MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
AUGUST 14, 1967
The City Council of the City of Downey held a regular meeting at 7:30 P.M. on
August 14, 1967, in the Council Chamber of the Downey City Hall, Mayor Ben 'd Corbin
presiding,

Reverend Mark Gress of Downey Methodist Church delivered the invocation.
Mayor Corbin called upon Ivan Robinson, Chief of Police for a special presentation.
Chief Robinson reported that the presentation is another "first" for the City of
Downey as it is the first award to a young man who exerted outstanding. courage in the
face of very definite danger and a threat in order to assist law enforcement as witness(
to a theft last April 21, 1967° The 14 -year old Danny Robert Peel was seated in an
automobile in a lot, observed threat of a theft, was then himself threatened; however,
he proceeded to report to the Police Department, subsequently identified the suspects
and they were arrested. This act showed fine citizenship.
Mayor_Corbin advised that Mr, James Dalton, Vice President of the U. S. National
Bank at Third and Downey also had a presentation to make. Chief Robinson called forward
the investigating officer, Dennis Welser, who made the recommendation for this presentation.
It was stated by Chief Robinson that the U. S. National.Bank-approximately a year ago
began a program known as "Operation Helping Hand". Mr. Dalton presented a Certificate of
Award and a $100 U. S. Savings Bond to Danny Peel which award is made for providing unusual
assistance for aiding an officer.
Councilman Dunnum thanked the young man for setting a wonderful example, not only
for youngsters but for the oldsters throughout the nation.
Councilman Dickerson informed Danny he was a rather outstanding young man who dis-
played this type of service to his community --there are too few persons assisting under
similar circumstances.
Councilman Temple added his comment that Danny's actionsr were very commendable.
Councilman Morton stated it was wonderful that a young person would take the time to
be concerned about the property of others and that he thinks Danny typifies the average
person in the City. He is proud to have such a citizen in Downey,
.—, Mayor Corbin congratulated the parents of Danny Peel, stating there are too many
parents who ignore children and proper bringing up of them.
Mayor Corbin opened the hearing on the appeal to Zone Exception #728, Clayton, and
inquired if the City Clerk had the Affidavit of Publication of Notice of Hearing. City
Clerk Della Doyle replied she had the affidavit.. It was ordered received and filed.
The City Clerk reported receipt of one protest letter from Mr. John P. Mahlstede, Jr.
and Mrs. Marjorie S. Mahlstede, b f 11507 Norlain Avenue. It was ordered received and
filed.

Bill.Goggin, Director of Planning, presented a resume of the zone exception case.
#728 for establishment of a cocktail lounge which the Planning Commission -had denied.
No one came forward to speak in favor of the appeal to Zone Exception #728 when
called upon by Mayor Corbin.
Speaking in opposition to the appeal was Mrs. M. A. Bahme, 7502 Phlox, at the south-
east corner of Norlain. Mrs. Bahme objected to the close proximity of the proposed
-_,cocktail lounge to residences in the area and schools. There was no one else wishing to
speak.
It.was moved by Councilman Temple, seconded by Councilman Morton and so ordered
that the, hearing on Zone Exception #728 be closed.
It was moved by Councilman Temple, seconded by Councilman Dunnum .and'pa.ss;ed by the
following vote that the appeal to Zone Exception #728, Paul B. Clayton, be denied and
the decision of the Planning Commission upheld denying the zone exception to establish a
cocktail lounge at the southeast corner of Burns Avenue and Old River School Road.

Mayor Corbin opened the hearing on the intention to vacate a water pipeline, Second
and Third Streets on LaReina. The Mayor inquired'of the City Clerk if she had the
Affidavit of Publication, and Posting. City Clerk Della Doyle replied she had the
affidavits and they were ordered received and filed.
Mayor Corbin turned the Chair over to Mayor Pro Tempore Priscilla Dunnum.
There being no oral and no written comments or protests, it was moved by Councilman
Morton, seconded by Councilman Dickerson and passed by the following vote that the hearing
on the intention to vacate a water pipeline, on LaReina Street between Second and Third
Streets, be closed.

RESOLUTION NO. 1951
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING
VACATION OF EASEMENTS FOR WATER PIPELINES AND INCIDENTAL PURPOSES
OVER PROPERTY LYING WESTERLY OF LA REINA AVENUE BETWEEN SECOND
STREET AND THIRD STREET

The Mayor resumed the Chair.

that the minutes of the regular morning meeting of July 25 and the regular adjourned
meeting of the afternoon of July 25, 1967, plus the regular adjourned meeting of August 3,
1967, be approved as submitted.
The City Clerk presented the following written correspondence:
A letter from Mrs. Ruth T. Loud requesting removal of recently installed stop signs
at Fairford and Mueller (sic). Mrs. Loud verbally requested a meeting with the Traffic
Committee and the residents in the Fairford area. It was recommended by Councilman Morton
that a meeting with the traffic Committee, Mr. King, Mayor Corbin and himself be arranged
with these residents and scheduled after the opening of school.

