A.M., son October 25, 1966, in the Council Chamber f Y presiding. PRESENT: Councilmen: Dunnum, Corbin, Morton, Temple, Dickerson ALSO PRESENT: Oren L. King, City Manager Royal M. Robinson, Chief of Police Bill Goggin, Director of Planning Della Doyle, City Clerk Alberta Pfeiffer, Deputy City Clerk The invocation was delivered by Reverend Henry Blackaby, First Southern Baptist Church. Mayor Dickerson announced there would be a slight deviation from the regular agenda in order that a resolution may be adopted and certified for it to be in the hands of the County Board of Supervisors at their early morning meeting this date. RESOLUTION NO. 1795 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST BRIDGE IMPROVEMENT AGREEMENT FOR FLORENCE AVENUE OVER THE RIO HONDO The resolution was read by title only. It was moved by Councilman Morton,'' seconded by Councilman Temple and so ordered that further reading be waived. It was moved by Councilman Morton, seconded by Councilman Temple and passed by the following vote that Resolution No. 1795 be adopted. AYES: 5 Councilmen: Dunnum, Corbin, Morton, Temple, Dickerson NOES: 0 Councilmen: Ngne ABSENT: 0 Councilmen: None The City Manager stated this was the City's portion for repair of the bridge over the Rio Hondo River on Florence Avenue and it is hoped that the award of the contract for the work can be made at 9 o'clock A.M. by the Board of Supervisors. Mayor Dickerson stated there would be a presentation of the merit award for Dr. Ralph Christensen, Chairman of the Citizens Civil Defense Advisory Committee. Mayor Dickerson presented Dr. Christensen with his award with Dr. Ralph Christensen stating he could only accept the award on behalf of the Civil Defense Advisory Committee as well as those who have served on it in past years and he deeply ^ appreciates it. Only as a quarterback can he accept it as a member of the team. Councilman Corbin stated Dr. Christensen certainly deserves everything he receives and thanked him for doing an excellent job. Councilman Corbin also mentioned Dr. Christensen's trips to Mexico where he donates his time and services. Councilman Temple complimented Dr. Christensen on the fine work he has done, not only in this'job but on others, such as the cancer crusade, reminding Council that a special commendation had been sent via Dr. Christensen to the City of Racine, Wisconsin, Council Minutes 10/25/66 -1- at which city a most educational and beneficial and useful film had been made relative to cancer warnings. He certainly appreciates what Dr. Christensen has done. The Mayor announced there would be a presentation of five-year awards to City employees which is an outstanding achievement not only for the employees and Commission members, but for the City. Without the dependability and sincerity of each one who will be receiving the five-year awards, the City of Downey would not be as it is today. There are many things which could be said individually. Mayor Dickerson thanked all for the extra work and effort applied in times of necessity and emergency and it is something which only happens to people who are really dedicated to a community, putting in five years' work. He hopes there is the possibility that each will receive a ten-year award. The Mayor stated that the total number of City employees,iricluding today's, who have received the five-year pins and bracelets is 248. The City Manager was asked by the Mayor to call these employees forward to receive their awards. Mr. King wished to state ,that it is most gratifying to have the type and level of service given to the City by its anployees and requested that each asmemble after the presentation for a group photograph. Mayor Dickerson placed upon the wrist of Mrs. Inice Durham, Mayor and Council secre- tary, her five-year bracelet award. The balance of the presentations were made with City Manager Oren L. King and City Clerk Della Doyle assisting the Mayor. Mayor Dickerson announced the hearing on the intention to vacate a portion of Garnish Drive. Mr. Lee Leavitt reviewed the case, stating it was recommended by the Planning Commission and the street is no longer necessary for public use for street pur- �oses and constitutes additional maintenance and liability to the City.":' There were no comments or written protests or comments. RESOLUTION NO. 1796 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING THE VACATION OF THE CUL-DE-SAC AREA AT THE END OF 9700 BLOCK OF GARNISH DRIVE The resolution was read by title only. It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered that further reading be waived. AYES: 5 Councilmen; Dunnum, Corbin, Morton, Temple, Dickerson NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None It was moved by Councilman Morton, seconded by Councilman Temple and so ordered that the Council Minutes of October 10, 1966, be approved as distributed. The City Clerk read and reported on the following written correspondence: Letter from Mr. Edgar Barratt, requesting consideration of further study of requirements for radio ham operators to install sidewalks. Councilman Dunnum recom- mended that an investigation and recommendation be made concerning this matter. The City Manager stated he would be happy to bring in a recommendatiopnrelative to the stipulations for ham radio operators which might be more workable and staisfactory for all concerned. Council ordered a report be submitted after complete study. A letter of appreciate City Employees Association public employees adopted a their annual conference on type action on the part of another tribute to the type standing job and certainly Lon from the City Manager to the President