FEBRUARY 14, 1967
The City Council of the City of Downey held a regular meeting at 7:30 P.M. on
February 14, 1967, in the Council Chamber of the Downey City Hall, Mayor Charles W.
Dickerson presiding.

Reverend C. Rodgjr Meyerof the Lutheran Church, Sixth and Paramount, delivered the
invocation.
Mayor Dickerson opened the hearing on the appeal to Zone Exception #695, Brain
property located at Florence and Downey Avenues.
The Mayor asked the City Clerk if she had the Affidavit of Publication. The City
Clerk replied she had the affidavit. Ordered received and filed.
The Mayor then requested William Goggin, Acting Director of Planning, to present
a resume of the Zone Exception #695, The property owner is requesting CH and other
C-1 and C-3 uses of the property which is presobtly zones R-1.
Mayor Dickerson inquired of the City Clerk if she had received any written communica-
tions or protests to the zone exception, City Clerk Della Doyle replied she was in
receipt of a written communication from Dr, James Rue and one from the Downey Homeowners'
Association in protest to the appeal. They were ordered received and filed.
Speaking in favor of the appeal were the following persons:
Robert Wendt, 10840 Paramount Boulevard. Mr. Wendt read a letter dated
November 30, 1966, from Robert Brazelton, President of the Downey Homeowners' Association
favoring the appeal with conditions.
Bob Brain, representing the Brain family, owners of the property in question.
Russell M. Yerkes, 8439 Gainford, who wished to state for the record that he
has no financial or fiduciary interest in the matter and that he is not personally
acquainted nor more than occasionally involved with the interested persons.

Speaking in opposition to the Zone Exception appeal were the following persons:
Edna Barr, 8362 Dinsdale. She stated she was asked to read a letter from
Robert Brazelton of the Downey Homeowners' Association reversing its former stand
in favor of the appeal.

Rebuttal was made by Robert Wendt, 10840 Paramount Boulevard, representing the
appellant.
It was moved by Councilman Morton, seconded by Councilman Corbin and so ordered
that the hearing on the appeal to Zone Exception #695, Brain, Florence and Downey
Avenues, be closed,
Councilman Morton stated he wished to state what his position has been and would
like to repeat what he has often said before. At the time he first ran for City
Council, many property owners will recall at that time Florence Avenue was one of the
issues. He urged t1bat the Master Plan be adopted as quickly as possible. The Master
Plan has since been brought into fruition as a guide to be used for development in the
future. He mill support the General Plan until such time as it might be changed. It
is susceptible to review in 5 years or less, and it was upon his suggestion that this
factor was added to the General Plan. Each time the problem on Florence Avenue zoning
has arisen, he has urged that the property owners involved get together; the City
Council authorized them to use their offices. Unfortunately the property owners have
reacted very adversely to the present proposal for use of the property located at
Florence and Downey Avenues and have not been able to resolve among themselves,
Councilman Morton stated he will continue to support the General Plan until it is
changed. He does not feel that a zone exception is the proper way to change it. He
feels that it needs a re -study. The property owners have gone to great lengths to
develop the property to the liking of the adjacent property owners. He stated the
General Plan was developed on the basis that the City Council would protect the resi-
dential areas and on the basis that the Planning Commission would be restricted to
certain defined areas: industrial, parks use, schools. The City Council spent
thousands and thousands of dollars to restore the downtown core area. At the present
time there are a tremendous number of vacancies.,. putting taxpayers' money into the
downtown area in trying to save the area. He does not believe that this request meets
the code as it has been set out. The vast majority of the people in his district are
opposed to the granting of the zone exception in question. Until the General Plan can
be changed by public hearing, he goes on record as supporting it.
It was moved by Councilman Morton, seconded by Councilman Temple to deny the appeal
to Zone Exception #695, and uphold the decision of the Planning Commission. The motion
passed by the following vote:
Councilman Dunnum prefaced her vote with comments that she feels each of the
Council should look at the situation realistically and impartially as an area of overall
community interest. Under certain conditions, exceptions could be granted to the
General Plan. The Planning Commission feel constrained to follow the General Plan. The
City Council act as an appeal board. It should examine every application that is
appealed realistically. As the City has grown, it is located on two very busy highways.
The property in question is zoned R-1 but it cannot be developed as R-1. There is
business to the east and to the west on Florence Avenue, Mrs, Dunnum stated she feels
the commercial development is a realistic one. The City Council has the basic factors
before it that it could grant a zone exception in this case. It is best to have a re-
zoning but which comes first is not really clear. The opixfon of many is to conform to
the General Plan until it is changed, but it seems in this case the justification is
there.

