MINUTES OF THE CITY COUNCIL
CITY OF DOWNEY, CALIF.
DECEMBER 12, 1966
The City Council of the City of Downey held a regular meeting at 7:30 P.M.,
December 12, 1966, in the Council Chamber of the Downey City Hall, Mayor
Charles W. Dickerson presiding.

Reverend Loren A. Williams, Assistant Pastor of the Trinity Baptist Church,
delivered the invocation;
Mayor Dickerson announced the presentation of 5 -year driving awards to be made
at this time. The City Manager reported there are 76 employees to receive the awards
for driving 5 years without accident. Council commended the employees for their good
driving record, which is a great achievement.
Mayor Dickerson announced the hearing on the appeal to Zone Exception #692,
Paramount Boulevard at Gallatin Road, and inquired if the clerk had the affidavit of
publication. The City Clerk reported she had the affidavit. It was ordered received
and filed.
There were no written communications or protests.
Speaking in favor of the appeal were the following:
Harold T. Tredway, Attorney, 11510 Downey Avenue, representing applicant,
Dr, Alfred Lemberger, Pittures and letters were submitted as part of the evidence
in the hearing, the pictures to be later withdrawn by Mr. Tredway when the matter
is resolved.
Also speaking in favor of the appeal was Charles Grimes, 8040 Gallatin Road,
directly east across the street from the corner of the property concerned in the
zone exception.
Speaking in opposition to the appeal were:
Levina B. Sharp, 9209 Paramount Boulevard
L. Whallon, 7920 Gallatin Road
J. C. Snell, 9224 Samoline Avenue
Leonard Stewart, 9229 Paramount Boulevard
Mr. Stewart presented a petition containing 36 signatures representing approximately
19 property owners opposing the zone exception.
After rebuttal by Mr. Tredway, it was moved by Councilman Morton, secprided by
Councilman Temple and so ordered that the hearing on the appeal to Zone Exception
#692, Paramount Boulevard and Gallatin Road, be closed.
Inasmuch as Mr. Tredway had not been present at the Planning Commission hearing,
Mr. Goggin pointed out that the applicant would not meet the requirements of the
code; that applicant would be receiving special privileges not granted to other sur-
rounding property owners, and would, in fact, be "spot" zoning.

Councilman Morton stated he would favor denial of the appeal as the foremost aim
of Council is to protect the residential areas,
Councilman Temple stated that he would concur with Councilman Morton and it was
then moved by Councilman Corbin, seconded by Councilman Morton and passed by the fol-
lowing vote that the appeal to Zone Exception #692, southwest corner of Paramount
Boulevard and Gallatin Road, be denied and that the decision of the Planning Commission
be upheld.

