MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
NOVEMBER 13, 1967
The City Council of the City of Downey held a regular meeting at 7:30 P.M. on
November 13,.1967, in the Council Chamber of the Downey City Hall, Mayor Ben Corbin
presiding.

The invocation was delivered by Reverend C. Rodger Meyer of the Messiah Lutheran
Church, followed by the flag salute led by the Girl Scout Troop present.
A commemorative plaque was presented by Mayor Corbin to Reverend John T, Chase
who is retiring from the First Christian Church. Reverend Chase expressed his sincere
appreciation for the commendation, stating he was very grateful. Council expressed
their appreciation for the fine contribution made to the City by Reverend Chase and
especially toward his Youth Revivals, and wished him many years of pleasant retirement.
The Mayor opened the hearing on Stamps Avenue improvements, AD 02, and inquired
of the City Clerk if she had the Affidavits of Publication, Posting and Mailing. The
City Clerk replied she had the affidavits and they were ordered received and filed.
The Mayor asked if there were any written protests. The City Clerk replied she

Mr. Michael Miller, representing Mr. & Mrs. George Levchuck, requested a con-
tinuation of the hearing as property owner Stanner and his legal counsel, H. Lee
Trafford, were unable to attend this evening's hearing.
.-.. Mr. Ervin Spindel, Director of Public Works, gave a report on the factual data
of the assessments, stating the total amount to be assessed to the district is to be
$70,265.82. An amount of $8,666.62 for acquisition of right of way is the major
contention as far as the protests are concerned, he stated.

There being no further oral protests, it was moved by Councilman Morton,
seconded by Councilman Temple and passed by the following vote to continue the hearing
on confirmation of the assessments for AD #82, Stamps Avenue, to 8:30 A.M., November 28,
1967, in the Council Chamber of the Downey City Hall.

It was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered
that the minutes of the Council Meeting of October 24, 1967, be approved as submitted.
The City Clerk reported on the following written correspondence:
A letter from the City of Pico Rivera relative to Helicopter Patrol Service was
ordered filed.
A letter from United Towing Service requesting consideration of its services.
Chief Ivan A. Robinson of the Police Department stated this company is the present
alternate towing company and would be•considered for regular service again at the time
of renewal of contracts for these towing services next June.
It was moved by Councilman Temple, seconded by Councilman Dunnum and so ordered
to give the United Towing Service Company consideration at contract renewal time.
A letter of invitation from the San Pedro Chamber of Commerce to participate in
.-� their boat parade. Councilman Morton recommended responding to this letter with
thanks for their consideration of the City of Downey.
A letter from Ambassador Christian Schools requesting that the portion of E. Quill
Drive between Old River School Road and Rives Avenue be appropriately posted as a
school zone. They are to be informed by letter the Public Works Department will handle
this matter.
A letter from the California Highway Commission notifying of a public hearing
with respect to the location of a freeway in Los Angeles County on State Highway 42
between Central Avenue and Route 605, to be held at 10:00 A.M., January 16, 1968, in
the South Gate Municipal Auditorium. Ordered filed.
Letters from the City of Whittier and R. S. Smith, Fire Chief, in appreciation of
the support received from Downey's Fire Department during the potentially disastrous
fire in Whittier on Sunday, October 15. Ordered filed.
A letter from the Sr. High Methodist Youth Fellowship requesting assistance of
the City in establishing a public auditorium for activities such as large dances.
Councilman Morton requested a breakdown be furnished to Council by the Finance Director
of expenditures toward the City's youth through the Parks and Recreation Department and
other City groups.
A letter of regret from Reverend Austin Coe who was unable to attend the meeting
honoring Reverend John T. Chase was ordered filed.
A progress report on the Brian McLeod Fund was ordered received and filed.
A letter from City Clerk -Treasurer Della Doyle stating she wishes to retire,
effective January 1, 1968.
It was moved by Councilman Temple, seconded by Councilman Dunnum and so ordered
that Council accept with regrets the resignation for retirement from City Clerk -
Treasurer Della Doyle, effective January 1, 1968.

The City Manager stated in expressing regrets he would like to read Miss Doylq's
letter in full.
A memorandum from Ervin Spindel, Director of Public Works, relative to the'drainage ani
paveout problem at 9124 Stoakes Avenue. Inasmuch as there is a serious drainage
problem, also a hazardous traffic condition, it would appear that the City would be
justified in participating in improving this condition by putting in an additional
catch basin into the storm drain just northerly of the Tomkins' property and complete
the street improvements, Mr. Tompkins, the property owner, is willing to contribute
$300 and to dedicate the necessary right of way for construction of curb, gutter
and paving. Total construction cost is estimated at $1800, funds being available in
the Street Maintenance funds.

the following vote to approve the recommendation of the Director of Public Works for
construction of improvements at 9124 Stoakes Avenue at an estimated cost of $1800.

