OF THE CITY OF DOWNEY
FEBRUARY 13, 1968
The City Council of the City of Downey, held a regular meeting at 7:30 p,m.,
February 13, 1968, in the Council Chamber of the Downey City Hall, Mayor Ben 'D Corbin
presiding.

Mr. Bill Edmonds of the Downey Y.M.C,A, delivered the invocation,
Councilman Temple introduced three students from Cal Poly College who were present
in the audience.
The Mayor announced the hour 7:30.pan. having come and gone, the hearing on DIP #569
was opened for Meadow Road between Birchdale Avenue and Lakewood Boulevard, Mr. King
asked if this could be moved up on the agenda until Councilwoman Dunnum arrived, since
this was in her District and she was expected momentarily. She had expressed a desire
to be present at the time the hearing is held.
Mayor Corbin opened the hearing on the Resolution of Intention to Annex Certain
areas to'Downey City Lighting District. The Mayor inquired if the City Clerk had
the affidavit of publication of notice of hearing, The City Clerk replied she had
the affidavit. It was ordered received and filed.
Mr. Spindel reported this is an annexation to the Downey City Lighting District
(Annexation F, Area 1, Zone 4) of that portion of Woodruff Avenue between Florence
Avenue and Via Amorita Street. The lights are to be placed on existing wood poles.
Mr. Spindel stated the cost would be as follows, as the rest of the Downey Lighting
District Zone #1:

The Mayor inquired if there were any written protests, The City Clerk replied
there were none,
The Mayor asked if there was anyone present who wished to speak for or against
the annexation. There being no written and no oral comments, it wasmoved by Council-
man Temple, seconded by Councilman Dickerson and passed by the following vote that
the hearing on Intention to Annex Certain Areas to Downey City Lighting District
(Annex F, Area 1, Zone 4) be closed,

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF.DOWNEY
ORDERING ANNEXATION .OF CERTAIN AREAS TO THE.DOWNEY CITY
LIGHTING DISTRICT AND TO MAINTAIN AND FURNISH ELECTRICAL
CURRENT TO THOSE STREET LIGHTING FIXTURES LOCATED ON THE
STREETS AND PUBLIC PLACES WITHIN THOSE AREAS UNTIL
JUNE 30, 1970 (ANNEXATION F AREA 1 , ,ZONE 4)
The resolution was read by title only. It was moved by Councilman Temple,
seconded by Councilman Dickerson and so ordered that further reading be waived.
It was moved by Councilman Dickerson, seconded by Councilman Temple and passed
by the following vote that Resolution No. 2029 be adopted:

Mr. Sorensen asked to have the following change in an amendment submitted to the
minutes of the January 23, 1968 meeting:
Mr. Sorensen's statement in the 5th line should read as follows:
. . . , obtained in this manner if not otherwise inadmissible and would be proper. .
The changes having been noted, it was moved by Councilman Temple, seconded by
Councilman Dickerson and so ordered that the minutes of the January 23, 1968 meeting
be approved as amended.
The City Clerk reported on the following correspondence:
A letter from Sheriff Peter Pitchess regarding "Project Sky Knight." It was
moved by Councilman Temple, seconded by Councilman Dickerson, and so moved to post-
pone any action on this until all Council were present -- probably the next morning
meeting.
A letter from Mr. Robert Shand, Director of Finance relative to a proposal from
Los Angeles Airways wherein the City of Downey would share 50% of the commission
realized on installation of an -insurance policy vending machine in the Heliport facility.
Mr. King stated he had talked with L. A. Airways, and that they had agreed to
pay the City 75% of the commission, retaining 25% for servicing the machine, installing
the policies, and all other documentation connected therewith.
Mr. Sorensen stated that his representation of Los Angeles Airways in another
matter is not in conflict with this, and he would like this clarified for the record.
It was moved by Councilman Dickerson, seconded by Councilman Temple, and passed
by the following vote to accept the terms of the agreement with Los Angeles Airways,
with 75% of the commission to go to the City of Downey.

