MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
JANUARY 8TH, 1968
The City Council of the City of Downey held a regular meeting at 7:30 P.M., January 8,
1968, in the Council Chamber of the Downey City Hall, Mayor Ben 'd Corbin presiding.

Reverend C. .'om Lane, Assistant Pastor of the First Presbyterian Church, delivered the
invocation.
Mayor Corbin announced the presentation of Zero Defect Awards in the Public Works
Department. Mr. Spindel, Director, stated the awards are given to employees selected by the
supervisory staff and fellow employees who have done the most error free work during the
past three months. The Director requested the Mayor to assist in presentation of the awards
to the following persons:
Nell Chapman - Secretarial
Verril Smale - Engineering
Coleman Akin - Forestry
Arthur Maier - Street Maintenance
Mayor Corbin congratulated the recipients of the Zero Defect Awards and stated it was a
pleasure to be able to present these awards each quarter.
Mayor Corbin then called upon members of the Downey Youth Historical Society represent-
atives to make their presentatLon. Karen Brown, President, related to Council that their
group requests historical markers throughout the City by use of signs -:at places of special
significance to the City of Downey's history. It was requested that the landmark signs be paid
f o'r:: with City funds and installed by City forces at all designated sites.
Barbara Nelson, Secretary of the Downey Youth Historical Society, presented lists of
proposed landmark sites to Council. Sandy Roach then outlined the five sites selected for
precedence should their request be approved: (1) Old Camp Ground; (2) 1st High School -
Parking Lot at Downey High School; (3) San Gabriel River; (4) City Hall; and (5) First
Church in Downey on Third Street.
Examples of what the signs would appear to be were displayed and it was stated that their
cost has been estimated at $25.00 per sign for a 24" x 18 " sign. It was stated that before
information is entered on the signs, the material will be researched and verified carefully.
Councilman Temple inquired if there was any thought given to a special route to be
� taken through the City to view these signs after they might be installed. Miss Brown stated
this has been done in other cities but there would have to first be several placed in order
,to do this.
Councilwoman Dunnum commended the representatives of the Downey Youth Historical
Society for their fine presentation and thanked them for their interest and efforts. The
matter was taken under submission for study and the group was informed they would be advised
of Council action.

Mayor Corbin opened the hearing on the Resolution of Intention to vacate a portion of
Second Street west of Brookshire Avenue and inquired of the City Clerk if she had the Affidavits
of Posting and Publication. The City Clerk replied she had the Affidavits.
It was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered that the
affidavits be received and filed.
The Mayor inquired if the City Clerk had received any written communications or protests
on the matter. The City Clerk replied she was in receipt of a letter from the Downey Children's
Theatre, Inc. urging Council to proceed as quickly as possible with the building program and
expressing their wish to serve in any -w-dy. . in helping to facilitate the conclusion of this