Mayor Dickerson declared a 5 -minute recess with Council reconvening at 9:15 P.M.
with roll call, all members of Council being present.
Mayor Dickerson announced the hearing on the Resolution of Intention of Abandonment
of the Downey County Lighting District. The City Clerk stated she had the affidavit
of publication and it was ordered received and filed,
Ervin Spindel, Director of Public Works, reported C}ecal�axTdonment ;Qi th"e, Downey
County Lighting District and 'subsequent annexation of various sections is for the
purpose of clarifying the lighting assessments in the area of the Downey County
Lighting District, These actions will have no bearing on any lighting districts
outside the Downey Minty Lighting District and will not in any way raise the assessment
rate for these areas. The action may result in a lowering of the rate of these areas
if the Council were to adopt the 20% City contributions in lieu of safety lighting, as
has been suggested.
Assessments for the Downtown Lighting District would raise from the present
9.88 to 11,7 and the assessment in other areas pointed out on maps submitted to
Council would raise from 90881 to 15�. Areas having no regular street lighting would
have the assessments dropped from the present 9,880 to O,OOe.
There were no written communications or protests.. John Barr, 110408 Samoline
Avenue voiced objections to the increase of assessment rates which was proposed,
Councilman Morton inquired about the safety lighting, as to whether it was
separate and apart from the lighting district. Mr. Spindel stated the safety lighting
can be installed and paid for by the General Fund and can be installed in any lighting
district without any hearing. It is planned that 970 safety lights will be installed
within the next 10 years, There are 1570 intersections in the City and approximately
600 with lights with almost 1,000 yet to be lit, The Department is trying to pick
out the most dangerous ones first and this program has been approved by the City
Council.
Councilman Temple suggested that the assessments be equalized for all lights,
and requested that a report be brought back on the cost of making a uniform assessment
of $0,10 per 100 throughout the City,
RESOLUTION NO,
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING
THE ABANDONMENT OF THE DOWNEY COUNTY LIGHTING DISTRICT
The resolution was read by title only, Councilman Dunnum stated that she would
like to have the question resolved which had been raised by Councilman Temple.
It was moved by Councilman Corbin, seconded by Councilman Temple and passed by
the following vote to take the matter under submission until the next Council Meeting,
Councilman -Morton stated he would support the motion but that he was not sure
that an additional $35, to $40,000 out of the General Fund which would be taking fram
the capital improvements would be practical, The City may have a problem to meet
the tax base.

Mayor Dickerson opened the hearing on the Resolution Ordering the Annexation to
the Downey City Lighting District, The clerk stated dze had the affidavit of publica-
tion. It was ordered received and filed.
There were no written comments or protests.
Mr. John Barr spoke in favor of the annexation.
It was moved by Councilman Temple, seconded by Councilman Corbin and so ordered
that the hearing on the Resolution Ordering Annexation tolthe Downey City Lighting
District be closed.
It was moved by Councilman Dunnum, seconded by Councilman Temple and passed by
the following vote to take under submission until the meeting of December 27, 1966.

The Mayor opened the hearing on the necessity and convenience of AD #95, Washburn
Road, and inquired if the City Clerk had the affidavits of publication and posting.
The City Clerk replied she had the affidavits. It was moved by Councilman Temple,
seconded by Councilman Corbin and so ordered that the affidavits be received and filed.
There were no written protests or comments.
Speaking in favor of the improvement was Mr. C. P. Ripley, 12049 Washburn Road.
It was moved by Councilman Morton, seconded by Councilman Temple and so ordered
that the hearing be closed,

OF WASHBURN ROAD IN THE CITY OF DOWNEY (AD #95 )
The resolution was read by title only. It was moved by Councilman Corbin,
seconded by Councilman Dunnum and so ordered that further reading be waived.

Mayor Dickerson opened the hearing on the Resolution of Intention for improvements

There being no written and no oral comments or protests, it was moved :.by
Councilman Temple, seconded by Councilman Corbin and so ordered that the hearing on

RESOLUTION N0, 1837
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING THE WORK TO BE DONE ON WASHBURN ROAD IN ACCORDANCE
WITH RESOLUTION OF INTENTION NO. 1828 (AD #95)

that the minutes of the Council Meeting held on November 22, 1966, be approved as

The City Clerk reported on the following correspondence:
A letter from the County of Los Angeles Department of Real Estate Management
transmitting original executed Quitclaim Deeds whereby the County of Los Angeles quit-
claimed subject property to the City of Downey. The City Clerk reported they had been
sent into the County Recorder's office for recordation. Ordered received and filed.
A letter of commendation to Mr. King, City Manager, from the League of California
Cities for appreciation of his serving as a member of a League Committee during the
1965-66 Year, Ordered received and filed.
A letter from Marianne J. Blanks relative to the possibility of installing a
traffic sign at Freeway 605 and Florence Avenue, It was moved by Councilman Morton,
seconded by Councilman Temple and passed by the following vote to refer this matter
to the Traffic Committee,