A letter from Southern California Rapid Transit -District regarding the District's
use of the UHF radio frequency 453.625 MC. This frequency adjoins -that of 453.000
currently being used by the City of Downey, Department of Public Works, and is one of
the frequencies that the F.C.C. currently has under consideration for allocation for
Local Government use.
After further discussion on. this, Mr. Spindel stated he hadseveral-meetings
with the Rapid .Transit District people and that actually th.ere are 3 cities involved
in this frequency, including Downey. Since they had reques.ted._.to use the same fre-
quency as our Public Works Department., it was moved by Councilman Temple, seconded by
Councilman Dickerson, and so ordered, to give the Director of Public Works authority
to pursue this matter further.

A letter from Standard Oil Company of California relating to their conducting a
geophysical survey along Rosecrans Avenue between Century Boulevard and Lakewood Boule-
vard listing the company's representative. Ordered filed.
A memorandum from.Mr. Ervin Spindel, Director of .Public Forks, regarding a park-
ing problem on Paramount Boulevard between Springer Street and Melva Street-. It was
the concensus of the Traffic Committee members that.this.problem has been resolved
with the placing of a "No Parking Here to Corner" sign, eliminating the visibility
hazard for vehicles entering Paramount Boulevard from Springer`Street. Ordered filed.
A memorandum from Mr.. Russ Reynolds relative to seating for Council Chamber.
He was informed that the factory in Wisconsin expects to ship the new seats around
February 5th, and arrival was expected approximately February .13th: Ordered filed.
Letter from Cerritos College .setting forth the purpose of the Community Research
and Development Committee, and requesting Downey, as a participating city, to contribute
$100 to the committee, and also budget the same amount -as an annual contribution for
the coming years. Mr. King stated this was the same program -that the City of Downey
helped to organize 3 or 4 years ago, having been budgeted previously relative to City,
School Beautification.
It was moved by Councilman Temple,.seconded by Councilman--Dicke-r-son, and passed-,
by the following vote to approve the request to contribute the $100 budgeted to the
Community Research,and-Development Committee, and budget the same amount as an annual
contribution fo.r'the coming years.

A letter from Police Chief Ivan A. Robinson, relative to activating the Police
Tactical Squad. Chief Robinson commented on the progress, duty assignments and
activity of this new squad, Ordered filed,
A letter from Police Chief Ivan A. Robinson, regarding,reimbursement for Peace
'— Officer Training, A check for $4,339. was submitted as payment.by the State of Cali-
fornia Peace Officers Training Fund for the calendar -year 1967. Ordered filed.
A letter from the Las Angeles County Board of Supervisors with resolution recom-
mending the City of Downey adopt similar one pertaining to penalties for use of dan-
gerous drugs, The City Attorney read the titldloaly of resolution he prepared.

A letter from Mr. Glenn D. Jones, Administrator of Downey Community Hospital com-
mending Lieutenant Shade for service above and beyond call of duty in assisting a
patient. Ordered filed.
Councilwoman Dunnum arrived at the Council meeting at 7:55 p.m.
Memorandum from Mr. Spindel regarding proposed Health and Sanitation Code, Mr,
King commented that this was pertaining to the 4 chap-ters in the Code.and was requested
by his office to cope with some of the early morning noises in connection with com-
mercial trash collectors adjacent to residential areas.

