MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
JULY 11, 1966
The City Council of the City of Downey held a regular meeting at 7:30 P.M.,
July 11, 1966, in the Council Chamber of the Downey City Hall, Mayor Charles Dickerson
presiding.

The invoc4#ion was delivered by Reverend Curtis Puryear of the Immanuel Baptist
Church of Downey.
Mayor Dickerson announced the time had arrived for the public hearing on Planning
Resolution No. 104, Zone Exception #108 and inquired of the City Clerk if she had the
Affidavit of Publication, City Clerk Della Doyle replied she had the affidavit. It
was ordered received and filed.
Mr. Sherman Griselle, Director of Planning reported on Zone Exception #108.
There being no written and no oral comments or protests, it was moved by Council-
man Temple, seconded by Councilman Morton and so ordered that the hearing on Planning
Resolution No. 104, Zone Exception 4108, be closed.
ORDINANCE NO.

AMENDING THE ZONING MAP ADOPTED BY SECTION 9107 OF THE DOWNEY
MUNICIPAL CODE (PTANNING RESOLUTION NO. 104)

It was moved by Councilman Corbin, seconded by Councilman Temple and so
ordered that the minutes of June 28, 1966, be approved as corrected.
Mayor Dickerson announced at this time Albert C. Martin & Associates would present
the preliminary plans of the municipal hospital.
Mr. Albert C. Martin presented Council with the preliminary plans for the proposed
hospital, schematic and estimated cost breakdown with an alternate plan which would
eliminate the sunshades and pillars in the original plans which, if not deleted, would
involve an additional cost of $117,000.00. Mr. Martin stated that approval of the plans
is necessary in order to submit to the State Department of Health for approval before
they can be ready for preparation of construction documents by their organization.

Hospital
Reverenq Cogswell, President of the Downey Community/Foundation, stated that they
would be willing to assume a little more cost in the interest of the comfort of the
patients and would like for Council to approve retaining the sunshades and pillars as
shown in the original plans. He added that the Foundation had reviewed and approved:'.
the preliminary plans and inquired what the total estimated cost of the hospital woui'
be. Mr. Martin replied the amount would be $4,055,000 plus an additional contingency
of $200,000 for possible increased cost of materials, which would amount to a total
then of $4,255,000. This figure does not include the approximate $1,200,000 in land
costs plus architecture fees, legal and financial fees and other miscellaneous costs.
The City Manager, Oren King, stated all the costs are still to be calculated
and should be presented by the financial consultants, Stone & Youngberg, within the
next 30 days.
The City Clerk reported on the following correspondence:
A communication from the Los Angeles County Road Department for allocation of
County Aid in the amount of $100,000,00 for the Downey improvements between the Southern
Pacific Railroad tracks south of Firestone Boulevard -and Fifth Street. Received and
filed.
Fourth quarter Financial Report from the Downey Civic Chorus. Received and filed.

It was moved by Councilman Temple, seconded by Councilman Morton and so ordered

Notice from the State Highway Engineer of relinquishment of the right of way to the
City of Downey relative to 605 Freeway, San Gabriel River Freeway, was received and filed.

Earnest Threlfall and Edythe R. Childers (Zone Exception #677, Lakewood Boulevard and

It was moved by Councilman Dunnum, seconded by Councilman Corbin and so ordered
to set public hearings for 7:30 P.M., in the Council Chamber of the Downey City Hall,
August 8, 1966, on Zone Exceptions#671 and #677.
A request from Robert G. Wendt relative to Zone Exception #661, Florence and
Downey Avenues, (Brain, et al.) for clarification relative to waiver of filing fees for
a new zone exception case was discussed by Council and after a report from Planning
Director Griselle relative to the action of Council as spelled out in the minutes of
June 20, the City Attorney advised that although the present appeal is denied insofar
as removing conditions attached by the Planning Commission, Council could refer the
matter back to the Planning Commission for the purpose of making a study in conjunction
with the property owners to determine whatever developments could be considered and
report back to the Council.
It was moved by Councilman Morton, seconded by Councilman Temple and passed by
the following vote that Mr. Wendt be advised that it was the intent of Council not to
waive the filing fees but to waive the waiting period of one year before going back
to the Planning Commission for a new zone exception case.

