MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
JULY 25, 1967
The City Council of the City of Downey held a regular meeting at 8:00 A.M. on
July 25, 1967, in the Council Chamber of the Downey City Hall, Ben 'd Corbin presiding.

Councilman Thomas H. Morton delivered the invocation in the absepee of a regularly
scheduled minister.
Mayor Corbin opened the hearing for protests on the confirmation of the assessments
on weedabatement. Mr. Spindel stated this is an annual hearing for the assessments for
weed abatement, and that the charges carry over from one year to the next. Some work is
done before the start of the fiscal year and some after. There were no written protests
and no oral comments or protests received. It was recommended that City Council affirm
the assessments as shown in the Director of Public Works' official record in the amount
of $12,480.40 for all work performed between July 1, 1966, and June 30, 1967. This
represents 542 cleanings, with the average cost per cleaning, per lot, being slightly
lower than that experienced in previous years, according to Mr. Spindel.

Mayor Corbin deviated from the agenda to tante up the matter of infested trees
which have been petitioned for removal by property owners on Dunrobin Street.
Mr. Spindel reported that it is the opinion of the tree department that spraying
would relieve the aphid problem and stop the dripping. Property owners still wish
them removed.
It was stated by Mr. Spindel that it is the policy of the City not to remove a
tree unless absolutely necessary. These "mock orange" trees are considered a regular
desirable street tree. Ridding them of the aphids by spraying and with proper tris,-
ming, the department feels these trees would remain a proper tree.
Councilwoman Dunnum suggasted and recommended that each property owner be sent

Mr. Spindel added that removal of part of the trees would allow a diversified
planting which sometimes gives a better appearance and less chance for infestation.
Property owners requesting the removal of the trees and speaking on the matter
were the following:

It was moved by Councilman Dunnum and seconded by Councilman Dickerson to take
the matter under submission. Due to the fact that the property owners present at
the meeting wished removal of their trees, Councilwoman Dunnum withdrew her motion
and Councilman Dickerson, his second to the motion.
Mrs. Dunnum requested that the property owners voice their wishes as to removal
of their trees. Requesting removal were the following:
Mrs. Marie Rodgers, 12258 Dunrobin
Marion Warren, 12252 Dunrobin
Mrs. Marie A. Vukojevich, 12152 Dunrobin
Mrs. Adolphe Bourdaa, 12249 Dunrobin
Mrs. Alice Rives, 12246 Dunrobin, stated she has no tree, however, if a tree is
planted in the parkway in front of her home, she would prefer not to have one of the
mock orange trees.
It was moved by Councilman Dunnum, seconded by Councilman Temple and passed by
the following vote that the trees of those who have appeared at the meeting and stated
they want the trees removed, have them removed during the regular tree removal program.

It was moved by Councilman Dunnum, seconded by Councilman Dickerson and passed

owners and request they respond in writing as to what disposition they wish made of
the trees at their properties.

A request was made for a list of trees which are acceptable to plant in the park-
ways. The property owners present were informed to meet with Robert DeSio. City
Forester, and he could advise them on available trees and answer any of their questions.
City Clerk Della Doyle continued with other correspondence as follows:
A letter from the Downey Unified School District reporting the appointment of
Dr. James R. Harvey and Hadley F. Morrison as representatives of the City -School
Traffic Committee for the 1967-68 School Year. Ordered filed.
A letter from Downey Unified School District reporting that Mrs. Grace E. Horney
and Dr. Charles J. Unice had been elected representatives to the City -School
Recreational Development Committee for the 1967-68 School Year. Councilwoman Dunnum
inquired what the next meeting date would be of this committee and was informed they
will be meeting on August 22. Ordered received and filed.
A letter of commendation for Robert DeSio, City Forester --Senior Administrative
Assistant, Department of Public Works, from the Sanitation Committee for his energetic,
enthusiastic and material contribution to the development and growth of the Committee.
A letter from National Communications, Inc. requesting a franchise to give a
right of way over or under the City -owned streets and thoroughfares for communication
cables. Councilman Morton stated he would like a report on what the purpose of the
franchise would be and what streets would be involved. The matter was referred to
the Director of Public Works for report to Council.

