PRESENT: Councilmen: Morton, Dunnum, Temple, Dickerson, Corbin ALSO PRESENT: Oren L. King, City Manager Carl Newton, Acting City Attorney William Goggin, Director of Planning James Ruth, Park Director Robert Shand, Director of Finance Ervin Spindel, Director of Public Works Ivan A. Robinson, Chief of Police Robert Gain, Fire Chief Walter Wanke, Water Superintendent Ray Lake, Director of Building and Safety Lee Leavitt, City Engineer Don Robison, Assistant to the City Manager Ruth Miller, City Librarian Della Doyle, City Clerk Alberta Pfeiffer, Deputy City Clerk Councilman Scott Temple delivered the invocation in the absence of the regularly scheduled minister. Mayor Corbin opened the hearing on the appeal to conditions set on approval of Zone Exception #730 for establishment and maintenance of a 2 -story office building for, general, administrative and professional office use at 10901 Paramount Boulevard, Downey, The City Clerk reported she had the affidavit of publication of notice of hearing and that there were no written comments or protests received on Zone Exception #730 appeal. William -Goggin, Director of Planning, gave a resume of the zone exception case. Speaking in favor of the appeal was Mr. William P. Wilson, 10833 Downey Avenue, who also called upon Bill Haynes, the architect, to describe the signs proposed for the building in question. Mr. Wilson requested Council to allow the installation of two signs, thus modifying'Condition #2 which allows only one sign on the front of the building, and that Condition #9 be deleted, requiring a.masonry type wall on the westerly prpperty line and Condition #11 deleted or revised relative to an assessment district for improvement of the alley at the rear of the property. When called upon for comment relative to ingress and egress to the parking area, should a wall be required, P&lice Chief Ivan Robinson remarked that it would constitute a hazard any time a wall is placed to the property line. Bill Haynes, the architect for the proposed building in Zone Exception #730, stated that, from a beauty aspect, he prefers there be no wall. He compared the wall to land- scaping adjacent to the building, looking through to the building from the parking lot. There was no one else speaking for or against the appeal to Zone Exception #730. It was moved by Councilman Temple, seconded by Councilman Dickerson and passed by the following vote that the hearing on the appeal to Zone Exception #730 be closed. AYES: 5 Councilmen: Morton, Dunnum, Temple, Dickerson, Corbin NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Council Minutes - 8/22/67 -1- 2051 It was moved by Councilman Dunnum and seconded by Councilman Temple to refer Zone Exception #730 to the Planning Commission for recommendation of the openings in wall, height of the fence and a study of the flow of traffic in the area. In effect, the motion stated above would grant the appeal and reconsider in- stallation of a masonry wall with the possibility of having one opening in the fence to allow ingress and egress from the alley. Councilman Morton remarked he was opposed to Condition #11 as depriving the property owner of objecting to an assessment district for improvement of the alley. The motion was further clarified that Condition #2 would be modified to allow installation of two signs as requested by Mr. Wilson, Item #11 to be deleted and Condition #9 to be referred to the Planning Commission for study and report as to the type, height and modification to leave an opening for ingress and egress to the alley, with also a study being made of the traffic flow in this alley way. After further discussion on the various conditions imposed and the condition of the alley, Mayor Corbin called for the vote on the motion. Motion failed by the following vote: AYES: 2 Councilmen: Dunnum, Temple NOES: 3 Councilmen: Morton, Dickerson, Corbin It was then moved by Councilman Dickerson to grant the appeal to Zone Exception #730, deleting Condition #11, Condition #2 being modified to allow installation of two signs as shown on plot plan and elevation; deletion of the requirement of a masonry wall on the westerly property line and referred to the Planning Commission for report. Councilman Morton suggested a recess in order that the Planning Director might discuss these modifications with Mr. Wilson and the architect; however, Mayor Corbin directed Council to hear from Mr. Dick Engle of the Pop Warner Football, Inc. relative to their Tenth Annual King Football Conference "Grand Opening" September 16, 1967, at 9:00 A.M. to 7:00 P.M. Mr. Engle requested Council action stipulatingwho will be responsible for the cost for police officers who will be in charge of crowd control. Police Chief Ivan Robinson advised Council that when officers are authorized for this type of protection, their pension and retirement must be protected by authorization of the hourly rate of overtime pay which is then placed in the General Fund. The Department of Parks and Recreation Director, James Ruth, advised that the cost could be appropriated from their budget. Council was invited by Mr. Engle