It was moved by Councilman Morton and seconded by Councilman Temple that the Planning
Commission be directed to initiate a re -study of Florence Avenue property as well as any
other areas in the City of Downey that should be studied in the General Plan.
Councilman Morton stated that certain contractors have indicated they would like to
see some other apartment areas zoned, and it may be propitious to indicate a modified
study.
Councilman Corbin wished the motion amended to state a study be made of the entire
General Plan.
Councilman Dunnum felt a priority list should be set up as to what areas should be
reviewed first, with an ultimate study of the entire General Plan.
Mayor Dickerson called for the vote on the motion as amended to initiate a review of
Florence Avenue zoning with subsequent review of the General Plan, setting up of a priority
list at such time as Council elects to do so.

Councilman Morton requested Mr. Gehling, if he would as spokesman, meet with the
president of the Homeowners' Association and come up with a committee of people in the
area to meet with him (Councilman Morton) in the immediate future.
Mayor Dickerson declared a 5 -minute recess with Council reconvening at 9:25 P.M. with
roll call, all members of Council being present.
Mayor Dickerson opened the hearing on Planning Resolution No. 109 and inquired if
the City Clerk had the Affidavit of Publication of the Notice of Hearing. The City Clerk
replied she had the affidavit. Ordered received and filed.
Mr. William Goggin, Acting Director of Planning, reviewed the Planning Resolution
relative to ramp standards.

SECTION 9127.20 TO THE DOWNEY MUNICIPAL CODE WHICH SECTION
RELATES TO RAMP STANDARDS (PLANNING RESOLUTION NO. 109)
The ordinance was read by title only. It was moved by Councilman Temple, seconded
by Councilman Corbin and so ordered that further reading be waived.

A letter from the First Church of the Nazarene regarding possible sale of the
property belonging to the church at Second Strett and Brookshire Avenue. It was moved by
Councilman Morton, seconded by Councilman Temple and passed by the following vote to
grant authority for the City to make an appraisal of the property.

A letter from Mr. George Binder requesting the City to take over the obligation for
paying the $100 monthly rental for the Southern Pacific parking lot at La Reina and Nance
Streets. The City Manager stated this matter is being studied by the Board of Parking
Place Commissioners and to date they have not come up with a recommendation. Councilman
Corbin recommended that a report be submitted within 30 days at the next council meeting
to be held on March 13, 1967.
A letter from Russell G. Lamkin, Standard Beauty Supply Company relative to
additional dox3dtown parking. The letter was referred to the Board of Parking Place
Commissioners.
A letter of commendation to Mr. Harold Williams, custodian at Furman Park. Ordered
received and filed.
Appeals to Zone Exception Case No.'s 702, 8636 Imperial Highway (Winchell Donut sign);
Zone Exception 698, Lakewood Boulevard and Cecilia and Zone Exception 703, Immanuel
Mennonite Church.
It was moved by Councilman Corbin, seconded by Councilman Dunnum and so ordered to
set the public hearing on Zone Exception #702, Winchell Donut Sign, for 8:00 A.M.,
February 28, 1967, and set the hearings on Zone Exception #698 and #703 for 7:30 P.M.,3/13/67,
in the Council Chamber of the Downey City Hall.
A letter from Fischbach and Moore relative to their missing bond coupon accompanied
by Affidavit of Missing Coupon. It was moved by Councilman Morton, seconded by Councilman
Temple and passed by the following vote to authorize the City Treasurer to pay the amount
of the missing coupon to Fischbach and Moore.

A complaint for damages from John P. Sentell, Jr. It was moved by Councilman Temple,
seconded by Councilman Corbin and so ordered that the claim be denied and referred to the
City's insurance carrier.

A letter of resignation from Planning Commission member, J. Arch Morris. Councilman
Corbin requested this matter be held for a couple of weeks. So ordered.
Letter from Rotary Club of Downey asking permission or authority to install four-way
test signs on the eleven Downey Welcome Signs at the entrances of the City of Downey.
It was moved by Councilman Dunnum, seconded by Councilman Morton and so ordered to
approve installation by Rotary Club or Interact Club members of four-way test signs on
the eleven Downey Welcome Signs at the entrances to the City of Downey.
A letter of commendation for Golden Park development and petition requesting the:
1. Widening of Golden Avenue at the intersection of Golden with Castana;
2. Erection of a stop sign at the southeast corner of Golden, intersecting
Castana;
3. Chaining off both ends of the parking lot at the close of the hours of
supervision each day.
This request was referred to the Department of Public Works. Mr. James Ruth, Park
Director, stated the item of chaining off the parking lot can be handled immediately.
A letter from Mr. Arnold Paul, Downey Bowling Center, requesting the lowering of
age limits to play billiards. The letter was referred to the Youth Committee for study
and report.
A letter from Barbara Wallace, requesting a light over the marked pedestrian walk
at Pomering Road and Florence Avenue. Councilman Morton stated he feels a light is
also needed at the crosswalk on Lakewood Boulevard across from the Jewish Temple, and
he would like this location also reviewed for possible overhead safety light. Mr. Spindel
stated this had been referred to the State and they should be hearing soon. The Pomering
Road -Florence Avenue matter was referred to the Department of Public Works.
A letter from Dana Miller, 9609 Horley Avenue, protesting the locating of a children's
theater at Furman Park was ordered received and filed.
A letter from Joe Glenn Coss, Acting Treasurer of the Downey Symphonic Society,
requesting that the Director of Finance conduct an audit of the Society's books. After
discussion, Council directed that the audit request be held until the Society's presenta-
tion which had been earlier requested by Council.

