PRESENT- Councilmen: Morton, Dunnum, Temple, Dickerson, Corbin ALSO PRESENT.- Oren L. King, City Manager Royal M, Sorensen, City Attorney Robert W. Gain, Fire Chief Ivan A. Robinson, Chief of Police Ray Lake, Director of Building and Safety William A„ Goggin, Director of Planning James Ruth, Director of Parks and Recreation Robert L. Shand, Director of Finance Ervin Spindel, Director of Public Works Walter Wanke, Director of Water Department Donald B. Robison, Assistant to the City Manager Alberta Pfeiffer, City Clerk Katherine J. Holtzclaw, Executive Secretary Mrs, .Judy Van Gemerr., Downey Y,M.C,A, delivered the invocation, A film was shown, featuring Miss Jo Jo Starbuck and Kenneth Shelley, Downey High Sc.hoo:'f students., in the ice skating that won the students medals at the Olympias held at Grenoble, France. The students related the heavy schedule of practice they must undergo to stay in training, Mrs, Starbuck and Mrs. Shelley, mothers of the skating stars, were introduced, Mayor Corbin presented Miss Starbuck and Kenneth Shelley each with a resoiu:*:i.on from the City Council commending them on winning the Olympics .-- award, The Mayor stated that Downey is indeed fortunate to have two y y young people as these in our midst„ 'It was announced that Miss Starbuck and Kenneth Shelley were appearing at Paramount's Skating Rink, Iceland., on April 21, 22, and 23, 1968, and anyone wishing to may come to enjoy their skating exhibitions along with those of other talented performers, Mr. Jim Dalton of the United States National Bank explained a program his bank is sponsoring, namely, "Operation Helping Hand." This program is designed to publicly commend those citizens who evidence unusual courage -in assisting officers in their line of duty, or someone in need, in an effort to help overcome public apathy toward enforcement in assisting officers. Police Chief Robinson related how Richard Allen Vaughn and David Leslie Woodell, both high school students, assisted his department recently on two separate oc- casions, and in doing so, were chosen to accept the award sponsored by the United States National Bank, Mr. Dalton presented each young man with the United States Bank's award and a $100 Savings Bond, congratulating each on their praiseworthy acts. Mayor Corbin presented each young man with a Commendation from the City of Downey in recognition for theft, concern for civic betterment. Fathers of the young men were introduced, It was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered that the minutes of the March 26, 1968 meeting be approved as submitted, Council Minutes - 4/8/68 31_40 The City Clerk presented the following correspondence: A letter from the City of Monterey Park enclosing a copy of their Resolution Number 7241 opposing any Municipal Court consolidation plan which acts to the detriment of the residents of their city. The City of Monterey Park solicited Downey's interest and support in this matter. After discussion on the resolution and inquiries as to the effect: this resolu- tion would have on the City of Downey if adopted, the City Attorney stated that the primary purpose of the bill is that it is more economical, and can spread the load of the Court to a greater degree. Mr. Sorensen stated the Local Administration of Justices Committee of the Los Angeles Committee of the League of California Cities has studied the matter in the present legislative session, as well as three previous legislative sessions when a similar bill had been introduced. Each time its conclusion has been that this is a bill that is of no advantage, in fact, of a disadvantage to a majority of the cities, and that Committee has recommended to the Los Angeles County Division, opposition to the bill. Opposition to this legislation had been recommended by Los Angeles County to the League of California Cities Board of Directors. The City Attorney stated it was a choice of whether the City of Downey would want its Municipal Court Judges elected throughout the County, or whether it wants the Municipal Court Judge to actually represent a particular city and be more con- cerned with the functions, the problems, duties of that particular city. Council- man Temple :recommended the City of Downey support Monterey Park and the League of California Cities on this issue. RESOLUTION NO. 2048 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY OPPOSING ANY MUNICIPAL COURT CONSOLIDATION .PLAN WHICH ACTS TO THE DETRIMENT OF THE RESIDENTS OF THIS CITY ,- The City Clerk read the resolution 'by title only. It was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered that f.urther.reading be waived. It was moored by Councilman Temple, seconded by Councilman Dickerson and passed by the following -,/ote that Resolution No. 2048 be adopted. AYES- S Councilmen- Morton, Dunnum, Temple,_ Dickerson, Corbin NOES- 0 Councilmen- None