Annual report of the Downey Civic Chorus was ordered received and filed.
A notice from the Local Agency Formation Commission of the hearing on August 23,
1967, relative to detachment from the City of Downey of the Southeast Recreation and
Park District. The City Manager stated he would attend this hearing as would others
who are able to do so, and that the Department of Parks and Recreation and the Parks
and Recreation Commission would be informed of the meeting..
A letter from Supervisor Frank G. Bonelli stating the Road Commissioner has
initiated a study of the widening of Imperial Highway over the San Gabriel River
which should becompleted in November. Ordered filed.
A copy of a letter from City Manager Oren L. King to the Southern California
Edison Company requesting they review the cost of installation of underground facili-
ties to replace existing overhead poles and conductors adjacent to the proposed new
Heliport site.
It was moved by Councilman Temple, seconded by Councilman Dickerson and passed
by the following vote to approve approximately $15,737.00 from Unappropriated
Reserves to Account No. 13758 General Fund for installation of facilities to replace
existing overheadpoles and conductors adjacent to the Heliport.

A request from Mr. Irvin Phelan, representative of the Downey Historical Society
to place a commemorative bronze plaque in concrete block foundation nearby the old
concrete post on the same foundation block originally set on the site approximately in
1908, for a 12 -Mile Post Monument, in front of an apartment house nearing completion
at 9931 Tweedy ;Lane, '1k blocks north of Florence Avetittte. Owner Harry Boand is paying
the expense of thisinstallationwith the exception of a" bronze tablet carrying
the wording. This cost will be approximately $150.00.
Councilman Morton inquired of the City Attorney of the wording "erected by the
City of Downey' in proposed ordinance for historical markers. The City Attorney
recommended that this phrase be changed to read "and erected under the authority of
the City of Downey."
It was moved by Councilman Dunnum, seconded by Councilman Temple and passed by
the following vote to authorize placing of the historical marker as recommended '
appropriate an amount not to exceed $200.00 from Unappropriated Reserves to Aecoaft'
No. 09100--331.10.

A letter from the City Attorney relative to pending legislation before the
Congress of the United States of an Interstate Taxation Act (H.R. 16491). If
passed, it appears as though it will limit very strictly the power of the state
and of the political subdivisions of the state to impose sales tax and other taxes
upon those engaged in interstate commerce.
It was moved by Councilman Morton,;seconded by Councilman Dunnum and so
ordered to refer this matter to the City tanager for contacting the City's congres-
sional representatives.
A notice of a Mexican Exposition to be held at the Anaheim Convention Center
July 21 - August 6. It was moved by Councilman Tempig, seconded by Councilman
Dickerson and passed by the following vote to authorize any councilman to attend
with reasonable expenses allowed.

It was moved by Councilman Temple, seconded by Councilman Dickerson and so
ordered to appoint Mr.. James Odle, 12219 S. Caladre Avenue to the Sanitation Committee
and all other District #2 committee members be reappointed.
A letter of appreciation from the Downey City Employees Association was ordered
received and filed.
A letter from the D & H Construction Company, Inc. requesting an additional
60 -day extension to October 1, 1967, on the escrow for the Stewart and Gray property.
Mr. A. A. D'Alessandro introduced Mr. Hugh Temple, 144161 Hamlin, Van Nuys, who will
be working with him and it was stated by Mr. Temple that it looks very promising
that the financing can be obtained for construction.
It was moved by Councilman Dunnum, seconded by Councilman Temple and passed by
the following vote to grant the extension of 60 days from August 1 to October 2, 1967,
provided there is some consideration commencing as of August 1, that D & H Construction
Company, Inc. will pay to the City $50.00 per day with a $1,000 deposit toward that
per diem rate.

As bids for Cash Contract #195, Firestone Boulevard westerly of Brookshire
Avenue, water main, are considerably higher than the engineer's estimate and are
in excess of what it is felt the cost of the improvementwshould be, it was moved
by Councilman Morton, seconded by Councilman Temple and passed by the following vote
to reject all bids and include the work with the proposed extension of a 121
water main between Brookshire Avenue and Patton Road, -which is to be done in con-
junction with the water main extension for the Downey Community 'Hospital as
recommended by the Water Board.

