MINUTES OF THE CITY COUNCIL OF THE CITY OF DOWNEY FEBRUARY 28, 1967 The City Council of the City of Downey held a regular meeting at 8:00 A.M., February 28, 1967, in the Council Chamber of the Downey City Hall, Mayor Charles W. Dickerson presiding. PRtSENT: Councilmen: Dunnum, Corbin, Morton, Temple, Dickerson ALSO PRESENT: Oren L. King, City Manager Carl Newton, Acting City Attorney William A. Goggin, Acting Director of Planning Ervin Spindel, Director of Public Works Hollis Stewart, Park Superintendent Robert Shand, Director of Finance Lee Leavitt, City Engineer Don Robison, Assistant to the City Manager Robert W. Gain,Fire Chief Ray Lake, Director of Building and Safety John Hume, Superintendent of Fine Arts Walter Wanke, Water Superintendent Ivan A. Robinson, Chief of Police Della Doyle, City Clerk Alberta Pfeiffer, Deputy City Clerk Reverend. Henry Blackaby of the First Southern Baptist Church delivered the invocation. Mayor Dickerson opened the hearing on the appeal to Zone Exception No. 702, Winchell Donut sign, and inquired if the City Clerk had the Affidavit of Publication of the notice of the hearing. The City Clerk replied she had the affidavit. Ordered re- ceived and filed. , -- The Mayor then asked the City Clerk if she had received any communications relative to the zone exception appeal. City Clerk Della Doyle replied she was in receipt of a letter from Mr. Harry Boand in explanation rather than in protest. Mr. William Goggin, Acting Director of Planning, reviewed the case. Speaking in favor of the appeal was Mr. James W. Hann, 9232 Samoline Avenue, Speaking in opposition to the appeal was Mr. Stephen G. Skinner, Jr., 2270 E. Alvarado, Fallbrook, former resident of Downey and property owner adjacent to the property in Question. After discussion it was moved by Councilman Corbin, seconded by Councilman Dunnum and so ordered that the hearing on the appeal to Zone Exception #702 be closed. It was moved by Councilman Temple, seconded by Councilman Dunnum and so ordered that the Zone Exception Case #702 be taken under submission to the Council Meeting to be held on March 13, 1967. Mayor pickerson requested a deviation from the agenda and the consideration of the correspondence relative to the Downey Symphonic Society, Inc. at this time. Mr. Robert E. Bird, Chairman of the Board of Directors of the Downey Symphonic Society, Inc. read a letter of resignation from Maestro Mario Cajati, effective at the end of the 1966-67 season, and portions of the letter which had been submitted to Council relative to the activities of the Society. Councilman Temple stated that he is in favor of continuing support of the Downey Symphonic Society if Downey people are used in the orchestra. It was moved by Councilman Morton and seconded by Councilman Corbin to rescind the former action of Council and grant authority to resume monthly payments to the Downey Symphonic Society, Inc. Council Minutes - 2/28/67 -1- 2812 Councilwoman Dunnum remarked that the purpose of the Society was to promote two services to the community and it is Council's desire to have concerts on the same pro- fessional level they have had for those vh o enjoy the listening pleasure of the concerts, but also she is most concerned about offering to the residents of Downey the opportunity to play with the symphonic orchestra. She wholeheartedly agrees to support .the Society the balance of the season, �XUIY4 that she hopes the Society can present to Councils; realistic concrete plans toward the building of a program whereby the citizens can participate. Mayor Dickerson asked for the vote on the motion: AYES: 5 Councilmen: Dunnum, Corbin, Morton, Temple, Dickerson NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Councilman Morton stated Council stands on one accord - Mr. Cajati has done an out- standing job in leading the orchestra over the years. On behalf of City Council he extended to him the appreciation of the service rendered to the City and the level of the music brought. He has done an outstanding job. He commended the Society on moving forward and he reiterated the policy which in his opinion was established marry years ago for professionals as well as non-professionals. Councilman Morton stated that he hoped some of the persons who have resigned from the Society over the past few months would consider joining again and he strongly urged them to assist in helping the organization to move forward. He particularly mentioned Reno Sirrine who had at one time been very active and who, he felt, should be encouraged to get back into the organization. Mayor Dickerson remarked that there is a new concept in the City of Downey, coming into an area in which the average citizens are going to demand more and more, He appealed to those who have resigned to reconsider and re -join the group. Councilman Dunnum stated the City has been giving complete support to the various cultural activities to enhance the City as a cultural center. She feels it might be appropriate to establish a Department of Fine Arts which would be in accordance with the other departments under the City Manager and City Council. Those activities within the community which would be