OF THE CITY OF DOWNEY
JANUARY 24, 1967
The City Council of the City of Downey held a regular meeting at 8:00 A.M.,
January 24, 1967, in the Council Chamber of the Downey City Hall, Mayor Charles W.
Dickerson presiding.

Councilman Thomas H. Morton delivered the invocation due to the absence of the
regularly scheduled minister.
Mayor Dickerson announced a presenoation of certificates to two water department
employees was to be made by Walter Wanke, Water Superintendent. The Mayor assisted in
presenting certificates to James Rubin for completion of a course in Water Treatment
and to Daniel Shonkwiler for completion of a course in Municipal Public Works Adminis-
tration.
Mayor Dickerson opened the hearing on the intention to vacate a drainage easement,
Mr. Spindel reported the drainage easement is located in_what was formerly Lindell
Avenue, a portion of which was vacated easterly of Lakewood Boulevard with a reserva-
tion of a drainage easement which is not necessary for City purposes. At the request
of the property owner, it was recommended by the Planning Commission and the Department
of Public Works that the drainage easement northerly of the centerline of Lindell
Avenue be vacated.
There being no written and no oral protests or communications, it was moved by
Councilman Temple, seconded by Councilman Corbin and so ordered that the hearing on the
vacation of the drainage easement be closed.
RESOLUTION NO. 1856
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING
THE VACATION OF A CERTAIN DRAINAGE EASEMENT (LINDELL AVENUE)

The Mayor opened the hearing on the intention to vacate a portion of the radius
at the northwest corner of Second Street and LaReina Avenue. Mr. Spindel stated that
should it not be vacated, it would create a hardship on the developers. The vacation
has been recommended by the Planning Commission and Department of Public Works.

RESOLUTION NO. 1857
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING

OF SECOND STREET AND LA REINA AVENUE

The City Clerk reported that the hearing on Planning Resolution No. 109 had been
advertised for the 14th of February rather than the 24th of January; therefore, the
matter would of necessity have to be held over to the 14th of February for hearing.
Mayor Dickerson opened the hearing on DIP #555, Alameda Street, with Mr. Spindel
reporting that the City Council, in prior action, had authorized the Department of
Public Works to initiate Chapter 27 proceedings against the properties, and right of
entry has been obtained through condemnation proceedings authorized by Resolution
No. 1782 on August 23, 1966, under Select System Project #150. The property owner
of the 2 sites under DIP #555 has been requeat6d to proceed with the improvements
which include curb, gutter, driveways, sidewalk and paving but to date, no work has
been done. The estimated cost of these improvements is $2,200.00.

Mr. Robert S. McLane, speaking for Mr, E. O. Felton, property owner, 8050 Downey
Avenue, questioned the property owner's having to bear the cost of these improvements
under Chapter 27.
After an explanation of Chapter 27 pm ceedings by the City Attorney, it was moved
by Councilman Morton, seconded by Councilman Temple and so ordered that the hearing be
closed on DIP #555.
It was moved by Councilman Temple, seconded by Councilman Morton and passed by
the following vote to authorize the Director of Public Works to proceed under Chapter
27 to improve the property at 8012 Alameda Street and the Alameda Street frontage at
12202 Paramount Boulevard with curb, gutter, driveways, sidewalk and paving.

It was moved by Councilman Temple, seconded by Councilman Dunnum and so ordered
that the minutes of the Council Meeting of January 9, 1967, be approved as submitted.
The City Clerk reported on the following correspondence:
A report from the Downey Junior Chamber of Commerce, July l to December 31. Ordered

received and filed.
A.petition for cleanup of 9255 Elm Vista Drive Mr. Ray Lake, Director of Building
and Safety, stated the property owner has been prevented from attending to this m+tter
due to illness and requested that the property owner be allowed another 30 days in which
to clean this property.
It was moved by Councilman Temple, seconded by Councilman Morton and so ordered to
grant a 30 -day extension for cleanup of the property at 9255 Elm Vista Drive.

Quarterly report from the Downey Civic Chorus was ordered received and filed.
A petition from Service Station Operators requesting a one-year moratorium on
the building of new service 'stations.'
The City Attorney stated the moratorium requested was impractical and either a
change in zoning through amendment of the zoning brdinance would be necessary, should
Council feel there were sufficient service stations within the City. No action on
the matter was taken by the City Council.
A request from Mr. Jack W. Laister to lease the building at 11504 Brookshire
Avenue as well as a request from the Gordon Electric Company to continue its rental
during the period of approximately two years during the construction of the hospital
was reported on by the City Manager,
Mr. King stated that there are four buildings on the present hospital site,
previously known as the Trenery property. The buildings identifiedas11516 and 11512
Brookshire are the 2 which are adjacent and closest to the location of the new hospital
construction. In conference with Mr. Jot Lloyd of A. C. Martin, it has been determined
that the southernmost building, 11516 Brookshire, now occupied by Laister Sailplane
Products, would be the most convenient for occupancy by the hospital contractor, and
the next building at 11512 would be most convenient for architectural purposes, Clerk
of the Works and City inspectors. Both of these buildings have lavatory facilities
and office accommodations, as well as storage space and parking areas.
It was moved by Councilman Morton, seconded by Councilman Corbin and passed by the
following vote to approve rental of the building at 11504 Brookshire Avenue to Laister
Sailplane Products for $170 per month, and permit the Gordon Electric Company to con-
tinue its rental at $125 per month during the period during construction of the
hospital, approximately two years, with a 90 -day cancellation clause.