An invitation from the Southeast Association for Retarded Children to observe
their operation at an Open House November 15 at 10:00 A.M. to 9:00 P.M. Ordered filed.
A memorandum from the Director of Public Works relative to a drainage problem at
the Santa Ana Freeway between Elston and Stamps Avenue. The Headquarters Office in
Sacramento has disapproved participation by the State, stating that it is the City's
responsibility, not the State's, since the City should have provided for the accept-
ance of the drainage when the properties were developed in this area. It is
recommended that the City of Downey would prefer to pursue the matter further and
authority was requested to take this matter up to the proper persons in Sacramento
while there on November 15 inasmuch as the problem was created by the Freeway.
It was moved by Councilman Temple, seconded by Councilman Morton and so ordered
to authorize the Director of Public Works to take the matter of the drainage problem
at the Santa Ana Freeway between Elston and Stamps Avenue to the proper persons in
Sacramento to endeavor to obtain cooperation with the State on a 50-50 basis.
A memorandum from Fire Chief Robert W. Gain relative to the water requirements for
Zone Exception #728, the proposed development of the southeast corner of Old River
School Road and Burns Avenue as a shopping center which necessitates water main improve-
ments for fire protection. It has not been the City's practice to participate in
private utility improvements; therefore, the developer has chosen to provide a limited
number of meters and thereby minimize the main extension sharing program within the
Park Water Company tariffs.
It was moved by Councilman Temple, seconded by Councilman Dickerson and passed by
the following vote to approve the Fire Chief's recommendation relative to the water
requirements in Zone Exception #728, Old River School Road and Burns Avenue.

A letter from A. B. Springer, Vice President and Manager of the Bank of America
requested handling the active account for the City of Downey. It was suggested that a
report and recommendation be submitted at the next meeting in consideration of this
request.
A memorandum from Adrian Wilson and Associates relative to theater site plans
which was held for later presentation to Council.
Quarterly financial report from the Downey Civic Chorus was ordered filed.

A letter from American Petrofina Exploration Company requested a Geophysical
permit for Vibroseis survey within the City of Downey.
It was moved by Councilman Temple, seconded by Councilman Dickerson and passed
by the following vote to authorize a Vibroseis survey as requested by the Am rican
Petrofina Exploration Company, providing the residents within a 500' radius of their
survey be notified and bonds and adequate insurance be in evidence, and that the
residential areas be a daylight operation and night operation approved for commercial
and manufacturing areas.

A letter from American Petrifina Exploration Company requested they be granted
subsurface oil and gas leases on City -owned property upon which they do not now have
these leases. Councilman Morton recommended that this be taken under submission until
the City Attorney can review the leases.
It was moved by Councilman Morton, seconded by Councilman Dunnum and so ordered
that the request of the American Petrifina Exploation Company for subsurface oil and
gas leases be taken under submission until the next Council Meeting.
A letter of appeal accompanied by the required $50 filing fee on Zone Exception
#745, 8607 Imperial Highway.
It was moved by Councilman Temple, seconded by Councilman Morton and passed by
the following vote to set a hearing for 7:30 P.M., December 11, 1967, in the Council
Chamber of the Downey City Hall.

A letter of commendation to the Fire Department rescue unit from the Downey
Community Hospital was ordered filed.
Schematic drawings were presented from Adrian Wilson and Associates for the pro-
posed Downey City Theatre construction on the newly acquired Nazarene Church
property at the corner of Brookshire Avenue and Second Street. The plans contained
the same square footage as the original plans for the Furman Park site, utilizing
Second Street by closing off Brookshire Avenue and establishing a cul-de-sac adjacent
to the City Hall. It was reported there do not appear to be any problems which
cannot be surmounted in establishing the theater in this site.
It was moved by Councilman Temple and seconded by Councilman Dickerson to
initiate proceedings for the necessary vacation of Second Street. It was recommended
that the site be adopted before other action is taken. Councilman Temple withdrew
his motion and Councilman Dickerson , his second.
It was then moved by Councilman Dunnum, seconded by Councilman Temple and passed
by the following vote to adopt the southwest corner of Brookshire Avenue and Second Street
as the theater site.

relates to the waiving of parking requirements pursuant to Section 9127.3 of the
Council Minutes - 11/11/67 -6-
Downey Municipal Code. In this section if the property is located within the
boundaries of the Parking District there can be a substitution of parking space and
Council can reduce the amount set at $2500 per parking space eliminated to any dollar
amount, so long as Council can make these .findings.

the bid proposal, and all other bids be rejected.

It was moved by Councilman Dunnum, seconded by Councilman Dickerson and passed
by the following vote to approve completion of escrow proceedings with Mr. Manley
in Downey Avenue Street Widening project and authorize the City Manager or Mayor
to sign escrow on behalf of the City in accordance with General Appraisal Company's
evaluation dated November 6, 1967, for severance damages in acquisition of 5' of
right of way in the Downey Avenue widening program.

It was moved by Councilman Temple, seconded by Councilman Dickerson that the City
Attorney be authorized to prepare the proper ordinance for a comprehensive Sanitation
Code. After discussion and a suggestion that Council study the proposed code so that
any changes they desire may be made prior to preparation of the ordinance, Councilman
Temple withdrew his motion and Councilman Dickerson his second, and the matter was taken
under submission until the next Council Meeting.