Ervin Spindel, Director of Public Works, presented a summation of a study made relative to
affic on Second Street. It was reported that consideration had been given to the feasibility
of the closure of Second Street, between Brookshire Avenue and Dolan Avenue, as part of down-
town development. Traffic Counts had been taken on 2nd and 3rd Streets which showed that dur-
ing Christmas shopping season, there were a total of 3360 vehicles per day on Second Street,
just west of Brookshire Avenue, and 2620 vehicles per day on Third Street just west of Brook-
shire Avenue. On non -holiday periods when school is in session, there were 2770 cars per day
on Second Street and 2840 cars per day on Third Street. In Origin and Destination studies con-
ducted by the Traffic Engineer, it was found that eastbound traffic on Second Street showed
67% had originated from the downtown business district and 25% were terminated at either City
Hall or the Bank of America parking lot and not going on to Brookshire Avenue. The Traffic
Committee at its meeting of January 4, 1968, after studying these data concluded that the clos-
ing of Second Street would not have an adverse effect on the traffic patterns in the downtown
area and that Third Street had adequate capacity to carry the combined traffic, both present
and future of Second and Third Streets. The Traffic Committee also recommended that if Second
Street were to be closed, that Dolan Avenue from Third Street to Iowa Street, and Iowa Street
from Brookshire to Downey Avenue, be developed as alternate routes into the central business
district.
The City Manager reported that the proposal to close off Second Street at Brookshire and
creation of a mall was originated by the architects, Adrian and Wilson; that it had been
studied by the Planning Commission, the Director of Public Works and the Traffic Committee.
This date the architects again went over the exact location of the theatre and what it would
A -.,,in attracting people to the downtown area. As they had outlined the theatre, it would ac-
;lly take up the street and the attraction would bring people into the downtown area both
and night. The architects for the theatre requested that this information be referred
LV the Council in their final recommendations.
Mayor Corbin asked if anyone wished to speak in favor or against the proposed vacation
of Second Street at Brookshire Avenue.
Robert Ryan, 7640 Third Street, Downey stated he was speaking neither in favor nor against
this matter, however, he would like several questions. answered as to just what has trans-
pired up to this point; figures on maintenance cost of the building; where the money will
come from; actual auditorium usage; its income; the maintenance; how many parking places are
being taken away and how many will there be to replace them; how inconvenient it will be to
detour from Second Street. He stated the Downey Children's Theatre has a definite need but
he wished to request Council to study completely before taking action.
Frank Perez, 11510 Downey Avenue raised questions relative to the survey report made by
Mr. Spindel relative to the number of cars converging on the theatre within a 45-minute period.
Mr. Spindel reported that by closing Second Street at Brookshire Avenue, an additional 90' of
curb will be gained for "drop-offs" to the theatre as a walkway is planned off Brookshire onto
Second Street to the theatre. Also, he stated there probably will be access to the parking
area adjacent to the theatre proposed off Firestone Boulevard.
William B. Cole, General Manager of the Downey Chamber of Commerce, read a recommendation
from the Chamber Board and their Zoning Committee. They reaffirmed their support of the con-
^:uction of the Downey Civic Theatre as outlined in its letter to the City Council dated
to 26, 1967, in that the auditorium would add immeasurably to the cultural pursuits of the
ftmuni ty .

He further stated that without additional information on the project they have arrived
at the conclusion that the site under the present conditions is not adequate for the project,
and the Board of Trustees recommends opposition to the construction of the theatre at the
Second Street and Brookshire Avenue location for the following reasons:
a. Site requirements; off-street parking; Master Plan (which made no provision for
the vacation of a portion of Second Street); affects on area merchants; possible
negotiations for future acquisitions of properties in the Civic Center area.
Mr.
Cole
stated with proper planning,
it would appear
to be
unnecessary for
the
vaca-
ion of
Second
Street. The Chamber asked
consideration of
these
facts in making
its
decision.
Dr. Robert J. Flynn, owning property at the corner of Second Street and Dolan Avenue,
stated he has plans for building and is opposed to closing of Second Street. He favors an
auditorium, however.
Arthur D. Hansen spoke in protest of the closing of Second Street at Brookshire Avenue.
Also Marvin Mangrum, 9318 Downey Avenue, owner of Downey Cleaners.
Mr. Wendell Wiser, 7816 Seventh Street, Downey, stated he is in favor of the City
Council taking action to vacate Second Street and that the City cotild work with the School
Board relative to adequate parking across the street from the proposed theater site, on the
Downey High School lot.
Maxine Jolley, 7803 Dinsdale Street, Downey, spoke in favor of the proposed vacation of
Second Street, stating she concurs with statements made by Mr. Wiser.
Mr. Carl Woodall, 9514 Brookshire Avenue, spoke in opposition.
Mr. Elton Wallar, 9241 Ratliffe, owning property at Firestone Boulevard and Brookshire
Avenue, stated he is opposed to the closing of Second Street as he feels it would jeopardize
the business of the downtown area, anywhere within 2 or 3 blocks of the theater.