to participate in the Pop Warner football program and stated that tickets will be available through the City Manager's office. Mayor Corbin declared a 5 -minute recess with Council reconvening at 9:20 A.M. with roll call, all members of Council being present. Bill Goggin stated it would be agreeable to property owner appealing Zone Ex- ception #730 to landscape the first parking stall with possibly a 2' strip which would encroach into the parking stall but would not prohibit use of the parking stall, and that property owner would, at his convenience, develop any further land- scaping as possible. Councilman Dickerson amended his motion to include landscaping of the first ^ two parking stalls, with trees approved by the City, with trees also being planted between the other spaces, working with City forces in this regard, and that other landscaping which could be worked out, subject to the approval of the City Forester, be added. Councilman Morton seconded Councilman Dickerson's motion as amended and it passed by the following vote: AYES: 5 Councilmen: Morton, Dunnum, Temple, Dickerson, Corbin NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Council Minutes - 8/22/67 -2- 2952 Councilman Dunnum remarked there was still the question of recommendations from the Planning Commission as to the flow of traffic in the alley and alley improvements. Council Morton inquired of the Planning Director and was informed that the Planning Commission will include a discussion relative to the improvement of the alley in its recommendations back to the Council on Zone Exception #730. The matter of the proposed increase in refuse collection rates throughout the City '~ was reopened for comments from the public. No one responded opposing the proposed rates. Mr. Larry Chaney, Chairman of the Sanitation Committee briefly reviewed their recommendation favoring the increase in rates. Councilman Dunnum stated she had received a number of calls, objecting not to the rate increase but to the condition in which the drivers leave the trash containers and she requested that they be more careful in handling these containers. Mr. Megargee of Rio Hondo Disposal Company stated they do stress upon their drivers to be careful in the handling of trash contain-ers. He also stated that property owners could assist by not forcing too much refuse into the containers, thereby making it necessary to use force in emptying -them, 'It was moved by Councilman Temple, seconded by Councilman Dickerson and passed by the following vote to approve recommendations of the Sanitation Committee relative to rate changes amounting to 25G per quarter. City Clerk Della Doyle reported on the correspondence received after Council agenda envelopes had been transmitted. A damage claim from Residential Mutual Insurance Company. It was moved by Councilman Dunnum, seconded by Councilman Temple and passed by the following vote that the claim from Residential Mutual Insurance Company be denied and referred to the City's insurance carrier. Fisher relative to unsightly parking of vehicles at the Shell Oil Station at Downey Avenue and Stewart and Gray Road, requesting that no outside repair or parking of trucks be allowed at se.rvice.stations. It was moved by Councilman Temple, seconded by Councilman Dickerson and passed by ,the following vote to refer Mr. Fisher's request to the Planning Commission. Unbudgeted Miscellaneous Paveouts AYES: 5 Councilmen: Morton, Dunnum, Temple, Dickerson, Corbin NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None It was reported by Mr. Spindel that as requested by the City Council at its July 25 meeting, an investigation was made as to the cost to the City for paving of residential area streets. In cases of existing paving which will have to be recon- structed if paveouts are to be considered, and as a result of the reconstruction, the total cost is estimated to be $2,000,000.00. Estimated cost to complete those areas where curb and gutter now exist and paving is required is $250,000,00. This cost would include reconstruction of many portions where existing pavement has not been built to the proper structural section or grade and is included in the $2,000,000.00 construction cost estimated above. Councilman Temple recommended further study on this matter. It was reported that numerous complaints have been received regarding stagnant water in the drainage channel in the vicinity of Downey -Sanford Bridge Road and Lubec Street, and also on the service road east side of Woodruff Avenue southerly of Ratliffe Street, These areas have been investigated and it has been determined that a possible solution for this problem would be the construction of dry wells at these two locations. The estimated cost of two dry wells is $2,500,00. This acquisition is for slope easements. It is necessary to have the City's approval and no cost is involved to the City. It was moved by Councilman Dickerson, seconded by Councilman Temple and passed by the following vote to authorize acquisition of right of way on the San Gabriel River as recommended. In addition to the Cities of Redondo Beach, Santa Fe Springs and Whittier, Ruth Miller, City Librarian reported the Cities of Arcadia, Glendora, Palos Verdes and Santa Monica were taking action for immediate affiliation. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY, CALIFORNIA' AUTHORIZING THE LIBRARIAN OF THE DOWNEY CITY LIBRARY, ON BEHALF OF THE CITY OF DOWNEY AND THE DOWNEY CITY LIBRARY, TO MAKE APPLICATION TO THE CALIFORNIA STATE LIBRARIAN AND TO THE SAN GABRIEL VALLEY LIBRARY SYSTEM TO PERMIT THE DOWNEY CITY LIBRARY TO BECOME A PART OF •--� SUCH SYSTEM; AND APPROVING AND ADOPTING THE PIAN OF SERVICE OF SAID SAN GABRIEL VALLEY LIBRARY SYSTEM The resolution was read by title only. Councilman Morton, as previously stated, remarked that this is another step in the direction of a regional type government; he thinks the present library is adequate for the purposes of the City of Downey; there has never been one complaint other than noise. The City's library has the ability to obtain from any Council Minutes - 8/22/67 -8- other library in the area, books and materials for reference purposes and he does not care what anyone says --taking money from Federal, State or County comes down to the fact that someone must pay for it. It is mentioned that taxes should be reduced and on the other hand, they are being raised. The City of Downey believes and supports home rule and "pay as you go". King reported brochures have been prepared for presentation to the Local Agency Formation Commission at 9:00 a.m., Wednesday, August 23, relative to the hearing on the detachment of the Southeast Recreation and Park District within the City of Downey and that it was hoped the Mayor and members of the City Council, as well as some of the members of the Park and Recreation Commission, will be able to atterd this hearing. The City Manager and Director of Parks and Recreation will provide transportation, leaving City Hall at 8:00 A.M. The City Manager again reminded Council to adjourn to noon, September 6, 1967, for bid opening review for Downey Community Hospital bowls. Many years have been spent in an endeavor to clarify the 20' buffer strip adjacent to the Chrysler Corporation from the Santa Ana Freeway to Telegraph Road, reported Mr. Oren King. Previous owners have agreed to deed this property to the property owners, provided the City will approve it. The City Attorney and Planning Commission have advised that this is the best way to clarify the situation and that the cost will be approximately $680.00 for title company expense. In order for the City to participate in the cost of this project in above amount, the City Attorney has advised it will be necessary for all the property owners to sign the parcel map. With Council approval, steps can be taken to proceed with obtaining signatures for the completion of the program. Councilwoman Dunnum requested that Council Minutes - 8/22/67 -9= 2959 Mrs. Boyd Williams, former Parks & Recreation Commissioner, be included in invitations to the dedication as she had worked with the Commission during the time this park was being developed. It was reported by the City Manager that the Water Board had approved entering into an Agreement between the Water Department and Goodyear Tire and Rubber Company for purchase of 400 acre feet of water in the Central Basin, This purchase is for water rights available in the Central Basin for the current water year, 10/1/66, to 9/30/67. It was felt by an officer of the Goodyear Company that the price of $14.00 per acre foot would be acceptable, the total price therefore being $5,600.00. The saving to the City Water Department would be a minimum of $6.00 per acre foot or $2,500.00. This savings represents the difference between the $40.00 paid to Metropolitan Water District for purchased water and the cost of $34.00, which figure includes the $14,00 purchase, together with a $20000 per acre foot pumping charge. Councilwoman Dunnum requested that a field trip be set up for review of the traffic problem on Golden Avenue. Councilman Morton presented a report on a trip to Camp Pendleton to observe field maneuvers of the Second Battalion of the Fourth Marine Division, William B. Cole, General Manager of Downey Chamber of Commerce, thanked Council for the position which it took relative to the library and offered general remarks relative to various other Council actions. Mr. Cole also reported that the sum of $2,500,00 is on hand to be put into use at such time as a mall area shall be developed which is to include a fountain. Council Minutes - 8/22/67 -10 Council expressed its desire to be informed what the Chamber is doing toward fostering business in Downey. Mr. Spindel reported construction on Florence Avenue and Paramount Boulevard toward re -surfacing is starting today and will somewhat obstruct traffic. Two lanes are required to be kept open during peak hours of traffic and it is hoped the project can be finished by September 1. Mr, Goggin reported that the Zoning Guide has been updated and copies are now available. Chief Gain thanked Council most sincerely for approval of expansion of the Fire Department Administrative offices.
