MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
OCTOBER 10, 1966
The City Council of the City of Downey held a regular meeting at 7:30 P.M.,
October 10, 1966, in the Council Chamber of the Downey City Hall, Mayor Charles W.
Dickerson presiding.

Dr. Wade Armstrong of the Trinity Baptist Church of Downey delivered the invocation.
Mayor Dickerson announced the public hearing on Resolution #107 (Planning).
Mr. Bill Goggin, Acting Director of Planning, gave a resume of the particulars of the
resolution, stating this is proposed in order that the City might acquire rights of way
in other than R-1 zones; heretofore, if 'there were no dedication, the City could not
require certain improvements.
There being no written and no oral comments or protest toManning Resolution No.
107, it was moved by Councilman Temple, seconded by Councilman Orton and so ordered
that the hearing be closed.
ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING
THE DOWNEY MUNICIPAL CODE BY ADDING SECTION 8100.4 AND SECTIONS 9150.1
THROUGH 9150.6, ALL OF WHICH SECTIONS RELATE TO REQUIRED STREET RIGHT
OF WAY DEDICATION
The ordinance was read by title only. It was moved by Councilman Corbin, seconded'
by Councilman Temple and so ordered that further reading be waived.
It was moved by Councilman Corbin, seconded by Councilman Temple and passed by the
following vote that the ordinance be introduced.

The Mayor announced the hearing on Zone Exception #690/Kilgore. Mr. King advised
that Councilmoman Dunnum, in whose district this case falls, had asked that the hear-
ing be continued until she could be present.
The City Clerk stated she had the proper affidavit of publication of the notice
of hearing on Zone Exception #690. The hearing was opened by the Mayor. It was then
moved by Councilman Temple, seconded by Councilman Morton and passed by the following
vote to continue the hearing on Zone Exception #690/Kilgore to 7:30 P.M., November 14,
1966, in the Council Chamber of the Downey City Hall.

Mayor Dickerson announced the hearing on Downey Improvement Project #548,
10505 Brookshire. Mr. Spindel reported on this proposed project, stating the side
walks were to be installed on Cherokee Drive side only and that proper notification
had been given the property owner.
The Mayor asked if the City Clerk had any correspondence. The City Clerk
reported she had received a letter from Mr. Johnson requesting matching funds on
the sidewalks. Mr. Spindel reported the opportunity had been given Mr. Johnson
on several previous occasions for matching funds, but Mr. Johnson did not avail him-
self of those matching funds at the time.
There being no oral and no written comments or protests, it was moved by
Councilman Temple, seconded by Councilman Corbin and so ordered that the hearing on
DIP #548, 10505 Brookshire Avenue, be closed.
RESOLUTION NO. 1789
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
CONFIRMING THE ASSESSMENTS FOR CHAPTER 2:"PROCEEDINGS
FOR DOWNEY IMPROVEMENT PROJECT NO, 548, BROOKSHIRE AVENUE
The resolution was read by title only. It was moved by Councilman Corbin,
seconded by Councilman Temple and so ordered that further reading be waived.
It was moved by Councilman Corbin, seconded by Councilman Temple and passed by
the following vote that the resolution, #1789 be adopted.

It was moved by Councilman Temple, seconded by Councilman Corbin and so ordered
that the minutes be approved as corrected for the Council Meeting held on September 27,
1966.
The City Clerk reported on the following correspondence:
A letter from Supervisor Frank Bonelli, advising the County will provide $15,000
with the City of Downey to provide $15,000 for repair to the Florence Avenue bridge
crossing the Rio Hondo River as a result of the recent and damaging fire.
It was moved by Councilman Corbin, seconded by Councilman Temple and passed by
the following vote to approve Gas Tax Funds (186.1) in the amount of $15,000.00 for
repairs to the Florence Avenue Bridge.

A letter from George Binder relative to the parking adjacent to the Southern
Pacific Railroad Company for which the property owners lease along Nance Street for
$100 per month. The request was for a review of this matter through the Parking Place
Commission.
It was moved by Councilman Temple, seconded by Councilman Corbin and so ordered
that the matter be feferred to the City Manager for further study and report. Councilman
Morton stated he wished to go on record as opposing any further consideration of this
matter.
A letter from Dr. Ralph Christensen of the Civil Defense Advisory Committee,
stating documentary slides were being donated to the City which constitute a
compendium of what has been accomplished by the Civil Defanse Advisory Committee in
establishing a four-phase disaster program for the citizens of the City of Downey.
Councilman Temple advised he had accepted these slides on behalf of the City. Letter was
ordered received and filed.

A claim for damages from Pacific Telephone and Telegraph Company. It was moved by
Councilman Temple, seconded by Councilman Morton and so ordered that the claim be denied
and referred to the City's insurance carrier.

A memorandum from Donald B. Robison relative to county dog nuisance ordinance,
#4729, Section #505, which accompanied the memorandum. It was moved by Councilman
Temple, seconded by Councilman Corbin and passed by the following vote to add to the
Downey Municipal Code, in substance, County Section #505 of the County ordinance.

Attorney Sorensen was directed to prepare such amendment to the Downey Municipal Code.
A letter from W. 0. Hoverman, objecting to conditions being required of amateur
or citizen band radio transmitters. Mr. Goggin reported on the requirements, namely
installation of sidewalks, for conditional use permits. The letter was ordered re-
ceived and filed.
Councilman Temple reviewed a letter from Mrs. Virginia Ostenhoudt which was in
appreciation for tree removal and repair of curbs at her residence at 7920 Melva Street.

