MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
NOVEMBER 22, 1966
The City Council of the City of Downey held a regular meeting at 8:00 A.M.,
November 22, 1966, in the Council Chamber of the Downey City Hall, Mayor Charles W,
Dickerson presiding.

Ray Lake, Director of Building and Safety Department, delivered the invocation in
the absence of the regularly scheduled minister.
The City Manager reported the City had been informed that it had earned a 30% refund
on its 1964-65 Workmen's Compensation Insurance premium, which is a considerable
increase over the 1963-64 dividend of 2%. The department heads and City employees are to
be commended for their safety consciousness which in 1965-66 resulted in the City's being
placed in the top one-third of its group (cities with 301-.600 employees) in the League
of California Cities, State Compensation Insurance Fund Safety Contest.
Present to submit the refund check in the amount of $24,824.00 was Mr. James H.
Takayama, Safety Representative of the State Workmen's Compensation Commission.
. Mayor Dickerson thanked Mr. Takayama for coming personally to present the check to
the City.
Mayor Dickerson announced the presentation of certificates of registration as
Civil Engineers in the State of California of two employees: Witold Hryniewicki, Civil
Engineer and Warren D. Seltzer, Assistant Civil Engineer. Mr. Spindel advised that this
is a great achievement in the field of Civil Engineering, comparable to being admitted
to the bar or being licensed to practice medicine. The certificates were presented by
the Mayor.
It was moved by Councilman Dunnum, seconde_& by Councilman Corbin and so ordered
that the minutes of the Council Meeting held on November 14, 1966, be approved as dis-
tributed.
Upon it being announced by the Deputy City Clerk that items of correspondence had
been placed on the Councilmen's desks prior to the meeting due to the communications
having been received subsequent to the time the -.agenda folders were delivered, Councilman
Dunnum stated she again wished to object to matters being placed on the Council desks.
The Deputy City Clerk reported receipt of a letter from the Greater Los Angeles
ChaptPr;`.iNpttional Safety Council, accompanied by a suggested resolution, relative to
support of their holiday traffic safety program. Mr. King was asked to review the
matter.

Letter from United States National Bank in appreciation of the growth it has
enjoyed since the bank was first estahlished in Downey three years ago ordered received
and filed.
Letter from Southern Pacific Company addressed to Mr. Irvin Phelan, President of
the Downey Historical Society relative to availability of the freight station building
to the society provided the society would move it from the premises. Councilman Corbin
advised a review of the feasibility of moving the building which is quite old. Councilman
Dunnum requested a study of the cost, means for removal, relocation, etc. Council
referred the matter to the City Manager for a reevaluation of the entire progran, which
includes the carriage house mentioned at a previous council meeting.
A report from Mr. Ervin Spindel, Director of Public Works relative to the San
Gabriel River drainage at Pico Vista Road at Cecilia Street. In a meeting on November 16
with representatives of the United States Corps of Engineers, Los Angeles Flood Control
District and representatives of the City of Downey, it was agreed that it was the Corps
of Engineers responsibility to rectify the condition which was caused by the general
construction. After discussing the various possibilities, it was decided that the most
feasible alternative would be to build a larger drain outlet into the channel at the
south end of the Rio San Gabriel Park and to grade the park so that it will drain the
north end, which is the southerly terminus of Pico Vista Rd., to this outlet. It was
also agreed that this work could probably not be accomplished during the current winter
and that the City would have to take such emergency steps as would be necessary, to
protect the adjacent properties if a heavy rain storm occurs. The Department of Public
Works is preparing to immediately make a topographic survey and to prepare grading plans
to accomplish this drainage, with the approval of the Park Department. It is believed
that this re -grading of the park area will also be beneficial to the park in helping
solve its drainage problems.
The Corps of Engineers is going to contract for improving the bbannel northerly of
Cecilia Street right after the first of next year and it is contemplated to have the work
included in the contract as the Number 1 priority itemof construction.
.A communication from the County of Los Angeles Health Department relative to their
immunization program in an attempt to "stop measles" with a list of the various clinics.

SECTION 4600,1 TO THE DOWNEY MUNICIPAL CODE, WHICH SAID SECTION
RELATES TO NOISE
The ordinance was read by title only. A question was raised relative to the
hours, The City Attorney reported the hours are the same as the existing section and
that the new section specifies power mowers, tools, machines. The police chief ex-
plained the reasons for addition to this section. He stated many complaints had been
received relative to gardeners' operation of power mowers before 6:00 a.m, and the use
of skill saws, power saws and equipment late at night, after midnight.
The City Attorney reported that the present Code Section 4602 also has provision
for the hours of 11:00 A.M. to 7:00 A.M. which was the reason for the use of these
same hours in the new section proposed, which was recommended by the Chief of Police.

