MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
MARCH 28, 1967
The City Council of the City of Downey held a regular meeting at 8:00 A.M.,
March 28,-1967, in the Council Chamber of the Downey City Hall, Mayor Charles W.
Dickerson presiding.

Reverend David Foster of the Free Methodist Church delivered the invocation.
It was moved by Councilman Temple, seconded by Councilman Dickerson; pursuant to
Section 14 of Resolution No. 1567 dated June 14, 1965, and Resolution No. 1774 dated
August 8, 1966, and passed by the following vote to authorize merit longevity be paid
to the City Manager and the City Clerk,

Mayor Dickerson announced the public hearing on.Planning.Resolution No. 115,
Stewart and Gray Road (former hospital site) and established that the City Clerk had
the Affidavit of Publication. Mr. Goggin presented a resume of the matter.
There being no written and no oral communications or protests,.it was moved by
Councilman Corbin, seconded by Councilman Temple and so ordered that the hearing be
closed.

AMENDING THE ZONING MAP ADOPTED BY SECTION 9107 OF THE
DOWNEY MUNICIPAL.CODE ( PLANNING RESOLUTION NO. 115)

The Mayor opened the hearing on .Planning Resolution No. 119 and the City Clerk
reported she had the Affidavit of Publication on file. Mr. Goggin reported the matter
also refers to setback lines and the proposed resolution amends the Precise Plan of
Setbacks on Downey Avenue between Fires.tone.Boulevard and Third Street.
There being no oral and no written communications or protests, it was moved by
Councilman Temple, seconded by Councilman Morton and so ordered that the hearing be
closed,

PLAN OF SETBACKS ON DOWNEY AVENUE BETWEEN FIRESTONE BOULEVARD AND THIRD
STREET (PLANNING RESOLUTION N0, 119)

It was moved by Councilman Corbin, seconded by Councilman Dunnum and so ordered
that the minutes of the Council Meeting of March 13, 1967, be approved as submitted.
The City Clerk reported on the following written communications:
An audit report from the firm of Diehl, Evans and Company. Ordered received and
filed.
^. A letter from Mr. Irving Gertler, All American Home Center, relative to granting
relief of requirement for additional parking. The City Manager briefed Council on the
situation which exists in the area in question. The City Attorney stated he did not
have before him the current amendment to the Downey Municipal Code setting forth the
findings necessary that Council establish in order to grant such relief as requested by
Mr. Gertler. The matter was held until a copy of the most recent amendment could be
supplied the City Attorney.
A copy of a letter from Mr. Jack F. Garland addressed to Mrs. John Paugh, Chairman
of the Parks and Recreation Commission, concurring with the Commission's recommendation
with regard to the Department of Fine Arts was received and filed.
A complaint for damages from James H. Bannister. It was moved by Councilman Dunnum,
seconded by Councilman Temple and so ordered that the claim be denied and referred to
the City's insurance carrier.

The City Attorney rend Section 9127 of the Downey Municipal Code pertaining to
Parking Assessment Districts listing the findings for waiver of the fee requirement
for additional parking and stated if the findings could be made by City Council, then
the fee can be reduced a minimum amount of the payment required.
It was moved by Councilman Morton, seconded by Councilman Temple and passed by the
following vote that Council make the findings set out in Section 9127 of the Downey
Municipal Code and reduelntgthe minimum amount of $2500 required by Section 9127.3, to absessa
sum of $1.00 per parking space for All American Home Center per Mr, Gertling's request.

north of Firestone Boulevard east of Downey Avenue.

The City Manager suggested that the Mayor, City Attorney and. City Manager be
authorized to enter into negotiations for the.purchase of theFirst Church of the
Nazarene at the southwest corner_of Second and Brookshire within the appraised figures.

t}e following vote to authorize the Mayor, City Attorney and City Manager to enter into
negotiations for the purchase of the First Church of the Nazarene at the southwest
corner of Second Street and Brookshire Avenue within the appraised figures.

The City Manager suggested that an architectural study be made of additional facil-
ities related to the police building and library addition for a -planned program
extended over the next two or three years.

It was moved by Councilman Temple, seconded by Councilman Morton and passed by the
following vote to authorize the employment of Anthony.and Langford according to the City
Manager's recommendation, for an architectural study for the Civic Center Complex,
primarily for police and library, the cost of suchs.tudy ($1,750) to be credited to any
architectural fee which may be negotiated if the Council proceeds with the construction
program as presented by the architects.

After a summation of bids for Cash Contract #161, Woodruff Avenue, Hall Road to
Firestone Boulevard water main,it was moved by Councilman Dunnum, seconded by
Councilman Morton and passed by the following vote to award the bid to the lowest and
best bidder, Robert G. Castongia, Inc. at the unit prices submitted in the bid proposal
and transfer the following funds:

and that all other bids be rejected.

As requested by Councilman Dickerson at the.previous meeting, a report of sidewalk
construction statistics showing that by mid 19.67 there will be 110.62 miles of sidewalk
or 30.2% of the total possible consttiid"ted, was received and filed.

following vote to approve access to the•existing.alley and frontage road, south side
of Imperial Highway, 350 feet east of Paramount Boulevard as requested by property
owner located on the south side of Imperial Highway, east of Paramount Boulevard.

