HomeMy WebLinkAboutMinutes-11-14-66-Regular Meeting2x`38 MINUTES OF THE CITY COUNCIL OF THE CITY OF DOWNEY NOVEMBER 14, 1966 The City Council of the City of Downey held a regular meeting at 7:30 P.M., November 14, 1966,'in the Council Chamber of the Downey City Hall, Mayor Charles W. Dickerson presiding. The meeting was called to order with roll call: -- PRESENT: Councilmen: Dunnum, Corbin, Temple, Dickerson ABSENT: Councilmen: Morton Mayor Dickerson then declared a recess in order that a film, "Downey Youth, Future Unlimited", could be 'shown. The filming had been done during Youth Recognition Week in 1965. Chief Ivan A. Robinson explained the processes followed in the filming of the picture. Council reconvened at 7:35 with Ray Lake, Director of Building and Safety Depart- ment delivering the invocation, Mayor Dickerson requested the City Manager to assist him in the presentation of commendations to the persons who had worked on the filming of the picture on Downey Youth immediately after roll call, PRESENT: Councilmen: Dunnum, Corbin, Temple, Dickerson ABSENT: Councilman: Morton ALSO PRESENT: Oren L. King, City Manager Royal M. Sorensen, City Attorney William Goggin, Acting Director of Planning Robert Shand, Purchasing Agent James Ruth, Director of Park & Recreation Department Ervin Spindel, Director of Public Works Lee Leavitt, City Engineer Ray Lake, Director of Building and Safety Department Don Warren, Assistant Fire Chief Ivan A. Robinson, Police Chief Walter Wanke, Water Superintendent Della Doyle, City Clerk Alberta Pfeiffer, Deputy City Clerk The awards were then presented to the steering committee which consisted of Mr. Bruce Moore, Superintendent of Schools, Chairman Oren L. King, City Manager, Ivan A. Robinson, Chief of Police, Donald L. Wilson (Youth Advisory Committee Chairman} - absent, C. W. Barrett, Judge Carroll M. Dunnum, Patricia Ann Smith - absent, and. John Hume, also absent; to North American Aviation Space and Information Division Per- sonnel and Public Relations: Dick Barton, Nels Wolford, Carl Conley, Larry Robertson, Bill Riddle, David L. Kerr, Bud Clarke, Lloyd Sayre, and Dennis Williams, four of whom were present to accept the awards; citizens assisting in the music and photography - Mrs. Jackie Drees, Mr. & Mrs. Edmond J. Dowd and Donald E Hess; Police Department personnel William Layton, Gil Sifuentes and Ferice B. Childers. Mr. King reported that George Putnam, narrator for the film, had stated since he was unable to appear at the meeting to accept his award, he would like to invite someone from the City of Downey so that he might accept his plaque during his television program. Councilman Temple reported the film has been previewed by police chiefs all over the State and they wish to borrow the film to show to their communities. He stated he is very proud of the film. Mayor Dickerson stated it was a real pleasure for everyone who worked on the project and that every time it is viewed, the workers will be remembered. Mayor Dickerson called for a recess in order to allow those present to leave if they did not wish to remain for the balance of the council meeting. Council reconvened at 8:55 with roll call, four members of Council being present as listed previously. Mayor Dickerson announced the time and place for the hearing on the appeal to Zone Exception Case #690 - Kilgore, which hearing had been continued from the October 10th Council Minutes - 11/14/66 -1- 2739 meeting. The City Clerk reported she had three postal cards signed by Henry O'Neil, Lola and John Herman, Mr. & Mrs. Joe Fredericks and a petition opposing the appeal, representing six property. owners. These communications were ordered received and filed. William Goggin, Acting Director of Planning, reported on the zone exception case. Speaking for the appeal were the following persons: Mr. R. R. Kilgore, 8509 E. Boyson, owner of 8503 Boyson Andrew Conti, 1211 Hyde Park Drive, Santa Ana klchard Knox, 8510 Boyson, directly across the street from the property owner, Kilgore Speaking against the appeal to Zone Exception #690 wore the following: Henry Sanders, 12215 Brookshire, directly across the street from the property in question Mr. Sanders turned over to the City Clerk some notes which had been left with him by residents in the area who were unable to attend the hearing. The, City Clerk stated there was a total of five notes, 3 of which were from persons previously submitting letters; the others being from Joyce Conway and Mr. & Mrs. Joseph Anderson. Others speaking against the appeal to Zone Exception #690 were: Mrs. Dorothy Maughan, 12221 Brookshire Avenue Otto Lusko, 12203 Brookshire Avenue Mrs. Burton, 12227 Brookshire Avenue James Wilson, 12233 Brookshire Avenue Rebuttal was made by Mr. Kilgore, The Director of Public Works was asked to give a report on the appraisal and breakdown of value