HomeMy WebLinkAboutMinutes-03-13-67-Regular Meeting2828 MINUTES OF THE CITY COUNCIL OF THE CITY OF DOWNEY MARCH 13, 1967 The City Council of the City of Downey held a regular meeting at 7:30 P.M.0 March 13, 1967, in the Council Chamber of the Downey City Hall, Mayor Charles W. Dickerson .-` presiding. PRESENT: Councilmen: Dunnum, Corbin, Morton, Temple, Dickerson ALSO PRESENT: Reverend Curtis invocation. Oren L. King, City Manager Royal M., Sorensen,City Attorney William A. Goggin, Director of Planning Robert Shand, Director of Finance James Ruth,.Park Director Ervin Spindel, Director of Public Works Don Robison, Assistant to the City Manager Robert W. Gain, Fire Chief Ray Lake,,Director of Building and Safety Walter Wanke, Water Superintendent Ivan A. Robinson, Chief of Police Della Doyle, City Clerk Alberta Pfeiffer, Deputy City Clerk Puryear of the Immanuel Baptist Church in Downey delivered the Mayor Dickerson opened the hearing on the appeal to Zone Exception Case #703 relative to the Immanuel Mennonite Church located at 10335 Paramount Boulevard. The Mayor asked if the City Clerk had the Affidavit of Publication of the Notice of Hearing. The City Clerk replied she had the affidavit and it was ordered received aqd filed. The Director of Planning reviewed the. case. There were no written communications or protests, according to City Clerk Della Doyle. .Speaking in favor of the appeal was Attorney Harold T. Tre.dway,.11510 Downey Avenueo representing the applicant. The objection was to the 46' setback being required as a condition of granting the zone exception by the Planning Commission, wherein an R-3 zone requires a 10' setback only. Mr. Tredway believes, he stated, that the case seers all five requirements of Section 9130.2 of the Downey Municipal Code relative to granting a zone exception. Speaking in opposition to the appeal were the following persons: John Barr, 10408 Samoline Charles Wheelers 7858 Via Amorita Mr. Wheeler stated he did not believe applicant meets the fifth requirement or finding under Section 9130.2 of the Downey Municipal Code "That the use for which the approval was granted was so exercised as to be detrimental to the public health, or welfare, or so as to constitute a nuisance." Also speaking in opposition were: Max Heine, 10324 Samoline Dr. Leon E, Evans, 10320 Samoline Richard 0. McCowen, 10414 Samoline Mr. Tredway presented his rebuttal* after which it was moved by Councilman Morton,. seconded by Councilman Temple and so ordered that the hearing on the appeal to Zone' Exception #7032 Immanuel Mennonite Church, be closed. Council Minutes - 3/13/67 -1- Councilman Morton questioned the City Attorney as to the Sunday School purposes, whether or not it might come under educational purposes whereby he feels there is a legal aspect to be ruled on regarding the use permitted under an R-3 zone. He recom- mended that phase be given some study and thatthe City Attorney give a ruling on it. Councilman Dunnum stated she feels the applicant has met the five findings for granting a zone exception and made a motion that the applicant be permitted to construct a building with the condition that a 10' setback be required; that there be no windows in the west wall, and using a gate to close off the 10' area to the south, Applicant Reverend H. Epp, 10310 Samoline,stated the facility would be used on Sunday mornings for Sunday School classes; Sunday evenings for a Christian endeavor, youth program, and on Wednesdays in the evening for youth prayer meetings. All recreation and parties, banquets, etc. are held in the Fellowship Hall adjacent to the proposed building. A college lounge is proposed where a college group can meet, but this is not for parties. ffi.a num' s Councilman Corbin seconded Councilwomani ; motion granting the zone exception as stated above. Mayor Dickerson called for a vote on the motion which failed by the following vote: AYES: 2 Councilmen: Dunnum, Corbin NOES: 3 Councilmen: Morton, Temple, Dickerson Councilman Morton qualified his "No" vote only because he is interested in a legal opinion from the City Attorney to find that the us -es tie in with the uses of a church and if conditions can be placed on the 10' setback. Councilmen Temple and Dickerson concurred with Councilman Morton's with their "No" votes. It was then moved by Councilman Temple, seconded by Councilman Morton and passed by -,a fallowing vote that the appeal of Zone Exception #703 be taken under submission, ea -,resting the City Attorney for an opinion as to whether the proposed uses of the church building are the permitted uses under the R-3 zone. (The City Attorney statdd that if they are, then the 10' setback would apply under the ordinance and that would be the only applicable condition. If they do not apply, then Council can attach other conditions.) AYES: 3 Councilmen: Morton, Temple, Dickerson NODES: 2 