HomeMy WebLinkAboutMinutes-04-11-67-Regular MeetingMINUTES OF THE OF THE CITY APRIL 11, CITY COUNCIL OF DOWNEY 1967 2849 The City Council of the City of Downey held a regular adjourned meeting in the Council Chamber of the Downey City Hall at 7:30 P.M., April 11, 1967. The regular meeting of April 10, 1967 was adjourned to this time due to lack of a quorum. The Cit Clerk reported that a co of the notice of adjournment was Y P PY � posted as required by law and that the proper affidavit covering the posting of the notice is on file. PRESENT: Councilmen: Dunnum, Corbin, Morton, Temple, Dickerson ALSO PRESENT: Oren L. Ring, City Manager Royal M. Sorensen, City Attorney William A Goggin, Director of Planning James Ruth, Park Director Ervin Spindel, Director of Public Works Robert Shand, Director of Finance Ray Lake, Director of Building and Safety Robert W. Gain, Fire Chief Walter Wanke., Water Superintendent Loren Morgan, -Deputy Chief of Police Della Doyle, City Clerk Alberta Pfeiffer, Deputy City Clerk Ray Lake, Director of Building and Safety, delivered the invocation in the absence of a regularly scheduled minister. Mayor Dickerson made a presentation to Mr. J. Arch Morris, Sr. of a plaque to a very honored and distinguished citizen of Downey on behalf of the City Council and the City of Downey. The Mayor commended Mr. Morris for his many years of dedicated life and assistance through the tribulations of Downey's.becoming incorporated and for his help to the City, both before and after incorporation. It is people like Mr. Morris, stated the Mayor, who make Downey the great City it is. Mr. Arch Morris thanked Council for having been -allowed the privilege of serving the City and stated he will miss the associations he had with'the City "family" which he has had through the years. He added that he will be happy to help in any way he can at any time the City may wish to call upon him for his services. The City Council expressed their gratitude for Mr. Morris' many years of service, both before and after Downey became a City; they stated he did an excellent job on the Planning Commission and that they appreciated his initiative and his fine work. Councilman Temple stated that Arch Morris is a true example of what other citizens might follow in being a good citizen. After the City Manager added similar comments of appreciation to Mr. Morris, Mr. Goggin, Director of Planning, stated Mr. Morris was one of the bebt commissioners the City has ever had and thanked him for all his,help while serving on that Commission. Mayor Dickerson concluded the presentation by stating that Mr. Arch Morris was a real tribute to the City and a good example to follow. Mayor Dickerson opened the hearing on the appeal to Zone Exception #698, Cecilia and Lakewood and asked the City Clerk if she had the Affidavit of Publication and the City Clerk replied she had the affidavit, which was ordered received and filed. Mr. William Goggin, Director of Planning, presented a resume of the case. Mayor Dickerson inqui`v-d if the City Clerk had received any written communication or protests. The City Clerk stated a letter had been presented just prior to the council meeting from the Stonewood Shopping Center which bore 54 signatures in an attached petition. Council Minutes - 4/11/67 -1- . 2850 It was moved by Councilman Temple, seconded by Councilman Dunnum that the letter and petition be filed as part of the record in the appeal of Zone Exception #698. It was so ordered. Speaking in favor of the appeal to Zone Exception #698 were the following: Neal Irving, 13708 Studebaker, Norwalk r -- Mr. Irving presented a petition bearing 47 names of residents in the area favor- ing the zone exception. He also presented a brochure to become part of the record which included a perspective rendering of the proposed development in the area in question. Sid Levee of Maxwell, Starkman and Associates, Architects 8730 Wilshire Boulevard, Beverly Hills Paul Stewart, Assistant Real Estate Manager, Market Basket 1337 Allen Avenue, Glendale Robert Seibert 12203 Gneiss, Downey (owner of three residences in the area) Speaking in opposition were the following persons: Ben Mitchell, 9066 Stonewood (Owners' representative) Barry Sholer, Owner of Strip Shopping Area at 10303-15 Lakewood Boulevard Edgar L. Glover, 10725 Shellyfield John Barr, 10408 Samoline Avenue Mr. Neal Irving presented his rebuttal and was supported by comments from Zachary Pettisini, 8730 Wilshire Boulevard, who explained a rendering of a new plot plan submitted to Council. Mr. Pettisini stated Market Basket.