Dickerson presiding. PRESENT: Councilmen: Dunnum, Corbin, Morton, Temple, Dickerson ALSO PRESENT: Oren L. King, City Manager Royal M. Sorensen, City Attorney Bill Goggin, Acting Director of Planning Ervin Spindel, Director of Public Works James Ruth, Director of Parks & Recreation Department Robert Shand, Purchasing Agent Lee Leavitt, City Engineer Robert W. Gain, Fire Chief Ivan A. Robinson, Chief of Police Ray Lake, Director of Building & Safety Walter Wanke, Superintendent of Water Department Don Robison, Assistant to the City Manager Della Doyle, City Clerk Alberta M. Pfeiffer, Deputy City Clerk Reverend Floyd Peterson of the Moravian Church delivered the invocation. Mayor Dickerson announced the hearing on Zone Exception #687, 8038 Dinsdale Street. The City Clerk stated she had the affidavit of publication of the notice of hearing. Bill Goggin, Acting Director of Planning, outlined the Zone Exception #687. Speaking in favor of the appeal was Bryan Brandmeyer, Attorney, on behalf of owner, Edgar H. Hatfield. There being no further comment for or against Zone Exception #687, it was moved by Councilman Corbin, secondod by Councilman Temple and so ordered that the hearing on the appeal to Zone Exception #687 be closed. It was moved by Councilman Temple, seconded by Councilman Corbin and passed by the following vote that the decision of the Planning Commission be modified to grant a zone exception for a 10' wall abutting the commercial property along the alley and, except for that modification, the decision of the Planning Commission be affirmed. AYES: 5 Councilmen: Dunnum, Corbin, Morton, Temple, Dickerson NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Mayor Dickerson advised that the matter will be referred back to the Planning Commission for report to Council at its next meeting. Mayor Dickerson announced the public hearing on an application to operate a for hire vehicle. The City Clerk stated she had the affidavit of publication of notice of the hearing. The City Attorney stated that under the provisions of Chapter 5 of Article 6, a permit issued would limit the operation and the carrying on of the business simply to the transportation of school children under any contract that he might have with the Downey Unified School District. There being no written and no oral comments or protests, it was moved by Councilmen Temple, seconded by Councilman Morton and so ordered that the hearing on the application for permit to operate a for -hire vehicle be closed. It was moved by Councilman Dunnum, seconded by Councilman Temple and passed by the following vote to grant a permit to Mr. Jimmie Shubin, limited to the trans- portation of school children as far as he may have a contract to do so with the Downey Unified School District. Robinson. Chief Robinson stated that Downey is the first City to have every police officer accredited for the basic certificate. This is accomplished through the State Peace Officers, State of California and League of California Cities under police officers Standards and Training Commission. Mayor Dickerson assisted Chief Robinson in presenting certificates as accredited supervisors to Sgt. James Mann, William Denton and Robert Williams. The Mayor commended Chief Robinson for maintaining the high standards of the police force for the City and his interest in pursuing the highest type of individual for the Police Department. Councilman Dunnum presented a proposed amendment to other Council members which would amend the last paragraph of the minutes of the Council Meeting of September 12 to read as follows: "It was moved by Councilman Dunnum, seconded by Councilman Temple and passed by the following vote that the City Council approve the request of Ivan A. Robinson to have the City provide the defense in the action of Furnish vs. Robinson, et al., the defense be'furnished through the attorney requested by the Chief in his memorandum of September 8, 19662 and this approval and agreement is with a reservation of rights to the City Council and is conditioned upon Chief Robinson's agreeing that the City may reserve its rights against him pursuant to Government Code Section 825 and 825.6 (b)." AYES: 3 Councilmen: Dunnum, Temple, Dickerson NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None ABSTAIN: 2 Councilmen: Morton, Dickerson The City Clerk reported on the following correspondence: Minutes of the Water Board meeting held September 20, 1966, In accordance with a recommendation contained in these minutes, it was moved by Councilman Dunnum, seconded by Councilman Temple and passed by the following vote to approve installa- tion of a gas engine at 11523 Dolan Avenue and grant authority to prepare plans and specifications and advertise for bids and appropriate $18,000 from unappropriated water reserves to Account #86032. AYES: 5 Councilmen: Dunnum, Corbin, Morton, Temple, Dickerson NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None A request from the Symphonic Society for additional funds. Mrs. Jordan Phillips, Chairman of the Finance Committee of the Downey Symphonic Society, stated this request came about due to the Union requiring musicians to be paid on the union scale after the original budget request was made. Councilman Dunnum asked for Mr. James Ruth's comments. Mr. Ruth, Director of the Parks and Recreation Department, stated he was not aware of this need and he requested time to review the matter. It was moved by Councilman Morton, seconded by Councilman Temple and passed by the following vote to refer the matter to the Park Commission for study, analysis and recommendation to the City Council at its next meeting. Invoice from the Southern California Association of Governments. Mr. King stated the City of Downey was paid up for 1965-66, and an additional amount is now due for 1966-67. It was moved by Councilman Dunnum, seconded by Councilman Corbin and passed by the following vote to authorize payment of the outstanding amount of r-� assessment for Downey's membership in the Southern California Association of Governments. It was moved by Councilman Morton, seconded by Councilman Dunnum and so ordered to authorize the City Attorney to proceed as requested, advising the District Attorney's office so that an appeal may be processed. Damage claim for Dixie Sue Purscell. It was