brought within this department would be the Downey Museum of Art, Downey Symphonic Society, Downey Children's Theatre, Downey Youth Band, Downey Civic Chorus and the Downey Historical Society. Mayor Dickerson stated it was Councilman Morton who envisioned this possibility many years ago, but it had been turned down. He wished to point out that the matter had been considered previously. Councilman Morton advised that Council has wrestled with the idea and $75,000.00 has been spent each year on cultural activities within the City and he feels it is time to give the status it warrants. It was moved by Councilman Temple that the City Attorney be directed to prepare an appropriate ordinance to set up a Department of Fine Arts. Councilman Corbin stated he felt it should not be set up as a department, which would involve additional personnel, funds, space for operation, etc. but that it should be considered as a commission. He felt it is something which can be handled by the Park and Recreation Department. Councilman Temple withdrew his motion and suggested that the matter be considered at the next council meeting. Councilwoman Dunnum reminded Council that these organizations have directors or boards already which is not the case in many of the other activities now classified under Park and Recreation. Whether it is a department or division or commission will depend upon how much these groups wish to do and on how much support the City Council wishes to give. Both approaches should be given very serious consideration, she stated. Council Minutes - 2/28/67 -2- ;813 It was moved by Councilman Morton, seconded by Councilman Temple and approved by unanimous consent that the matter of setting up a Department of Fine Arts, a Division or Commission be considered at the next morning Council Meeting of March 28, 1967. Mayor Dickerson declared a 5 -minute recess with Council reconvening at 9:25 A.M. with roll call, all members of Council being present. Mayor Dickerson opened the hearing on weed abatement. There being no oral and no written comments or protests, it was moved by Councilman Corbin, seconded by Councilman Temple and so ordered that the hearing on weed abatement be closed. It was mov0d by Councilman Temple, seconded by Councilman Dunnum and passed by the following vote that the Director of Public Works be instructed to arrange for informal bids and submit recommendations and alternates for an hourly rate as well as by the lot, and to also submit the cost figures for the same job done last year. Thd City Clerk reported on the following correspondence: Letters from the Downey Chamber of Commerce (1) regarding zone exception require- ments; (2) zoning committee study and recommendations; and (3) request for copies of resolutions, ordinances and agenda. Mr. Robert Reed, 10005 Pico Vista reviewed the communications from the Downey Chamber of Commerce, reiterating their requests. Council agreed that the request regarding zone exception requirements warrants study and directed the City Attorney and Planning Department to study and report at the next morning Council Meeting, March 28, 1967. Councilwoman Dunnum stated she believed it should be agreeable to mail the copies of ordinances and agenda requested by the Chamber of Commerce. Councilman Morton stated he is not in accord as Council has adhered to one policy with regard to all organizations relative to minutes, agenda, resolutions and ordinances and that he feels the Council should adhere to the regular practice which it has been following. Mr. Leslie Olson stated that where there are changes being proposed to the zoning ordinances and policies, the information is not received in time for their committees to study it. It was pointed out to Mr. Olson thatthe information or proposals are made available to the public at the same time, or even sooner, than the City Council receives it prior to council meetings. In studying the General Plan, once a proposal is made there will be a special study in open sessions to the general public the sessions being informal, in order to prepare something for a public hearing. Chamber of Commerce representatives and any others are welcome to attend these meetings. A letter from the Civil:Defense and Disaster Board, Area "E" of Los Angeles County relative to revised warning systems. Ordered received and filed. A letter of appeal from Mr. James V. Schneider relative to a proposed relocation of a residence in Huntington Park to 7374 Rio Hondo Place in Downey. It was moved by Councilman Corbin, seconded by Councilman Dickerson and so ordered to set a public hearing for 7:30 P.M., March 13, 1967, in the Council Chamber of the Downey City Hall. Communication from Assemblyman Carley V. Porter relative to legislation changing the requirements for publishing prevailing wage scales when calling for contracts for public works, stating it does not appear possible to obtain such a measure at this session of the Legislature. Council Minutes - 2/28/67 -3- It was moved by Councilman Temple, seconded by Councilman Corbin and so ordered that a committee be appointed from Council to recommend positive action on the pre- vailing wage scale publication