Councilwoman Dunnum stated that when this was first presented, certain questions
were asked verbally on the Council floor concerning the effect of this adoption in
the City of Downey,,setting up its own Health Officer, and the costs involved in the
endorsement of such an ordinance.
Mr. King stated that this pertains only to those areas covered that are respon-
sible to the Director of Public Works and everything related to the Health Code had been
deleted.
Councilwoman Dunnum stated that it was her understanding that the City of Downey
now contracts with Los Angeles County, and if this portion of the Code is adopted,
there will be no difference in the cost involved.
Mr. Spindel stated that the proposed Code is strictly in relation to rubbish
pickup and weed abatement, that all other items have been deleted as previously pre-
sented so that the Health Officer has never been involved within that operation,
and the City does not intend, under this particular Code, that it will. The only
change in the existing Code of this proposed ordinance is that it gives the City the
power to require a separate permit for commercial rubbish haulers. At the present
time, the only control is a business license, and there have been quite a few abuses
by commercial rubbish haulers over which the City has no control.
Mr. Spindel stated there was another Chapter on biological waste, which was
recou vended by the Citizen Sanitation Committee, to give the City more power to con-
trol the type of waste that may be deposited by doctors' offices and medical centers.
This has become a problem, as it is not enforced by any otlber agency to give the City
the power to see that things are properly disposed of.
Councilman Temple asked if there would be added cost involved and Mr. Spindel
replied that there would not -- in fact, the City might benefit with revenue from
permits.
Councilwoman Dunnum stated her question was with Chapter 1 as proposed. It
was her understanding that the cost to the City now is $1.00 per year, but then to
undertake the adoption of this Code is specifying that the City have its own Health
Officer other than the one from the County Health Department, that the City is the
same as dealing with them as a completely independent contracting agency.
Mr. Lake, Director of Building & Safety, stated he had been meeting with Mr.
George Greenhagh and Mr. Bill Schulenburg of the County, and they assured him that
the Health Code kfiicFa they have, and which the City is attempting to establish as
its own Coda then contracting again for that enforcement, won't cost the City any
more. It can be amended separately, or added to, but the charge will, remain the
same as it is now ($1.00 a year).
Councilwoman Dunnum inquired that if the City were to adopt this as its Code
now, and find later that what is stated here tonight does not work out as practical
as desired, can it be changed back to the present code?
Mr. Sorensen replied that the Code can always be amended or appended.
Councilwoman Dunnum asked if Downey could contract again at the cost being paid
now, assuming of course that the County does not change its conditions.
Mayor Corbin asked if the same Health Officer that inspects for the County would
do the same for this, and would it be two people instead of one?
Mr. Lake replied that it may be 2 or 3, however, it is still the same Health
Department which has the jurisdiction.
Mr. Sorensen stated that as he understood it from this ordinance, the provisions
of this ordinance would be enforced only by City Officials and not by any represen-
tatives of the County.
Mr. Spindel replied that that was correct as far as the provisions for rubbish
collection and weed abatement are concerned,
Mr. Spindel was asked if Chapter No. 1 is necessary to accomplish what the City
wants with the permits to garbage haulers.

Mr. Spindel replied that Chapter No. 1 was not necessary-, that it could be
eliminated and Mr. King stated it might be well to include that with Mr. Lake's study
being carried on with the Health Department.
Mrs. Dunnum commended the Sanitation Committee for their long hours and hard
work on this study.
Mr. Sorensen was asked to exclude Chapter 1 and work with Mr. Spindel on
Chapters 2, 3 and 5,
It was moved by Councilman Temple, seconded by Councilman Dickerson and so or-
dered to have the City Attorney prepare a Health and Sanitation Ordinance for adoption.
A letter from Mr. Robert Shand, Director of Finance, showing their appreciation
for their new quarters and thanking City Council for making it possible. Ordered
filed.
Letters from Martin & Chapman Company, election suppliers; Royal Sorensen, City
Attorney; and from the City Clerk directed to Mrs. Ida Berry., Ordered' -filed.
A letter from the Los Angeles County Board of Supervisors requesting any City
measures be held for General Election ballots in November, 1968. The City Manager
reported the City of Downey has none. Ordered filed.
Letter from the City Clerk regarding affiliation with the Soroptimist Club., It
was moved by Councilman Dickerson, seconded by Councilmen Temple and passed by the
following vote to approve affiliation by the City Clerk, Alberta Pfeiffer, as
requested.

A letter from Lott Collins & Associates regarding Downey Veterans Memorial as
related to the Civic Center. Mr. King stated that due to the interest shown by
Mr. Collins in the Theatre, Civic Center, etc. he thought it would be well to meet
with them. Councilwoman Dunnum wished to stipulate that City Council be advised of
this meeting, when it is scheduled, and that Council members able to do so, be in
attendance at that meeting.
A letter from League of California Cities stating Mayor Ben 'D Corbin had
been appointed to serve on the Water Committee. Ordered filed.
A letter from Mayor Sam Yorty of Los Angeles, requesting Mayor Corbin to serve
on the Committee to have Los Angeles as Host City for the 1976 Olympic Games.
It was moved by Councilman Temple, seconded by Councilwoman Dunnum and passed
by the following vote that the Mayor serve on the committee to support the bid to
have Los Angeles designated at the American city to host the 1976 Olympic Games.