The ordinance was read by title only, Water Superintendent Walter Wanke explained
the amendment is merely to existing sections dealing with extensions and mainly to
clarify sections regarding cost and reimbursement procedures.

is a re -adaption due to the newspapers discrepancy in not publishing the hearing in
the required time.

Mr. $pindel, Director of Public Works, reported the assessment rpll had been
modified and the change distributed among all the parcels on the basis of benefit
received; the street to be brought up to satisfactory condition; the low portions
in the drainage area have been remedied to the contractor's satisfaction and the
street, in his estimation, is in better condition than it was previously.

Mr. Ervin Spindel, Director of Public Works, brought Council up-to-date on the
Downey County Lighting District which, last year, was recommended to being extended
the one year. A resume was given of the various areas, type of lighting which is
installed and the need for additional lighting, which includes safety lighting at
intersections constituting about 50% of the lighting which is beneficial to the
general public.
Councilman Morton stated he would like to receive a complete file from last
year's Council material as he knows there are quite a number of protests in view
of the fact that the City has encouraged citizens to establish their individual
lighting districts.
Council agreed there should be further study of the lighting program and
safety lighting and the Director of Public Works was directed to bring more informa-
tion to Council.
A report of Select System Street expenditures was submitted to Council for
their information only.
In SS Project No. `120, Third Street west of Paramount Boulevard improvements,
it was reported that in addition to the land value, the costs of engineering, legal
fees, court costs and appraisal costs make an overall cost of right of way acquisi-
tion $38,000.00,` making it necessary, therefore, to appropriate additional funds to
cgy#F, these costs.

the following vote to budget funds in the amount of $13,000.00 from 186,1 funds to
Account No. 16029 in SS Project #120, Third Street west of Paramount Boulevard.

The City Manager announced that the Youth Week film will be shown on Tuesd
night of this week for those who are interested in seeing it.

by the following vote, in order to comply with Senate Bill No. 3 re: -drunk driving
offenses which became effective October 6, to purchase a breakh tester at $719,00
supplemented by necessary equipment of $147.00, totaling $866.00, and authorize the

Mr. King reported that the City Administrator from Bellflower advised that
Bellflower would like to reopen discussion on construction and maintenance on
Gardendale Street. Council took no action with the expression that the City Limits
should be in the center of the street so that Bellflower and Downey could share in
the costs.

by the following vote to authorize purchase of new automobile for the Fire Department
as specifications appear in Item 3 of the City Manager's report for which funds are
available from adequate depreciation funds for the replacement of this car.

The City. Manager reported on a program designated "Zero Defects Program" in
continued efforts to reduce wasted time and money through the prevention of errors,
The Public Works Department has requested authority to participate in a "Zero
Defects Program" and it is believed it may be effective upon a City-wide basis,
sponsored:. by the City Manager's Office, with the hope that the City's Workman's
Compensation and General Liability premiums may be reduced. It would also increase
good public relations and monetary savings in administrative procedures.

the following vote to approve participation in a "Zero Defects Program" as outlined
by the City Manager.

the following vote to grant authority to participate in a research program, American
Public Works Association Research Foundation, not to exceed $200.00, paid out of the
Public Works budget, as_outlined 'in Item #5 of the City Manager's report.

In accordance with the recommendation of the Citizens Fire Advisory Committee
and Fire Chief Robert W. Gain that the 1945 Mack 750 gpm pumper, which is presently
in reserve, be immediately activated to increase the manned hose -carrying and pumping
capacity, it was moved by Councilman Morton, seconded by Councilman Temple and passed
by the following vote to authorize approval of two additional Fire Engineer positions
in order to permit two existing personnel to be promoted to Fire Engineer, each to be
in charge of the equipment mentioned. (The cost to initiate the program is $82.00
per month, which can be accomplished in the current personnel budget of the Fire
Department due to time ensuing between filling of recent vacancies.)

the following vote to approve attendance by Hollis Stewart and Gary Lindstrom to the
California Park and Recreation Society, Kountain Workshop November 13-14, at the
University of California Conference Center at Lake Arrowhead, costing $17.00 per

person, which includes registration, meals, room and bedding.

Further study was ordered for selection of an architect for Treasure Island
Park with a possibility of using City employees as much as possible.
It was moved by Councilman Temple, seconded by Councilman Morton and passed
by the following vote to authorize improvements at 11701 Rives Avenue/Wineberg, in
exchange of right of way at a cost of $5,900.00, even though the value of the right of
way was only`$5,300.00, due to the great benefit of these improvements proposed.

Mr. King clarified the item relative to change of telephone directory, stating
the yellow sections are to remain the same, and Council is on record as opposing the
changes.
Councilman Morton suggested that at least two council members, the Director of
Public Works, City Manager prepare an analysis of the proposed location of the
Century Freeway in the Downey area and other cities relative to some of the problems
brought up by the State Highway Division Director in Sacramento and feels the need of
a study and analysis of what the implications would be if the Century Freeway would
come through Downey with any of the routes other than the southerly one. Some form
of formal presentation should be prepared to be presented at the next hearing on the
Century Freeway.
It was moved, by Councilman Morton, seconded by Councilman Temple and passed by
the following vote that at least one Councilman, Public Works Director and City
Manager, and one other from the Public Works Department and the Planning Director,
with someone starting work immediately, relative to preparing for the Century Freeway
hearing. (Councilmen Morton and Corbin were designated to work on this program.)

Councilman Temple suggested a freeway sign showing the City of Downey be installed
at the Firestone Boulevard off -ramp of the 605 Freeway, San Gabriel, which shows only
Norwalk.
There being no further business to come before Council, the meeting was adjourned
at 9:30 P.M.