A letter of thanks from the Division of Highways, State Highway Engineer J. A. Legarra,
for acknowledgment of the City of Downey of his appointment to this post. Received and
filed.
A letter from City Attorney William A. Sorensen, relative to SB556 concerning a
cigarette tax which has been adopted and signed by the Governor. The City Attorney
informed Council that if the City of Downey wishes to participate in the State Cigarette
Tax Revenue, the City's cigarette tax will have its effect nullified as of October 1.
Thus, an ordinance should be adopted to this effect prior to September 1.
Councilman Morton suggested reaffirming that the money obtained from the cigarette
tax be allocated for civic development.

THE PROVISIONS OF SECTIONS 6140 THROUGH 6153 OF THE DOWNEY MUNICIPAL
CODE WHICH SAID SECTIONS RELATE TO THE CIGARETTE TAX

It was moved by Councilman Morton, seconded by Councilman Dickerson and so ordered
to reaffirm the position of the City Council that money received from the cigarette tax
be set aside for civic development purposes.
A letter of appeal from Gallatin Medical Group, 10729 S. Paramount Boulevard, to
Zone Exception #731. It was moved by Councilman Temple, seconded by Councilman Dickerson
and so ordered to set a hearing for 7:30 P.M., September 11, 1967, in the Council Chamber
of the Downey City Hall.
A letter from Governor Ronald Reagan relative to "Salute to City and County
Government" program. Received and filed.
Copy of letter directed by the Mayor to Governor Ronald Reagan relative to support
of various legislation. Ordered filed.
Communication from Los Angeles County Road Department indicating an increase in the
amount previously approved for highways through cities from $100,000.00 to $200,000.00
for improvements on Downey Avenue (SS #119). Received and filed.
Complaint for damages from Mary A. Shanahan. It was moved by Councilman Temple,
seconded by Councilman Dickerson and passed by the following vote to deny the claim and
refer to the City's insurance carrier.

A letter from Larry R. Chaney, Chairman of the Citizens Sanitation Committee,
relative to refuse collection rate changes. Mr. Chaney stated he would like to have
the Committee's recommendations approved by Council.
Councilman Morton suggested as the citizens have not been apprised' of this rate
change proposed, they should be given an opportunity to appear for comments if they so
desire.
It was moved by Councilman Morton, seconded by Councilman Temple and so ordered to
take the matter of proposed refuse collection rate changes under submission until the
next meeting on August 22, 1967.

The City Attorney advised he had reviewed a proposed Joint Powers Agreement between
the City of Downey and Los Angeles County for Bryan McCloud, Sydney, Australia, to be
cared for by Rancho Los Amigos Hospital. The hospital has certain limitations and hereto-
fore have cared for local residents only. Money has been raised by the Lions Club of
Dy, Australia; a guarantee of credit has been submitted to Bank of America. The City's
obligation will be limited to the availability of the funds under the guarantee of credit
and would end when the funds are down to $5,000.00. The City Attorney stated the General
Counsel of the County of Los Angeles has not approved the agreement as it requires that
the City be responsible for the trust fund to be set up for Bryan McCloud's care at
Rancho Los Amigos. He recommended that the trust fund be limited to withdrawals therefrom
on the City's approval.
Councilman Dunnum moved for approval of the Joint Powers Agreement. After much dis-
cussion Mr. Martin, member of the Downey Lions Club, requested written instructions as
to what can be done or how to proceed as the boy is in a critical condition and already
has been.in.this area for three weeks.
Councilman Morton cited Section 900, Article IX of the City Charter which states
the City Council, in its judgment.if required, can designate boards or commissions. He
recommended setting up the members of the Lions Club who had been designated to sign checks
on subject trust fund, :as the official board to operate such fund.
Robert Shand, Director of Finance, advised Council that there are at least four City
employees who are members of the Lions Club who might possibly be designated as the Board
to administer the Trust Fund for Bryan McCloud.
Councilman Temple seconded Mrs. Dunnum's motion to complete the Joint Powers Agree-
ment between the County of Los Angeles and City of Downey relative to the care of Bryan
McCloud at Rancho Los Amigos Hospital and authorize the Mayor to sign the agreement.