Councilman Dickerson stated there are many telephone company employees who continue
to park in the lot recently established and urged stricter enforcement as this parking
was to be for shoppers' parking to do business in the downtown area. The City Manager
advised that numerous citations have been issued and Mr. Montgomery of the telephone
company had been contacted and had reported bulletins had been issued to the employees
not to park in this lot. Mayor Dickerson urged more rigid enforcement on the parking.
The Police Chief stated 65% of the time spent on enforcement can be utilized in the
downtown business area.
Mayor Dickerson declared a 5 -minute recess with Council reconvening at 8:40 A.M.
with roll call, four members of Council being present.
Mr. Ken Theodore, representative of the Downey Junior Chamber of Commerce, invited
the Mayor, Councilmen, their wives and families to ride in the Christmas Parade and to
view the parade from the reviewing stand at Downey Avenue and New Street on December 4,
1966. Councilmen Corbin and Dickerson offered regrets that they will be unable to accept
the invitation as they will be out of town attending a National Congress of Cities.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY AUTHORIZING
r THE EXECUTION OF A CONTRACT WITH THE DEPARTMENT OF FINANCE OF THE
STATE OF CALIFORNIA FOR A POPULATION ESTIMATE
The resolution was read by title only. Mr. King stated this population estimate
had been approved about three months ago, and that this will be the City's last chance
to obtain the population estimate prior to 1970. It was felt there would be enough of
an increase that the City would benefit from having this population estimate made at
this time. Each person would allow for a little more than $13 per capita. The State
Director of Finance has advised that signing the agreement will result in the City's
acceptance of their population figure. It was deemed advisable that the City Manager
check further as to the possibility of a population increase which would benefit the
City in the distribution of gas tax monies and that possibly authorization be granted
to the Mayor to execute the contract at such time as the City Manager shall report
favorably. After discussion, it was felt that there should be no limitation put on
the signing of the contract since it might delay or jeopardize proceeding with the
population estimate by the State Department of Finance.

After summation of bids on Cash Contract #SS -161, for the improvement of the
north side of Florence Avenue between Downey Avenue and Brookshire Avenue, it was
moved by Councilman Corbin that the bid be awarded to the lowest and best bidder,
Louis S. Lopez, in the amount of the unit prices submitted in the bid proposal..
The City Attorney advised there was a defect in the bid in that the bid bond was
not submitted on the City's form and no mention was made of the requirement of a
Labor Materialsman Bond. Under State regulations, the contractor is required to
submit both a Faithful Performance Bond and a Labor Materialsman Bond; therefore,
the contractor will need to comply before the contract can be executed.
After discussion and comparison with the next lowest bid and
City Attorney that the next low bid also had the defect mentioned
Louis S. Lopez, Councilman Dunnum seconded the motion to award the

Mr. Spindel assured Council that no contracts can be entered into with the
contractor's first supplying the City the Labor Materialsman Bond. If bonds cannot
be furnished by the low bidder, the City Attorney advised that the bonding company
would not be obligated to pay on the bid bond.
Mr. Robert Shand, Purchasing Agent, reported that it is always mentioned before
bids are opened that the bid will be awarded subject to approval by the City's legal
Counsel.
The City Manager requested members of Council who are able to do so to be at
George Putnam's office at KTIA television station at 1:30 P.M., November 23, to make
an official presentation of an award for narrating the Downey Youth Film.
Councilman Dunnum wished to commend Mr. James Ruth, Director of Park and Recreation.
Department for a fine meeting of the California State Recreation departments, such
meeting having been hosted for the first time by the City of Downey.
Councilman Corbin requested repair of holes in the pavement at Fourth and New
Streets, and a drainage problem at Seventh Street and Paramount Boulevard.
Mr. Spindel reported the street drainage at Seventh is being worked on b-eti.een
Downey Avenue and Paramount Boulevard and that storm drain construction can begin
within the next year.

Mr, King reported that the fin al audit of the City's comprehensive general
liability policy for the period from May 16, 1965, to May 16, 1966, has been com-
plated. The net earned insurance premium for the twelve-month period exceeded the
prepaid premium by $318.00. Inasmuch as the current insurance budget has been dis-
bursed in view of the increased liability coverage in the new insurance contract, it
will be necessary to transfer $318,00 from Unappropriated Reserves to pay off the
outstanding expense,

Taken under submission until the first meeting in January was the matter of
calling for bids on the ten -unit green apartment house across from the City Hall

It was announced that the new Rose Queen is Miss Vickie Lee.
Chief Gain was commended for his fine performance as Master of Ceremonies for the
Rose Queen competition.
Mayor Dickerson inquired of the progress being made relative to installation of
sidewalks on Brookshire Avenue across the Southern Pacific Railroad. Mr. King stated
that verbal assurance from the Southern Pacific Company was given that it will provide
sidewalks with all other installations.
Mayor Dickerson requested an investigation by the Public Works Department of the
poor condition of Phlox Street.
