HomeMy WebLinkAboutMinutes-07-10-67-Regular Meeting2924 MINUTES OF THE CITY COUNCIL OF THE CITY OF DOWNEY JULY 10, 1967 The City Council of the City of Downey held a regular meeting at 7:30 P.M. on July 10, 1967, in the Council Chamber of the Downey City Hall, Mayor Ben 'd Corbin presiding, PRESENT: Councilmen: Dunnum, Temple, Dickerson, Corbin ABSENT: Councilman: Morton ALSO PRESENT: Oren L. King, City Manager Royal M. Sorensen, City Attorney William Goggin, Director of Planning James Ruth, Director of Parks and Recreation Ervin Spindel, Director of Public Works Robert Shand, Director of Finance Lee Leavitt, City Engineer William Fritsche, Assistant Director of Bldg, & Safety Don Warren, Deputy Fire Chief Ivan A. Robinson, Chief of Police Walter Wanke, Water Superintendent Della Doyle, City Clerk Alberta Pfeiffer, Deputy City Clerk Reverend Ralph Irvine, Downey Baptist Temple, delivered the invocation. Mayor Corbin asked for the representative of the Downey Historical Society to come forward to make his presentation at this time. Mr, Irvin Phelan expressed the wishes of the Society in preserving the old Southern Pacific Railroad Depot, the oldest building presumably in the City of Downey. A painting of this building was displayed, Mr. Phelan then called upon Bob Boffman, President of the Downey Youth Historical Society, who requested assistance of the Council in furnishing a location to move the depot building to one of the parks within the City for possibly a future museum and meeting place for the Historical Society. The Youth Society feels they can raise the money to move the building. Council complimented Bob on his presentation. After discussion of cost of removal of the building, it was suggested by Councilwoman Dunnum that an exact miniature of the building be made, if moving the building proved to be unfeasible. It was moved by Councilman Dunnum, seconded by Councilman Dickerson and so ordered that the matter relative to the depot building be taken under submission for study. Other youthful members of the Downey Youth Historical Society were presented by Bob Boffman. Oren King, City Manager, then presented a plaque to Ervin Spindel, Director of Public Works, from the Metropolitan Transportation Engineering Board in Los Angeles commending him for his years of service and the past year as president, Mayor Corbin congratulated Mr. Spindel for his fine work on the committees repres- enting the MTEB, Mayor Corbin opened the hearing on the Resolution of Intention to Vacate a portion of Lexington Road and Brookshire Avenue and ingilired if the City Clerk had the Affidavit —^ of Publication, City Clerk Della Doyle replied she had the affidavit. It was moved by Councilman Dickerson, sem nded by Councilman Temple and so ordered that the Affidavit of Publication be received and filed. After submission of oral report by Mr. Spindel, Mr. Wendell Wiser, 71316 Seventh Street inquired if there was dedication on Brookshire Avenue made by the property owner, Mr. Spdndel informed Mr. Wiser that dedication was made to the standard width of 40' from the center line and that it was in exchange for improvements. It was moved by Councilman Dickerson, seconded by Councilman Temple and so ordered that further reading be waived. RESOLUTION N0, 1939 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING ANNEXATION OF CERTAIN AREAS TO THE DOWNEY CITY LIGHTING DISTRICT AND TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO THOSE STREET LIGHTING FIXTURES LOCATED ON THE STREETS AND PUBLIC PLACES WITHIN THOSE AREAS UNTIL JANUARY 31, 1983 (ANNEXATION E - ZONE 4) The resolution was read by title only. It was moved by Councilman Dunnum, seconded by Councilman Dickerson and so ordered that further reading be waived. City Clerk Della Doyle reported she had the affidavits. It was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered that the affidavits be received and filed, Mr. Spindel reported that the assessment distribution is based on benefits received and total costs resulting therefrom. As authorized by the Resolution of Intention No. 1828, there shall be a public contribution to this project out of the Gas Tax Fund. In addition, the road easement was acquired over that portion of land which is adjacent to 12050 Regentview Avenue in exchange for full improvements, as authorized by the Council on October 25, 1966, A portion of this Assessment No, 11, $315.00, is paid out of the Gas Tax Funds, but the remaining_ amount, $658.65, is ineligible for funding out of Gas Tax Funds and is therefore requested to be transferred Council Minutes - 7/19/ri7 -2- from Unappropriated General Fund Surplus to Account No, 14430, There being no oral and no;.