Councilman Dunnum suggested signs to show entering Downey at the off -ramp of the
same freeway at Firestone Boulevard where it points to Norwalk,
Mr. Spindel stated this off -ramp is located in Norwalk, however the City of Santa
Fe Springs had a sign "To Downey" and the same arrangement probably could be worked
out with Norwalk. The matter was referred to the Public Works Department,
A letter from the City Attorney transmitting revised Bylaws of the Sister City
Association and the Articles of Incorporation.
Report on activation of the Downey Civil Defense radio communication group.
Ordered received and filed.
Complaint for damages from Howard R. Morehouse. It was moved by Councilman
Morton, seconded by Councilman Temple and so ordered to deny and refer this claim to
the City's insurance carrier.
Letter from Kenton E. Krogstad, Attorney, relative to Downtown Vehicle Parking
District #1 in AD #66. The City Attorney explained that money received on the
assessments for the Vehicle Parking District were received in trust by the City and
paid out to the bond holder when the coupons are received. There was an error on the
part of the property jowner in paying, The City Attorney stated he does not see any
way the City can pay'as requested in Mr. Krogstad's letter, The matter had all been.
referred to the City Attorney and City Treasurer,
A letter of thanks from the Downey Symphonic Society, Inc. for additional funds
granted them for the 1966-67 season, Ordered received and filed.
A letter from R. K. Summy, Inc., Oil and Gas leasing on behalf of Atlantic
Richfield Company, for subsurface oil and gas leases in the Downey Area.n The letter
was referred to the City Attorney,
A letter from Patrick Healy, Interim Chairman, Town Affiliation Association of
the United States, requesting a foundation grapt in a minimum of $100 for continuance
through the National League of Cities of the People to People program, Councilman
Corbin stated he opposes support of this Town Affiliation Association.
Councilman Morton stated he opposes any amount of money going to the organization
until such time as the sister city program has an opportunity to review both groups

and for their findings to the City Council. He stated it is a matter of philosophy
as to whether the program should be on a people to people or government to government
basis.
It was moved by Councilman Temple, seconded by Councilman Morton and so ordered
to refer the matter to the Sister City Association for study and recommendation to
the City Council.
Newspaper clipping relative to Fireman Don Bradley who assisted at the scene of
an automobile accident by rendering first aid.
It was moved by Councilman Morton, seconded by Councilman Temple and so ordered
that proper recognition be given Fireman Don Bradley.
Ivan Robinson, Chief of Police, stated such commendations to police officers
are usually in the form of a letter and he felt these commendations throughout the
City should be uniform.

It was moved "by Councilman Corbin, neconded by Councilman Dunnum and passed by
the following vote to approve purchase of three (3) City vehicles with the following
specifications, and that the truck be advertised for bid.
One new 3/4 Ton Pick Up Truck at a cost of $2452.32, including sales tax, less
a trade-in allowance on one 1958 Ford 1/2 ton pick up truck of $350, a net total
of $2102.32. (Funds are available in the Funded Reserve Account.)
One new 4 -door, 6 cylinder sedan per Councilapproved specifications contained
.—. in the City Automobile Purchase -Maintenance Contract, costing $2215.20, including
sales tax. The 1962 Ford vehicle which is to be replaced is used by the Chief License
Inspector and would be transferred to the Central Services Division for use as a
"Pool Car" and for use by the Deputy Director of Civil Defense, replacing one 1958
Ford sedan which has been in City service for nine (9) years.

It was suggested that the 1958 Ford sedan be offered as trade-in or declared
surplus property by the City Council and sold to the highest bidder, if the trade-in
allowance is too low,
The Finance Department - Revenue and License Division is also requesting one
new 4 -door, 6 cylinder sedan for use by the License Inspector (also to be used by
the Director of Finance). $2500,00 is budgeted for this purchase. Specifications
identical to those of the above-mentioned vehicle.