legislation. Councilmen Temple and Dickerson were appointed as the committee. Councilman Dunnum stated that she felt it would be advisable to have representatives from other cities to work with this committee. Councilman Temple suggested that the Independent Cities might assist; Councilman Dunnum stated possibly the Southeast Cities would also like to work with them. A letter from the Youth Advisory Committee relative to the lasering of age limit fof minors in a public pool or billiard room, indicating a committee study of a similar request in 1964 recommended that no change be made. This committee has found no significant change in community circumstances justifying a lowering of the age limitations and recommended that Council decline Mr. Arnold Paul's request for the Downey Bowling. Center. It was moved by Councilman Dickerson, seconded by Councilman Morton and passed by the following vote to uphold the Downey Youth Advisory Committee's findings of 1964 and abide by them, and that Mr. Paul's request be denied. AYES: 5 Councilmen: Dunnum, Corbin, Morton, Temple, Dickerson NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None ,A communication from the Division of Highways relative to the bearing on Thursday at 10:00 A.M., March 30 in the South Gate Auditorium on the proposed location of Route 42 Freeway from Central Avenue to the Route 605 Freeway. (Century Freeway,) The Mayor urged a full City Council to be present at this meeting if at all possible. The City Manager stated the Realty Board had asked that the "Facts Relative to the Location of the Route 42 Freeway Between Central Avenue and the Route 605 Freeway" be presented at their breakfast meeting Wednesday morning and invited any Councilman to also attend. ORDINANCE NO. 327 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY ADDING SECTION 9127.20 TO THE DOWNEY MUNICIPAL CODE WHICH SECTION RELATES TO RAMP STANDARDS (PLANNING RESOLUTION NO. 109) The ordinance was read by title only. AYES: 5 Councilmen: Dunnum, Corbin, Morton, Temple, Dickerson NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Council Minutes - 2/28/67 -4- 2F3�.5 The City Manager asked that Council deviate again from the agenda and permit Mr. Urban J. Schreiner to present recommendations of the Downey Municipal Hospital Corporation relative to appointments of a construction consultant, clerk of the works, trustee, as well as an explanation of tax exemption procedure. Mr. Urban Schreiner, 433 S. Spring Street, Attorney with O'Melveny & Meyers, legal counsel for the Hospital Corporation, stated that Mr. John Aird, Jr. had been recom- mended by the Hospital Corporation for the position of construction consultant. Mr. Aird is very highly qualified for this appointment. .The fee was set for his services at $25,000.00 Councilman Morton stated he would like to see if City Council could obtain someone within the City in the light of the fee involved. Mayor Dickerson stated in view of such short notice of these recommendations he feels there should be time to study this further, and it was suggested that two council- men be designated to study and report their findings at the next Council Meeting. Councilmen Dickerson and Morton were designated to review the matter. Councilman Morton stated the appointment of the Clerk of fhe Works recommended by the Hospital Corporation is again going outside the City. The primary consideration of the members of the Hospital Board of Directors should be having someone expert reporting back and responsible to the Directors - thus having a buffer between them and the responsibility they undertake to have someone liable for that service. Councilman Morton stated that if there is someone capable to do the job, it should be kept within the City. Councilman Corbin inquired about the liability involved if something should go wrong. Mr. Schreiner stated that Mr. Aird is covered by liability insurance as a construction consultant and would be liable. Councilman Morton also stressed further consideration should be given to the hiring of the consultant and clerk of the works due to increased costs arising for materials, etc., and additional services being required from time to time. Mr. Spindel stated that the City Attorney had reviewed the Joint Agreement and made several changes: on Page 1, Paragraph 2, starting with line 28, the entire paragraph is to be deleted; on Page 2, the tat portion of the paragraph #3 to line 7 is to be deleted, such paragraph to begirt,' "Company does hereby surrender . "; and Paragraph 4, page 2, end of second sentence - insert and add at end of sentence on line 20: "except; such permits as may be required for making improvements within the public way." Mr. Spindel stated the corrections by Attorney Sorensen are all favorable to the City of Downey and have been orally approved by the California Edison Company. Simpson Company in the amount of unit prices submitted in the bid proposal and reject all other bids. AYES: 5 Councilmen: Dunnum, Corbin, Morton, Temple, Dickerson NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Mr. Spindel reported that plans and specs for reconstruction and widening of Manatee Street between Brookshire