received by Mr. Kilgore for his property. Mr. Spindel stated that Mr. Kilgore had been paid $10,000: $3,500.00 for land; $4,750 for a duplex; $1,750.00 for damages resulting from lessening the land value due to a reduction of size. Councilman Dunnum questioned the amount of square footage Mr. Spindel clarified that there is sufficient square footage as would be required in the zone exception and added that the property had to be cleared for. the Btookshire.Ave�right of way. As to the question of whether or not Mr. Kilgore had been told he would have to demolish the duplex on the property to make room for the right of way, Mr. Spindel stated it is always up to the land owner as to whether the obstruction is to be moved or demolished. After questions and discussion by Council, it was moved by Councilman Dunnum, seconded by Councilman Temple and passed by the following vote that the hearing on Zone Exception #690, Kilgore - 8503 Brookshire Avenue, be closed. AYES: 4 Councilmen: Dunnum, Corbin, Temple, Dix&x�rson NOES: 0 Councilmen: None .� ABSENT: 1 Councilman: Morton Mayor Dickerson announced the hearing on the vacation of a portion of Lindell Avenue (Lakewood Boulevard/Telegraph Road) and asked the City Clerk if she had the affidavit of publication. City Clerk Della Doyle reported she had the affidavit of publication and it was ordered received and filed. Council Minutes - 11/14/66 -2- �r40 The Director of Public Works reported that, according to the City Attorney, in a vacation of this type where an easement becomes involved, it is necessary to hold another hearing on the vacation of the easement. Councilman Dunnum inquired if it might not be possible to proceed as far as possible, in vacating the portion of Lindell in order not to hold up the property owners in the improvement of their property. She was advised this would be possible. Howard L. Miller, Attorney, representing property owners, 300 East Penn Street, Whittier, stated he and the property owners appreciated all the investigating done by the Public Works Department of the problems existing on the property. He requested abandonment of the street; then abandonment of the easement for easement for drainage which is not needed, thus allowing the property owners to improve the property. It was moved by Councilman Temple, seconded by Councilman Dunnum and passed by the following vote that the hearing on the vacation of a portion of Lindell Avenue be closed. It was moved by Councilman Temple, seconded by Councilman Corbin and so ordered that further reading be waived. It was moved by Councilman Dunnum, seconded by Councilman Temple and passed by the following vote that Resolution No. 1809 be adopted. There being no written and no oral comments or protests, it was moved by Councilman Temple, seconded by Councilman Corbin and so ordered that the hearing on the convenience and necessity for AD #108, Nada Street be closed. RESOLUTION NO. 1810 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY FINDING THAT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE IMPROVEMENT OF NADA STREET IN THE CITY OF DOWNEY (AD #108) The resolution was read "-by title only. AYES: 4 Councilmen: Corbin, Dunnum, Temple, Dickerson NOES: 0 Councilmen: None ABSENT; 1 Councilman: Morton The City Clerk reported on the following correspondence: A letter from the Union Oil Company of California relativetotheir conduction of a Subsurface Oil and Gas leasing program in portions of the City of Downey and offer- ing the City $30.00 upon execution and acknowledgment of their lease on City -owned property, Council approved acceptance of this lease. The letter was ordered received and filed, The City Attorney advised that if Council wishes to approve this lease, under the City Charter it must be done by ordinance. The City Attorney was instructed to bring, to Council an ordinance for adoption relative to the subsurface oil and gas lease. Letters from the Downey Historical Society relative to hiring of a part-time secretary and preservation of certain historical buildings in the City of Downey were noted. Mr. Irvin Phelan, President of the Downey Historical Society stressed the urgency of the need of secretarial assistance to the Society and efforts to retain certain historical buildings within the City. These matters were referred to the City Manager for investigation and report as to the part-time secretarial services and the feasibilty of moving or acquiring the Southern Pacific Freight Depot and the carriage house from Governor Downey's home. Quarterly Report from the Downey Civic Chorus was received and filed. A request from the Gallatin Medical Group for a $10 increase per examination of City employees (primarily fire and police) was reported on by the City Manager who stated a $10 increase had been granted them on November 8, 1965, from $65 to WS and the examination