ABSENT- 0 Councilmen- None A letter from :Gott -Collins and Associates relative to the Veterans Memorial Mail and Fountain Contract and Fee/Services, Mr, King stated Mr. Collins had requested that his letter be withdrawn for further study and report, So ordered. Memo from Mr. Russ Reynolds, Purchasing Agent directed to the City Manager relative to City of Downey street maps. The City Manager reported that the maps furnished to the Chamber of Commerce for printing are prepared in the Public Works Department, Mr. King stated he would bring back at the next Council meeting, a recommendation from the Chamber of Commerce as to cost. An anonymous letter from a "Loyal Alumni" asking the City to hold a banquet honoring its athletes, as did the City of Bellflower recently. Councilman Temple asked to have the mouth Committee look into this possibility and report back to Council. Councilwoman Dunnum stated she feels that Jo Jo Starbuck and Kenneth Shelley should be included in the list. Mayor Corbin directed the Youth Committee to coordinate with the Schools on this matter. So ordered. Council Minutes - 4/8/68 v 2 3141 Progress report from Robert L. Shand, Director of Finance, relative to status of the Brian McLeod Fund, Councilman Dickerson reported Brian McLeod is doing pretty fair since the last operation. Councilman Dickerson also wished to express the appreciation of Brian's mother and father to the City of Downey. A letter from the Southern Pacific Company relative to the "Depot." The City Manager reported that the Park and Recreation Commission are studying the moving cost and relocation area for the depot. A field trip is scheduled for next week. Jim Ruth, Director of Parks and Recreation stated the Park and Recrea- tion Commission meets on April 11th and will have a report for the next Council meeting, Ordered received and filed. A memorandum from Deputy Chief Morgan relative to Tactical Squad Activities in February, 1968. Chief Robinson reported that with just the six men working on the Detail, there was a 59% increase in arrests during the last month. Ordered received and filed, A letter from the Los Angeles County Board of Supervisors relative to "National Sing Out Day" asking the City of Downey to also proclaim this day (April 20th)u Since the information submitted was sketchy, the City Manager stated he would check on the letter, for a more specific report. A memorandum from James Ruth, Director of Parks and Recreation relative to Edison Property Park Development at Dinwiddie and Rio Hondo Drive, Mr. Ruth re- ported that the conditions as stipulated by the City Attorney were submitted to the Park and Recreation Commission. He stated that the City Attorney pointed out the potential hazards in children flying kites and model airplanes with the high tension wires, but that this could be controlled. Mr. Ruth checked with the City of Monterey Park who have a similar situation and they were able to control this by posting signs prohibiting the kite flying and model airplane flying. The Park and Recreation Commission were in accordance with the acquisition and develop- ment of this area. Councilman Dickerson inquired as to the lease coat of the area and Mr. Ruth responded that it would be approximately $125 per year. Letter from Mr. Louis Lorenzetti, appealing Zone Exception No- 777, 8061 Florence Avenue. it was moved by Councilman Morton, seconded by Councilman Temple, and so ordered that a public hearing be set for Zone Exception No. 777 al' 7,30 p.m., May 1.3, 1968, in the Council Chambers of the Downey City Hall. Letter from Mr. Harry W. Schlentz appealing Zone Exception Case No, 779, 10302 Julius Avenue. it was moved by Councilwoman Dunnum, seconded by Councilman Morton and so ordered that a public hearing on Zone Exception #779, 10302 Julius Avenue, be set for 8-00 a,m,, April 23, 1,968 in the Council Chambers of the Downey City Hall. Legal Claim from General Telephone Company of 2020 Santa Monica Boulevard, Santa Monica. It was moved by Councilman Temple, seconded by Councilman Dickerson and passed by the following vote to deny the claim and refer to the City's insurance carrier. AYES- 5 Councilment Morton, Dunnum, Temple, Dickerson, Corbin NOES, 0 Councilmen: None ABSENT-. 