HomeMy WebLinkAboutMinutes-09-11-67-Regular Meeting2964 MINUTES OF THE CITY COUNCIL OF THE CITY OF DOWNEY SEPTEMBER 11, 1967 The City Council of the City of Downey held a regular meeting at 7:30 P.M. on September 112 1967, in the Council Chamber of the Downey City Hall, Mayor Ben 'd Corbin presiding. PRESENT: Councilmen: Morton, Dunnum, Temple, Dickerson, Corbin ALSO PRESENT: Oren L. King, City Manager Royal M. Sorensen, City Attorney Robert Shand, Director of Finance James Ruth, Director of Parks & Recreation William Goggin, Director of Planning Ervin Spindel, Director of Public Works Lee Leavitt, City Engineer Don Warren, Deputy Fire Chief Ivan A. Robinson, Chief of Police Walter Wanke, Water Superintendent Don Robison, Assistant to the City Manager Della Doyle, City Clerk Alberta Pfeiffer, Deputy City Clerk Councilman Thomas H. Morton delivered the invocation in the absence of the scheduled minister. Mayor Corbin announced the hearing on Zone Exception #731, and the Director of Planning reported there had been discussions held with the applicant and his attorneys with some counter proposals being made for a different type of development extending possibly to the next 5 years. Applicant had requested that the hearing be continued' to the next meeting for discussion with the doctors in the Gallatin Medical Group# and due to the fact that the attorney representing applicant was out of town and not able to attend the hearing set for this date. Mayor Corbin opened the hearing and inquired of the City Clerk if she had the Affidavit of Publication of Notice of Hearing. City Clerk Della Doyle replied she had the affidavit and it was ordered received and filed. It was moved by Councilman Temple, seconded by Councilman Dickerson and passed by the following vote that the hearing on Zone Exception #731, Gallatin Medical Group, be continued to 7:30 P.M,, October 9, 1967, in the Council Chamber of the Downey City Hall. AYES: 5 Councilmen: Morton, Dunnum, Temple, Dickerson, Corbin NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Mayor Corbin opened the hearing on the Resolution of Intention for vacation of a portion of the alley located between Manzanar Avenue and Brookshire Avenue, south- westerly of Vista Del Rio Avenue. City Clerk Della Doyle reported she had the Affidavit of Publication and it was ordered received and filed. It was then report- ed by Mr. Spindel that the matter had been referred to the Planning Commission and they had recommended vacation of this area, and that the vacation would be subject to a reservation of easement for utility purposes. There being no written and no oral communications or protests: it was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered that the hearing on the Resolution of Intention for vacation of a portion of the alley located between Manzanar Avenue and Brookshire Avenue, southwesterly of Vista Del Rio Avenue, be closed. RESOLUTION NO. 1965 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING VACATION OF A PORTION OF THE ALLEY LOCATED BETWEEN MANZANAR AVENUE AND BROOKSHIRE AVENUE, SOUTH- WESTERLY OF VISTA DEL RIO AVENUE The resolution was read by title only. The City Clerk replied she had the affidavit and it was ordered received and filed. Mr. Spindel reported the matter had been submitted to the Planning Commission and they had recommended the vacation. There being no oral and no written comments or protests, it was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered that the hearing be closed. RESOLUTION NO. 1966 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING VACATION OF THAT PORTION OF TELEGRAPH ROAD, FORMERLY ANAHEIM TELEGRAPH ROAD The resolution was read by title only. It was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered that further reading be waived. It was moved by Councilman Dickerson, seconded by Councilman Temple and passed by the following vote that Resolution No. 1966 be adopted. AYES: 5 Councilmen: Morton, Dunnum, Temple, Dickerson, Corbin NOES: 0 Councilmen: None ABSENT: 0 Councilmen: Nome Mayor Corbin opened the hearing on Downey Improvement Project No. 564, 9416 Telegraph Road. Mr. Spindel reported that action is not now necessary as the property owner has given a deed for street right of way as approved by Council at its last meeting in exchange for improvements and $700.00 cash award. Work is now proceeding on this project and it is unnecessary to hold this hearing. It was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered that the minutes of the meetings of August 22 and September 6, 1967,E be approved as submitted. The City Clerk reported on the following correspondence: A letter and petition from Mr. & Mrs. James Santangelo, 8426 Dacosta in com- plaint of the condition of a swimming pool at 9953 Brookshire Avenue, together with copy of letter sent in reply from the City Manager. Ray Lake, Director of Building and Safety reported an investigation of the property had been made and all problems have been eliminated. A letter from Della H. Hurlbert relative to service stations was ordered received and filed. A letter from M. J. Gneier relative to sidewalk sales was ordered filed. A letter from Andrew Johnson, Vice President of Rockwell Music & Cigarette Vending Company relative to cigarette tax was ordered filed. Complaint for damages from D. L. Schreyer. It was moved by Councilman Temple, seconded by Councilman Dickerson and passed by the following vote that the claim be denied and referred to the City's insurance carrier. Bleamaster relative to lot split requirements. Council suggested the matter be referred to the Planning Commission. Mr. Goggin reported there had been considerable discussion with Mr. Bleamaster who wants the City to commit itself, however since no definite figures have been presented, the department does not know exactly what Mr. Bleamaster desires. Therefore, the City is not in a position to submit definite requirements. The matter was referred to the Planning Department. A letter from Assemblyman Bob Monagan relative to Assembly Joint Resolution No. 29. The matter was referred to the City Manager for further information. A letter of appreciation from Downey Board of Realtors for the City's contribu- tion to its "Now Downey is Ten" -- Progress --of the City program on August 16. A letter from -Steed Bros. Construction Co. requesting extension