A letter from Atlantic Richfield Company relative to a damage claim as a result of
their vibroseis survey. Received and filed.
A letter from KFOX relative to City Public Service broadcasts, Received and
A memorandum from James D. Ruth, Director of Recreation and Park Department relative
to the new requirement for this department's employees' examination yearly for tuberculosis.

A letter from the First Church of the Nazarene, 8456 East Second Street, informing
the City they will not accept its offer for purchase of the church property. Ordered

Mr. King stated that the plans for the additions for Finance and Police Departments
will be presented at the next meeting if desired by Council.
A petition from residents on Castana Street requesting stop signs on Castana at
Reydon, a crosswalk at the same location; a crosswalk on Golden Avenue at Castana, a
boulevard stop and crosswalk at Castana and Deming..
Mr. Spindel reported that a double centerline will be installed, more speed signs,
and the requests contained in the petition considered by the Traffic Committee,
Councilman Dunnum requested a field trip be made by Council before the meeting of
August 22, 1967.

Mr. Spindel gave a report on sewage odors reported by residents in the area of
Horley Street northerly of Gainford. He stated that the fact that outfall sewer into
which the local sewers discharge is overloaded and during the day causes a backup effect
in the local sewers which, in turn, causes deposition of solids and grease, becoming
septic. This has been called to the attention of the Los Angeles Sanitation District,--
and
istrictsand they are taking steps to alleviate the overloaded condition in the outfall sewer. The
City°s maintenance crews have conducted extensive cleaning operations on the local sewers
in this area and have applied chemical admixtures to the sewers in order to eliminate the
odors. Mr. Spindel stated these measures have abated the odor nuisance and periodic
application of the chemicals in order that the odor may be controlled will be continued.
Councilman Dickerson wished the Director of Public Works to contact the Los Angeles
Sanitation District to determine when the steps will be taken by them to alleviate the
overloaded condition in the outfall sewer, as stated.
Mr. Goggin presented a detailed report relative to regulations and standards for
construction and re -development of service stations required by other local jurisdictions,
and suggestions for development of standards which would create a higher quality of service
station development in the City of Downey, It was recommended that an emergency ordinance
be adopted to include a requirement for a conditional use permit by the Planning Com-
mission, Mr. Goggin also reported that a policy statement had been prepared for submission
to the Planning Commission for their consideration.
Councilman Temple stated most major compapies should not object to improving of
service station development to make them more appealing.

Councilman Dunnum stated she does not feel the matter warrants an emergency ordinance
and it appears the purpose of the ordinance is primarily for beautification. She inquired
what would prevent the City from requiring any other type of business to be upgraded.
Mr. Frank Beckner objected to the time spent by the Planning Department on studying
the service station development and wants to see more 'diligent study of the master plan.
Councilman Dunnum requested that the City Manager review the minutes for the schedule
,^ for review and priority list for studying the master plan.
Councilman Dunnum moved that the matter of setting standards for construction and
re -development of service stations be taken under submission. The motion died for lack
of a second.
Councilman Morton reviewed that fact that this matter of service station development
in the City had arisen initially at his request as a matter of study. Downey is not
holding to the minimum acceptable standards of business endeavors which are taking over
some of the key corners in the City. The report verifies what he had suspected --the fact
that Downey claims to be a quality community and yet when they get down to the point of
maintaining quality standards, are reluctant to do it. Everything this City has been
doing is to establish controls so that the community will maintain the proper residential
aspect. The biggest eyesore in the City is the gas station.
Councilman Dunnum stated there might also be other businesses which may need upgrad-
ing and suggested possibly an ordinance and criteria whereby certain blighted areas
could be declared nuisances with proper notices given to property owners, and if after a
certain time, these areas were not cleaned up, repainted, etc., that the City do it with
assessment to the property owner and that this would be without any class legislation
against any kind of business.
Mr. Goggin reported studies are being made of billboards, signs, but that the biggest
blight in the City is at the four corners --the intersections of the City.
�. Councilman Morton stated thatfrur years ago he had initiated the same plan and had
submitted a model ordinance dealing with store fronts, certain buildings from a city in
New Jersey, He stated there should be uniformity throughout the entire City and the City
must work at all times toward maintaining values. Councilman Morton stated that what
Mrs. Dunnum had suggested should be the ultimate objective of the City Council.
Coundlman Dunnum moved that the matter be taken under study for the purpose of
establishing criteria for any blight areas to be restored by the property owners and,

City Attorney Sorensen stated that legally a service station development can be
handled under a conditional use permit. To set up an ordinance to determine certain
blight areas and where there must be reconstruction or re -servicing in some manner, might
present some problems. There are certain performance standards for construction of any
kind of building, remodeling, repairing and these standards will take effect, but perhaps
there could come about a blight area ordinance requiring someone to paint a house. The
City Attorney stated he would like the opportunity to give it further study.