Councilmen: Dunnum, Corbin The City Attorney advised he would have the ruling on whether or not the uses pro- pss•:-�c: meet the permitted uses of R-3 zone by the next council meeting. The City Clerk announced she was in receipt of a letter from applicant in the appeal to Zone Exception #698, Lakewood Boulevard and Cecilia Street, requesting a continuance of the hearing as applicant was called away unexpectedly due to an emergency and is unable to attend this hearing this date. Mayor Dickerson opened the hearing and inquired if the City Clerk had the Affidavit of Publication of the Notice of the Hearing. The City Clerk replied she had the affidavit and it was ordered received and filed. Councilman Morton advised that he feels the hearing should be continued to the next regular night meeting, adding that he feels it should be explained to interested citizens present for the hearing that the request for continuance was received last Thursday, obviously too late to notify them. Since he feels it very deffnl.tely should be a night meeting, the next regular night meeting of April 10 being his 25th wedding anniversary, he therefore wished to continue the hearing to the following evening, April 11, in order haat he might be present. It was moved by Councilman Temple, seconded by Councilman Morton and so ordered that the hearing on Zone Exception #698, Lakewood Boulevard and Cecilia Street appeal, be continued to 7:30 P.M., April 11, 1967, in the Council Chamber of the Downey City Hall. Mayor Dickerson declared a 5 -minute recess with Council reconvening at 9;15 P.M. with roll call, all members of Council being present. Mayor Dickerson opened the hearing on the appeal to the relocation of a building from Huntington Park to 7374 Rio Hondo Place. Council Minutes - 3/13/67 -2- s i6 Mr. Ray Lake, Director of Building, reported the facts of the case, stating over 50% of the property owners in the area where the building was proposed to be moved, had objected. The City Attorney advised that the denial is not based on the percentage of protests, but on one of the requirements which may not be met by applicant, as qualified under the Downey,Municipal Code. The right to relocate -is determined on the final analysis of the findings of the appeal - not on a real mathematical.matter of protests. Mayor Dickerson inquired if there were any written protests. The City Clerk replied she was in receipt of 32 written protests. It was moved by Councilman Temple, seconded by Councilman Morton and so ordered that the letters be received and filed. n Speaking/favor of the appeal was applicant, Mr. James V. Schneider, P. 0. Box 445, Huntington Park (owner of house proposed for relocation from 5420 Passaic Street, Huntington Park, to the City of Downey, 7374 Rio Hondo Place. Mr. Schneider requested that his architect, Frank Evola, 3298 Tweedy Boulevard (Residence: 10279 Foster Road, Downey) explain the plans showing what will be done with the property upon relocation of the house in question. Speaking in opposition were the following persons: Estel R. McCollum, 7363 Rio Hondo Place,.also speaking for fellow property owners. Ken Radford, 7045 Rio Hondo Place Jerome Smaltz, 7383 Rio Hondo Place Steven E. McNeil, 7371 Rio Hondo Place Lynn Cameron, 7359 Rio Hondo Place After Mr. Schneider's rebuttal, it was moved by Councilman.Temple, seconded by Councilman Dunnum and so ordered that the hearing on the appeal of Mr. James V.. Schneider for relocation of building,to 7374 Rio Hondo Place in Downey be closed. The Building Director stated the denial of the.request was not entirely predicated -upon the 10% protest. There were extenuating circumstances and as a.result the denial was made. It was moved by Councilman Temple, seconded -by. Councilman Dunnum to'deny the appeal, uphold the Director of Building and making the finding_ that the value of'property to be moved in the neighborhood of the proposed location is not in keeping with the surrounding properties and would cause values to depreciate in the area. Before the vote was taken on:.the motion,..Mr. Lake_was.a ked by Councilman Morton to give the values placed on various properties;surraunding the proposed location of Mr. Schneider's house. Mr. Lake stated they ranged from $50,000 to $72,000,and there is one valued at around $80,000. Councilman Morton pointed out that this speaks of a difference in values of the homes in the area affected of between $15,000 and $20,000. Mayor Dickerson called for a vote on the motion denying the .appeal of Mr. James V. Schneider to relocate the building to 7374 Rio Hondo Place. AYES: 5 Councilmen: Dunnum, Corbin, Morton, Temple, Dickerson Mayor Dickerson announced the matter of the appeal of Zone Exception #702, Winchell Donut Sign, which had been taken under submission to ae'e:whether or not applicant and Mr. Stephen G. Skinner, Jr. could agree upon the location of