A letter from Fred Sa0ches of Lakewood Pan American Festival, Inc. inviting the
City of Downey to enter a float in their parade on April 21, 1968 with the Mayor on,
or preceding the float in a car. After discussion, it was decided that since time
is short, a letter be written to them expressing thanks and possible participation
next year.

A legal claim from Farmers Insurance for W. S. Dunham of 15203 Leffingwell Road,

A legal claim from Jackie Lee Harriden, 10634 Old River School Road, Downey,
relative to injuries as result of fall over brick wall at 7414 Muller. Mr. Shand
referred to a memorandum submitted by the Director of Building and Safety, Mr. Ray
Lake, stating that the City records indicate no building permits have been issued
on the subject property since the City was incorporated, nor is there any record of
any permit being issued since the original house was constructed in 1950 for any
type of planter or garden wall. The records were checked to the adjacent property
at 7414 Muller and find the original building permit issued in 1950, but have no
record of any subsequent building permit on his property.
It was moved by Councilman Temple, seconded by Councilman Dickerson and
passed by the following vote to deny the claim from Jackie Lee Harnden and refer
to the City°s Insurance Carrier.

Letter from the City Manager relative to City Hall remodeling. Ordered filed.
The Mayor opened the hearing on DIP #569 Meadow Road between Birchdale Avenue
and Lakewood Boulevard which had been continued from January 8, 1968,
Mr. Spindel stated DIP #569 related to the sidewalks on Meadow Road and that his
office had given notice to all property owners of what the costs would be, and also
that they could apply for sidewalk matching funds if they so desired. At this time
all property owners except one at 8732 Meadow Road have applied. The cost for the
one not applying is $52.15.
Upon telephone contact to the property owners in this project, Councilwoman
Dunnum stated she had learned that there is a hardship case which Council might
wish to grant a 30-day extension in which to contribute the necessary funds.

Councilwoman Dunnum also stated that one of the property owners advised that
certain of the sidewalks were inferior and thought it was the contractor himself
who contracted the work. They wanted to know if there was a safeguard that the
work would be guaranteed under the contract.
Mr. Spindel replied "very definitely," that if they do not meet the specifi-
cations of the City, the contractor is not paid.
The Mayor inquired if there was anyone in the audience who wished to speak
for or against this hearing and no one came forward.
It was ascertained by Councilwoman Dunnum that --payments could be made on in-
stallments instead of one lump sum. It was moved by Councilwoman Dunnum, seconded
by Councilman Temple and passed by the following vote that the property owner at
8732 Meadow Road be granted an additional 30 days from this date to take advantage
of the matching funds program and authorize the Director of Public Works to so
notify them.

Regarding the reimbursement of weed abatement costs, 1967 prcg ram and the
manner in which the Public Works Department helped in this project, Councilwoman
Dunnum wished to commend Mr. Spindel for the manner in which he helped this par-

It was suggested that the report on Helicopter Patrol Service be brought
up again at the next morning meeting.
The Downey Youth Historical Society, supported by members of the Downey
Historical Society, requested City Council to authorize proceeding with the in-
stallation of historical markers under a cost estimate not to exceed $100. per
marker.

so ordered, that Councilwoman Dunnum and Councilman Morton continue serving on
the committee to work with the Historical Society on this matter.
Mr. Phelan inquired as to the cost of $100. per marker. Mr. Spindel stated
as a result of studies of the material and installation cost, each sign would
approximate $100. with no difference in price whether it is for one or 3 signs.

