Dickerson presiding. PRESENT: Councilmen: Dunnum, Corbin, Morton, Temple, Dickerson ALSO PRESENT: Oren L. King, City Manager A. C. Gabriel, Director of Finance Carl Newton, Acting City Attorney Sherman Griselle, Director of Planning Ervin Spindel, Director of Public Works Lee Leavitt, City Engineer Don Robison, Assistant to the City Manager Ray Lake, Director of Building & Safety Robert W. Gain, Fire Chief Ivan A. Robinson, Police Chief Walter Wanke, Superintendent of Water Department James Ruth, Superintendent of Park Department Della Doyle, City Clerk Alberta Pfeiffer, Deputy City Clerk Reverend Henry Blackaby of the First Southern Baptist Church delivered the invocation. Mayor Dickerson introduced student, acting Mayor, Dave Presnall from Pius X High School; Councilman Morton, Joe Aramanda, Pius X; Councilman Temple, Kathy Pickett, Downey High School, acting as members of the City Council, which was one of the events of Youth Recognition Week. Mayor Dickerson announced that two other students: Vickie Byam and Gerrie Ha ttig, Warren High School, could not attend. Police Chief Ivan A. Robinson acted as master of ceremonies in the absence of the Superintendent of Schools, Bruce Moore, to present students who made a choral presentation as members of Starlight Players which was taped and filmed. Chief Robinson reported Youth Recognition Week activities had been in the planning for eight months with an Ad Hoc Committee for the youth and commended the committee the various organizations throughout the City, the P.T.A., Public Works Director Spindel, street maintenance personnel for their diligent work in organizing the various activities and setting up the Youth Parade and Fair. The police chief stated a 25 to 30 -minute motion picture sound film of the various Youth Recognition Week activities will be sent to Governor Brown and possibly to President Lyndon B. Johnson as evidence of the City of Downey's interest in their youth. Certificates for participation in the Downey Youth Recognition Week were presented by the Mayor to the participating students, acting as the City Council and Mayor, and the students expressed their thanks for having been privileged to participate in their City government. Mayor Dickerson announced the hour of 7:30 o'clock having come and gone, it was the time and place for hearing evidence to determine whether the public convenience and necessity require the improvement of Stamps Avenue, AD #82, by grading and paving, and asked the City Clerk if she had the Affidavits of Publica- tion and Posting. The City Clerk replied she had the affidavits. It was moved by Councilman Temple, seconded by Councilman Morton and,so ordered to receive and file the affidavits. Mayor Dickerson asked if there were any written protests. The City Clerk read a letter of prot4st from Attorney H. Lee Trafford on behalf of Robert E. Stanner and Frederick H. Upperman. Mr. Spindel reported that the protest involzres�_; less than 50% of the district, being two parcels of a total seventeen parcels existing in Assessment District #82, Stamps Avenue. Council Minutes - 5/9/66 -1- 2U05 The Mayor asked for oral protests. Speaking against the improvements proposed for AD #82, Stamps Avenue were the following: Robert Stanner 9807 Stamps (City Attorney Sorensen arrived at the Council Meeting at 8:30 P.M.) Speaking against, continued: Melvin Decker, 9805 Stamps Avenue Mr. Decker inquired what was to become of the 12 -foot strip at Parcel X63 which could be utilized by him, should he be allowed to purchase this strip. Frederick W. Upperman, 9807 Stamps Avenue Mayor Dickerson asked for any comments for the assessment district improvements. Speaking for: Homer Geiss, 409 N. Las Palmas, Los Angeles Councilman Morton reminded that approximately three years ago a field trip had been made to view Mr. Decker's property and, as he recalls, a peculiar problem exists. At that time it was contemplated that some plan might be worked out to enable Mr. Decker to have access to his garage to alleviate that situation. Council Morton stated if the hearing is closed at this meeting, he would be of a mind to reopen it as he feels Mr. Decker should be given some relief for his problem. The City Attorney advised that he knows of no manner in which a hearing may be reopened, but that it could be continued. After further discussion, it was moved by Councilman Temple, seconded by Councilman Morton and passed by the following vote that the hearing on AD #82, Stamps Avenue, be continued to 8:00 a.m., May 24, 1966, in the Council Chamber of the Downey City Hall. Mayor Dickerson announced it was the time and place for the hearing on AD #82, Resolution of Intention, and asked if the City Clerk had the Affidavits of Publication, Posting and Mailing. The City Clerk replied she had the affidavits. It was moved by Councilman Temple, seconded by Councilman Morton and so ordered that the affidavits be received and