�Iritten comments or protests, it was moved by Councilman Dickerson, seconded by Councilman Temple and so ordered that the hearing be closed. RESOLUTION N0, 1940 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY CONFIRMING THE ASSESSMENT FOR THE IMPROVEMENT OF WASHBURN ROAD (AD #95)� The resolution was read by title only. He also reported that the property owner of 7649 Firestone Boulevard expressed concern over alteration of his off-street parking due to installation of the required street improvements. A study was made of the problem and the solution appeared satisfactory to the property owner. There being no written and no oral comments or protests, it was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered that the hearing on DIP #560 be closed. It was moved by Councilman Temple, seconded by Councilman Dunnum and passed by the following vote that'the Department of Public Works proceed under Chapter 27 for the improvements for Downey Improvement Project #560, 7649 and 7737 Firestone Boulevard, as recommended. There being no written and no oral comments, it was moved by Councilman Dunnum, seconded by Councilman Temple and so ordered that the hearing be closed. It was moved by Councilman Dunnum, seconded by Councilman Temple and passed by the following vote that the Department of Public Works be authorized to proceed with the improvements for Downey Improvement Project #561, Paramount Boulevard, Seventh Street to Florence Avenue, as recommended. AYES: 4 Councilmen: Dunnum, Temple, Dickerson,Corbin NOES: 0 Councilmen: None ABSENT: 1 Councilman: Morton Council Minutes - 7/10/67 -3- The hearing was opened on Downey Improvement Project #562, Mr, Spindel reported that all property owners had been duly notified, Joseph Cuevas, 7321 Cecilia, Downey, owner of property located at 7919 Imperial Highway, stated he is in favor of the improvements if the City will pay 50% of the sidewalk costs. Mr. Cuevas stated that from the written notice he had received, he did not understand that he was to notify the Department of Public Works that he wished to participate in matching funds for sidewalks, that he felt he would be eli- gible after the improvements were put in. Upon inquiry by the Council, Mr. Spindel reported that written notices are sent ,—. to all property owners in a Chapter 27 proceeding and normally followed up by a personal contact for giving more complete information and explanation to the property owners. In this instance, Mr. Cuevas stated he not been contacted by anyone from the Public Works Department. It was moved by Councilman Temple, seconded by Councilman Dunnum and passed by the following vote to allow matching funds for sidewalks for Mr, Joseph Cuevas at 7919 Imperial Highway and to hold up on the proceedings to see if there may be other property owners involved and wishing the matching funds. AYES: 4 Councilmen: Dunnum, Temple, Dickerson, Corbin NOES: 0 Councilmen: None ABSENT: 1 Councilman: Morton It was moved by Councilman Temple, seconded by Councilman Dunnum and so ordered that the hearing on Downey Improvement Project #562 be closed. It was moved by Councilman Temple, seconded by Councilman Dunnum and passed by the following vote that after notification of property owners under DIP #562, to authorize the Department of Public Works to institute proceedings, bearing in mind that 50% matching funds for sidewalk installation may be desired by these people and, if so, the matter brought back to the City Council for their approval. AYES: 4 Councilmen: Dunnum, Temple, Dickerson, Corbin NOES: 0 Councilmen: None ^ ABSENT: 1 Councilman: Morton Mayor Corbin opened the hearing on Downey Improvement Project #563, 12501 and 12515 Paramount Boulevard, Mr, Spindel stated that all property owners had been duly notified, Mr. Lloyd Williamson, 12501 Paramount Boulevard, stated that he was of the same misunderstanding of matching fund procedures for sidewalk installation as Mr. Cuevas in the previous matter, and that he feels he should also be entitled to matching funds on his property. It was moved by Councilman Dunnum, seconded by Councilman Temple and passed by the following vote to authorize 50% matching funds to Mr. Lloyd Williamson, 12501 Paramount Boulevard under Downey Improvement Project #563, and the Department of Public Works to contact the other property owners with regard to a possible misunderstanding on notification of Chapter 27 proceedings. AYES: 4 Councilmen: Dunnum, Temple, Dickerson, Corbin ABSENT: 1 Morton It was moved by Councilman Dunnum, seconded by Councilman Temple and passed by the following vote that the Department of Public Works be authorized to proceed under Chapter 27 proceedings, DIP #563, 12501 and 12515 Paramount Boulevard, after notification of the other property owners and report back to Council if other property owners are desirous of sidewalk matching funds. Mrs. Dunnum stated that the intent of her recommendation for replacement of City flags was not for "all" flags but for only faded ones. The City Clerk reported on the following correspondence: A letter from Utter -McKinley Mortuaries congratulating the Police Department for their fine job the ten years of existence. Ordered filed. A