A'report was submitted by the Director of Public Works on DIP #562 and DIP #563
regarding notices used with Chapter 27 proceedings as requested by Council at the
previous meeting.
Councilman Morton inquired of the City Attorney as to whether the City loses
jurisdiction upon allocations of County or State funds for streets. The City Attorney
reported that the use of Gas Tax Funds cannot lead down a path which would divest the
City of its jurisdiction over the streets. It is simply money allocated under certain
formulas. The mere fact that money has been used, does not give the State or County
any control. These funds are not State funds but funds that are actually collected and
allocated back to the cities. AB -2454 requiring that State Gas Tax Funds must be used
on Select System of Streets only and to their standards does not hinder the City from
deviating and using its own funds. In 1963, the_lo gas tax increase was not a State
tax but a. City tax to be collected and allocated back to the cities.
Council ordered preparation of resolution requesting funds through the County
highways through cities program for future capital improvements project to proceed
along Paramount Boulevard.

the following vote to authorize the Fire Department to develop plans and specifications
for Council review for acquisition of new fire pumper and authorize the Fire Department
and Purchasing Division to negotiate a 2 -year lease=purchase agreement with provision
for full payment on delivery, on or about July, 1968. Currently budgeted is $20,000.
The addition $20,000 to be budgeted to the General Fund #352-621 for the fiscal year
1968-69.

.•�, Councilwoman Dunnum asked to be excused at 9:55 A.M. Councilman Morton wished to
report, before Mrs. Dunnum left, that the Vietnam Memorial had been reviewed by the
Park Commission and had approved this. The program has developed a tremendous amount
of interest and some funds have already been received. Letters have been sent to
numerous organizations inquiring if they are interested in.supporting this memorial
program. Councilman Morton recommended that James Ruth be,authorizedto serve on
the committee and also requested any member of Council, as well as a representative from
the Chamber of Commerce, who would be interested, to serve on this committee to let
Councilman Dickerson know. Councilman Morton also stated that since it is a city-wide
matter having city-wide significance, the design proposed may be too small.
Coundlman Dickerson added that the plans are for dedication of the Vietnam
Memorial the first of September and that he is gratified to see that the program is
meeting with so much enthusiasm.
Council authorized James Ruth to serve on the Vietnam Memorial Committee.

Councilwoman Dunnum left the Council Meeting at 10:05 A.M.
It was reported that the Los Angeles Police Department had notified the City
that due to demands for their own personnel hiring, they will be unable to accept
Downey recruits in the present class. They are contemplating a change in training
procedure wherein recruits will be assigned to the academy for 4 weeks, back to the
agency for 4 weeks, return to the academy for 4 weeks' training, return to the agency
for 4 weeks of field work, then return for the final 4 weeks of training. This will

make the period of time between the start of training and graduation approximately
5 months. As a result, the continually improving recruit training program of the
Los Angeles County Sheriff's Department of 16 weeks' duration has been evaluated
and is found to be equal to the present Los Angeles Police Department program.
Sheriff Peter Pitchess has authorized the City's use of their facilities for training,
with the next recruit school starting Monday, July 24, one week prior to the Los
Angeles Police Department, and the sheriff has authorized on an emergency basis that
all the City of Downey's recruits presently cleared for hirin'U,, be enrolled.
Chief Robinson reported that the refusal of the Los Angeles Police Department
0 --ft to accept Downey recruits for training is only a one-time refu8al at this time;
their course is 12 we against the 16 of the Sheriff's Department. Itis found
to be equally balanced excepting the Sheriff's Department has a supplemental portion
in their training in the civil area, training their sheriff's to be bailiffs and
jailers. The courses are almost exactly the same at the present time and have been
improving the Sheriff's Academy constantly for the last 10 years. They probably will
be offered the use of both facilities at Downey's option.
In reply to the City Manager's question as to emergency calls to other agencies,
it was stated that the Sheriff's Department is the first to be called upon and that
it is on the list of mutual aid for police services with 10 area cities.
After discussion of the request to send all police recruits to the Los Angeles
County Sheriff's Training Center, effective immediately, at a reduced cost per
recruit,.it was suggested that this action not be taken at. -this time, awaiting further
developments at the Los Angeles Police Academy.

that the action of the Chief of Police in the training of new police officers in the
class which began Monday, July 24, at the Sheriff's Training Center, be ratified.
After summation.of bids for City Council seating, it was recommended that the bid
of the Heywood -Wakefield. Company be accepted at a. price of approximately $38.00 each
installed, with 11 seats: in the front row to include fold. away writing arms at $10.00
additional each. It was also recommended that Council authorize the purchase of 16
^ upholstered chairs, matching the others, for department heads and press, at a cost of
approximately $25.00 each. 'It is suggested that the end panels of the auditorium
seats be a combination of walnut«paneling, with the upholtering of Amerglo 636 Grotto,
or its equivalent. This is a teal -blue green with a gold badkgr.ound and should provide
a very durable upholstery which will not be soiled very eas=ily. Funds have been
previously appropriated for this expenditure and a purchase order will be issued for
the installation, upon Council approval. It is also understood that the old Council
seats will be removed at a cost,of 65p each, and will remain O-ty property to be made
available to any local organiz4fion desiring them.