Avenue and Patton Road have been completed. Also included in the proposed improvement is the completion of the alley construction along Margaret Street between Brookshire Avenue and Patton Road. Estimated cost if $18,000.00. It is proposed to complete curb, gutter and pavement prior to commencement of constructicn of the hospital site and since work on the hospital site is scheduled for within the next few months, it is recommended that authority be granted to proceed with construction on the Manatee Street project. An appropriation of $18,000 from Account No. 13814, Capital Improvement Unbudgeted to Account No. 13818, Manatee Street improvement was also recommended. Mayor Dickerson suggested this item be held until near the completion of con- struction on the hospital in view of the fact there will be heavy equipment moving along the street for which improvements are proposed. So ordered. After summation of bids for Cash Contract #178, Florence Avenue, Tweedy LajW.to Paramount Boulevard, it was moved by Councilman Temple, seconded by Councilman. Morton '> and passed by the following vote to award the contract to Witon Company, the lowest and best bidder, in the amount of the unit prices submitted in the bid proposal and that all other bids be rejected. Rullo Enterprises, in the amount of unit prices submitted in the bid proposal and all other bids be rejected. Councilman Dunnum stated it might encourage more people to install sidewalks. A report was submitted by Mr. Spindel on observations made on the effects of the remedial actions taken on Deming Avenue between Gardendale Street and Lakewood Boulevard. It was stated that a double line was put down the center line of Deming Avenue which is rather curved, and also 25 MPH signs placed on Deming Avenue close to the entrances from Gardendale and Lakewood. Radar observations of speed were made prior to this action and after. The effect of the center line and speed signs is that the average speed has been reduced from 32 MPH to 28 MPH. Also, steps have been taken to clear the shrubbery around the intersection of Deming Avenue and Castana in order to increase visibility. Continual observation will be made in order to try to maintain the area as safety as possible, and, if necessary, other remedial actions will be recommended. The City Manager reported that a request be made by the City Council for the holding of a public hearing before the Planning Commission to amend the precise plan of setbacks on Downey Avenue between Firestone Boulevard and Third Street. He stated this will reduce the present precise plan which requires a 25' reduction to either 15' or 18' radius. Firestone Boulevard will be reduced 35' to 25' radius and still provide sidewalk area. Otherwise, it would require removal of 5' of the buildings at the corner intersections. It was moved by Councilman Corbin, seconded by Councilman Dunnum and so ordered to authorize a joint meeting with Supervisor Bonelli and the Mayors, City Managers and Public Works Directors of the Cities of Norwalk and Downey in an endeavor to arrive at a joint agreement and financing arrangements for projects outlined below, over the next 3 to 5 years: Council Minutes - 2/28/67 -10- 2821. A. Imperial Highway between 605 Freeway and Woodruff Avenue. (Mutual traffic problems.) B. Consideration of the widening of the 'bridge across the San Gabriel River on Imperial Highway, while existing Imperial Highway has six lanes, the bridge now provides only four lanes of traffic which are filled at peak hours due to heavy industrial traffic from the area. C. The widening of this bridge is part of the street improvements program included in the Ten Year program adopted by the City Council. D. Also, the possibility of shifting the City boundary at Cecilia Street, east of the San Gabriel River, to the center of the street. Councilman Dunnum requested that Council be notified of the meeting date. The City Manager reported that a meeting has been arranged for Tuesday, March 7 at 10:00 A.M. with the City Managers and Public Works Directors of both Bellflower and City of Downey to further discuss the shifting of the City boundary on Gardendale and on Foster Road between Lakewood Boulevard and the easterly city limits, and relatdd costs. Councilman Dunnum requested that Council be notified. The City Manager commended the City Clerk and her staff for codifying the 326 ordinances passed since the City was incorporated and bringing the Downey Municipal Code up-to-date with savings of many thousands of dollars by making this an annual procedure. It was reported '_b.y- the City Manager that A. C. Martin and Associates have advised that the State Bureau of Hospitals will require specific hospital zoning for the Downey Municipal Hospital site. It was suggested that the City Council request the Planning Commission to proceed with the zoning of this area to a C-3 Zone (presently M-1), subject to the approval of a conditional use permit for hospital purposes. Councilman Dunnum suggested that the City Attorney report back what effect the present tract restrictions will have or effect there will be with regard to any change upon the surrounding area.