-, Mobil Oil and other shops would own their separate parcel with mutual parking arrangements to conform to that required by the Planning Commission. The City Attorney stated that if a zone exception be granted by the City Council tp on such conditions, one would be that a certain amount of parking be maintained on the property upon which the zone exception is sought; if there should be a sell-off, or a lot split, then any conditions which might be necessary at that time would have to be set. After further discussion, it was moved by Councilman Temple, seconded by Councilman Morton and so ordered that the hearing on the appeal to Zone Exception #698 be closed. Councilman Morton made detailed comments and reviewed the matter of development of the property located at Lakewood Boulevard and Cecilia Street; went through the five points for findings required in the granting of a zone exception; revidwed the Stonewood Shopping Center development, calling attention to Council that the vast majority of the adjoining area is high residential; that it has been the consensus of opinion that good zoning practice is to have "step-down1° zoning from a high intensity of commercial, down to a lesser commercial, on down to a residential, and requirement of buffer zones. Councilman Morton stated he does not feel this application meets the five requirements cited in the code. It was moved by Councilman Morton and seconded by Councilman Corbin that the appeal to Zone Exception #698 be denied and the decision of the Planning Commission upheld and that the application does not meet the findings set out in Section 9130.2 of the Downey Municipal Code for granting of a zone exception. Councilman Dunnum commented on the problem involved in R-3 development of the area in question, since it is on a busy highway, the crime rate tends to soar in an apartment development. She stated inasmuch as there is commercial directly to the north and to the south of this proposed commercial, she would favor the granting of the appeal and the zone exception. Council Minutes - 4/11/67 -2- 2851 Mayor Dickerson called for the vote on the motion denying the appeal and upholding the decision of the Planning Commission in Zone Exception #698, Lakewood Boulevard and Cecilia Street. AYES: 4 Councilmen: Corbin,, Morton, Temple, Dickerson NOES: 1 Councilman: Dunnum ABSENT: 0 Councilmen: None Mayor Dickerson declared a ten-minute recess with Council reconvening at 9:45 P.M. with roll call, all members of Council being present. The Mayor opened the hearing on the Convenience and Necessity for AD #4, Irwingrove Drive, and inquired if the City Clerk had the Affidavits of Publication and Posting. The City Clerk replied she had the affidavits, which were ordered received and filed. There were no written communications or protests. Mr. John Demick, 9365 Otto, representing the Moravian Church at 7337 Irwingrove Drive, inquired if the church property was to be included in this assessment district. He stated all improvements had been installed at their property, Mr. Demick was informed that the boundary of the assessment district did not include the church property and thus, they were not affected by the assessment district. It was moved by Councilman.Corbin, seconded by Councilman Dunnum and so ordered that the hearing on the Convenience and Necessity for AD IN, Irwingrove Drive, be closed. RESOLUTION NO. 1890 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY FINDING THAT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE IMPROVEMENT OF IRWINGROVE DRIVE IN THE CITY OF DOWNEY (AD #4) The resolution was read by title only. It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered that further reading be waived. The City Clerk stated she had all three affidavits. It was moved by Councilman Temple, seconded by Councilman Morton and so ordered that the affidavits be received and filed. There being no written and no oral communications or protests, it was moved by - Councilman Temple, seconded by Councilman Morton and so ordered that the hearing on the Resolution of Intention for AD #4, Irwingrove Drive, be closed. RESOLUTION NO. 1891 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING WORK TO BE DONE ON IRWINGROVE DRIVE IN ACCORDANCE WITH RESOLUTION OF INTENTION NO. 1880 (AD #4) The resolution was read by title only. It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered that further reading be waived. It was moved by Councilman Corbin, seconded by Councilman Dunnum and passed by the following vote that Resolution No. 1891 be adopted. It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered that the minutes of the Council Meeting held on March 28, 1967, be approved as corrected. The City Clerk reported on the following correspondence: Seven letters from various organizations and citizens requesting that the name of the new hospital be changed from Downey Municipal Hospital and retaining the name of Downey Community Hospital. Mrs. Gail Rose, 8616 E. 5th Street, President of the Downey Community Hospital Auxiliary requested that Council change the name back to a name revered