of the Downey for the statement of principal opposing work stoppage by t the California League of City Employee Associations at Saturday, October 15. Mayor Dickerson stated he feels this the Employees Association of the City of Downey is but of people employed in the City. They have done an out - stand up for the City. Council Minutes - October 25, 1966 -2- The City Manager stated letters from Schooling and Schooling, Attorneys at Law representing the D & H Construction Company are in relation to the agreement between that company and the City. The agreement has been reviewed by the Director of Public Works, the City Attorney, and the City 'Manager. The City Manager stated the agreement was for six months until it will be completely financed and the City paid off. The City is retaining three sites for Park and Recreation facilities at a cost set at $36,000.00, the costs being based upon the value of these three lots after they have been fully improved, should the same be used for subdivision purposes. For compliance with all stipulations Council is on record as accepting and signing the agreement for the full amount of $611,000.00. Bidding was open throughout the City of Downey and throughout Los Angeles. The price of $611,000.00 represents over 100% of the original acquisition on this hospital site. All costs will be drawn from hospital funds and not from the City's General Funds account. This represents the only bonafide and legitimate bid received on the Stewart and Gray property since last January. Councilman Temple moved that the escrow instructions be approved and authorize the Mayor to sign the final escrow for the City. Councilman Corbin suggested a change in Paragraph 5 "to retain restrooms" instead of eliminating them. While he was reviewing the agreement, Mr.'King reported that the architects are progressing well with construction drawings for the hospital for the review of the hospital Board to call for bids next spring. The site has been fully cleared, Early next year the City should be proud to see a new hospital started. The Mayor asked the Director of Parks and Recreation if he had any suggestions relative to the park site to be retained in the subdivision being constructed by the D & H Construction Company. He reported that it was the preference that there not be any facilities or structures on the site. it would be well to make the provision for restroom facilities at this time, in the event it might prove to be necessary to have them at some future time. The City Attorney stated an addition to Paragraph 5 could be that the City may erect sanitary facilities to service the park site. Councilman Temple re -stated his motion to include the suggested amendment by the City Attorney. Councilman Dunnum questioned Paragraph 9 as to cancellation of the escrow --who would pay the escrow fees and title report fees, the City or the contractors? The City Attorney wanted to further review the agreement and recommend possible further amendment. Mr. King suggested bringing up the request of the Downey Symphonic Society, Inc. The Director of Parks and Recreation was asked to make any comments. Then Mr. Austin briefly reviewed the original presentation made and the request for additional funds from the City. Mrs. Jordan Phillips was then called upon to make her statement relative to the needs felt by the Symphonic Society, Inc. Board for additional funds, reminding that the union.scale had been raised. Mrs. Phillips reported that a letter had been sent to Supervisor Bonelli from the Mayor for possible assistance from Los Angeles County Music Commission and $2,500.00 has been allocated, which they will receive. This, plus $2,000.00 from the City. would cover their expenses, events planned for the year, but no expansion. Two thousand five hundred dollars will not cover the planned program butit will barely pay their expenses. She feels there has been some misunderstanding. Ethel Pickard of the Downey Symphonic Society stated there was actually a deficit which was not shown on the budget report. Councilman Morton stated there was one point which she raised which was to be considered --the extension of the Downey Symphonic Orchestra's presentation to include amateur musicians. Mr. James Ruth, Director of Parks & Recreation Department, stated this is being taken under consideration by'the Commission but on a long term basis, as it is difficult to organize amateurs. Councilman Dunnum said her understanding was that the budget presented to the Downey Park Commission appeared to be in balance. Actually, according to Mrs. Phillips' presentation, it was not. This is one of those activities in the City of Downey which Council and the City is most grateful to have and can point to with pride. It is not equalled in the surroandLng communities. She understood that the proposed program of the non-professionals was intended to be included in this year's activities and not merely as a long term arrangement. The Council must not overlook the great number of people Council Minutes - 33® who participate in one way or another, those volunteers working with the program, the musicians and the hundreds who attend regularly. She feels it is a case well made. It was moved by Councilman Dunnum, seconded by Councilman Morton and passed by the following vote to authorize an additional amount of $2,000.00 for the Symphonic Society, Inc. program and the following transfer of funds: AMOUNT FROM ACCOUNT NUMBER TO ACCOUNT NUMBER $2,000.00 Unappropriated Reserves 9-100-331.1 AYES: 5 Councilmen: Dunnum, Corbin, Morton, Temple, Dickerson NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Councilman Corbin stated