0 Councilmen: None Council Minutes - 4/8/68 - 3 - A letter from Mr, Peter Weinberger of the California State Employment Service relative to extending the termination date of the Downey Youth Employ- ment Service to November 1, 1968. Councilman Dickerson reported on the public's awareness of the need of the Youth Employment Agency in the City of Downey and its accomplishments and merits in its years of existence. Councilman Dickerson stated he requested the Youth Employment Agency to provide him with a recapitu- lation of the years it has-been in operation and the number of jobs it has pro- vided. He stated he talked with Assemblyman Jack Fenton regarding the need for the Youth Employment Agency here in Downey, and Assemblyman Fenton assured him of his help in this area, A Letter from Mr, Frank Verhoorn, 7419 Buell Street, Downey, with a reply from Mayor Corbin relative to undergrounding utilities for beautifying the City, Ordered received and filed. A letter from Mr. Paul Yokota, 7117 East Stewart & Gray Road, Downey relative to vewonsideration of sewer connection requirements at 7115 and 7117 East Stewart and Gray Road, Mr. Spindel stated that Mr. Yokota was attempting to work out a method of payment that would be easier, A few weeks ago, the City Council applied Chapter 27 of the Streets and Highways Code on this frontage- At that time he stated the City would put in the sewer prior to paving. During the construction of the sewer and street improvements, it was found there were cesspools in the parkway, Under the City Code, the connec tion must be made immediately and the total connection fee for the sewer in front of his property is $2,992.93 plus the cost of any sewer laterals which are put in, Mr, Yokota inquired today if he could pay it off in installments, or have it added to the Chapter 27 lien to be prorated on his tax roll; however, the City Attorney advises that the City cannot do that as far as sewers are concerned, About all the City could do is Split the cost or just charge connection fee for the portion of this property which is served by these cesspools, rather than all of it, When the. property owner develops the rest of the property and connects again to the sewer, then he would pay the rest of the fee, This can be done on an apportionment basis, Mr, Sorensen stated that the property could be divided into certain sewer service parcels and that this could be done administratively if approved by the City Council. I Mr, Yokota stated that he feels this is a fairly heavy assessment at tKis time since lk weeks ago he paid $1,660, on street improvements, and now, according to the latest communication, almost $3,000 has been requested, and only two resi- dents have the septic tanks and cesspool in front of their property, The other house has -it in the rear, so would not be affected, Mr. Yokota asked if at this time it were possible to pay for the two residents that are directly affected, and that he would certainly appreciate this. He also stated that the zoning is R-3, however all he Uses it for now is R-1 purposes. It was moved by Councilman Temple, seconded by Councilman Dickerson and passed by the following vote at this time to charge -for the connection fee for the portion of Mr, Yokota's property which is served by the cesspool; with the property owner paying the balance of the fee when the property development is completed, and additional connection to the sewer is accomplished; payments for these connections to be on an apportionment basis, as recommended by the City Attorney and Public Works Department, AYES 5 Councilmeny Morton, Dunnum, Temple, Dickerson, Corbin NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Council Minutes - 4/8/68 - 4 - 3143 A letter from the Mayer Const:ruction, Inc. relative to Tract 27079, Lubec Street with agreement and map attached. Mr. Spindel stated that as of today, all the requirements of the agreement have been met along with the.approval of the Title Insurance and Trust Company. RESOLUTION NO, 2049 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE FINAL SUBDIVISION MAP OF TRACT NO. 27079, ACCEPTING THE DEDICATION THEREIN OFFERED, APPROVING AN AGREEMENT WITH THE SUBDIVIDERS, AND ACCEPTANCE OF A CASH BOND (LUBEC STREET) The City Clerk read the resolution by title only. None Councilman Morton stated he has received telephone cal-Is,commending-the City Council for taking the initiative in installing the new tennis courts, and re- quested the compliment be passed on to the Park and Recreation Commission, Councilman Morton stated relative to upgrading-Distr-ict I residential areas, with 2,500 lumen incandescent lights, he noted that City Council has the authority to increase the tax -rate without holding a public hearing-.. -He stated he would not be in favor of it without a public hearing. He requested that if action is taken, it should be done through a public hearing. Councilman Temple co.La"urred in that he also thought citizens should be aware of the increas-e of .04(,,-. As requested by the City Council at the regular meeting of March 26, 1968, a report was submitted on the status of the current 1967-68 citywide Safety Lighting Program. Received and filed. A report was submitted relative to the Street Name Sign Program, This Program was reported on at the March 26, 1968 City Council Meeting with a request to hold for further revort. It was moved by Councilwoman Dunnum, seconded by Councilman Morton and passed by the following vote to authorize the Department