A report by the City Manager showed the City of Downey rated fifth among 33 cities
in Group IV (300 to 600 employees), for effective safety programs throughout the last
year, and that the City has already entered the contest for 1967-68. The program not
only provides increased safety to the employees but also reduces the State Compensation
Insurance Fund.
A suggestion that a map be imprinted upon the back of the City business envelopes
showing the City of Downey as the center of the Los Angeles -Orange County Basin was
rejected by Council.

At the request of some of the downtown business people, an inquiry was made of the
Police and Finance Departments concerning the effectiveness of the parking meters in the
Stamps-Stecklein parking lot at Second Street and Downey Avenue. The consensus of
opinion is that the revenues derived from these meters do not pay for the maintenance.
The Police Department informs that there would be no difference in enforcing 2 -hour limits,
whether there are meters or not. It was recommended that the 46 meters be removed and the
easterly row of parking be converted to permit parking on the current basis of $5 per month
for half, or 23 spaces.

Councilman Morton recommended a study of parking lots and a report from the City
Manager after he has talked with officials at the General Telephone Company relative to
telephone employees' continued violations in permit parking on the various lots.
The Director of Public Works reported in accordance with statewide policy, 605
Freeway signing will be placed with one south of the Imperial Highway interchange for
northbound traffic, one north of the Florence Avenue interchange for southbound traffic
and including the one already installed south of the Florence Avenue interchange into the
City of Downey. The local office of the Division of Highways is recommending that signs
stating "Downey Next 3 Exits" be placed.
The City Manager reported that at the December 11 Council Meeting, 41 men and 4 women
will be recognized for ten years' service with the City of Downey, and also 5 -year pins
and bracelets will be given to 2 women and 9 men. To date, 271 employees have received
5 -year awards and 27, 10 -year awards.
Money paid to the City on September 27, apportioned by the County for the 1967-68,
fiscal year Aid to Cities Street Maintenance was requested to be transferred to the
County Aid to Cities Fund.

The City Manager reported a public hearing for detachment of the area within the
City of Downey lying within the Southeast Recreation and Park District will be held at
the regular meeting of the County Board of Supervisors on Tuesday, December 19, at
10:00 A.M. It was recommended that as many people as possible should attend this hearing
to speak in favor of the detachment so that the 42(,� tax may be deleted from the 1968
property tax for the people in this area.
A first Annual Report prepared by members of the Downey Historical Society was
submitted to Council with a request for authority to print 200 copies at an approximate
cost of $600.00. The matter was taken under submission for study until the next Council
Meeting.

prepare a complete and documented history of the City under Salary Schedule 17-A. (It

Unappropriated Reserves of an amount not to exceed $3,000 under the current budget to

As requested by Council previously, a report was presented to Council on Land Use
and Fire Zone Study in the vicinity of the Downey City Hospital.
The City Manager submitted a report to Council relative to excess right of way of
the San Gabriel River Channel which indicated the Mayer Construction Company is
negotiating for purchase of excess right of way on the west side of the San Gabriel
River Channel from Los Angeles County Flood Control District. The District now feels
it has a fairly firm commitment to the Mayer Construction Company to sell this excess
right of way. The question is whether this strip of excess right of way, which varies
from 10' to 20' in width, is desirable for the City of Downey and if an issue should be
made of it at this time. This information was submitted to keep Council abreast of
this right-of-way question.
Council recommended that the official name of the heliport be the "Downey Municipal
Heliport."

and reasonable expenses to the Town Affiliation Association Meeting to be held in
Los Angeles November 30 to December 2, the first of its kind to be held in California.

Councilman Dickerson suggested that Council give thought to having an annual
Guadalajara Festival Day sometime during the summer to reactivate the Sister City
program. He stated he feels the City will have to take the initiative in doing some-
thing of this nature.
Mr. Dick Raabe, 10323 Birchdale, objected to certain assessments appearing on his
tax bill, namely the Downey Cemetery District, lighting district, 4 different water
taxes, and he requested that his name be removed from the tax roll of the Cemetery Dis-
trict, in particular.
Mr. Raabe also urged the Council to uphold the School District in its rejection
of using a certain "Freedoms" textbook in its classrooms.

The City Attorney announced a Public Utilities Commission hearing on the Grey Line
Tours for an increase in passenger rates for local passenger tours.
Chief Ivan A. Robinson announced the second graduation ceremony from the Los Angeles
County Sheriff's Academy for seven recruits at 10:30 A.M. Friday and invited anyone who
could, to attend. The ceremony is to be held at the Los Angeles County Hall of Adminis-
tration.
Mayor Corbin requested an investigation of street signing on LaReina from Florence
Avenue to Seventh Street. Chief Robinson advised he would check the signing and station
radar equipment in this area.
It was requested that all building plans be cleared through the Building Department
before being submitted to Council for approval.