that he voted Aye with the understanding that it goes toward forming an amateur group. Councilman Dunnum stated that there are really two programs being considered, one for amateurs and one of professional quality and that the high quality of music should be maintained for the great number of persons attending. Mayor Dickerson stated he personally knows how much the Board of Directors of the Downey Symphonic Orchestra have put into it, especially Mrs. Jordan Phillips. She has been its inspiration, backing it from the very start. Efforts which she has put forth are the results of what the City has today in its fine symphonic orchestra. He feels the money will be spent wisely and the City will benefit from it. Mrs. Phil- lips was thanked by the Mayor for her presentation, etc. It was moved by Councilman Dunnum, seconded by Councilman Temple and passed by the following vote that the disbursement of the funds to the Downey Symphonic Society, Inc. be on a quarterly basis. (Mr. James Ruth stated that it would certainly be helpful to the Society for them to be paid on the quarterly basis.) (Vote on the motion was not taken until the following comment was made by Councilwoman Dunnum that these organizations should have the opportunity to negotiate the agreements as they are directly concerned with, and know better than the Council, the workings and programming of their activities.) Councilman Morton stated that he did not feel these agreements should be held up but could be acted upon individually. Mayor Dickerson called for the vote on the above motion: AYES: 5 Councilmen: Dunnum, Corbin, Morton, Temple, Dickerson NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None The City Attorney stated that a motion would be in order to approve the agreement and th.orize the City's Mayor to execute the same on behalf of the City and that the other party could then approve or offer an alternative. It was moved by Councilman Temple, seconded by Councilman Morton and passed by the following vote to approve the Agreement between the City and the Downey Symphonic Society, Inc. and authorize the Mayor to execute it on behalf of the City. AYES: 4 Councilmen: Messrs, Corbin, Morton, Temple, Dickerson NOES: 1 Councilmen: Dunnum ABSENT: 0 Councilmen: None The Mayor then advised the members of the Downey Symphonic Society still present that they should advise the City if they believe changes in the agreement are necessary. Returning to the agenda and taking up additional correspondence, the City Clerk reported receipt of a letter from the Southern Pacific Company relative to closing down the freight station located in Downey, relocating in Anaheim. It had also been report- ed by Mr. N. L. Smith, District Freight and Passenger Agent that the Downey Historical. Society is welcome to the building but that they would have to have it moved themselves. The City Manager stated that Mr. Smith has been very helpful in approval of the opening of Patton Road for installation of sidewalks on Paramount Boulevard at the ex- pense of the City. Council Minutes - 10/25/66 -4- It was moved by Councilman Temple, seconded by Councilman Corbin (repeating the motion relative to the D & H ,Construction.Company escrow agreement and instructions) as amended by the City Attorney as follows: Under the Paragraph, #9, the statement should read " . . that the party hereto requesting the cancellation will pay the cancellation fees." Mr. King reported receipt of a letter from Congressman Del .Clawson relative to mail boxes and one from the Postmaster which indicate that results can be obtained at the local level. The letters state that the requirement is eliminated for placing mail boxes at curbside in new subdivisions in the future. ORDINANCE NO. 315 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE DOWNEY MUNICIPAL CODE BY ADDING SECTION 8100.4 AND SECTIONS 9150.1 THROUGH 9150.6 ALL OF WHICH SECTIONS RELATE TO REQUIRED STREET RIGHT OF WAY DEDICATION The ordinance was read by title only. It was moved by Councilman Corbin, seconded by Councilman Morton and passed by the following vote that further reading be waived. Councilman Morton inquired of the City Attorney as to the distinction between second hand dealer (those who deal in first obtaining and selling secondhand and personal property and auctions thereof) as against an antique dealer as specifically allowed by C(1). After the City Attorney explained that the ordinance does include secondhand dealers and such es tablishments as antique dealers and that the change from the existing ordinance is changing primarily the term "auto wrecker' to "dismantler" and also provides some other changes relative to filling out of forms, the police chief concurred. The City Attorney reported there was a change to the estimated cost of this improvement district and that the resolution declaring the intention to improve, determining that bonds shall be issued to represent the cost therefor, declaring the work to be of more than local or ordinary public benefit, and that the expense thereof shall be assessed upon a district has a figure change? Section 1, Page 1, the estimated cost should be $12,994.65. It was moved by Councilman Morton, seconded by Councilman Temple and so ordered that further reading be waived. Morton, Temple, Dickerson Mr. Ervin Spindel, Director of Public Works, gave a very comprehensive report on the Downey County Lighting District and proposal for dissolution for this district in the near future. Mr. Spindel stated there was no action by Council necessary at this time. It was pointed out by the Director by maps, the areas having lighting, the lighting districts, the safety lights installations at intersections.