A semi-annual report was submitted setting forth the Public Works projects
of Capital Improvements Projects either completed or under construction for this
current fiscal year.
After discussion on the emergency power generator for City Hall functions
for up to one week's duration, it was decided to bring a more detailed report
back to the next Council meeting.
The City Manager presented a progress report of the Downey Community Hos-
pital. The following recommendations were made by Albert C. Martin & Associates
and Mr. Maurice A. Baker, Hospital Consultant, and approved by the Hospital
Authority:
Request.for payment for additional service to Albert C. Martin & Associates
in the amount of approximately $1800. for revision of architectural and elec-
trical floor plans, details and specifications to change X-ray equipment speci-
fically defined and recommended from Mr. Glenn Jones, Hospital Administrator,
detailed information 'to be presented later.
It was also estimated an additional $2500. will need approval from the City
Council after design and bids have been received for the Contractor to complete
this change.
Approval was requested from City Council for Change Order No. 1 in the
amount of $315.23 to Steed Brothers Construction Company covering labor and mat-
erial to pump out, remove debris and fill three existing septic tanks.

Councilwoman Dunnum stated with reference to the traffic signal at Birchdale
and Alameda, it was requested to have a flashing red signal with the East-West
traffic, as well as the North -South traffic, due to the fact that motorists do
not slow down with the flashing caution.
The Director of Public Works stated he would like to study this problem
as far as cost is concerned and see what could be done. He will bring a report
back to the next Council meeting.
Councilwoman Dunnum requested a letter be directed to the property owner
at 8732 Meadow Road advising them of the 30-day extension granted them.
Councilwoman Dunnum stated she and Councilman Dickerson had met relative to
the proposed Guadalajara Fountain. Their recommendations were reported to Coun-
cilman Temple, who concurred with the following criterion and recommendations for
the Citywide competition for design of a Guadalajara Fountain.
1. The Fountain to be in the center of the cul-de-sac which will be located
at the easterly terminal of Second Street. The exact useable dimensions
for the fountain area to be obtained from the Public Works Department and
Adrian Wilson and Associates.
2. Entries are to be judged by a committee composed of three members of
the Beautification Committee, three members of the City's Sister City Com-
mittee and the president of the Chamber of'Commerce. Each of the respective
committees will appoint or elect its three representatives.
3. The award for the best design will be in the form of a plaque upon
which the name of the winner will be engraved. The plaque to be permanently
affixed in the area of the fountain. In addition, a $50. United States
Savings Bond will be awarded the winner.
4. Only residents of the City of Downey are eligible for the contest.
There is no age limit. Amateurs and professionals alike are eligible.
In the event a design is submitted in the name of a firm, the firm is
eligible only if its principal place of business is in the City of Downey.
5. Contributions will be accepted to the Guadalajara Fountain Fund in
care of the Office of the Mayor, City Hall, City of Downey.
6. Attorney Sorensen shall be requested to give his opinion in writing
as to how a donation may be made, so that it will be deductible on the
donor's income tax return. (The designation of the aWancy to whom con-
tributions are to be made may be changed to concur with Mr. Sorensen's
opinion.)
7. The design is to contain the actual fountain and surrounding area
within the cul-de-sac and should, if the contestant wishes to include them,
set forth landscaping and walk area. In the event a contestant submits
the engineering, that will be welcomed, but will not be considered as a
part of the design for contest purpose.
8. A copy of these rules and regulations and a scale drawing of the
cul-de-sac may be obtained from the Mayor's Office.
9. Designs shall, be submitted to the office of the Mayor .and Co-uncil
with the contestant's name, age (if a minor), residence, and business
address (if a firm is a contestant), in a sealed envelope attached to
the design.
Councilwoman Dunnum asked the City Attorney's opinion with regard to the $50
United States Savings Bond to be given the -winner. The City Attorney stated that
in this way to stimulate an interest in the contest is a proper purpose. Monies
donated to a City can be deducted as a charitable contribution or some similar
contribution. It generally depends upon the purpose for which the donation is
made. If it is for a street, probably not, but for a Park or recreation, then
perhaps yes. He added that he could not give a categorical answer at this time.