filed. Mayor Dickerson asked if there were any written protests. The City Clerk replied there was the protest presented by Attorney H. Lee Trafford on behalf of Robert E. Stanner and Frederick W. Upperman. It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered that the hearing on the Resolution of Intention for AD #82, Stamps Avenue, be con- tinued to 8:00 A.M., May 24, 1966, in the Council Chamber of the City Hall. The Mayor announced the hearing to be held on zone exception, #648, and inquired if the City Clerk had the Affidavit of Publication. The City Clerk replied she had the affidavit. The. Director of Planning, Sherman Griselle, reviewed Zone Exception No. 648. There were no protests. Speaking in favor of the appeal were: Mr. Leslie Olson, 10022 Tristan Dr., representing applicant Louis De Palma, 637 N. 2nd Street,(applicant and owner of property located at Paramount Blvd. & DePalma St.), Montebello Villiam De Palma, 637 N. 2nd St. , Montebello John A. Keegan, 7986 Cleta St. Council Minutes - 5/9/66 -2- 2606 It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered that the hearing on Zone Exception #648, De Palma --Paramount and DePalma St.) be closed. It was moved by Councilman Corbin, seconded by Councilman Dunnum that the appeal be granted and the matter referred back to the Planning Commission. (ZE #648) After discussion that applicant had requested certain changes in the original plot plan, Councilman Corbin withdrew his motion and Councilman Dunnum withdrew her second to the motion. It was then moved by Councilman Corbin, seconded by Councilman Dunnum and pageed by the following vote to refer Zone Exception #648, DePalma (Paramount Blvd. & De Palma St.) back to the Planning Commission in accordance with the request made by the applicant for certain changes in the plot plan, and a report and recommendation be made by the Planning Commission to guide the Council in approval or denial of the appeal filed. Council commended Mr. S. T. Ziler on the many hours he put into studying and working with the committee on ordinance amendments under consideration. Speaking for the Planning Resolution amending the zoning ordinance relative to off-street and leased parking was Mr. S. T. Ziler, 7648 Cecilia, who first thanked Council for its commendations and, in turn, commended the Planning Department for its detailed report on the study conducted relative to the proposed ordinance. There were no additional oral comments and no protests voiced or written. It was moved by Couilman Temple, seconded by Councilman Morton and passed by the following vote thata hearing on Planning Resbhution No. 103 be closed. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SECTION 9127.1 OF THE DOWNEY MUNICIPAL CODE AND ADDING SECTION 9127.18 TO THE DOWNEY MUNICIPAL CODE WHICH SAID SECTIONS RELATE TO OFF-STREET PARKING AND LEASED PARKING, RESPECTIVELY (PLANNING RESOLUTION NO. 103) The pgdianance was read by title only. Lane. Mr. Spindel reported on the improvements proposed in this project. Council Minutes - 5/9/66 -3- 260' Councilman Morton returned to the council chamber at 9:50 P.M. Speaking for the improvements in DIP #545 were: M. M. Viles, 8512 Tweedy Lane E. E. Briesemeister, 8602 Tweedy Lane Objecting to installation of 140' of sidewalk was Mrs. Vivian Drotter, who requested the sidewalks be deleted as they were not being required of other property owners adjacent to her property at 8528 Tweedy Lane. Mr. Spindel stated that the reason other property owners were not being required to install sidewalks at this time was due to the fact the City did not have the right of way. It was moved by Councilman Temple, seconded by Councilman Dunnum and passed by the following vote that sidewalk installation be deleted from the parcel located at 8528 Tweedy Lane. The City Clerk presented the following correspondence: A request from Supervisor Frank G. Bonelli seeking support to locate Jack Kent Cooke forum sports arena in the Whittier Narrows. Councilman Morton stated he is not in favor of supporting this proposal, and gave a detailed background on the matter, stating it was a private enterprise and to the benefit of other cities. He stated that it would not seem to him to be in the best interests of the City of Downey. The request was ordered received and filed. A letter from Gil Huffman, 1312 W. Ball Rd., Anaheim, commended Downey!s beautifica- tion project relative to landscaping medians on Firestone Blvd. & Lakewood Blvd. It was moved by Councilman Morton, seconded by Councilman Temple and so ordered that items appearing in Paragraph #4,of Mr. Huffman's letter relative to areas in Mr. Huffman's opinion which are in neog of cleanup and beautification be referred to the City Beautification Committee. A communication from the California Highway Commission acknowledged a_letter from the City of Downey relative to a request to desist from taking any further action with respect to Route 