now given City employees usually carries a fee of $120.00. It was moved by Councilman Dunnum, seconded by Councilman Corbin and passed by the following vote to approve the increas?of medical examination fee from $75 to $85 performed for the City of Downey, effective January 1, 1967. AYES: 4 Councilmen: Dunnum, Corbin, Temple, Dickerson NOES: 0 Councilmen: None ABSENT: 1 Councilmen: Morton Council Minutes 11/14/66 -4- 2742 A request from the Feather River Project Association for the City of Downey to join in their program and execute a $500 contract. The City Manager was requested to submit a report to Council. Walter Wanke, Water Superintendent, stated the City belongs to the CMUA and that this association handles such programs as outlined by the FRPA and that the Water Boardrhad opposed joining this organization. A letter from Mrs. Gloria Beck,er 10623 Chaney Avenue, Downey, relative to radio towers and requesting she be put on notice of future application for radio towers. Mr. Goggin stated there are several sections of the Downey Municipal Code which would need to be amended to cover radio towers such as zone exception provisions for curbs, gutters and sidewalks which actually has no connection with the erection of a radio tower. He stated that some neighborhoods do not want anything over 35' in height; however, hams who wish to go to Australia, Japan, etc. cannot do this on a 35' tower. Ray Lake made an explanation on the various heights and variances for radio towers. Mr. Goggin stated he will report to Council at a future date the results of the study and investigation on the revised requirements An appeal from Tredway and Brandmeyer, Attorneys representing applicant Kenneth A. Donaldson in Zone Exception #692. It was moved by Councilman Corbin, seconded by Councilman Dunnum and so ordered to set a public hearing on Zone Exception #692 for 7:30 P.M., December 12, 1966, in the Council Chamber of the Downey City Hall. A report was made by Robert Shand, Purchasing Agent, relative to ambulance fee collections with an explanation of the procedures followed which have proved to be very unsatisfactory. Mr. Shand was directed by Council to check into possible changes in the collection procedures and report his findings. A memorandum from the City Manager announced that Mr. Ervin Spindel has been nominated for office of Secretary of the Los Angeles City and County Engineers Associa- tion. Mr. Spindel reported the meetings are always held at night and would have very little interference with City business. The duties would begin January 1, 1967. Ordered received and filed. r It was moved by Councilman Dunnum, seconded by Councilman Temple and so ordered to approve the acceptance by Mr. Ervin Spindel, Director of Public Works for the nomination for the office of Secretary of the Los Angeles City and County Engineers Association. So ordered. A letter and petition from 11 property owners requesting correction of the grade in order to incorporate proper slope for drainage. The matter was referred to the Department of Public Works. (Dos Rios Road and Glencliff Drive on the "Island".) A request from the Department of Motor Vehicles for use of the City's East confer- ence room in order to conduct hearings, interviews, and group meetings for those persons whose licenses may have^been revoked or suspended, who may be considered for re- instatement. Individual attention is applied cases involving a health program as well as those having questionable driving records. At the present time Downey residents are asked to appear in Bellflower or Bell and plans are being -made to convene group meetings in Montebello. Thus, better service could be provided -these people if the contact could be made in the City of Downey. Individual hearings are normally scheduled on a 45 -minute program, from 8:30 a.m. through 3 :30 p.m., 2 days a week (possibly Tuesday and Thursday would be quite adequate. It was moved by Councilman Temple, seconded by Councilman Dunnum to"grant approval of the request of the Department of Motor Vehicles per their letter. The City Attorney advised there should be a time limit set, should the City need to revoke the approval for use of the conference room as requested. Mayor Dickerson stated it seemed advisable to him to table the matter until there` is a full Council for action on this request. Councilman Temple amended his motion to include a time limit for revocation or cancellation within a reasonable period of time in order to allow the Department of Motor Vehicles to reschedule its cases. The City Attorney,however, advised it should state a definite time period. The motion was then amended to approve the request and that it be revokable within 30 days. Mayor Dickerson read a letter addressed to him in appreciation from the Mayor of Guadalajara for the appearance of the Downey Civic Chorus and