Councilman Morton recommended, due to the fact it is in his district, is a critical
area for the people of Florence Avenue, that Councilman Corbin of District #5 and him-
self act as a committee of two, together with the Planning Director, to meet with the
property owners to come to somewhat of an understanding to present to the Planning
Commission.
It was moved by Councilman Dunnum, seconded by Councilman Corbin and so ordered
that the City Attorney be directed to draft and present an ordinance which would allow
the City Council to waive the filing fees for zoning cases when Council so finds it is
in the best interests of the applicant to do so.
It was moved by Councilman Morton, seconded by Councilman Temple and so ordered
that Councilman Morton from District #4 and Councilman Corbin from District #5 and
Mr. Sherman Griselle, Director of Planning, meet with property owners in the area
at Florence Avenue and Downey Avenue in an attempt to help resolve some areas of mis-
understanding in Zone Exception #671 (Wendt/Brain, et al.)
The City Attorney advised that relative to the various ordinances relative to
building code revisions based upon the 1964 edition of the Uniform Building Code, the
Uniform Housing Code and the Uniform Plumbing Code, together with the 1965 edition
of the Uniform Wiring Code, with the 1963 edition of the State of California Electrical
Safety Orders and the 1965 edition of the National Electric Code, he would read their
respective titles. The first one could be introduced but should not be adopted until
such time as hearings are held on subsequent ordinances and all building ordinances
adopted so that all will be effective and operable at the same time.

After summation of bids for Cash Contract #161, Woodruff Avenue water mains,
Firestone Boulevard to the Southern Pacific Railroad and since it is in relation to
Woodruff Avenue, it was moved by Councilman Morton, seconded by Councilman Temple and
so ordered that all bids be rejected and authority granted to readvertise for con-
struction as the bids were excessive.
Mr. Spindel remarked that with some revision of plans and specifications they might
possibly get the contractors at a better time.

the following vote to authorize improvements in exchange for right of way in Select
System Project No. 115, 12046 and 12056 Rives Avenue.

It was moved by Councilman Corbin, seconded by Councilman Temple and passed by the
following vote to approve agreement with the City of South Gate for jail services for
the next fiscal year and authorize the Mayor to sign.

The City Manager reported on the Downey Avenue improvement for widening and
re -facing of the businesses. Right of Way Agent, Bob Chalmers, reported that Mr. Steck-
lein and his mother, Mrs. Stecklein, are ready to sign the agreement for the 5 ft. of
right of way which would bring the percentage of signers in the area to 74%.
Mr. King acknowledged in the audience, Mrs. Zella Brumley, and read the names of
the property owners who signed for the improvements on Downey Avenue. He recommended
entering into escrow for appraiser's amounts for acquisition of the 5 ft. frontage of
the Downey Avenue properties.
The City Attorney inquired if by authorizing the Mayor and/or the City Manager to
enter into escrow, did Council wish to authorize entering into escrow before the other
property owners have signed.
The City Manager replied other property owners are out of town on vacation and
there are others who wish to obtain additional structural information.