The Planning Commission shall make studies and formulate a recommendation relative
to amending the zoning ordinance requiring standardsofdevelopment_for_service stations.
This would serve to remove all zone exceptions and conditional use permits.
It was hoped that this could be done as soon as possible to do away with the zone
exceptions and conditional use permits to a business coming into Downey will know just
what it can have.
Mr. King reviewed a request made by the D and H Construction Company for a revision
of Tentative Tract #26653 to alter Pernell Street from a 60' to a 56' street with 2' on
each side for parkway. Mr. Goggin stated the request has had the approval of Fire, Police,
Public Works, Planning Departments and the Department of Building and Safety.
Mr. D'Alessandro was having difficulty in developing the property because of an R-2 zone
that faces Stewart and Gray Road. With the limited amount of traffic expected in these
streets in the tract,the 36' street would be acceptable, curb to curb width, maintaining
2' parkways with 4 foot sidewalks.

The City Attorney stated that as an emergency ordinance requires a 4/5 vote, the
motion to adopt failed; however, it could qualify as a first reading of the ordinance,
subject to the review by the City Attorney as to whether or not the abstention counts
as a "yes" vote and, if so, a second reading then will not be necessary.
A summary of activities and plan of service adopted by the San Gabriel Valley
Library System, composed of the Cities of Pasadena, South Pasadena, Altadena, Monrovia and
Sierra Madre, had been presented to Council. Addition of new libraries within the Los
Angeles County to the system is being invited at this time and such action on the part of
the City of Downey is recommended by the Downey City Library Advisory Board and the City
Librarian, with the belief that affiliation of the library with the other libraries in
the area will implement and enlarge the library services at no additional costo Joining
this system would supplement the number of books and the quality of service, according to
the City.Librarian, Ruth Miller, A further report was requested by Council to be presented

It was reported by the City Manager that the forestry crew removed a camphor tree
at 9030 Irwingrove Drive which had created a water problem through raising the gutter
at this location, and that there are 13 other camphor trees along this same street
which it is recommended be removed so that all the damaged curb can be repaired at
the same time. The City Manager was directed to arrange a field trip to the area
before contacting the property owners to proceed with removal of the memainder of these
trees.
A program of upgrading all radio communication equipment for the Police Department
was submitted as much of the equipment, including the base stations and console, is
obsolete, The Motorola Corp. submitted a figure of $30,510,91 for this upgrading in
order to bring all of the police communications equipment up to the latest standards
which it is believed is necessary at this time.

bids at 4:00 o'clock, authorize issuance of bonds and contract.

Mr. King reported that the Trenery Building is being set up for quarters for the
contractor for the hospital and the City's architects and building consultant.
Councilman Morton brought Council up to'date on the Vietnam Memorial Fund.
Councilman Dickerson reported on the Sister City Conference which he had attended,
Mr. William Cole, General Manager of the Downey Chamber of Commerce commented on
the legislation on cigarette tax, action taken by Council on service station development
and the proposed affiliation of the Downey Library with the San Gabriel Vallyy Library
System,
Mr. Norman Woodruff, 9103-E. Raviller Drive, Downey, protested the payment of a
$3.50 building permit fee 'for replacement of a broken water closet in his home, and
requested a study be made of this portion of the City Ordinance.
Mr. Ray Lake, Director of Building and Safety, advised Council and Mr. Woodruff
that the fee is standard procedure throughout the Western states and quoted from
Sections 1,.8and 1.13 of the Uniform Building Code.
Mr Wendell Wiser, 11215 Woodruff Avenue, thanked Council for awarding contract for
new seating for the Council Chamber. Mr. Wiser then stated that he would like to see a
civic auditorium built in Furman Park on land at no cost to the City,.rather than having
it ,placed across the street from the City Hall
The City Attorney reported on the litigation of Mocabee vs. City of Downey relative
to-adquisition of right of way for Third Street. He stated the matter can be settled
by paying $5,000.00 and he recommended this settlement as being legally correct and
practical.

following vote to approve settlement of the Mocabee litigation as recommended by the
City Attorney by payment ,of $5,000.00.

The City Attorney also reported on condemnation proceedings on Patton Road (DiMateo
property). This matter can be settled in the amount of $58,600.00 which is within the
range of the appraisal. It was the City Attorney's recommendation that this matter be
settled, paying the $58,600.00, and the City to install curb, gutters, etc., not to fall
under Chapter 27 proceedings.