letter of appreciation from the City of Norwalk for Council action in supporting them in the proposed widening of Imperial Highway bridge crossing the San Gabriel River was ordered filed. A letter of appeal to Zone Exception #728 from Mr. Paul B. Clayton. It was moved by Councilman Dunnum, seconded by Councilman Temple and so ordered to set a public hearing for 7:30 P.M., August 14, 1967, in the Council Chamber of the Downey City Hall. Budget report from the Downey Civic Chorus was ordered filed. A letter from Larry R. Chaney, Chairman of the Citizens Sanitation Committee, relative to their appointments and meeting to be held on July 13 to consider possible rate increase for refuse contractors was ordered filed. Councilman Corbin reappointed the two members from District 5 to the Sanitation Committee: Larry Chaney and Paul Edwards. Councilman Dunnum inquired of the Director of Public Works about coordinating the refuse pickup and street sweeping for the same day. Mr. Spindel stated that the street sweeping program is in the process of being revised and will be coordinatjed with the refuse pickups. Councilman Dickerson reappointed William M. Troy and Duncan Cormack of District 3 as members on the Sanitation Committee. ,--ft Councilwoman Dunnum reappointed Lou Cops from District 1 to the Sanitation Committee, Legal claims from Leonard Ruane and Mrs. Larry Hoag. It was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered that the claims be denied and referred to the City's insurance carrier. A letter of notification from the Chief Administrative Officer of the County of Los Angeles that Mr. Lee Arnold will be the new senior staff member of the Special Services Division of that office, due to appointment of Morton J. Golden as Administrative Deputy with the Los Angeles County Fire Department was ordered filed. A letter of thanks from Mr. Sam Agrusa relative to re -planting of trees on his property was ordered filed. A letter from Mrs. Camille R. Molyneux, 7704 DePalma Street, relative to sweeping of streets the same day trash is picked up, previously reported upon earlier in the meeting, was ordered filed. RESOLUTION NO. 1941 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ADOPTING AND SUBMITTING A BUDGET FOR EXPENDITURE OF STATE ALLOCATED ENGINEERING FUNDS The resolution was read by title only. AYES: 4 Councilmen: Dunnum, Temple, Dickerson, Corbin NOES: 0 Councilman: None ABSENT: 1 Councilman: Morton After summation of the bid received for acquisition of motorcycles and maintenance thereof, it was moved by Councilman Dunnum, seconded by Councilman Dickerson and passed by the following vote to award to the S & J Harley Davidson of Bellflower at a rate of $ U35 pet mile and replacement price for new 2 -wheeled motorcycles at $2,271.55 each less a $700 trade-in allowance, effective JuLy Lst, 1967, to remain in effect until June 30, 1970, with a 60 -day provision for cancellation by either party. Police Chief Ivan A. Robinson reported that the alternate had been used but one time throughout the past year and thus would pose no problems, if selected at this time. Council Minutes - 7/10/67 -6- 2930 Councilman Temple remarked that if it became necessary, Council can review for another alternate should United Towing Service become unavailable. It was moved by Councilman Temple, seconded by Councilman Dunnum and passed by the following vote to award bid for annual towing and impounding for the Police Department for the 1967-68 fiscal year, and authorize the Mayor to execute the agreement on behalf of the City designating Ray's Automotive Service and Doug's Toug with United Towing Service as an alternate as recommended. AYES: 4 Councilmen: Dunnum, Temple, Dickerson, Corbin NOES: 0 Councilmen: None ABSENT: 1 Councilman: Morton After summation of bids, it was moved by Councilman Dickerson, seconded by Councilman Temple to award annual purchase contract for road materials, crushed rock and sand, to the lowest and best bidder, Owl Rock Products Company, and that all other bids be rejected. Council requested bid figures of the other bidders and the matter was held until the Director of Finance brought back to Council. Mr. King reviewed the Capital Improvements Budget for the 1967-68 fiscal year: encumbered from the 1966-67 budget - $435,000.00. The Capital Improvements 1967-68 budget totaling $667,770.00, showing an encumbered amount of half the cost of a pumper for the Fire Department in the amount of $20,000.00 with total encumbrances and improvements amounting to $1,102,770.00. It was moved by Councilman Dunnum, seconded by Councilman Dickerson for funding $20,000.00 of the price of a pumper for the Fire Department and authorize the purchase of a new unit with the order being placed forthwith. After discussion, Councilwoman Dunnum was agreeable to funding the entire amount of $40,000.00. Thereupon Councilman Dickerson withdrew his second. Councilwoman Dunnum changed her motion to