As no one else wished to speak for or against the closing of Second Street at Brookshire
►enue, it was moved by Councilman Temple, seconded by Councilman Dunnum and passed by the

Mayor 'Corbin ded�4ked a 5-minute recess with Council reconvening at 8:40 P.M. with roll
call, all members of Council being present.
Mayor Corbin opened the hearing on the Resolution of Intention to vacate a portion of
alley parallel to Telegraph Road between Lakewood Boulevard and Lindell Avenue and inquired
of the City Clerk if she had the affidavits of publication and posting. The City Clerk
replied she had the affidavits.

The City Clerk reported there were no written communications or protests.
Mr. Spindel presented a resume, stating the property owners are going to re -develop the
property and furnishing new easements for utilities and have dedicated additional right of
way. The alley is no longer necessary.
Mr. Robbins, 9901 Paramount, Downey, real estate representative for Mobil Oil stated he
was present to APswe-r, questions Council might have and was in favor of the vacation.

There being no further oral comments, it was moved by Councilman Morton, seconded by
Councilman Temple and so ordered that the hearing on the Resolution of Intention to vacate a
portion of the alley lying southerly and parallel with Telegraph Road between Lakewood
Boulevard and Lindell Avenue be closed.
RESOLUTION NO. 2019
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING
VACATION OF A PORTION OF THE ALLEY LYING SOUTHERLY AND PARALLEL
WITH TELEGRAPH ROAD BETWEEN LAKEWOOD BOULEVARD AND LINDELL AVENUE
It was moved by Councilman Dickerson, seconded by Councilman Temple and so ordered
that further reading be waived.
It was moved by Councilman Dickerson, seconded by Councilman Temple and passed by the
following vote that Resolution No. 2019 be adopted.

Mayor Corbin opened the hearing on Downey Improvement Project #568, 7107 Stewart and
Gray Road. It was reported that proper notification had been made to the property owner
relative to the proposed improvements. The Director of Public Works reported that funds
have been budgeted by the City for 50% of this work fronting on this property (from gas tax
monies). The property owner has been required to pay for curb, gutter and 1/2 the cost of
sidewalks under bonds of a lot split. The property owner has not yet put up the money for
his portion and, therefore, under consultation with the City Attorney, since funds have
been budgeted for over 1/2 of this project, authority was requested to proceed with Chapter
27 in order to put all the work in at one time, rather than doing it peacemeal.
Mr. Paul Yokota, property owner at 7117 East Stewart and Gray Road protested to instal-
lation of these improvements as he was of the impression that the amount of $2,500.00 was
necessary to be paid for the improvements at this time. He was informed that the amount
"Fuld be put on his tax bill for the improvements and pro -rated over as long a period of time
s 10 years, if he so desired.
Mr. Goggin, Director of Planning, was asked to give a resume of the lot split. He
reported that it originated on the request for the subdivision for the back portion of the
property in question. The applicant for the tentative tract was Mr. Yokota and then this
part was not a part of the entire parcel. Subsequently Mr. Yokota sold that portion which
was a subdivision. Mr. Yokota was then required to file for a lot split, because he was
dividing his property and selling the subdivision property to anoth'e r party which requires
a lot split. At that time the dedication was required for Stewart and Gray Road since this
was part of the parcel to be divided off. It was normal, prior to that time, to require
full street improvements but because of a change in the ordinance, they were not required
and it was felt eventually the R-3 development would be improved. As the ordinance stands
now, full improvements are required to be put in by the applicant.

Councilman Morton stated it has been -/observation that the letters being sent to citi-
zens often contain information new and strange to the average layman and property owners
do not understand City problems and procedures. He urged a review of the types of letters
being sent by all departments and to take out any harshness and be a little more explana-
tory where rights and obligations of the citizens are involved.
It was moved by Councilman Temple that the matter of requiring improvements under
Chapter 27, DIP #568, 7107 Stewart and Gray Road, be taken under submission for further study.
The motion died for lack of a second.

hd Director of Public Works relative to dedication of right way in exchange for improve-
bnts on adjacent property and requirements under the lot split, it was moved by Councilman
Temple, seconded by Councilman Dunnum and so ordered that the hearing be closed.
It was moved by Councilman Temple, seconded by Councilman Dunnum and passed by the fol-
lowing vote that authority be granted the Department of Public Works to proceed under
Chapter 27 with improvements under DIP #568, 7107 Stewart and Gray Road which was agreeable
with Mr. Yokota.