Mayor Corbin stated he would like to see the Guadalajara Committee
into this project since they were a part of initiating the fountain concept.
Mr. Bill Cole, of the Chamber of Commerce, stated the Guadalajara Committee
does not exist any longer, and that their funds have been set aside to be apgli d

Mr. King received a letter from the Downey Historical Society showing an
interest in preserving the old Southern Pacific Depot. After some discussion
Mr. King stated he talked with the Southern Pacific people and they stated they
would cooperate in not razing the Depot for another 6 months to allow the City,
along with the Historical Society, more time to study the cost, new location, etc.

so ordered, to allow another 6 months delay to further study the matter; any fur-
ther comments or reports to be forthcoming from the Historical Society and Historical
Youth Committee in hopes they might be able to help with a solution.

ordered that Councilwoman Dunnum and Councilman Morton continue to serve on the
Committee with the City Manager, Director of Public Works and the Planning Dir-
ector relative to the sites and markers.
Mr. Phelan stated it gave him great pleasure to see the accomplishments thus
far and that he felt they were making great history in the City of Downey in res-
pect to their young, who were contributing something to their City. He commended
Mr. Bill Boyd of Downey High School for his part in this.
Councilman Temple suggested investigating the idea of having a resuscitator
permanently located at City Hall available at all times, due to the recent emergen-
diea, occurring here. Mr. King was asked to bring back a recommendation to the
next meeting to include training courses.
Mr. King stated Councilman Dickerson, Councilman -Morton and Jim Ruth made
a field trip to Rio San Gabriel relative to draining the park. He also stated
Councilman Morton suggested sending a letter to Mr. Frank Bonelli with a carbon
copy to go to the -County Flood Control Engineers and the U.S. Army Engineers
asking if they will proceed with the project to install a large conduit to drain
it, cover it, and restore the park. Recommendation was made for the Mayor to
sign the letter to go out.

Councilman Temple stated he received a report from Courtland and Courtland,
Inc. asking to transfer a liquor license to 8024 Imperial from a restaurant which
had not served liquor. Several complaints from property owners in this area had
been registered against this action. There are 30 days from February 6, 1968 to
hear protests. This location is not over 150' from one and possibly other resi-
denfies.3hat the City Ordinance prohibits this. He asked the City Manager to
investigate.
Chief Robinson stated it was already brought to his attention when the
application was filed and it is presently being investigated. He stated a previous
one had been protested out at another location.

Councilman Temple asked Mr. Spindel if it would be feasible to go underground
with utilities on Rives Avenue. He stated he would appreciate a survey and a
feasibility report.
Councilman Dickerson asked Mr. Spindel if he had observed Telegraph Road from
Paramount to Lakewood with reference to the paving on it. The unevenness in pave-
ment was discussed and Mr. Spindel stated it was because Telegraph Road had
initially been paved in concrete, that Telegraph Road is very difficult to pave
and the condition would improve with warm weather.
Councilman Dickerson asked Mr. Goggin about the unsightliness and noise
problem of rubbish at Sav-On Drug Store. The new development on Tweedy Lane is
affected by the unsightly appearance of the boxes and rubbish stacked sometimes
from 6' to 8' high. Mr. Goggin reported he would bring a report to the next
Council meeting after he has investigated this condition. Mr. King stated the
new ordinance proposed should solve the rubbish abatement.
Mayor Corbin stated he had been informed of a problem of dumping rubbish
over a wall at a location on Foster Road. The Director of Public Works, Mr,
Ervin Spindel, reported the property owner has been given notice and if the
rubbish is not cleaned up, the City forces will pick it up and the property
owner will be assessed.
Mr. Weber of 8742 Meadow Road stated he wished to bring forth the addresses
of the two people on Meadow Road with reference to inferior sidewalks in DIP #569
and added that Mr. Amescua of 8712 Meadow Road, a neighbor anticipating putting
sidewalks in under matching funds, does not want the same results, as did not
Mrs. Wilma Mack of 8729 Meadow Road. Also, an inquiry for extra work, such as
driveways was made by Mr. Weber who was informed by Mr. Spindel, Director of Pub-
lic Works, that they can either contact the contractor when he is on the job or con=
tact the Department of Public Works regarding this.
The Mayor suggested they get in touch with the Director of Public Works
relative to these complaints.
Mr. Wendell Wiser, 7816 Seventh Street, stated he had the same request as
Councilman Temple with reference to putting utilities underground except he had
a different location in mind, which is Paramount Boulevard at the intersection of
Firestone. He thought this area was going to be widened, and inasmuch as the
poles have to be moved, it would be nice if the utilities could be put under-
ground.
There being no further business to come before Council, the meeting adjourned