their Director, Mrs. Marjorie Phelan, with photographs enclosed. Mayor Batiste stated the group left a magnificent impression and most pleasant memories with the people of Guadalajara. The letter also acknowledged the City of Downey's Readers Digest Sister City award bestowed upon its representative at the Washington, D.C. meeting recently. It was stated by the City Attorney that when total assessments are less than $500, the Council can order changes in the work simply by a resolution of this nature. The work is being done on private property to ,_.. relocate fences and no cost will be assessed to property owners other than those whose fences are being moved. The City Manager reported on the outcome of negotiations by the Group Insurance Committee and the City's broker, Mr. Lee Cranmer, Jr. of the Pacific Group Agencies, the California Physician Service "Blue Shield" which was an offer to extend the existtr4 contract rates at a 5% overall increase on current premiums. In addition, the present coverage on all unmarried dependent children over 14 days and under 19 years of age will be expanded to include unmarried dependent children between the ages of 19 and 23, if full-time student. The overall cost to the City, which currently pays 75% of the employee's hospital and major medical coverage, will increase from $31,313 per year to $38,376 per year, based on a total of 383 insurable employees. No changes will be --made in the Group Life Insurance coverage which is currently 31G per $1,000. This rate is possible through the continued association with the Group.. The recommendation of the Insurance Committee is that the City of Downey renew the entire Group Insurance Contract, which will include all existing coverage benefits plus the amendment for additional dependent age limit mentioned above. The 5% overall increase on CPS/CPIC coverage is reasonable in the face of increased hospital costs, which have advanced approximately 20% within the past year. The 5% rate adjustment is made possible through a continued favorable experience rating on the City's Group Hospital Base Plan which the Insurance Committee revised in 1965. This rate considera- tion reflects the loyalty curve which has been established through a continuous assoc*1on with CPS/CPIC over the past 2k years on annual bid contracts. The City Manager stated further study can be made, if desired; however, approval is needed by January 1st. This procedure has been placed into effect as of July, 1966. The Southeast News agreed to cooperate with'the City by allowing a reduced rate for the second legal ad which is Council Minutes - 11/14/66 -9- 2'74'7 required for Public Works contracts. Also, Mr. Ervin Spindel carefully extracted all unnecessary labor classifications from the schedule in an effort to reduce advertising costs. However, the legal ad costs will have increased over four times the normal current budget by the end of the fiscal year. (The legal ad expense for the lot quartet of 1966-67 is $1900 vs. a budget of $1,050,) It was suggested that'a resolution be prepared for submittal to other Cities whereby each City would kp ep a current wage schedule on file in the office of the City Clerk in lieu of costly newspaper.publications. The City Attorney advised the City to keep track of the costs as evidence of ,added expenses. Sample questionnaire or ballot also was, -submitted to Council which was propgsed by Mr. Miller be circulated among the residents on the "Island". Mayor Dickerson stated he appreciated all of Mr. Miller's efforts relative to the propog6d park. Councilman Temple stated he had received a letter relative to litter in various areas of the City and inquired if the City has any code or ordinance covering this matter. Chief of Police Ivan A. Robinson stated there have been some citations nude when the persons are seen disposing of the litter. However, nothing can be enforced when it is on private property. City Clerk Della Doyle requested a week's vacation the week of November 21 through the 26th. It was announced by the City Manager that the Tenth Anniversary Celebration of the City of Downey will be celebrated beginning at 10:00 A.M., Friday, December 16;; with open house throughout the City Hall; a review of the Fire and Falice Departmehts in dress parade and full equipment displayed; official ceremonies to occur at Approxi- mately 4 o'clock. The ceremonies will be MC'd by Assemblyman Carley V. Porter. An invitation has been -:extended to Mrs. Phelan to present the Downey Civic Chorus and to Caesar Mattei to present the Downey Youth Band. Mayor and Councilmen's wives will assist in serving tea, etc., in the Council Chambers. Councilman Corbin stated the Rose Float Association would like very much to have a full turnout for the final selection of the Rose Float Queen for 19670 which is to be held this -coming Sunday.