the sign, would be considered at this time. Applicant James Hann, 9232 Samoline, informed"Council that Mr. Skinner and Winchell Donut are in agreement with the location of the sign. Mr. Goggin reviewed the case, stating that the Planning Commission had granted a sign of square footage less than what the Winchell Donut people usually install, and that was the basis of the appeal. He stated further that Winchell had, however, installed signs smaller than their usual ones. The City Manager reviewed the correspondence as follows: A special audit review report by Diehl, Evans and Company at the termination of the City Manager's acting as Finance Director and beginning of appointment of Robert Shand as Finance Director. Ordered received -and filed. A letter from the City of Pasadena relative to the Rapid Transit Committee to which the City Manager had been appointed.. Mr,. King stated he would make a further report on accompanying suggested resolutions.;at a later, date. Received and filed. A letter from Mrs. Doris M. Ruff relat*ve.to removal of a tree house at 7306 Rio Hondo -Place. The City Manager related.that•he had spoken with Mrs. Ruff and that the matter, he feels, can be handled administratively- He feels that since the children in the area are all grown, the tree house may be_ removed or the tree 'trimmed. Ordered ,.� received and filed. A report from Police Chief Ivan A. Robiftson of° s. appointment to. the Law Enforcement Advisory Committee for the Department of Youth Adbhoxity,;State of California. It was moved by Councilman Temple, secordded by Councilman Morton and so ordered to approve appointment of Police Chief Ivan A. Robinson to the Law Enforcement Advisory Committee. A report from Police Chief Robinson relative to the dismissal of two civil cases against the police department. Received and filed. A letter from Mary Hollis Robertson, Chairman of the City Beautification Committee announcing May as Clean Up, Paint Up. Fix Up Month. Received and filed. RESOLUTION NO. 1872 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY AUTHORIZING THE PERFORMANCE OF CERTAIN PUBLIC WORK BY CITY EMPLOYEES (Treasure Island Park) The resolution was read by title only. The City Manager stated there should be a change in section F of the third "Whereas" atthe end of the section from "Slauson" Freeway to "Santa Ana Freeway", Councilman Dunnum requested a,summary,of the proposal of the City of Downey For the Century Freeway route and bringing Council-aud citizens in the audience up to date on the matter. Reverend George Duerr of the Good Shepherd Luthern Church located at 13200 South Clark Avenue, and Mr. Jack Randall, 9029 Priscilla Street, reqe9 ted that sound barriers be installed on the proposed freeway at school locations: C 'C w�a and LutherpnDay Schools, with the Division of Highways bearing the expense, in the event the most southerly mute (great -orange) proposed by the City of Downey is the final route desig- nated by the State. Mr. Spindel stated that this request can be made at the time the freeway agzeemeot is signed with the Division` of Highways.. AYES: 5 Councilmen: Dunnum, Corbin, Motbon, Temple, Dickerson RESOLUTION NO. 1883 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING FORM OF LEASE AND LEASE -BACK TO BE ENTERED INTO BETWEEN SAID CITY AND DOWNEY CITY HOSPITAL CORPORATION The resolution was read by title only. The City Manager reported that the City Attorney reviewed the lease with Mr. Schreiner, attorney for O'Melveny & Meyers. Mr. Schreiner advised that certain changes were to be made as follows: Section 1, page 1 should read "$650,000 advance rental is to be paid as consideration for the ground lease." Page 6 - paragraph 12, second line: contingency "impossible" should be changed to "Possible". Councilman Morton requested the possib le'd'eletion of the warranty clause onypage 3 and on page 5,.section 7 which is cumbersome, that work changes up to (setting an amount) can be made on the site, subject to representative of the Corporation's approval. It was moved by Councilman Temple, seconded by Councilman Corbin and so ordered that further reading be waived. AYES: Councilmen: Dunnum, Corbin, Morton, Temple, Dickerson After summary of bids for demolition of the apartments ("green" and "brown") located on Second Street across the street from the City Hall, it was moved by Councilman Temple, seconded by Councilman Dunnum and passed by the following vote to award bid to Sav-On Salvage Company, which was $75 higher than the low bid; however, the low bid was a verbal one; to authorize the Purchasing Agent to make an adjustment for allowing the garages to remain for storage purposes until additional storage is added to the City Hall; and authorize the following transfer of funds: $1410 From: Capital Improvements Unbudgeted Account To: Account #13814 - Civic Center Land Acquisition Account AYES: 5 