Councilwoman Dunnum asked if it would be possible to enter into escrow without
actually closing the escrow until the balance had signed.
The City Attorney advised that the City would be committed for the balance of
the properties, one way or the other.
It was requested that the agreement be read which the property owners on the
Downey Avenue project are requested to sign, and it was read in full by the City
Attorney.
It was moved by Councilman Temple, seconded by Councilman Dunnum to proceed with
the escrow,
Mr, Elwood Stecklein from Minnesota, visiting his mother at 8362 Second Street
asked for clarification on the uniformity of the improvements on Downey Avenue if
certain property owners do not sign the agreement,
The City Attorney advised if the City takes the balance of the property through
eminant domain proceedings, it could take up to one year for completion and then the
City could not compel the owners to build or improve the property, but there would
be no problem of setbacks, which will be required to be at least the additional 5 feet.
The motion to proceed with the escrow was restated by Temple, seconded by
Councilman Dunnum that the Council approve all the agreements signed by property
owners on Downey Avenue for the 5 ft, right of way and authorize the Mayor to sign.
It was so ordered.
It was moved by Councilman Temple, seconded by Councilman Dunnum and passed by
the following vote to authorize signing of the City -School Reciprocal Recreation Agree-
ment with the Downey Unified School District for reciprocal use of parks and recreation
and for the Parks and Recreation Department's use of schoolgrounds during the summer
months.

Mr. King reported the City had received a request from Mr, Bob Dufeck, Connie
Mack Baseball League, requesting that trophies be displayed in the case at the City
Hall,
It was moved by Councilman Temple, seconded by Councilman Morton and so ordered
that Mr. Dufeck's request to display baseball trophies in the City Hall trophy case be
approved,
City Attorney Sorensen reported on the procedures for withdrawal of a portion of
the City in the Southeast Park District, A sample letter for sending to the residents
in the area was submitted to Council and it was suggested that an attached sheet or
post card should contain some representation of the property --either address, a map
designating the parcel, but that it should have some identification of the property
owner giving the consent.

the following vote to authorize the Director of Parks, James Ruth, to send letters to
property owners in the Southeast Park District in the City of Downey for their consent
to withdraw from the district,

Mr, King recommended that Dr. Henry Reining of USC be authorized to initiate,
supervise and bring to a conclusion, a classification survey of all positions within
the City, (He would work with the City Manager and Don Robison, Assistant Personnel
Director, for the appropriated amount of $1,000,00°) It was moved by Councilman Temple,

The City Manager reported on a. proposed actuarial survey of public safety
employees (fire and police personnel) under Government Code 21.264 after retirement
for survivor on industrial disability which would cost about $100.
It was moved by Councilman Temple, seconded by Councilman Corbin and passed by
the following vote to proceed with the survey of public safety employees survivors dis-
ability benefits on Government Code 21264.

It was reported by City Manager that the Stewart and Gray property programming
progress with soil tests, topographic map, subdivision preliminary engineering.
Any interested buyers are welcome to use this information.
It was moved by Councilman Morton, seconded by Councilman Temple and so ordered
that the City Council recognize the retiring Park. Board with an appropriate award certi-
fying their outstanding community service, the awards being made formally at a Council
meeting,
Dorothy Levin, 9311 Clancey, Vice President of the Downey Museum of Art and on
the Board of Directors requested modifications to the museum in the amount of $6200,

that she feels it is extremely necessary to have fulltime person and director,
Ms. Levin read a letter from Mrs, Grow, President, who was unable to appear due to ill-
ness. It was pointed out by Ms. Levin that the Downey Museum of. Art was listed in the
International Art Calendar bonklet,
Mayor Dickerson stated the regnest for the additional $5,000,00 is stall under
submission as it has not: been passible to have a full council meeting together to
arrive at a decision regarding this 'request: due '�,:o vacations and heavy schedules.
Pat Lowe, 9505 Lubek:, wht_: works with the art, school at: the Downey Museum of Art,
urged Council to consider favorably the request :for the additional. amount necessary to
supply full-time employees for operation of the Museum.
Mayor Dickerson wished to commend a, small girl, who had sent a letter and pictures
from her reader of painted, artistic l.it:ter cans and for consideration by her of
beautification of the City.
It was moved by Councilman Temple, seconded by Councilman Morton and so ordered
that the City Attorney be directed to prepare a 'reso'l'ution of commendation for Mr. Cabell,
former Director of the Los Padrinos Juvenile Hall for Council's adoption at its next
regular meeting.
There being no further business to come before the City Council, the meeting was
adjourned at 9:30 P.M,