Mayor Dickerson declared a recess with Council reconvening at 9:30 A.M. with
roll call, all members of Council being present.
Mayor Dickerson requested a legal ruling from the City Attorney as requested by
Council at its last meeting on Zone Exception #703, on the permitted uses for the
Immanuel Mennonite Church. The City Attorney advised the Sunday School operation comes
within the permitted uses of an R-3 Zone and so long as it is used solely for Sunday
School and religious purposes, no zone exception is necessary. Council requested that
the City Attorney's communication be made a part of the minutes:

buildings unless the building with which it is joined is one used solely for
religious worship. It would not appear appropriate that the new building be
joined with any kind of a gymnasium or building used primarily for social functions
of the organization-.
"There are no cases which .are..dire.ctly in point, however, the case of Fellow-
ship of Humanity vs. County of Alameda, 153 Cal, App. 2(d) 673 appears to bear out
our conclusion that Sunday School uses are within the meaning 'used solely and
exclusively for religious worship',
"Under the circumstances it would appear that the zone exception need not be
granted as no exception is required in order for the applicant to make the desired
use of the property,"

Mr. Harold Tredway, 11510 Paramount Boulevard, representing appellant in Zone
Exception #703 appeal stated their appeal will be withdrawn.
Councilman Morton urged that the church and developer cooperate with the
neighborhood and citizens in the rear of the church with regard to windows, landscaping,
etc,
The City Manager reported a meeting had been held with the Director of Public Works,
himself and the City Manager and Director of Public Works of the City of Bellflower
relative to moving the southern City Limits of Downey and that further progress will be
presented at a later date,

Mr. King advised that the Century Freeway meeting, is to be held Thursday and that
the School Board has now approved the southern route. He briefly outlined the schedule
to be followed in planning of the freeway and stated that it will be toward the end of
this year before it will be known what route will be decided upon.
Mr. King announced the League of California Cities Conference of City officials
will be held at the Newporter Inn May 18 - 20.

and asked that Council authorize condolences being sent to the family.

The Mayor recognized Mr. Oliver McGill and Al Springer in the audience, members of
the Finance Advisory Committee, and asked if they had something to present to Council.
Mr. Al Springer reported that next week is National Chamber of Commerce Week and
called upon the Downey Chamber's president, Russell Yerkes. Mr. Yerkes thanked Council
for proclaiming National Chamber of Commerce Week next week. He also advised that
Mr. Bill Cole, formerly the assistant manager of the Chamber, has now been hired as
Manager of the Chamber of Commerce and with his knowledge and ability he should do a
fine job.
Councilman Dunnum expressed appreciation to Russell Yerkes for stepping in and
doing the job of manager as well as president of the Chamber in the interim of having
no manager.
Mayor Dickerson stated that he deemed it time that a matter which was taken under
submission relative to a Fine Arts program be renewed at this time and asked for speakers
from the audience.

of Councilmen to discuss the matter of the establishment of a Department of Fine Arts,
or of putting it under the Park and Recreation Department with possibly a Division
Manager working under the Director of Parks and Recreation. Motion died for lack of a
second.
The City Manager recommended that the various cultural groups meet with the City
Manager, the Director of Parks and Recreation and Mr. Hume and go over their goals
during the next two weeks while budget sessions are in progress, with their recommenda-
tions being presented at the next Council Meeting.

Councilman Temple suggested that possibly someone in the City's employ could
assist with the bookkeeping for the cultural groups needing this type of service.
William Goggin, Director of Planning, reported that planning meetings have been
held among cities from Whittier to Long Beach and they would like to set up some
programs of interest to Council in order to invite them to attend some of these meetings.
A request was made for Council to suggest some subjects about which they would be
interested,
Councilman Temple suggested the reviewing and revising of a General Plan.
Councilman Morton stated he was pleased with the action taken by the Downey
Unified School Board on the Century Freeway, He followed his remarks by reviewing the
history of the various actions taken by the City Council of the City of Downey since
1958 on the matter of the Century Freeway, all of which were public records.
Ivan A. Robinson, Chief of Police, reminded Council that he had been authorized to
attend a conference in Sacramento April 4 and in conjunction with this, he has been
advised the City of South Gate City Attorney and Chief of Police plan to attend a legis-
lative session relative to AB -867 and AB -868 concerning affirmative legislation on
pornographic and indecent action on the part of juveniles. He requested permission to
also attend this session. The City Attorney advised they should be very careful about
these specific bills and should refer to the League of California Cities' views.
It was moved by Councilman Morton, seconded by Councilman Temple and so ordered
to approve Chief of Police Ivan A. Robinson's attending the legislative session as
requested, providing there has been full coordination with the City Manager, with the
City Attorney and the League's legal counsel and to take no position which would con-
flict with the League of California Cities.
Mayor Dickerson reported that on Friday, March 31, the City Manager will have been
with the City ten years and he complimented and praised him highly for his work with
the City, stating that it is a fine tribute to Downey. It was reported that the City
^ Attorney and Councilman Scott Temple also will have been with the City ten years within
a short time,
The City Manager, Oren L. King, stated they have been of the most productive and
happy years in his life in this field and he feels the City of Downey is in the same
bracket with Glendale, Burbank, Pasadena and Beverly Hills.
The City Manager reported receipt of a letter from Mr, U. Schreiner of Albert C.
Martin and Associates expressing a desire to meet with the Hospital Corporation relative
to the. Corporation's having an employee of its own for the project for its own protection.
No matter who might be hired for this position, it was stated by the City.Manager that he
feels it will save the City a great deal of money by having this hospital consultant.
It was moved by Councilman Dunnum, seconded by Councilman Morton and passed by the
following vote to recommend to the Hospital Corporation as recommended by the Committee,
Thomas H. Morton and Charles We Dickerson, that they should employ a hospital consultant
(Mr, Maurice E. Baker) with a maximum fee and minimum of time set forth in the contract.