authorize $40,000 toward purchase of a pumper for the Fire Department and the ordering of it forthwith. Councilman Temple stated he was in favor of the funding of $20,000.00 only. The motion died for lack of a second. It was moved by Councilman Dickerson, seconded by Councilman Temple and so ordered that the matter be tabled until the next meeting for additional information as to a lease -purchase agreement, etc., the City Manager and Department Head to bring a report to Council. The Director of Finance submitted the bid figures on the annual. purchase contract for road materials, crushed rock and sand. The vote was then taken on the award of bid to the low bidder, Owl Rock Products Co., as follows: AYES:i 4 Councilmen: Dunnum, Temple, Dickerson, Corbin NOES: 0 Councilmen: None ABSENT: 1 Councilman: Morton After summation of bids for the annual purchase contract for road materials, emulsion, it was moved by Councilman Temple, seconded by Councilman Dickerson and passed by the following vote that the bid be awarded to the lowest and best bidder, Douglas Oil Company in the unit amount of bid and reject all other bids. AYES: 4 Councilmen: Dunnum, Temple, Dickerson, Corbin NOES: 0 Councilmen: None ABSENT: 1 Councilman: Morton After summation of bids, annual purchase contract for road materials, asphaltic concrete, it was moved by Councilman Dickerson, seconded by Councilman Dunnum and passed by the following vote to award bid to the lowest and best bidder, Sully Miller Contracting Company, and that all other bids be rejected. AYES: 4 Councilmen: Dunnum, Temple, Dickerson, Corbin NOES: 0 Councilmen: None ABSENT: 1 Councilman: Morton Council Minutes - 7/10/67 -7- 2931 After summation of bids, it was moved by Councilman Dunnum, seconded by Councilman Tetple and passed by the following vote to award Bid #4349, annual contract for rubbish removal to the lowest and best bidder, Calsan, Inc, and that all other bids be rejected. AYES: 4 Councilmen: Dunnum, Temple, Dickerson, Corbin NOES: 0 Councilmen: None ABSENT: 1 Councilman: Morton Mr. King read a report on miscellaneous and cultural activities to be included in the 1967-68 budget as follows: Miscellaneous $25,000 Jr. Chamber of Commerce 1,200 Symphony Orchestra 8,500 Area "E" Civil Defense 1,700 Community Hospital 10,800 Youth Band 2,500 Art Museum 12,060 Sister City 2,000 Mixed Chorus 800 Historical Society 1,200 Christmas Parade 1,300 Youth Week 600 Miscellaneous Awards 600 Christmas Lighting 3,750 $ 72,010 Mr. King stated that the above miscellaneous appropriations have been included for Council consideration and they may not be expended without approval of the City Council through contractural agreements with each of the organizations concerned. It was reported that there were six items on the cultural budget for monthly payment: Downey Jr. Chamber of Commerce, Downey Symphonic Society, Downey Community Hospital, Downey City Youth Band, Downey Museum of Arts, and the Downey Civic Chorus, It was moved by Councilman Dickerson, seconded by Councilman Temple and passed by the following vote to authorize the Mayor to execute agreements between the City of Downey and the six organizations as submitted. AYES: 4 Councilmen: Dunnum, Temple, Dickerson, Corbin NOES: 0 Councilmen: None ABSENT: 1 Councilman: Morton Mr. James Ruth reported on the Children's Theater, Downey Junior Athletib Associa- tion,'Downey Museum of Art and the Downey Symphonic Society contracts which merely a continuation of the services which have been through the Department of Parks and Recreation the past years. It was moved by Councilman Dunnum, seconded by Councilman Temple and passed by the following vote to authorize the Mayor to execute agreements on behalf of the City for the above organizations as presented. AYES: 4 Councilmen: Dunnum, Temple, Dickerson, Corbin NOES: 0 Councilmen: None ABSENT: 1 Councilman: Morton RESOLUTION N0, 1942 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ADOPTING THE ANNUAL CAPITAL IMPROVEMENT BUDGET FOR THE FISCAL YEAR COM- MENCING JULY 1, 1967, AND FIXING THE LIMITATIONS OF EXPENDITURES The title of the resolution only was read. It was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered that further reading be waived. Council Minutes - 7/10/67 -8- 2832 It was moved by Councilman Temple, seconded by Councilman Dickerson and passed by the following vote that Resolution No. 1942 be adopted for the annual capital improvement budget for the fiscal year commencing July 1, 1967 amounting fo $1,102,770.00. AYES: 4 Councilmen: Dunnum, Temple, Dickerson, CorbinABSENT: 1 Morto The City Manager stated that Council may re -allocate $20,000.00 for a fire pumper when deemed desirable. Mr. King reported the appraisal on the Syd Herman property on Downey Avenue for re -facing, street widening, etc. amounts to $11,990.40 and requested approval of Council for the 5' acquisition necessary for this improvement, and appropriation from Gas Tax Funds. It