recommendations to the City Council, for present and future undergrounding pro- jects, in order to be under the initial allocation for early priorities of these funds from the utility companies. It was moved by Councilman Temple, seconded by Councilman Ferris and so ordered, that the Mayor and City Council appoint an Undergrounding Utilities Committee, consisting of Councilman Ferris, the City Manager, the Director of Public Works, Planning Director, Director of Building and Safety, and a representative from the Edison Company and the General Telephone Company. The City Manager reported the following legislation was presented to the City Council on April 29 for study, and recommended that authority be granted for the following action on the various Assembly Bills and Senate Bills: AB-684, Cigarette.Tax Allocation -- no action. The City Manager reported the Downey Community Hospital Authority's previous regdest to transfer the existing Architectural Agreement between Albert C. Martin and Associates, Hospital Architects, and the City of Downey, over to the City of Downey Community Hospital Authority had -been. -reviewed -with the -City Attorney. In accordance with the provisions set forth under Section 12 for the design and con- struction of the hospital, it is noted that the City shall prepare, or cause to be pre- pared, schematic plans, preliminary plans and specifications, and final plans and speci- fications for the hospital and, in accordance therewith, the City Attorney has advised that this Contract cannot be transferred Mr. King reported on the organizations -and duties of the Traffic Committee. Under Section 2410 of the Downey Municipal Code, the Traffic Committee is composed of the Chief of Police, the Director of Public Works, the Fire Chief, the City Manager., the Traffic Engineer, or any of their designated representatives. The City Manager fur- ther related if it is desired to amend the ordinance covering this.item,.the City Attorney should be instructed to prepare an amendment, as desired by the City Council, relative to the number of citizen appointees, the manner in which they are appointed, their terms, and their voting rights. The City Manager reported on the Southern California Associa-t.ion-o-f-Governments as requested by the City Council and reaffirmed the previous recommendation that the City of Downey remain a member of SCAG, which is a voluntary and advisory form of cities and counties. Ferris and passed by the r-� following vote to continue the participation in SCAG, reappoint official delegate, retaining Ben 'D Corbin, and authorize dues payment in the amount of $483. for the 1968-69 fiscal year. There are 26 libraries in the State which are open on Sunday after- noons, which is an increase from.on-ly-two-Libraries being open two years ago. Mrs. Ruth Miller has outlined a program for Council consideration -of -keeping the Downey City Library open from 2 p.m. until 5 p.m. on Sunday beginning September 8, 1968 at an estimated annual­c•ost- of - $1000-. It was suggested that a 30-day trial period be initiated beginning September 8th to ascertain if the citizens of Downey would us-e the Library on Sundays. Councilman Winton inquired if this time being utilized would relieve some of the workload during the week. This was not certain at this time. It was moved by Councilman Temple, seconded by Councilman -Corbin and so ordered that the request to keep the Library open on Sundays from 2 to 5 p.m, be referred to ,--. the Library Board for study and report back to Gouncil. The City Manager reported on completing extra roofing for the Public Works Building, with Christian 4 Letner Roofing Company Contractor performing the work on the City Hall Complex, Mr. King stated this was included in the original -•bid, but not authorized at that time. It has now been deemed necessary. The amount of $1,560. is included in the overall bid but Council action is recommended for authorization of the work. Councilman Corbin requested that letters be sent to Mr. Pickett and Mr. Joe Coss signed by the Mayor commending them for their fine work and also the necessary Council Minutes - 5/28/68 - 11 - 11203 resolutions be prepared and presented for Council action. Councilman Temple reported on the Law Enforcement and Community Recognition Associa- tion of Los Angeles County banquet held at the Palladium on May 15th. The Organization's main purpose is to promote law enforcement, particularly in Los Angeles County and recog- nize law enforcement lagencies. Two "Bobbies" from England were present, where professional law enforcement was started some time ago.. During the ceremonies, the two "Bobbies" gave a talk during which they particularly wanted to recognize Chief Robinson.:for his help and courtesy to them while they were at the Peace Officers Conference, as -well as -their visit to Downey. Councilman Temple accepted a silver badgeon a plaque for Chief Robinson and his Department that evening and presented it to Chief Robinson in behalf of the police from Great -Britain. Councilman Temple inquired of the Director of Building as -to building -activity he noticed at 7200 Firestone Boulevard to which Mr. Lake replied they had checked into the matter since they also noticed it and found this building (in the old Ed Tunks Ranch Market building) to be in process without a building permit, and had informed them to bring in their building plans for checking by the Building.Dep-artment. Mr. Lake re- ported that this building has been going...on approximately 3-4 months. Mr. Paul Clayton, drawing the plans, was notified to bring..in the plans for checking; -however,. when he brought them in, he refused to fill out an application for a -building permit and as such, no valid building.p.ermit appli:cation..is in the files. Last