- Mr. Spindel also reported, however, that it will require a hearing being set at the next Council meeting for the last meeting in November as, by January, some action will need to have Council Minutes - 10/25/66 -10- 2`735 been taken regarding dissolution of the Downey County Lighting District. There are about 130 or 160 intersections now lighted with safety lights and a total of 606 throughout the entire City. (About 157 of these are within the Downey County Lighting District.) Councilman, Morton stated he is more amenable to the plan presented this year than he was with the one which was presented last year and held for further study and report by Council. About 100 safety lights can be installed this year, and ultimately more the fol- lowing year, reported Mr. Spindel, and the safety lighting program can go ahead regardless of whether or not the Downey County Lighting District is dissolved. The City Attorney was asked by Councilman Morton if he had reviewed the Agreement pertaining to Park Department Retirement Continuation. The City Attorney stated he had not seen the agreement but that it is a standard agreement and not really much can be done about it. On August 17 members of the Park and Recreation Commission met with Mrs. Alice Woodrow and members of the Board of Directors of the Museum to review this operation and the request for the building addition. As a result of the meeting between the Commission and the Museum Board, the Park and Recreation Commission initiated and subsequently approved plans which were prepared by the Park and Recreation Department providing for an 18 x 27 frame and stucco addition to the north side of the existing building. The City Manager stated construction of this addition will allow for the utilization of existing space to be converted into expanded office facilities, with the new addition housing all storage needs. Plans have been approved for enclosing the patio area, which has been used for an open air'storage facility, which is not too satisfactory, Councilman Morton stated, to clarify Council's previous action, when the first request was received from the Downey Museum of Art, it was rejected; however, it was retained on the agenda for further study. Council agreed the Downey delegate 'should be the Mayor and the Mayor Pro Tempore, the alternate delegate and so on down the seniority list of Council members. Mr, Irvin Phelan made a brief report on the performances of the Downey Civic Chorus at Downey's sister city, Guadalajara, Mexico. He stated that the Chprus really got to the people there in Guadalajara -- thousands of them. He then askel& Council's permission to have two of the members of the Chorus tell a little of the experience of singing for the people of Guadalajara. First Mrs. Ona McCrery thanked the City Council for all the wonderful support given their group as they continue to progress. They sang six times during their two-day visit to Guadalajara. On Sunday afternoon, they sang before 10,000 persons. Before their first number was finished, the entire area was filled by people so enthralled with their singing they had moved,up, filling in all the vacant seats toward the front of ^ the searing area. They sang at the orphanage which has had support through the sister city program, where they had to sing A Capella. In fact, for every performance but a television performance, there was no accompaniment. Mrs. McCrery also stated it seems to her the people were really reached. Mrs. Beverly Staub stated she would give some of the personal angle. The people of Guadalajara ran after their bus for three blocks as they were leaving to return home. They wanted to just touch the performers when they were giving their appearances. Council Minutes 10/25/66 -12- 2737 Mayor Dickerson stated that until you witness this warmth and appreciation it is difficult to bring it back and tell it completely. This type of thing is certainly strengthening the Sister City Program immensely. The groundwork laid will be for future trips of the various groups to participate. It is hoped the program is expanded in many other phases. The Mayor thanked Irvin Phelan and Mmes. McCrery and Staub. Councilman Temple complimented them on their presentations in Guadalajara. Councilman Morton stated this demonstrates the real purpose of the program and knows they reached the people. He added that they will have to come to grips as to whether they are in a people to people or an official to official program. Further comment was that to competing groups within the Washington area, there is this conflict of interest. It suffices it to believe that this type of program, stated Councilman Morton, demonstrates to him what former President Dwight Eisenhower had in mind when he initiated this people to people program, which is bringing about a deeper understanding of people of the other nations: Councilman Dunnum thanked Mr. Phelan and the members of the Downey Civic Chorus for coming to tell of their experiences. It is;especially worthwhile, she said, and knows the organization represented the City of Downey in the very best possible way. Councilman Corbin stated he cannot add anything -- it has 'all been said. In con- currance, he states he feels it is a very good relationship between the two cities. Mayor Dickerson expressed his appreciation to the ministerial association, and especially to Reverend Blackaby of the First Southern Baptist Church who had stayed throughout the entire Council Meeting. The Mayor stated he thought this was especially commendable. He knows of his many calls of duty and would be a sacrifice of his time.