It was reported by the City Manager that Superintepdent Bruce Moore has inquired
if there might be a possibility of the Downey Unified School District's utilizing
the 2 -story Nox.sel building across from the School District's Admin istration Building
during the interim period prior to the building's being moved to the City Library.
It was moved by Councilman Morton, seconded by Councilman Temple and passed by
the .-following vote to authorize a letter being sent to advise the Downey Unified
School District that they may use the Noxsel building as requested on a month to
month basis to be at no cost but with a "hold the City harmless" clause.

The City Manager advised Council that notices have been sent to the occupants of
the 10 -unit green apartment house on Second Street across from the City Hall, to
vacate their premises within 90 days.
It was moved by Councilman Morton, seconded by Councilman Temple and passed by
the following vote to call for bids for sale and removal of the green and brown
apartment units across the strett from the Downey City Hall.

It was reported that the parking lot adjacent to Fire Station 1 on Downey
Avenue has been completed affording 53 parking spaces for use of the public.
It was moved by Councilman Morton, seconded by Councilman Temple and passed by
the following vote to authorize setting up the parking spaces on the parking lot
adjacent to Fire Station #1 on Downey Avenue on a monthly rental basis at $5 per
month to be paid to the Finance Office in the same manner as has been used in those
on the parking lot immediately south of the Municipal Courts building,

Council approved Mr. Spindel's meeting with the City Administrator and Director
of Public Works of the City of Bellflower relative to a suggested boundary re-
alignment on Gardendale Street, the City Manager to report at a later date,
Robert De Sio presented the plans for landscaping of the hospital which had
been prepared in conjunction with Mr, Jot Lloyd, Project Manager and Mr, Robert
Cgrter, Landscape Architect, Councilman Corbin stated the landscape was to have
been eliminated from the contract with the architects and was to be accomplished by
the Public Works Department with the City's doing the work.

the following vote that the position of the Council deleting the landscape architect's
services from the architectural contract on the hospital be reaffirmed and that the

architect and the landscape architect be informed that the services of the architect
and landscape architect are not to be paid for by the City; that the landscape
design and planning are to be done by City forces.

Mr. DeSio gave a_detailed report on the establishment of a plant and tree
nursery and stated the Los Angeles Water & Power Department might possibly grant
an area 1.6 acres to the City of Downey for use in the growing of specimen plants
and small trees.
The City Manager outlined the 10 -year Achievement Report and the 10 -year long-
range capital improvement program which shall cost approximately $5,900,000.00.
These funds will come from cigatetde tax, gas tax, sales tax and hotel -motel tax.
Councilman Morton suggested adjournment of this meeting to �6nsider the
adoption of the 10 -Year Capital Improvement Program on the City's 10th Anniversary,
Friday, December 16.
The City Attorney advised the motion adopting the Capital Improvement Program
should be specific in that it is a guide line and Council are not attempting to
establish any set pattern, and that the City would make it perfectly clear that it
would not be binding.
Councilman Morton suggested that the City Clerk read the statement made by the
City Attorney at the adjourned meeting relative to adoption of the Capital Improvement
Program.
The City Attorney stated he had contracts relating to acquisition of lands which
had been deeded to the State for delinquent taxes. The tax sale lands are located
along: 1. a narrow strip along Conrad Street; 2. the Alley off Tweedy Lane westerly, easterly
of Rives Avenue andnort~lierly of Birchcrest Road; and 3. parcel protruding to Downey
Avenue off Bixler Street which would be good for street purposes. The properties
can be acquired for about $1 each. The City Attorney reported the agreements had been
prepared in blank form and submitted to them.

the following vote to authorize the Mayor to execute the agreements and that the
amount of the purchase of each parcel not exceed $5.00.