in the community - a name known in the community and stated it might be possible that bonds will be more difficult to obtain if the term "municipal" is retained in the name. It was moved by Councilman Temple and seconded by Councilwoman Dunnum that the new Downey hospital be known as the Downey Community Hospital, as long as it does not affect purchase of bonds, Mr. Glenn Jones, Administrator of Downey Community Hospital, 8656 East 5th Street, reported on how few existing hospitals contain "city" or "municipal" in their hospital names, and added that eastern bonding companies do not appear to be interested in bonding hospitals which have the name "municipal" in them. Mrs. Mary Hollis Robinson, 8334 Luxor, stated that she is not speaking about the bond issue, but that to her, the main reason it is wanted that the name "Downey Community Hospital" be retained is because people are real proud in Downey that they believe in taking care of their own business instead of letting the government tak6rgare of them, and to her, that's what it means='municipal". The citizens know that their Council and their City have backed them in this hospital but they feel as citizens of Downey that it is their hospital -- "yours, mine, all of our hospital". And they don" _t have any Hill -Burton funds like most of the hospitals had to have. They feel they're going to do this on their own. To her, she stated, it's just being proud to be an American and say "Downey Community Hospital" belongs to this community of Downey rather than municipal government 6r anything else. It's just not in there, to her. They have government, yes, but she doesAt think they need to think all the time in the form of municipal if they can get the bonds and sell them and still be a community hospital. It just means a lot to her, she stated.. Councilman Temple withdrew his motion and Councilman Dunnum her second to the motion to hold action on naming the new hospital until clarification of the issuing of bonds. Councilman Dunnum stated that if there appears to be any problem in the leas- ing of the new hospital to the Downey Community Hospital Foundation „ perhaps the lease agreement should be amended to include the consent of the hospital foundation to retain the name Downey Community Hospital, in the event the City might need to assume the operation of the hospital at some future time. Dr. Ralph Christensen stated it is a rare opportunity for him to be compulsed to address the City Council because he has always enjoyed good representation, but since the subject of the name of the new hospital has come before Council, he would like to see the name is maintained. He stated he is not speaking as a staff member, but only out of a sense of civic pride as a citizen of the community. His statements were as follows: "Downey Community Hospital has served the population of our community and surrounding area for many years. It has developed and established a reputation of excellence in patient care and administration of the medical and dental necessities of our community. "This reputation has been established through the excellence of its staff, administration and medical auxiliary. The hospital Auxiliary as well as other civic groups have aided in its growth and needs to maintain these high standards of care. The staff may be looked upon with pride. The calibre of the staff has been carefully screened and selected. (This in itself is a little known community service.) Many of the men who have established the criteria of excellence are not only known and respected nationwide but internationally, as well. A point which, perhaps, may not be generally known. Council Minutes - 4/11/67 !Ve 2853 "Through this reputation gained by many years of hard work an "identity" has been established, not. only for the hospital but the community as well. "Downey Community Hospital is a part of that which is 'Downey' and a facet of its tradition. "There are many technical reasons from an administration, records, maintenance, and change in protocol standpoint which make this desirable. However, in addition to these reasons I ask you to reconsider and not shelve this reputation and identity by a new name, but maintain its identity and perpetuate this part of community tradition and effort by whatever legal means necessary. Tradition will not hamper progress." Councilman Corbin stated he is not opposed to changing the name but he is thinking in terms of money which might possibly be saved on the bonds. A letter from the Pacific Telephone and Telegraph Company reporting the installation of a historical plaque on the front of their new building st 11040 Downey Avenue about the first of May was ordered received and filed. A list of hold -over members and new members indicating they will serve on the 1967 Rose Float Committee from the Downey Rose Float