90 ("Slauson Freeway"). Ordered filed. A letter from the Downey Symphonic Society, Inc. requested an additional sum of $700 to meet an expected deficit and carry them into the next season. Robert Austin, Chairman, explained the reason for the deficit in their budget which arose from an unexpected added expense from increased union scales. It was moved by Councilman Dunnum, seconded by Councilman Morton and passed by the following vote to grant to the Downey Symphonic Society, Inc. the additional $700 as requested. A request from the City of Alhambra for support of SCAG and opposition to the Three County and Five County organizations,uwas recommended to be held for study. Claim for damages from Phil F. Castro. It was moved by Councilman Temple, seconded by Councilman Corbin and so ordered that the claim be denied and'referred to the City's insurance carrier and the City Attorney. A letter of commendation for Building Department employees from Mr. & Mrs. David Lawrie was ordered received and filed. A letter of appeal with the required $50 deposit from Robert Cy. Wendt to Zone Exception #660, Florence and Downey Avenue. It was moved by Councilman Morton, seconded by Councilman Temple and so ordered to set a hearing on Zone Exception #660, Florence and Downey Avenue, in the Council Chamber of the Downey City Hall, for 7:30 P.M., :]tune 20, 1966. RESOLUTION NO. 1733 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY AWARDING CONTRACT TO IMPROVE MEADOW ROAD (AD.106) IN THE CITY, IN ACCORD- ANCE WITH RESOLUTION OF INTENTION NO. 1686 The resolution was read by title only. The engineering estimate for this job was $1,654.06. The subdivider will be paid one-half of the amount ($827.03). It was moved by Councilman Morton, seconded by Councilman Temple and passed by the following vote to authorize the following transfer of funds: AMOUNT $827.03 FROM ACCOUNT NUMBER 86003 Council Minutes - 5/9/66 -7- TO ACCOUNT NUMBER 86029 AYES: 5 Councilmen: Dunnum, Corbin, Morton, Temple, Dickerson NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None It was suggested by Councilman Morton that such items for transfer of funds appear on the agenda under Council Actions rather than appearing in the City Manager's report in the future. �- The City Manager reported that the Water Board, at its meeting of May 2, approved an 8" main extension from Brookshire, 325 feet westerly on Florence Avenue. This extension is necessary to serve the Downey Memorial Christian Church; however it will eventually be extended to Downey Avenue as new properties on the north side of Florence Avenue are developed. The present extension will cost $3,150, for which the applicant will pay one-half for the main across his 200' frontage. Applicant's share will be $900 and the money has been deposited with the City. It was moved by Councilman Morton, seconded by Councilman Temple and passed by the following vote to authorize the following transfer of funds: AMOUNT FROM ACCOUNT NUMBER TO ACCOUNT NUMBER $3,150 86003 86028 and that Council authorize calling for bids. AYES: 5 Councilmen: Dunnum, Corbin, Morton, Temple, Dickerson NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None A total estimated cost of $5,200 for a proposed parking lot at Fire Station No. 1 with an estimated 40 to 50 parking spaces, based on a minimum type of con- struction which would be grading and compacting of natural sub -grade, 1 1/2" A.C, surfacing, 2 driveways, striping and bumpers was reported upon by the City Manager. After discussion, it was moved by Councilman Temple, seconded by Councilman Corbin and so ordered to hold the matter of the proposed parking at Fire Static No. 1 for further study and report. Councilman Dunnum suggested that it be investigated as to how the lot would be assessed and collected, should the lot be improved at Downey Avenue and Phlox Street. The City Manager was directed to submit a report on this item at the next Council Meeting. Council granted authority to send a letter to the City of South Gate suggest- ing a joint study of the possibility of installing a bridge across the river channel at Stewart and Gray Road. Mr. Spindel submitted a full report on the City's continued efforts to gain the approval for the installation of a traffic signal at Cherokee and Lakewood. Councilman Morton objected to the statement made by the State Division of Highways that upon completion of Brookshire and Downey improvement, consideration could be given to the installation of the traffic signal at Cherokee and Lakewood stating that the problem is not only vehicular but that the intersection i•= being used by 3 different schools. He requested the City Manager to investigate who. in Sacramento can make the decision rather than locally, if the City has to go to Sacramento to get the recommendation. It was moved by Councilman Morton, seconded by Councilman Temple and passed by the following vote to authorize the Mayor and