was moved by Councilman Dunnum, seconded by Councilman Temple and passed by the following vote to authorize the acquisition of 5' of right of way from Syd Herman for Downey widening from Gas Tax Funds in the amount of $11,990.40 in accordance with the General Appraisal Company appraisal. AYES: 4 Councilmen: Dunnum, Temple, Dickerson, Corbin NOES: 9 Councilmen: None ABSENT: 1 Councilman: Morton The City Manager read a letter to be sent to the City's legislators relative to Assembly Bill #2452, Matching Funds under the Collier -Unruh Act, stating that AB -2454 is much more workable and that both senators had signed this bill. Mr. King reported that bids will be opened on the hospital on Friday, July 14, in the Council Chamber of the City Hall at 4:00 P.M. and read a brief report from the architect handling the bid forms. The City Attorney reported the results of his study made relative to the City of Downey's becoming a separate and individual school district --the legal aspects, and then, if feasible, would it be independent of the State Board of Education. The pertinent facts are that the City of Downey is a Charter City. The City of Downey is located within a Unified School District, a portion of which district lies without the boundaries of the City. The attorney's conclusions were that the establishment of a public school system within the State of California is a matter of statewide concern, thus not a municipal affair, and therefore no city can establish a public school system independent from the State School System, free from regulation and control by statewide legislation. The district cannot be dissolved and cannot withdraw without following the pro- cedures set out in the Education Code of the State of California. The Unified School District was formed in accordance with the provisions of the Education Code and would be subject to laws governing same. Councilwoman Dunnum stated she had discussed the matter with Mr. Morton; that this study was requested by Councilman Morton and herself, and supported by the other Councilman, basically because they had hoped they might..obtain more local control, as well as establish a better financial structure. She stated that a good many citizens came to the conclusion that the City does not have as much local control of the school system as they would like to have. It was their thinking that possibly the study could make findings that would be advantageous to everyone concerned. Councilwoman Dunnum agrees that unless real benefits can be obtained, there is no purpose in pursuing the matter any further. Councilman Dickerson concurred. Councilman Temple requested that further action be taken to remove heavy equipment from an R-1 area near Alameda and Caladre Avenues. Property owners have been objecting and this equipment is not in a proper zone. Steps were to be taken through the Public Works Department and City Manager's office to expedite this action. Councilmen Temple and Dickerson reported on the U. S. Conference of Mayors and their part in adoption of a Statement of Principles brought about by requestg' of larger cities for Federal aid. Council Minutes - 7/10/67 -9- 2933 Mr. Spindel reported that construction of the main line storm drain at Downey Avenue, DePalma Street going south, should be started Tuesday. This is the last project of the 1964 Storm Drain Bond Issue in the City of Downey. Completion is expected within 27 working days. Work at Third and Dolan Street will also begin Tuesday, it was reported by Mr. Spindel. —� The City Attorney advised Council he had been requested to review a suggested ordinance providing for placement and protection of historical markers. Council recommended a study. The City Manager reported this matter had come from the Historical Society and was a request for safeguarding historical markers. It was moved by Councilman Dickerson, seconded by Councilman Corbin and so ordered that Councilman Temple and Councilwoman Dunnum be reappointed to serve on the City and School Joint Recreation Committee the coming year. Mr. William B. Cole, Manager of the Downey Chamber of Commerce, inquired who is responsible for towing and impounding lots. Chief Robinson stated they are the responsibility of the persons contracted. They are requir ed._.to furnish storage facil- ities, remove and maintain. Except for the safety of the vehicles, the City has no jurisdiction. Mr. Cole stated he feels the auto salvage lots are in violation of the compre- hensive zoning ordinance. Mr. Cole commended Councilmen Temple and Dickerson for their fine job in representing the City of Downey at the U . S. Conference of Mayors in Hawaii,. Councilman Temple requested an investigation of auto salvage lots and conformance thereof to the comprehensive zoning ordinance, stating that the owners should be approached to persuade them to clean them up and thus satisfy those citizens interested in and working toward city beautification.