The City Manager reported that the architects will be'ready to make their formal
recommendation to the Hospital Authority and the City Council at 4:00 P.M. this after-
noon, at which time a letter of confirmation may be authorized from the hospital
Authority, advising that the contract will be awarded on or before September 12, 1967,
the eeUsras.Construction Company (recommended by Albert C. Martin and Associates, tb-
Architect) in the amount of $3,886,426.0 0, subject to successful issuance of bonds.
Mr. King reported SB -982, which more definitely defines the procedures for the
purchase of ground, as.well as the building of structures, under the Joint Powers
Authority, has passed the Senate and has the unanimous approval of the Assembly
Committee for passage at an early date. This bill has the emergency clause, which
after signature of the Governor, becomes law immediately and will satisfy requirements
of the Title Insurance Company.

Mr. King suggested that Council might wish to adjourn the meeting to the afternoon,
should any Council action be necessary with regard to the hospital.
A brochure picturing entrance signs of other cities and proposed signs for three
locations for Downey was submitted to Council. Signs would cost approximately $600 each
to $700 each. The three locations suggested to initiate this program are Firestone
Boulevard at the easterly city limits;;{ Florence Avenue near the easterly city limits;
and Downey Avenue near the southerly city limits.
Councilman Dickerson stated he was of the opinion a field trip should be arranged
to view some of the other cities` entrance signs. After discussion it was moved by
Councilman Dickerson, seconded by Councilman Temple and so ordered that the matter be
taken under submission. The City Manager stated he will arrange for a field trip to
view other entrance signs in surrounding cities.
Councilman Dickerson informed Council that the Vultee organization will have
sufficient items to fill the Vultee Room at the proposed heliport building.

to authoutze preparation of plans and specifications and call for bids for the heliport
building, Cash Contract #71, Unit 2.
Councilman Temple inquired if the 2'k million dollar addition to Los Padrinos
Juvenile Hall will stay within its present confines. Mr. William Goggin, Director of
Planning, stated he was not aware of this expansion and that the County merely notifies
as a courtesy with the City of Downey having no contr.ol.over it.
Councilman Morton requested a study by the Traffic Committee on Brookshire Avenue,
just north of Firestone Boulevard. Persons traveling south on Brookshire just before
coming to Firestone intersection in the early and late evening are hindered by persons
parking on the west side, when adult school is in session at Downey High School
Traffic coming north on Brookshire are forced to make a.one-lane situation. People
going south wanting to turn left into the parking lot at the high school are thus
holding up the through traffic. Councilman Morton suggested there should be no parking
on the west side of Brookshire Avenue right on into the evening, after business hours,
r` so all the traffic is not held up going south.
Councilman Morton reviewed his suggestion that the possibility be studied for
additional fire station close to the proximity of the hospital area and urged that
it be done. He feels there is a need for a good study for an additional fire station
similar to the one on Florence Avenue and would like some recommendation on that. Fire
Chief Robert Gain stated reports on the study should be on the way to them as they
were completed and dispatched the night before.
Councilman Morton stated there should be some determination made soon with regard
to the two additions to the City Hall as evidently the matter of obtaining the
church property at Brookshire Avenue and Second Street had not been brought to fruition
and if this is not going to work out, then the other program should proceed.
The City Manager reported he would check again with the church and report at the
next Council Meeting.
Bill Cole, General Manager of the Downey Chamber of Commerce, reported that the
Stonewood merchants are quite enthused about the propm ed new entrance signs to Downey
as the old signs are in extreme need of repair.
Mr. Cole reported he will discuss the matter of serving on the Vietnam Memorial
Committee with President of the Board, Mr. Clifford Hiemforth, and assured Council
that the Chamber would have a representative to work on the committee.
Councilman Dickerson requested the Director of Public Works to study the problem
of the drainage ditch where new homes are being constructed on Downey and Sanford
Bridge Road with possible construction of a dry well to drain some of the water.
Mr. Spindel stated this would not handle storm water but that he will check on the
matter of whether or not a dry well might work for draining other water.