Association, Inc. was held until the next Council Meeting, when other committee appointments will be considered for either reappointment or new appointments. An invitation to the dedication ceremonies of a Community CenterBuilding in the City of Hawaiian Gardens was reported on by Mayor Dickerson. He stated he had attended the Sunday dedication and that it has a very beautiful facility. Letter was ordered received and filed. A letter from the Kiwanis Youth Fair Committee relative to approval of Sky Divers jump during the Youth Fair activities from Kiwanis Youth Fair Committee Chairman was ordered received and filed. A request from the Altrusa Club of Downey for approval of installation of its club emblem on the Downey Welcome signs at the entries of the City was discussed. 1t was moved by Councilman Corbin, seconded by Councilman Dunnum and so ordered that approval be granted -the Altrusa Club's installation of its club emblem with the club paying for the cost of the installation. A letter from Royal M. Sorensen, City Attorney, requesting additional retainer fee in next year's budget due to addition of various departments and retainer matters as a consequence was ordered received and filed for budget study. A complaint for damages from the Downey Methodist Church. It was moved by Councilman Temple, seconded by Councilman Corbin and so ordered that the claim from the Methodist Church be denied and referred to the insurance carrier for the City. A request from the Square and Compass Building Association relative to establish- ing additional parking by demolishing of the old Temple Building at the corner of Downey Avenue and Third Street was ordered received and filed. A request from the Christmas Parade Committee of the Downey Junior Chamber of Commerce and the Lions Club for an appropriation in next year's budget for the parade. was ordered received and filed for budget study. ^ Letters from the Principal of the Fairford School, President of the P.T.A. and various citizens in the area relative td a heavy traffic problem on Fairford Avenue were discussed. Mr. Spindel reported that the Traffic Committee had approved installation of a stop sign at Cecilia and Fairford which should slow up the traffic; however, the approval must be obtained from the City of Norwalk before this step may be taken. Council Minutes - 4/11/67 -5- 2854 Councilman Morton suggested that the City Manager, Director of Public Works, President of the P.T.A., Principal of the Fairford School and himself meet and review the problem. The Mayor instructed the City Manager to set up such a meeting. Mr. John Koslov, 11117 Fairford Avenue, requested further investigation and study for alleviating the traffic problem on Fairford Avenue as he did not feel the stop sign would be the complete answer. Councilman Morton suggested that the police and fire departments also should be represented at the meeting as someone had suggested closing of one of the streets, forming a cul de sac. He also added that there is added problems caused by people living outside the area using Fairford to enter the freeway from Cecelia Street rather than from,Dollison Road. Rullo Enterprises, in the amount of the unit prices submitted in the bid .proposal, and that all other bids be rejected. None ABSENT: 0 Councilmen: None It was moved by Councilman Dunnum, seconded by Councilman Corbin and passed by the following vote to authorize the Mayor to negotiate the Agreement reappointing the auditing firm of Diehl, Evans_ and Company as auditors for all departments of the City, effective July 1, 1967. AYES: 5 Councilmen: Dunnum, Corbin, Morton, Temple, Dickerson NOES: 0 Councilmen: None ABSENT: 0 Councilmen= None The Downey Historical Society submitted copies of its by-laws with a request that the City authorize the City Attorney to prepare incorporation papers enabling them to become incorporated. The papers were referred to the City Attorney to review. It was moved by Councilman Dunnum, seconded by Councilman Temple and passed by the following vote to authorize Robert W. Gain, Fire Chief, to attend the California Fire Chiefs' Association Annual Conference at Santa Rosa, California, May 23-26, 1967; Donald B. Robison, Assistant to the City Manager, to attend the Personnel Association Regional Conference in San Francisco, California, April 28 - May 3, 1967; and Ivan A. Robinson, Chief of Police, to attend the Peace Officers' Conference at Sacramento May 21 - 24, all with reasonable and necessary expenses allowed. The City Attorney will need to prepare a resolution. It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered .-4 that the City Attorney be authorized to prepare the necessary resolution establishing the method of disposing of outdated records in accordance with the Director'of Finance's request. The City Manager reported it now appears that the Los Angeles Airways are ready to execute the lease for helicopter service in the City of Downey, with operations stated therein to begin July 31, 1967. It was moved by Councilman Dunnum, seconded by Councilman Temple and passed by the following vote to authorize the Mayor to enter into Agreement with the Los Angeles Airways for helicopter service. None ABSENT: 0 Councilmen: None Councilman Dunnum moved that the request of the Junior Chamber of Commerce relative to granting of funds for the Christmas Parade for 1967 at this time, rather than awaiting budget studies, be considered at the next Council Meeting provided an emergency faces the Junior Chamber and the Lions Club in preliminary plans and prepara- tions for the parade. The motion died for lack of a second. Mr. Walter Wanke, Water Department Superintendent, reported that Pump #301 located on Bangle Road had failed and since the well is a low producer and past history shows numerous repairs, the Water Board approved the recommendation that new equipment not be purchased and that the well be abandoned. It was moved by Councilman Dunnum, seconded by Councilman Temple and passed by the following vote to approve the Water Board's recommendation that the existing equipment at Pump #301 located on Bangle Road be dismantled and sold as surplus equipment. He stated this phase should be completed by June 1. It was moved by Councilman Tenple, seconded by Councilman Dunnum and passed by the .-+ following vote to approve the recommendation to initiate Phase I of Treasure Island Park. AYES: 5 Councilmen: Dunnum, Corbin, Morton, Temple, Dickerson NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None The City Attorney advised that a matter of arrest of one of the attorneys in Downey on April 4, 1967, was again brought up by the Southeast District Bar Association, requesting again that members of the Police Department involved in the matter appear Council Minutes - 4/11/67 -9- 2858 before the Special Committee of the Southeast Bar Association for investigation and examination. There is no litigation pending or proposed. The City Attorney suggested that he be authorized to reply on behalf of the Deputy Chief of Police and the City Council, advising that they do not think it is in the best interests of the City and the employees of the City to do as requested. It was moved by Councilman Morton, seconded by Councilman Temple and so ordered that the City Council reaffirm its previous actions and remarks relative to the request of the Southeast District Bar Association as suggested by the City Attorney. Mr. John Kosov, 11117 Fairford, inquired about the park situation in the triangle area of the City and what had become of the matter of dissolution or withdrawal from the Southeast Park District. He was informed by Councilman Morton that the City has been awaiting the outcome of the decision of the Division of Highways in obtaining acreage and that the Southeast Park District seemingly was not in favor of the triangles withdrawal from that District to become a part of the City of Downey's park department. Mayor Dickerson stated he had talked with the attorney for the Southeast Park %strict and had been informed that that District would not take any steps toward dis- solution until it received a complaint from the citizens relative to double taxation. Mr. Kosov requested the names of the property owners who had replied affirmatively to the cards which the City had sent relative to the dissolution of the Southeast Park District in the triangle area. Councilman Morton advised Mr. Kosou the answers to all his questions were not readily available at this time. The City Manager stated he would work with Mr. Kosov in supplying him with the names and information requested by him. .-. Councilman Mopton stated he has been impressed by the School District's formation of an ad hoc committee to study additional ways to raise revenues. The study was taken under submission but not before they had suggested additional sales tax which would raise additional funds without additional tax on real property. Mr. Morton stated he feels the sales tax is a fair way to amortize tax on the citizens. Councilman Temple recommended that Council proclaim Police Week in May. Mayor Dickerson praised the action of a former councilman in turning the Rio Hondo Country Club over to teenagers for a party last Friday evening, with Director of Finance Robert Shand and the Coordinating Council overseeing it. There was a total of 323 boys and girls at the teenage "hop" who conducted themselves in a very orderly fashion. It was moved by Councilman Temple, seconded by Councilman Dunnum and so ordered that the Mayor be authorized to send a letter to be from the Mayor and City Council in appreciation for this night of good, clean fun for the teenagers of the City.