of Public Works to ad- vertise for bids for refleotorIzed street name signs for 400 intersections through- out the City, and the funds be allocated from the 1968-69-Budget. Morton, Dunnum, Temple, Dickerson, Corbin NOES. 0 Councilmen: None ABSENT- 0 Councilmen- None With reference to a report of street needs submitted by the Department of Public Works, Councilman Morton stated he had gone through it and would like to say he thought it was very well done, He appreciated the excellent manner in which the report was prepared by showing the street needs by individual streets. He wished to commend the Department of Public Works on this. Mr. Spindel stated that the report was prepared by the City Engineer, Mr. Lee Leavitt, who spent a great deal of time on it, This estimate report of street needs is being held for further study. Council Minutes - 4/8/68 - 7 - 3146 Mr. Spindel reported on investigation of a request from the Principal of Pius X High.-Sch.00.l in regard to proposed parking south of Consuelo Street westerly of Paramount Boulevard. He stated the -Principal of the school was of the opinion that the sidewalk along the south side of Consuelo Street was City property, however, on checking.it was found to be County property. His Depart- ment could find no restriction to access from -the adjacent -properties to Consuelo Street, therefore a permit for driveway aprons cou-ld-be issued by the City, Since the sidewalk along thesouthside of Consuelo Street is outside the City right of way.,.and its relinquishment would be a matter for the County, it was recommended by Councilman Morton and Councilman Temple concurred, that Mr. Spindel assist the school in making contact with the County and also Mr. Bonelli's office, So ordered. It was moved by Councilman Temple, seconded by Councilman Dickerson and passed by the following vote to award Bid No. 4462 for purchase of 3/4 ton pick-up truck for the Water Department, to Downey Auto Center, the lowest and best bidder in the amount of $2,474.69 and that all other bids be rejected, AYES: 5 Councilmen: Morton, Dunnum, Temple, Dickerson, Corbin NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None The City Manager reported on a request to employ Mr. Thomas W. Mitchiner as an Administrative Intern=, on a part time basis, at a salary range of approxi- mately $2.25 per hour for four hours per week. Mr. King stated he would primarily use his services at this time in assisting with the Downey Youth Employment Program., It was moved by Councilman Temple, seconded by Councilman Dickerson and passed by the following vote to approve the employment of Mr, Thomas W. Mitchiner as an Administrative Intern for four hours a week on a part time basis, at a salary -range of .$2025 per hour, AYES: 5 Councilmen: Morton, Dunnum, Temple, Dickerson, Corbin NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Mr. King reported on a further conference with officials of the Youth Em- ployment Service resulting in extending the present Youth Employment Services until November, 1968. The City Manager commented on an article in the Mar-ch issue of "The Police Chief" by Chief Ivan Robinson and Lieutenant Ferice B, Childers of the Police Department entitled "How ,We Attacked the Motorcycle Police Problem," He wished to congratulate the Police Chief and a-ll those involved in the program, The City Manager submitted copies of the proposed agreement between the City of Downey and the Little Lake School District for use of facilities and re- lated systems of playground and recreation for the year beginning July 1, 1968. The City Manager reported that this agreement has been reviewed by the City Attorney and Director of Parks and Recreation with their approval. It was moved by Councilman Morton, seconded by Councilman Temple and passed by the following.vote that the.Mayor be authorized to execute the proposed agreement on behalf of the City between the City of Downey and the Little Lake School District for use of facilities and related systems of playground and recreation for the year beginning July 1, 1968. April 19t.h through .June 14th., 1968, (Police Chief Robinson .reported the first two meetings would be one -day seminars; Friday after- noon and Saturday, The balance six 2-da,y sessions, once a week.) None ABSENT: 0 Councilmen: None Councilman Dickerson inquired of the Director of Public Works as to sewer construction still in operation since JanuaryCouncilman-Dickerson stated he has had -at -least: six- complaints from citizens in his area relat-ive to the damage to curbs and gutters. He made a visual inspection of the area and found there was also damage to shrubbery caused by the construction, from sewer pipes placed there. The Director of Public Works replied that the contractor is liable for damage.to-.plants, that he has inspectors from the Department of Public Works as- signed