Mayor Corbin opened the hearing on Downey Improvement Project No. 569 -- Meadow
Road between Birchdale Avenue and Lakewood Boulevard.
It was reported proper notification had been made to all property owners. Mr. Spindel
stated that Council, in prior action, had authorized the Department of Public Works to in-
itiate Chapter 27 proceedings against the properties for construction of sidewalks where over
-1i0% of this improvement already exists. All of the property owners have applied for and
deceived authority for sidewalk matching funds. It was recommended that the Department be
Uthorized to proceed with these improvements to allow for the possibility that the property
uwners do not follow through to have the improvements constructed.
Mr. Howard C. Weber, 8742 Meadow Road, advised Council he has not been informed of
any cost factor for the sidewalks. Mr. Weber also requested permission to handle the side-
walk matching funds for his neighbor, Mr. Whitfield, 8736 Meadow Road as he is out of the
State and made this request of him. Mr. Weber was advised this could be done and that a
letter advising of the cost for the sidewalks would be forthcoming.
Since the property owners had not been advised of the estimated cost for their share
of matching funds for the sidewalks, it was moved by Councilman Dunnum, seconded by Council-
man Temple and passed by the following vote to continue the hearing on DIP #569, Meadow
Road, to 7:30 p.m., February 13, 1968, in the Council Chamber of the Downey City Hall, with
letters to be sent advising property owners of the date of the continued hearing.

Mayor Corbin opened the hearing on Downey Improvement Project No. 570 - South side
of Cherokee Drive between Downey Avenue and Stamps Avenue.
It was reported that proper notification had been sent to the property owners. Mr,
"pindel reported the City Council, in prior action, had authorized the Department of Public
orks to initiate Chapter 27 proceedings against the properties for the construction of curb,
utter and sidewalks, where over 50% of the improvements already exist. Both property
owners have applied for and received authorization for sidewalk matching funds, however
no permits have been issued for the curb and gutter work, estimated cost being $675.
There being no comments or written protests, it was moved by Councilman Dunnumo
seconded by Councilman Temple and passed by the following vote that authority be granted
for initiating Chapter 27 proceedings for DIP #570 -- south side of Cherokee Drive between
Downey Avenue and Stamps Avenue.

The City Clerk reported on the following correspondence:
A report from Director of Finance Robert Shand relative to a study on cigarette tak
distribution. Mr. Shand reported a study session had been initiated by the City of E1 Monte
for the possibility of revisions to the present act. The report was merely for information
to Council.
.--. A letter from Stewart Center urging immediate action to initiate the construction of
itorm drains at.the shopping center located on Stewart and Gray Road.
Mr. Spindel reported this is a critical drainage situation on Old River School Road
from Stewart and Gray Road to Hondo Street and should have top priority at the present time
over those which are already budgeted.

It was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered to
give priority as requested on the next drain project to the Stewart and Gray location.
A letter from The Southland Corporation requesting information relative to the action
taken by Council on the Zone Exception Case #745, Yale Engineering Company, Imperial High-
way. Also, a letter from Yale Engineering Company requesting a change of their request in
the zone exception case to a delicatessen/grocery and neighborhood -type family restaurant.
The hearing on this matter had been held December 11, 1967, and taken under submission.

lowing vote that the matter of Zone Exception Case #745 be referred back to the Planning
,Commission for a further hearing and that additional fees be waived.

A letter from the Southern California Rapid Transit District relative to public meeting
on preliminary report of the Southern California Rapid Transit District, at 9:30 a.m.,
January 15, 1968 in Room 210, Transit District Building, 1060 S. Broadway, Los Angeles.
It was suggested that a representative from the City of Downey attend this meeting.
A letter from Diehl., Evans and Company, auditors for the City, and recommendations for
a written policy following Council directives relative to a fee schedule for excavation
permits; an independent payroll distribution by the City Clerk -Treasurer's office once
quarterly; outstanding check cancellation and travel advances and allowances. It was reported
by the City Manager that a report on these recommendations relative to excavation permit
fee policy and the independent payroll distribution will, be submitted to Council at the next
meeting.
Complaint for damages from Mary Ryder, It was moved by Councilman Dickerson, seconded
by Councilman Temple and passed by the following vote that the claim be denied and referred
to the City's insurance carrier.