Councilmen: Dunnum, Corbin, Morton, Temple, Dickerson It was moved by Councilman Temple, seconded by Councilman Dunnum and passed by the following vote to authorize the following transfer of funds for the continuing program for demolition of sub -standard buildings. (8134 Comolette and 7208 Pellet): ,^ $791 From: Unappropriated Reserve To: Account No. 9-100-399 AYES: 5 Councilmen: Dunnum, Corbin, Morton, Temple, Dickerson After review of the sole bid received on Purchasing Contract #149 for a 3 Yard, Twin Engine, 4 -Wheel Street Sweeper, it was moved by Councilman Temple, seconded by Counc}loran Morton and passed by the following dote to award contract to the American Hoise"Company in the amount of $11,684.58, for which sufficient funds are budgeted. AYES: 5 Councilmen: Dunnum, Corbin, Morton, Temple, Dickerson It was moved by Councilman Morton, seconded by Councilman Temple and passed by the following vote to award bid #4317 for 2000 feet of 2-1/2" Double Jacket Fire Hose to the lowest and best bidder, Wardlaw Fire Equipment Company of La Habra at the amount of the ,unit price in the bid proposal, rejecting.all other bids. AYES 5 Councilmen: Dunnum, Corbin, Morton, Temple, Dickerson Ater summary of bids for lot cleaning, it was moved by Councilman Temple, seconded by,Councilman Dunnum and passed by the following vote to award the bid to the lowest and best bidder, C. H. Cochran at an hourly rate of $12.50 and that all other bids be rejected AYES: 5 Councilmen: Dunnum, Corbin, Morton, Temple, Dickerson Mr. King analyzed the memorandum report submitted by the committee composed of Mayor Charles W. Dickerson, Councilman Thomas H. Morton, City Manager Oren L. King and Ray T. Lake, Director of Building and Safety as previously appointed by the City Council to bring in a report relative to the need of an appointment of a Hospital Constructim Consultant and Clerk of the Works. This study authorized by the City Council was the result of a recommendation by Mr. Urban Schreiner of O'Melveny & Meyers and the Hospital Corporation that these appointments be made. The Committee recommended first that the Hospital Corporation Board and the City Council should have a construction consultant which they recommended be called a Council Minutes — 3/13/67 -8- 2836 "Project Manager" who would be directly responsible to the Hospital Corporation and to the City Council for proper analysis and checking of the plans relative to any areas of savings to the City, -as well as to expedite the completion of the project in an 6440&VOV to save money for the City. It was estimated by the Committee that the savings incurred by a "Project Manager" would be majnj:y due to the cost of his services at $1,000 per -month, In accordance therewith, the Committee wishes to suggest that the Council recommend the retention of Mr. Maurice A. Baker as "Project Manager" at a fee of $1,000 per month, and authorize the City Attorney to prepare the proper contractual agreement satisfactory to the Hospital Corporation and the City Council. A review of Mr. Baker's experience and his interest in community affairs in the City of Downey presents him as a very qualified, conscientious and capable ccntractor who.is a resident of Downey, -and who would act in behalf of the City in this major construction project. With relation to the Clerk of the Works., it is suggested this responsibility be delegated to the Director of Building and Safety, Mx. Ray T. Lake, in the assigrnment of a qualified man from his Department who will do.the daily inspection for Mr. Lake and I provide the necessary information from daily reports to the "Project Manage'. Councilman Corbin felt a time should be sttipulated in.any agreement entered into. for a. project manager,,and a ceiling be placed for a maximum cost for his services. Mr. John Nordbak, 7235 Via Rio Nido, stated he was of.the opinion the Council would be duplicating services of Albert C. Martin and Associates in hiring a project manager, and that the architectural firm .should he the only ones to follow through and responsible for construction of the hospital- .according to their plans and specific&- tions,approved by Council and the Hospital Corporation. Councilman Corbin concurred with Mr. Nordbak's statements that the architect could do the job for which a project managor would be hired. The Building Director stated that the Hospital Corporation feels it needs someone to keep the project from escalating and that the.Building Department's responsibility is that the hospital is built in accordance with the plans. It was moved by Councilman Corbin, secoiid'ed.hy Councilman Dunnum and so ordered to take the matter of appointment of a project manager under submission until the next council meeting. Mr. King requested authority to grant employee's two hours off duty on Good Friday but City offices to remain open. Council so ordered.