to projects, and -until the job meets all the qualifications and inspections of his Department., the contractor is not paid, Councilman Morton stated .it was with regret that he had been informed of the passing of Mr, Ed Caudle of the Personnel Advisory Board; because Mr. Caudle was his appointment and since the Personnel Advisory Board will be meeting almost immediately for budget studies, he would like to recommend to the City Council the appointment of Mr, Lloyd La Stromberg as his representative to the Personnel Advisory Board, Councilman Morton wished to comment that Mr. Stromberg has been active in civic affairs in the City for many years and is-we-ll acquainted with the problems of our City. He also has a tremendously fine business background and Councilman Morton believes he will bring to the Personnel Advisory Board that which is needed, a good sound business acumen. Stromberg to the Personnel Advisory Board replacing and completing the term of Mr, Ed Caudle, AYES: 5 Councilmen: Morton, Dunnum, Temple, Dickerson, Corbin NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Councilman Morton brought out that at the last Council meeting a request was made of the Park and Recreation Department and Commission and initiate a study to determine the needs of a park and recreation program north of the Santa Ana Freeway, Since that meeting, Councilmen Morton and Dickerson met with Mr. Jim Ruth and the representatives of the P.T.A. to determine just what the needs were and it was quite apparent that a program is needed. It was also brought out that the area west of Lakewood Boulevard is not being served by any type of park and recreation program, and that at the present time there is no school property where the youngsters can go, It was moved by Councilman Dickerson, seconded by Councilman Morton and so ordered that City Council request the extension of that study to include some area west of Lakewood Boulevard that may be acquired, even if only a small space, for the children in the neighborhood to play, Councilman Morton stated he appeared before the Park and Recreation Com- mission meeting the other night relative to future growth of the programs with extended leisure time that will be available to our citizens projecting in the future, and reduction of retirement age due to fewer working hours, suggesting that they initiate studies toward a park and recreation program as it would be envisioned 5-10-15 years in the future, He stated the foundation laid today will determine the type of program the city will have in the future, Council- man Morton was very impressed with the dedication of this group, some of the matters that were disc,:5sed, and the pointed questions asked by the representatives on the Commission, He found that the Commission must initiate studies and take •— time of their own going to the various parks and cities, seeing first hand some of the programs being initiated and studied, Councilman Morton stated he felt City Council should seriously consider reimbursing the Park and Recreation Commission for expenses the same as the Water Commission and the Planning Commission, Councilman Morton recommended that this be put on the agenda for Budget Study. Councilwoman Dunnum stated each member of Council had received a copy of a report from the Judge's Committee for the Guadalajara Fountain, and asked approval of City Council that she might, on behalf of City Councils advise them to proceed in accordance -with the recommendation to draw up some rules; that the contest be extended to June 30, and request that whatever rules they deem ad- visable be submitted to City Council at the next regular Council meeting. Council Minutes - 4/8/68 - 10 3149 Mr. William A. Goggi.n.,. Director of Planning_, reported that some time ago the City Council had appropriated $680 to alleviate a title problem involving a 20mfoot strip south of Telegraph Road. The problem has now been resolved and the Title Insurance Company will issue title to the property, Mr. Wendell Wiser, 7816 Seventh Street, stated he appreciated the oppor- tunity to talk to the elected officials and administrative heads. Mr. Wiser stated he heartily approved of the "Annual Report" mailing -which he received in the mail. Mr. Wiser related that he was happy the mailer went to registered voters to enlighten them of the facts of what their Council has accomplished, He also commended the Fire Department on being.the finest in the Country, judging from the low amount of fire losses in Downey, and he also commended the Police Department, Councilman Temple thanked Mr. Wiser for his comments and stated the mailer was designed to bring a resume of the Councils activities for the past year; that he thought the annual report should be mailed to let people know what the City is doing, Councilman Dickerson also thanked Mr. Wiser for his comments.