City Manager to enter into escrow for purchase of Parcel B in the amount of $172,240.00 plus the City's share of escrow charges in exercising the option contained in the Agreement of 7/20/65 between the City of Downey and the Downey Unified School District. AYES: 5 Councilmen: Dunnum, Corbin, Morton, Temple, Dickerson NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Council Minutes - 5/9/66 -8- ?S.4.2 The City Manager reported that the estimates relative to moving the Noxsel building were quite different in cost, running somewhere between $12,000 to $17,000, which includes complete renovation on the site. Two suggestions were made: one, to refer to the Library Board for their consideration of possible library use of the building; and, two, to engage Wally Langford at a nominal fee to advise on location and use, if it is properly designed, and to submit his recommendations to the Council, preparatory to placing it in the budget for the next fiscal year. It was moved by Councilman Morton, seconded by Councilman Temple and passed by the following vote to grant authority to the City Manager to proceed as out- lined above to ascertain the need of using the Noxsel Building in the library complex. It was moved by Councilman Temple, seconded by Councilman Dunnum and passed by the following vote to authorize payment to Mr. Ray Noxsel of $750 fcr all doors, fixtures and all equipment at the building located in the proposed hospital site in lieu of the $1,000 suggested by him at the previous meeting. It was moved by Councilman Temple, seconded by Councilman Morton and sc ordered to proceed with obtaining a horizontal billboard sign for recognigtion of the City Council and displaying the City Seal; listing names of the Hospital Development Commission, Downey Municipal Hospital Corporation, Downey Hospital Foundation Board and officers; Downey Hospital Auxiliary, Downey Chamber of Commerce, and names of all permanent committees. Councilman Morton reminded Council of the suggestion to appoint five members from each Councilmanic District to work on a program of education of the voters relative to the proposed dissolution of the Downey Park and Recreation District. Mayor Dickerson requested that the appointees' names be submitted by the coming Friday to be checked for dupl.i*cations before being turned over to the Park Commission. Councilman Morton recommended there be a general chairman, perhaps scmccne who had worked on the City Charter Committee or the Cerritos College issue. Councilman Morton stated he was in receipt of a letter requesting appointment of a director and alternate to serve on the Independent Cities Association, Cn which Mrs. Dunnum had been the director and he the alternate. Councilman Dickdrson moved that the appointees remain as they presently are. Councilman Dunnum stated inasmuch as she was unable to attend many meetings this past year, perhaps someone else should be designated the director. Councilman Morton stated he is willing to serve as the alternate and attend whenever it is not possible for Mrs. Dunnum to do so. Councilman Morton seconded Councilman Dickerson's motion, it was so ordered that Councilman Dunnum be designated the director and Councilman Morton, the alternate to serve with the Independent Cities Association. Council Minutes - 5/9/66 -9- 4714044 11 Councilman Morton apologized that he was not in attendance at the last Council Meeting and questioned how an additional small amount for expanding the City Hall central and west wings had turned out to be $33,000, when the estimates for the first phase were $45,000. He recommended taking the plans to a consultant to see what can be done to reduce the costs and accomplish the same objective for less than $78,000, the present total cost estimates. Mayor Dickerson commended Don Robison in his presentation to the student; acting as Mayor and City Council on the City -Manager -Council type of government. Mayor. Dickerson requested a cleanup of Bangle Road where some bushes have been allowed to lap over onto adjacent property, knocking down a fence. The City Attorney reported on a litigation whereby the State of California Attorney General had been appointed to represent the City of Downey relative to water pipe companies. The attorney informed Council that the expenses involved on the part of the City in ferreting out old records, assuming they are available (which is doubtful) would not be worth what might be recovered. Authorization was requested for the City Attorney to advise the Attorney General that the City of Downey wishes to withdraw from the litigation. It was moved by Councilman Morton, seconded by Councilman Dunnum and passed by the following vote that the City Attorney be authorized to advise the Attorney General of the State of California that the City of Downey desires to withdraw from the case of the State of California, et al. vs. Western Pipe, American Pipe and Constructier.