moved by Councilman Corbin, seconded by Councilman Temple and passed by the following vote to deny the claim and refer to the City's insurance carrier. Robinson to the City Attorney re- quested a revision of the ordinance relative to pawnbrokers, secondhand dealers, auto wreckers and junk dealers. It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered to authorize the City Attorney to prepare an ordinance as requested. It was moved by Councilman Dunnum, seconded by Councilman Corbin and so ordered to set a hearing for 7:30 P.M. on October 10, 1966, for Zone Exception #690, 8503 Boyson Street (Kilgore). Mr. Iry Phelan, 7714 Yankee, requested funds to send the Downey Civic Chorus to Guadalajara to perform at their October festival. Previous arrange- ments had been made for th6 Chorus members to stay in private homes; however, this arrangement was later withdrawn. After much discussion, it was moved by Councilman Temple and seconded by Councilman Dickerson to increase the appropriation to $1100 for the Downey Civic Chorus. Councilman Morton stated he is b asically in concurrence entirely with both Councilman Dunnum and Corbin who feel that the City should not use funds in this manner, however he feels the matter has gone too far --unfortunately the matter should have been brought to City Council some time ago before printed programs were involved. The City of Downey would be embarrassed since the programs show that the Downey Civic Chorus will sing at this function in Guadalajara upon seven occasions. Councilman Dickerson stated he also concurs with Councilmen Dunnum and Corbin in their views, but that he feels the Downey Civic Chorus can further help cement relations between the two cities. He asked Dick Raabe if he cared to add something. Mr. Raabe stated that he felt Guadalajara people were definitely very pleased with the two ambulances which were recently presented to them, after having been driven to Guadalajara by Mayor Dickerson and himself. Mr. King reported that a field trip had been made to Meadow Road and that the Director of Public Works will see that the paving is done to the same standard it was before the work was done under AD #106. Councilman Dunnum stated that the contractors had the direction of the then property owners to leave the fence in question down; that we cannot impose a burden on contractors to check with subsequent owners, and therefore no further action should be taken regarding the fence. It was moved by Councilman Dunnum, seconded by Councilman Corbin and passed by the following votethatthe assessments'be modified in AD #106, Meddow Rd., by showing a City contribution in the amount of $500, and the road be brought up to standard. None ABSENT: 0 Councilmen: None Mr. William Bonnar, one of the property owners in Meadow Road Assessment Dis- trict #106, asked why he was unable to obtain a copy of public records, namely a breakdown of the costs of the assessment district. He was informed these records were not available until such time as the City Council has had them. Mr. Spindel pointed out that there had actually been a net savings on these improvements of around $900. RESOLUTION NO. 1785 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DESIGNATING JULIUS AVENUE AS A YIELD STREET AT THE INTERSECTION OF IRWINGROVE DRIVE The resolution was read by title only. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING ITS INTENTION TO VACATE A PORTION OF LINDELL AVENUE BETWEEN LAKEWOOD BOULEVARD AND TELEGRAPH ROAD The resolution was read by title only. Mr. Shafer, 8842 Lakewood Blvd., spoke in favor of the vacation of a portion of Lindell Avenue between Lakewood Boulevard and Telegraph Road. It was moved by Councilman Morton, seconded by Councilman Temple and so ordered that the matter be tabled in order to make a field trip to the area, with a report from Mr. Spindel relative to drainage. Councilman Morton stated the field trip is appropriate because there is potential long-range improvement in this area to the east of Lakewood Boulevard, and a question of a right turn in this area. Report is to be at the next morning meeting of the City Council, Ocrober 25. Councilman Morton stated that the people in the area want the General Plan followed with regard to any further commercial use. The City Council should bear in mind it could set a dangerous precedent. Very summarily, she stated, she would like to thank Mr. King for his many activities to the Council as individuals and as a group and this is brought out at this time by comanents which Councilman Dunnum stated she has heard from time to time, particularly from the Mayor's comments regadding him from the meeting at San Diego recently, and by how well the City was represented by Mr. King in his extra courtesies. Councilman Morton expressed his thanks for the opportunity to represent the City of Downey at the presentation of awards relative to the Sister City program in Washington, D.G. After meeting with the various representatives of Cities participating in the People to People program, Councilman Morton stated he now knows what the problems are in the Sister City program and would like to go over this with the Council sometime in the future. Councilman Morton stated he has received continuous complaints about the use of motor bikes and presented a picture to Council showing marks on the front lawn of Mr. Francis N,:.-Harf; which were made by the path of a motor bike. It was requested that the Police Chief give the matter some thought as there seems to be an increase in this type of nuisance. Councilman Morton questioned the film program and audio-visual services of the Downey City Library, reminding Council of previous statements he had mdde on the subject. Mrs. Evelyn Young, 7342 Finevale, submitted a petition signed by 180 residents, objecting to development of Treasure Island Park. Councilman Temple requested investigation for control of animals running at large. Relative to the joint use of parks and schools by the City and the Downey Unified School District, it was reported that two members from the School District shall be appointed from their Board and two members of the City Council as a com- mittee to study the joint use of parks. Councilman Corbin moved Councilmen Dunnum and Temple be appointed to this committee. So ordered.