Letter from John A. Lambie, County Engineer, reporting the detachment of the portion of
the Southeast Recreation and Park District within the City of Downey. Ordered filed.
A letter of appreciation from Assemblyman Floyd L. Wakefield for pictures and news
clippings sent him of the City's anniversary observance. Ordered filed.
Copy of a letter from Frank G. Bonelli to the Road Commissioner soliciting his efforts
in trying to meet the priority schedule on the Imperial Highway Bridge widening with 50-50
participation by the County and the City on one-half of the construction costs after F.A.S.
financing of the project, Ordered filed,
A letter of appreciation from Della Doyle for the honor bestowed upon her by proclama-
tion of the Council of "Della Doyle Day" her last day with the City, December 29, 1967::
The City Manager announced he was in receipt of a wire from the State Highway Division
delaying the hearing on Highway 42 for several months. Ordered filed.

Mr. Spindel presented the report pursuant to the Street Lighting Act of 1919. It was
moved by Councilman Morton, seconded by Councilman Temple and passed by the following vote
to accept and file the:.report.

Councilman Morton stated this lighting district was the direct result of a meeting
held in his District approximately one month ago where the Mayor and he were present. People
in that area surrounding East Junior High School went right ahead getting petitions signed
and it is Councilman Morton`s desire that the Department of Public Works send notes of com-
mendation and appreciation to those persons responsible. This area is in a very dark area and
hat high speed traffic down Woodruff Avenue.

Director of Public Works Ervin Spindel and Police Chief Ivan Robinson commended Asst.
Civil Engin er Dayne Stiles who had worked on these plans and for his patience in making
any requested changes. They stated he had done a very fine job.

following vote to grant a ten-day extension of time to Mission Valley Tree Company for
the completion of tree removal in various locations throughout the City under Cash
Con -tract #207.

As requested by Council, a report was given on the study made to eliminate the
traffic hazard on Downey Avenue north of Stewart and Gray Road due to the convergence
from two lanes to one, caused by parked cars between Stewart and Gray and DePalma, and
by the installation of left turn bays in this area. It was reported that the following
actions were taken:
1. Installation of warning signs just north of Stewart & Gray Road for northbound
traffic and just north of DePalma Street for southbound traffic indicating
merging traftic.
2. Peak pour "No Parking" signs have been placed on the wesit side between
DePalma and Stewart and Gray Road,
3, A lightly painted line which has caused some confusion is being removed,
The Traffic Committee, it was reported, is continuing to work with the Nursery
School owner to come up with a satisfactory solution. As part of this continuing study,
the Traffic Committee had a special meeting where it was recommended one hour parking
be established on both sides of Fontana Street, from Downey Avenue to the alley easterly.
^,Further, it is felt by the Traffic Committee and the Traffic Engineering Section that
,left turn pockets recently installed on Downey Avenue north of Stewart and Gray Road are
urgently needed to give protection in left turns, not only for the students driving to
Warren High, but for proper access to businesses along there, particularly those on the
west side, north of Stewart and Gray Road.
The Director of Public Works reported bid opening on the Joint Outfall "H",
Unit zA Relief Trunk Sewer to be constructed under the jurisdiction of the Los Angeles
County Sanitation District is scheduled for January 10 with an estimated cost of
improvement of $300,000:00. The proposed location is within the Southern California
Edison Company easement and there should be no excavation necessary on Downey City streets.

After summation of bids for Bid #4434 for a compressor for pneumatic tools for
the Public Works Department, it was moved by Councilman Morton, seconded by Councilman
Temple and passed by the following vote that the bid be awarded to the lowest and best
bidder, American Compressor Company, for the total net delivered bid price of $1,230.17
and that all other bids be rejected.