of time for their acceptance of proposal and time for entering into contract with the City for construction of the new hospital building. This extension had been authorized previously by Council for a period of approximately three weeks from this date. Ordered filed. A memo from the City Manager with attached resolutions;; information and sug- gested proclamations received from the Governor's office relative to designating the week of October 8 - 14 as City and County Government week. The matter was held for further study. RESOLUTION NO. 1967 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING ITS INTENTION TO VACATE A PORTION OF THE SERVICE ROAD LOCATED ALONG THE SOUTHERLY SIDE OF TELEGRAPH ROAD, AT THE SOUTHEASTERLY CORNER OF PASSONS BOULEVARD The resolution was read by title only. AYES: 5 Councilmen: Morton, Dunnum, Temple, Dickerson, Corbin NOES: 0 Councilmen: None ^ ABSENT: 0 Councilmen: None After summation of bids for Cash Contract No. 206, remodeling of the Mayor's Office, it was moved by Councilman Dickerson, seconded by Councilman Temple and passed by the following vote that the contract be awarded to Lee Construction Co. in the -lump sum price submitted in the bid proposal for a total of $5,364.00, and that all other bids be rejected. Gain, Fire Chief, to attend the Annual California League of City Employees' Associations Meeting in Berkeley, October 4 - 6, 1967, with reasonable expenses allowed. Mr. Shand stated a monthly report will be given. The procedure for administration of the fund has been approved by the City Attorney. Councilman Dickerson wished to thank Mr. Sorensen for all his work on this project. It was reported by the City Manager that the Southern California Chapter of the American Public Works Association is going to hold its quarterly meeting at the Los Amigos Country Club in Downey on Thursday, September 14 and Mr. Ervin Spindel, a member of the Chapter Executive Committee, extends an invitation to any of the City Council and the City Manager to attend this evening dinner if possible.. Council Minutes - 9111/67 -5- In response to a request by Council, City Manager Oren King stated the Director of Public Works reports that the County Sanitation District is working on the design of a relief sewer to relieve the overloaded conditions existing in the Tweedy Lane trunk sewer which has caused backwater conditions leading to unpleasant odors. It is anticipated that it will go to bid in October of this year. The sewer will extend from Firestone and Old River School Road up to Florence and Tweedy, and will eliminate the downstream conditions which have caused the overloading. The City's maintenance crews are engaged in preventative measures to keep the odors abated in the meantime. Mr. King reported that all actions necessary for the Hospital Authority have been taken to provide for construction of the Downey Community Hospital and that when the bonds have been sold, the contractor's signature will complete the final transaction for construction to begin on approximately the 2nd or 3rd of October. Mr. King reported that Turner Construction Company, contractor for the Bank of America Building -to be built by Louis Frahm, wishes to lease some of the buildings known as "Margaret Courts" for construction purposes, and a 50 x 150' lot for storage of equipment. It was recommended that they be granted a lease for one year, with the contractor being required to demolish Parcel No.s 1, 2, 3, 8, 9 and 10 and clean- ing the area at no extra cost to the City within 60 days, retaining Parcels 4, 5, 6 and 7. At the end of construction, in addition they would be required to demolish these remaining buildings and turn the property back to the City. Cost to the City, if the City demolished these buildings, would be $2700. It was moved by Councilman Dickerson, seconded by Councilman Temple and passed by the following vote to authorize the City Manager and City Attorney to prepare a contract with a "hold harmless" clause for the City for lease of Parcels 4, 5, 6 and 7 of Margaret Courts to the Turner Construction Co., with the stipulation that they demolish Parcels 1, 2, 3, 8, 9 and 10, cleaning the area at no cost to the City within 60 days, and that at the end of the construction period, the leased parcels also be demolished and turned back to the City. None ABSENT. 0 Councilmen* None Councilman Temple requested additional study on the parking problem back of the Warren High School on Gurley Avenue, Councilman Dickerson reminded Council of the dedication of Treasure Island Park, Sunday, September 24, at 2 PM and commended the Department of Parks and Recreation for their work on this project, Councilwoman Dunnum was informed by James Ruth, Director of Parks and Recreation that former member of the Parks & Recreation Commission, Mrs. Boyd E. Williams, had been included in the invitations and her name'will appear on the plaque to be presented. Councilmen Dunnum and Dick6rson complimented the Park Department on their fine music programs given in Furman Park during the summer. The City Attorney reported he had received a notice of a hearing to be held before the Public Utilities Commission for rate increase application by Greyline Tours. He stated it does not seem to affect the City of Downey or its citizens. Mr, Chester Knowles, 12711 Barlin Avenue, complainted of a roach "epidemic" in his neighborhood and requested Council to require cleaning up of the property. Mr. Ray Lake, Director of Building and Safety, reported the health problem had been verified and that the Department of Health was contacted to investigate the problem. Mr, Greenhall, Chief Sanitation officer from the San Antonio Health Center, had checked on the problem, the property has been sprayed several times, and it is reported there now is no serious problem. Council Minutes - 9/11/67 -6- 29'70 Councilwoman Dunnum suggested the matter be called to the attention of the land- owner who does not reside at the property in question. The City Manager reported there is a meeting of SCAG on September 29, from 9:15 a.m. to mid-afternoon, to be held at the Statler Hilton Hotel, and also a League Meeting for underground utilities to be held at the Hilton Hotel in San Francisco,_ September 29, which the City Manager, as a member of the Underground Utilities Committee, would like to attend if convenient.