week, an inspection disclosed they were planning to open their doors; however, the Building -Department gave.them-a- definite stop order advising that if they attempt to continue without the proper permits, they will be cited by the Police Department. As of this time, they have no clearance from the Police, Fire or Building Department, nor the County Health Department, Mayor Morton showed concern about anyone's starting a teenage program in Downey and not abiding with the law from the very beginning. Chief Robinson stated he has been in contact with Mr. James Cord; the person planning the Thunderbolt Teen Club, and Mr. Cord stated he wished to remodel this into a Concert Hall at first inviting name bands for the adults. He has publicized this in the Southeast News with a large ad notifying that he was-going.to have the first after- hours entertainment between 2-7 a.m.; that he was going to sell membership for adults for certain opportunities; that -he was to sell certain group..members.hip.s all the -way - down to 14 years of age; and..youth groups on Saturday- a-nd-Sund-ay mo.rning.. The -.-Police Department notified him that he could not operate at any time in the City of Downey under the ordinance -as ­prescribed -by City -Council -and they could not have an after- hours entertainment location; they could not have any person under 18 years of age -present at that location at a dance without a parent with them; and that-.basically-th-is-would limit the operations for dancing and the groups between 18 and adult age. without the evening life. Mr. Cord re-evaluated his program and was noti€i-ed that after -all the licenses, permits, etc, were applied for and conformed with, he could apply for a char- itable, religious permit, and -that he could apply to the Police Department for permission to use the facilities for teen dances where they were properly sponsored by adults. At the present time he has complied with none of the requests, resulting with the Building., Fire and Police Departments notifying him officially of the last day they would take en- forcement action if the doors were opened. He stated he -had -also observed a sign ex- pressing regrets they cannot open. At the present time, Mr. Cord has applied for the permits as required; he has been photographed, fingerprinted, and upon the return of the F.B.I., C.I.I. reports, they will start investigation as to how far he will be allowed to progress., Chief Robinson was directed -to submit a summary on this to City Council. Councilman Temple inquired of the Director of Public Works why the signs -had not been posted at the location of Paramount Boulevard between Melva Street and Springer Street for parking, and directed the Director of Public Works to expedite this matter, Councilman Ferris directed the Director of Public Works to check the condition of Rivergrove Street north of Foster Road on Treasure Island-; when and how it could be taken care of, and the Director of Public Works responded he would check it, although it is not a dedicated street. Councilman Winton stated Mr. King had contacted Los Angeles Airways at his request and they have made an oral commitment to maintain a minimum amount of flight time over the residential areas of District #1, and they will reply back in the method of F.A.A. regulations regarding street access rights on takeoffs and landings. Council Minutes - 5/28/68 - 12 - 3204 Councilman Winton reported a parking problem to residents on Stewart and Gray Road and Imperial Highway due to the numerous apartment developments on Brookshire Avenue. He was advised that- many of -the tenants in the- aprtments -are parking -into the driveways of the residents from whom he has received numerous complaints, and inquired of the Director of Public Works if some parking -restriction might be established in order to allow the residents to have access to their driveways at all times. Mr. Spindel, Director of Public Works, advised the driveways could be "red tipped" within 2' or 3' of the residential driveways. r-•. Mayor Morton reported a problem on Telegraph.RoaA with respect to cleaning of the tree wells and watering the trees located there. The Director of Public Works advised that the tree wells are to b-e-cleaned out -this summer and that they are being watered. Mayor Morton also stated there have been complaints relative to damaged sidewalks on Florence Avenue by the Rio San Gabriel Bridge due to heavy equipment crossing over it. He was advised that -.the sidewalk will be restored before the contractor leaves the job. Chief of Police Ivan Robinson reported the radio control program breakfast meeting was very successful. He recommended Council endorsing this program whereby businesses will cooperate with the law enforcement agencies in reporting suspicious acts. It was moved by Councilman Morton, seconded by Councilman Temple and so ordered that the City Manager be directed to prepare a resolution endorsing the radio control program as described by Chief of Police Ivan Robinson for Council action at its next Council meeting. The Park Department was requested by Councilman Corbin to investigat.e.and correct a defective water faucet at the Rio San Gabriel Park which had been reported to him by a Senior Citizens' Group. Mayor Morton wished to report for information, should others question the mosquito problem at Rio San Gabriel River, that the Mosquito Abatement District has sprayed the area 3 times the past month and will continue to keep ahreast- of the situation. It was moved by Councilman Temple, seconded by Councilman Corbin and passed by the following vote to approve reimbursement of $2,385.41 -as the -Water Department's share for installation of an 8" main along Woodruff Avenue on property being developed by Robert Reed.