A summation of,bids for carpeting -specified areas of the City Hall rWAs= submitte4i
according to a previous request by Council relating to savings on floor coverings. The
City Manager reported the Purchasing Agent, Mr. Russ Reynolds, had made a very extensive
survey on this and it shows there would be a saving of at least 60% in maintenance cost
through installation of a hard weave carpeting as is now being used in many banks,
businesses and hospitals. It was recommended that the bid be awarded to the Downey Furniture
Company in the amount of $2,380 for their "Viking" carpeting. This relates to 480 square
feet of carpeting for the Finance and Fire Wing instead of the previously suggested tile.
Councilwoman Dunnum objected that not all carpet suppliers within the City of Downey
had been contacted. Mr. Reynolds advised two additional bids were due but had not come in.

that this bid be taken under submission until the other bids are submitted.

the following vote to authorize Director of Public Works to attend the-�American Society
of Civil Engineers National Meeting on Transportation Engineering in San Diego,
February 19-23, 1968, with reasonable and necessary expenses allowed.

The City Manager requested authority to attend the Annual Advance Training Program
(Management) in Santa Monica sponsored by the International City Managers Association

The City Manager stated funds had been approved in the 1967-68 Capital Improvements
Budget for the traffic signal coordination on Imperial Highway in conjunction with the
County of Los Angeles and neighboring cities. It seems the neighboring cities are in a
better position to effect the coordination on Florence Avenue ddring this fiscal year
than on Imperial Highway; therefore it was requested that this item in the Capital
Improvements Gas Tax budget of $25,000 be changed from Imperial Highway Traffic Signal
Coordination to Florence Avenue Traffic Signal Coordination.

the following vote to approve the Capital Improvements Gas Tax budget of $25,000 being
changed from Imperial Highway Traffic Signal Coordination to Florence Avenue Traffic

After summation of bids for drapes and paneling in the Administration Office,
Personnel and Conference Room, it was moved by,Councilman Morton, seconded by Councilman

$420, for Administration and Finance Office, respectively, and authorize the following

.-•. It was suggested by Councilman Morton that the Council Meeting could be adjourned
to Thursday morning in order to consider additional bids on the floor covering for the
new Finance and Fire Department wings.
The City Attorney suggested that a change order be approved in the present contract,
substituting the hard weave type carpeting instead of the tile included in the previous
contract, at a cost not to exceed $2,380, as previously submitted by Mr. King, City
Manager.

It was moved by Councilman Morton, seconded by Councilman Temple and so ordered
that Mr. N. R. Mallory, 10412 Woodruff Avenue, be appointed to the Citizens Beautifica-
tion Committee.
Councilman Morton inquired if any investigation had been done on the red paint being
applied for curb markings. Mr. Spindel stated the cause for the paint's not adhering was
due to its application to new curb and gutter upon which material had been sprayed to cure
it. Steps will be taken to wash thoroughly before re -applying the red paint.
Councilman Morton again requested a report be submitted relative to the sidewalks
j proposed along Shellyfield.
Councilman Morton complimented the City Clerk and Deputy for the fine job they did
at the meeting, the first to be handled in their official capacities.
Councilwoman Dunnum recommended that the presentation of historical sites made by
the Downey Youth Historical Society be referred to the Adult society and that the De-
partment of Public Works review the locations proposed.

Council requested a separate report of all comments and questions raised raltive
to the proposed vacation of 2nd Street at Brookshire, in addition to the Council minutes.
Police Chief Ivan Robinson reported that the crime rate at the end of the year for
the City of Downey showed a 5.4% increase, which is one of the lowest that he knows about
in the entire State of California. Also, he reported, for the eighth year, the traffic
accidents have continued to decrease, and in 1967, with a 30% increase in traffic, there
has been a decrease of 23% in traffic accidents. He stated the citizens, engineers and
the safety education program deserved much credit.

appoiht Bob Allison and Mrs. Norma Fergus to the Sister City Committee.