Councilman Morton stated there was a similar problem existing on the west side of

It was moved by Councilman Morton, seconded by Councilman Corbin after a summation
of bids to award Cash Contract #SS -70 to the lowest and bidder, General Asphalt Company
for improvements on Imperial Highway -Paramount Boulevard, in amount of the unit prices
submitted in the bid proposal and reject all other bids. Passed by the following vote:

After summation of bids, it was moved by Councilman Temple, seconded by Councilman
Dunnum and passed by the following vote to award Cash Contract #185, Rives Avenue water
main to the lowest and best bidder, N. L. Rogers, in the amount of the unit prices sub-
mitted in the bid proposal and that all other bids be.rejected.

It was reported by the Director of Public Works that when Telegraph Road between
Tweedy Lane and the Rio Hondo Channel was widened and improved the parkway easterly and
westerly of Rives Avenue on Telegraph Road was graded to meet the newly constructed
street. As a result of this grading, a wall along the south property line has been
endangered because of the grade differential and the effect of rains on the slope in
this area.

In order to stabilize this condition it is recommended that a small retaining wall
be constructed to support the wall, and since the properties to the south of Telegraph
Road in this vicinity have no access to Telegraph Road, it is further recommended that
the City construct full width. sidewalks in this area in order to alleviate the continual
maintenance problem which exists. Estimated cost of this proposed impaovement is $3500.

following vote to authorize appropriation of funds in the amount of $3500 from Account
No. 15000 for construction of sidewalks on Telegraph Road in the vicinity of Rives
Avenue.

It was moved by Councilman Corbin, seconded by Councilman Dunnum and passed by the
following vote to uphold the recommendation of the Parking Place Commission to eliminate
the driveway immediately adjacent to Firestone Boulevard with construction of a driveway
farther north so that the intersection can be more readily cleared of cars coming in and
out of the parking lot and allow an opening between the All American Home Center parking
lot and the Parking District Lot #3, with the property owner filling in the parkway
on Firestone Boulevard with concrete and changing the bumpers on the lot to concrete
ones and to bring the lot up to standard,

It was moved by Councilman Temple, seconded by Councilman Morton and so ordered to
authorize preparation of plans and specifications for an employees' lounge adjacent to
the Women's restroom and lounge at the center rear of the City Hall.
The owner of property at Paramount Boulevard and Alameda Street has agreed to dead
the right of way to the City for the amount of $7,000, with provision that the City
install curbs, gutters and paving. (Gas tax money is eligible.) The appraised value of
the right of way to be deeded is $13,040 on Paramount Boulevard and $3,285 on Alameda
Street, a total of $16,325. It is estimated by the Department of Public Works that the
City can pay this amount of money and put in the improvements within the appraised value.

following vote to appropriate $5,000 from 186.1 Gas Tax Funds to Account $16034 for
acquisition of right of way for street construction purposes at Paramount Boulevard and
Alameda Street and installation of curbs, gutters and paving.

the League of California Cities Institute on Labor Relations March 8-10 at the Biltmore
Hotel in Los Angeles with reasonable expenses allowed.

It was moved by Councilman Corbin, seconded by Councilman Temple and passed by the
following vote to approve the City Park and Recreation Department to supervise the
competitive swim program of the Downey Dolphins' Swim Club with use of the Downey High
School pool for Monday, Wednesday, Friday evenings and part time week ends at no charge.
(Estimated costs will not exceed $200 for the remainder of this fiscal year and money
is in the park budget for this program.)

mending eliminating matching requirements of Collier -Unruh Gas Tax Funds and attendance
by the Director of Public Works, Ervin Spindel, to testify on the elimination of matching
funds at hearings being conducted in Sacramento on Thursday, February; 16, with necessary
expenses.