Mayor Dickerson reported on receipt of a letterfrom the Southeast Mosquito
Abatement District requesting approval of a member to represent Downey on its
committee, the present term expiring January 2, 1967.
Councilman Dunnum requested that a report be submitted from the City Manager and
Mayor's offices as to what the commissions and boards are and determine which
appointments should be rotated and which should be on the basis of a continued ap-
pointment.
Councilman Morton stressed continued representation by the same member,
especially in important matters, and he stated that he does not know if serving
less than a year or year and a half is of benefit to the City.

the following vote to reappoint for a two-year term, Councilman Thomas H. Morton, to
the Mosquito Abatement Committee.

Councilman Morton stated there is a matter pending regarding reorganization of
the Mosquito Abatement as to whether to continue it as a separate taxing agency or
letting the county health committee take it over.
It was moved by Councilman Temple, seconded by Councilman Corbin to instruct the
City Attorney to prepare resolutions, if necessary, to keep the Southeast Mosquito
Abatement District as it is, not allowing it to become any larger, with local control
of all contiguous areas So ordered.

MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
DECEMBER 16, 1966
The City Council of the City of Downey held a regular adjourned meeting at
2:45 P.M. in the Council Chamber of the Downey City Hall, Mayor Charles W. Dickerson
presiding. The regular meeting of December 12, 1966, was adjourned to this time by
motion of the City Council and a copy of the notice of adjournment was posted as
required by law and further reported by the clerk that notice of the adjournment was
given as provided by law for notice of special meetings. The clerk stated she has
on file the proper affidavit covering the foregoing.

Mayor Dickerson announced the Council would discuss.the 10 -Year Capital Improve-
ment Program and asked the City Clerk to read the City Attorney's statemalt made at
the last meeting relative to this program and adoption.of it by the City Council. The
City Clerk read as follows:
"The ,City Attorney advised the motion adoptitg the Capital Improvement Program

for the next 10 years' program of the City of Downey.

Councilman Dunnum complimented each of the department's work in preparing tete
first 10 years' summary and also their recommendations as well as the City Manager for
having compiled the recommendations and making the final proposal for Council to
consider and adopt., She stated she thinks this is a very good step forward, especially
at a 10 -year anniversary date, to indicate the intention of the Council to 'continue to
move ahead progressively and constructively.
Councilman Corbin stated he thought it was:a good program and he admires the
Finance Department in their work in the final accomplishment of the program.
Councilman Temple stated he thinks the program is very objective and he, too,
concurs with the Councilmen that it is an excellent program. The guide lines as set
forth, as each year goes by, will be something to look at the proposals and with
possibly a few modifications, try to follow it.
Councilman Corbin made one more comment, that it would be done without an increase
of taxes. Councilman Temple stated it will be the pay-as-you-go basis.
Councilman Morton arrived at the Council Meeting at 2 :50. He stated he had made
a very detailed study of the capital improvement program since the meeting of Monday
night, December 12, and he wants to say that he is very proud of the achievements that
the City of Downey has made the past 10 years starting with the first Council. He
thinks the City Councils over the years, together with the City Administration and
the employees have established a wonderful record and a tremendous foundation upon
which to build. Looking at the report and analyzing what has been accomplished by the
various Councils, he stated he is tremendously impressed that they have built a solid

foundation and thinks that now, as the City reaches its tenth anniversary, it is well
that they establish a milestone and project themselves for another 3 - 6, 7 and 10
years. He thinks the program is energetic, shows initiative, comprehension by the
City Council and by the Administration, an awareness of the City's problems. He
concurs that Council 'adopt the 10 -year Capital Improvement Program as a guide line,
for the City's future growth, but certainly not binding on future City Councils --
merely to pass on their thinking as they have looked at the City's problems today,
yesterday and in foreseeing them tomorrow. He would be very much in favor of proceeding.
Mayor Dickerson stated he feels that persons looking back ten years from now will
not help but be able to say that the City of Downey is one of the most outstanding
cities in the entire southeast area.
Councilman Morton asked that his vote be cast so that the vote to adopt the
10 -year Capital Improvement Program would be by a unanimous vote. So ordered.