A memorandum from the City Manager advising of the app]tcation of the Perk Water
Company for authorization from the Public Utilities. -Commission to increase its rates
for water service. Ordered received and filed.
A legal claim from Philip D. Ringer. Itwas moved by Councilman Morton, seconded
by Councilman Temple and passed by the following vote to deny the claim and refer to
the City's insurance carrier.

A request from the Downey City Youth Band requesting the budget payment of $700
as allocated in the current City budget. It was moved by Councilman Morton, seconded
by Councilman Corbin and passed by the following vote to approve the request to
advance the $700 allocated to the Downey City Youth Band.

A list of locations Th ere it is proposed to remove trees at various locations
throughout the City, submitted to Council, as explained by Mr. Spindel, Director of
Public Works, was comprised of requests by various property owners concerned.
Mr. Spindel stated it would be in the interest of public safety and economy that
their requests be granted and the estimated cost of the work indicated is $9,500.00.
Mr. Spindel also reported that as many as twice the number of trees are planted as
are taken out.
After discussion and a request by the Mayor that a report be submitted at the
next Council Meeting from the Department of Public Works on the amount of trees
removed last year, it was moved by Councilman Corbin, seconded by Councilman Dunnum
and passed by the following vote to approve the specifications and grant authority to
advertise for bids for Cash Contract #176, tree removal in various locations throughout
the City.

It was moved by Councilman Dickerson, seconded by Councilman Morton to table for
further study, the plans and specifications for Cash Contract #193, east wing addition
to the City Hall (Police Department) to consider the possibility of having a two-story
building rather than extending into the patio area.

the following vote to amend the motion to include the west wing plans.

Councilman Dunnum stated she hoped the plans would be ready by the second meeting
from this, assuring that all department heads concerned have been consulted for their
suggestions and consideration.
Mayor Dickerson called for the vote on the motion taking the wings additions under
submission to be considered again not later than the next morning meeting of Council.

for the acquisition of property known as Parcel 2, Margaret Court.

The City Manager reported the owners of buildings at 8134 Comolette, 8760 and 8772
Pritchard, 7208 Pellet and 6515 Rivergrove have been notified as provided in Section 8206
of the Downey Municipal Code, to bring the buildings up to safe standards but none have
so far complied. Therefore, in accordance with the recommendation of the Director of
Building and Safety, under Section 203 of the Uniform Building Code, and Chapter 10,
Uniform Housing Code, it was suggested that the Council order the demolition and removal
of these unsafe and substandard structures and that the necessary sewer laterals be
capped.
It was also recommended that the estimate of A-1 Demolition Contractor be approved,
as outlined below:

The City Manager presented Dr. Henry Reining, Dean of the School of Public
Administration of USC (Personnel Consultant), who presented the tentative proposed
Personnel Classification Plan. Mr. Reining stated the classification plan is an
occupational inventory of all the positions in the City and that any changes made
are minor:
The City Manager stated that in from 30 days to 2 months, it is hoped the
classification plan can be re -submitted to Council for their approval and aloption.
It was announced that a hearing will be held before the Personnel Board this Thursday for
further comments from City employees.
Councilman Dunnum stated the City Council, employees of the City and the community
have been very privileged to have Mr. Reining working for the City in this consultant
capacity.
Councilman Dickerson congratulated Mr. Reining on expediting the study.
Mr. Reining stated the compliments belong usually to the Administration. Several
thousands of dollars (probably around $10,000) have been saved by having the reclassi-
cation study done by the City.
Councilman Dunnum reported that the Downey Dolphins or Acquatic Club was to have
a recommendation to present Council regarding use by the Park and Recreation Department
of Downey Pool; however, at the School District's Board Meeting, the matter was
referred to the Administration of the Downey Unified School District for a meeting at
10:00 A.M. this morning, as reported by Mr. James Ruth, Director of Parks and Recreation
Department; therefore, there can be no action by Council at this time.
Mr. Morales, 9414 Sideview Drive, of the Downey Dolphins, stated that they can
merely wAtt until the action of the Downey Unified School District and this group
therefore had nothing to present at this time.
Mr. King stated that the School Board will consider letting the City Park and
Recreation utilize the school pool for the two groups, the Downey Dolphins and
Acquatic Club.
Mr. Spindel reminded Council that it had requested a report on the striping of
Deming Street in order to limit the speed problem. He reported the striping has
been accomplished. Also 25 miles per hour speed limits have been put up at each
approach of the street. Because of weather conditions, it has been impossible to
make a complete study, The resident at the corner has agreed to cut down shrubs
to improve sight. Motorists will be cited for crossing the double line. The
Department of Public Works will have further report at the next Council Meeting.
The City Attorney stated a letter directed to the Chief of Police involving a
false arrest action had been referred to the attorneys for the City's insurance
carrier as well as himself. The amount of the action is in excess of the City's
coverage, however the City Attorney stated the matter seems to be a rather routine
^ case and the City could be exposed to a judgment, but he cannot see any advantage
of employing additional counsel but feels the legal counsel of the insurance carrier
should be sufficient. Unless advised to the contrary, the City Attorney stated he
will so inform the insurance carrier in writing.
The City Attorney stated the property owner has requested a modification in
the agreement between the City and himself in the Downey Avenue improvements being
undertaken. Mr. Governale's building is to be torn down completely and certain
problems have arisen making a modification necessary. Subparagraph (c) of
Paragraph 5 should be modified in the first portion to read as follows:

(c) City shall deposit in escrow within 120 days from opening of escrow
the sum of $40,600.00, plus $2,850 demolition costs. Said sum shall
be paid out to owner or owner's assignee as follows:
(1) When dehd properly executed has been deposited in escrow,
$23,150.00 may be paid over to remove the existing trust
deed on the property and for demolition costs, and the
balance of said sum to be applied to the cost of con-
struction for a new building to clear the right of way
needed for Downey Avenue. Remainder of said $40,600.00
($20,300.00) shall be paid . . .

Deputy Fire Chief Warren reported there has been a change initiated in response
procedures. Only the District engine will be responding with lights and sirens;
all assisting companies will be responding only with lights. This will eliminate 3,
4 or 5 pieces of equipment with sirens which exposes people to possible accident.
This is on a trial basis but has proved satisfactory with other cities having used this
method of response.
Councilman Morton apologized for missing the last council meeting, indicating
there was a death in his family, requiring that he go back east. When he returned,
he learned of the resignation of one of the Downey Symphonic Society's prime members.
He reviewed for Council the action taken by the Society in requesting additional funds,
the action subsequently taken by Council in allowing the request, which appeal was
made so strongly by Mrs. Phillips. Mrs. Phillips had gone to great lengths to appeal
for the additional $2,000 with the statement that primarily the funds would be used
with regard to expanding its efforts in using Downey people rather than professional
musicians. Council had approved the request basically on this stipulation. It appears
there is some confusion in the Society; Mrs. Phillips has not had its support,
especially since she presented the appeal and there has been no increased activity to
use non-professionals.
Councilman Morton stated he feels it would be in order to hold such additional
funds pending a complete report from the Society of its intent.
It was then moved by Councilman Morton to withhold additional funds originally
budgeted until such time as the Downey Symphonic Society provides in writing to the
City Council,its intention to support the presentation made by Mrs. Phillips.
Councilman Dunnum stated she would not like to see the Society jeopardized in its
future activity, but knows that the volunteer approach has not been followed through.
Councilman Dunnum reported that the Board is considering entering into contract
with the Director. He has not had a written contract heretofore and the inquiry was
made by her of the City Attorney as to whether it can be the same kind of personal
service contract which can be terminated at any time; how it might be affected by
the Musicians Union; would the City Council be within its proper jurisdiction to
request permission to review the contract prior to its being entered into? The com-
bined sum now going to the Director is $150 from the Park and Recreation and $150
from City Council.
After these statements Councilman Dunnum then seconded the motion of Councilman
Morton to withhold further funds from the Downey Symphonic Society.
R. L. Shand, Director of Finance, stated the additional funds of $2,000 had been
paid to the group and asked if there might be a moratorium on the budget for further
funds.

industry to come to Southern California and to Downey.

in lieu of also sending a letter of commendation as suggested by Councilman Morton.

The City Manager briefly presented Mr. Russell Reynolds, Purchasing Agent of the
City since January 16.
The City Manager than asked Albert C. Martin and Associates to make their
presentation on the completed construction documents for the Downey Municipal Hospital.
Mr. Albert C. Martin stated he is very pleased to submit the Construction Docu-
ments to the City of Downey for Building Department Plan Check and subsequent issuance
of building permit for subject project. Submitted were two complete sets of working
drawings; one set of structural calculations; two complete sets of specifications;
one copy of LeRoy Crandall and Associates soil report.
There are 123 regular sheets of drawings in each set. Mr, -Martin reported that
these documents have also been submitted to the Bureau of Hospitals of the State of
California. Plans cannot be placed out for bid without the Bureau's approval.
Councilman Morton commended Albert C. Martin and Associates for doing an outstand-
ing job in adhering to the schedule. Mr. Martin's personal touch can be seen throughout
which is just what the City Council originally requested, said Councilman Morton.
Councilman Corbin complimented the firm for holding very closely to the budget,
and added they have done an excellett job.