Relative to acquisition of land and vacation on Patton Road in connection with the
extension of Patton Road to tie in with hospital construction, the City Attorney reported
he had filed the notice and is in the process of setting a trial date.
It was moved by Councilman Dunnum, seconded by Councilman Temple and so ordered
to refer to the Street Naming Committee, a petition requesting that Patton Road, after
extension, be re -named with one name used the length of it.
Authority was requested by Fire Chief Robert W. Gain to request a transfer of
$6,000 from Account No. 9-352-111, Salaries and Wages, to Account No. 9-352-626, Fire
Fighting Equipment, for the purpose of purchasing fifty-five fire hydrants. Due to the
critical nature of the bronze and brass market, it is felt it would be wise and cheaper
to purchase at this time, rather than during the next fiscal year. This approach last
year resulted in a saving of over 20%. These hydrants would be stock piled and utilized
as next year's supply. The transfer, if approved, would eliminate the need to budget
for this item in the 1967-68 budget.

It was moved by Councilman Morton, seconded by Councilman Dunnum and so ordered to
study parking at the rear of business between Firestone Boulevard and 150' easterly of
Downey Avenue and subsequent study, block by block, of parking in the downtown area.
(In conjunction with this, it was suggested that a study conducted Approximately 1k
years ago by the Planning Commission, be reviewed.)
The City Attorney outlined a revised copy of agreement between the City of Downey '
and Adrian Wilson and Associates for architectural work on the Downey Theater, Inc.,
together with an alternate to the last page of the agreement.
It was moved by Councilman Dunnum, seconded by Councilman Temple and passed by the
following vote that the City Epunctl approve the City's assuming the previous architectural
agreement between the Park District and Adrian Wilson and Associates for architectural
work on the Downey Theater with modifications as presented by the City Attorney and
authorize the Mayor or the City Manager to sign the agreement, using the alternate to the
las t page and inserting the words "3 years".

Mr. Bob Koches, President of the Downey Junior Chamber of Commerce, recommended
Council proceed as soon as possible in the building of the Theater.
It was moved by Councilman Temple, seconded by Councilman Dunnum and passed by the
following vote to authorize a mechanical engineering check not to exceed $1800 and an
electrical engineering check not to exceed $1,090 of hospital plans by registered
engineers, such amounts to come from hospital funds, to be done in time for the final
approval.
Councilman Morton requested that the architect supply names of each of the persons
rendering hospital drawings as well as dates, as some have been omitted. He reminded
Council that they had previously requested this information on all drawings.

Mr. Spindel displayed map of suggested Century Freeway routes, stating the official
hearing is to be held sometime around the end of March. There will be least 30 days'
notice on the exact hearing date. Mr. Spindel stated that the route through Downey will
be at Gardendale west of Brookshire and just south of White Front parking lot. It does
not affect any schools. He mentioned that the cities of Bellflower, Paramount, Compton,
South Gate and Lynwocodconcur with Downey's recommendation of the most southerly route.

following vote to approve replacement of a 1962 Ford Falcon pickup truck, bid going to the
low bidder, Downey Auto Center, in the amount of $2,067.54, with all other bids being
rejected.

A letter was presented from Mr. Louis H. Frahm stating it will be necessary that
he acquire the 50' by 150' lot at 8129-31 Second Street immediately west of his property
on Second Street, upon which part of the proposed Tempest Building will be built. He
submitted Cashier's Check in the amount of $5,000 as down payment to proceed into
escrow on February 15, with a total purchase price of $45,000 for a 120 -day escrow.
Councilman Corbin left the Council Chamber.
The City Attorney advised this property could be sold in this manner as it was
above the current appraisal value.
It was moved by Councilman Temple, seconded by Councilman Dunnum and passed by the
following vote to authorize the City Mangger or the City's Mayor to enter into escrow for
the purpose of conveying the property requested by Mr. Louis H. Frahm at a total amount
of $45,000 with an option recorded granting to the City the right to purchase the
property for the same sum in the event the building is not commenced substantially in
accordance with the plans'and specifications within two years.

PM% grant Mrs. Dora Alexander a six months' leave of absence without pay due to illness.
The City Attorney reported on various communications including one from the Southeatt
District Bar Association relative to an inquiry regarding police personnel.
It was moved by Councilman Temple, seconded by Councilman Corbin and so ordered that
the City Attorney be directed to submit a letter to the Southeast Bar Association and
that the City Attorney refer the matter to the District Attorney's Office for any other
action advisable, the letter to the Southeast Bar Association to state that it does not
appear feasible for such police personnel to appear as requested.
The City Manager reported James Ruth, Director of Parks and Recreation, is to be
congratulated and commended on his obtaining his Master of Science Degree on February 1,
1967.
