MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
APRIL 11, 1966
Council of the City of Downey held a regular meeting at 7:30 P.M.,

Councilman Thomas H. Morton delivered the invocation.
A resolution adopted by the Junior Chamber of Commerce advocating the dissolution
of the Downey Recreation and Park District was presented to Mayor Temple by
Brian Brandmeyer.
It was moved by Councilman Corbin, seconded by Councilman Dickerson and passed
-- by the following vote that the resolution be received and filed.

Mario Bernali from the Guadalajara California Soccer League of East Los Angeles
extended an invitation to Mayor and Council to attend a game scheduled for Sunday,
April 17.
Mayor Temple announced the continuation of the hearing on AD #106, Meadow Road
and inquired if there were any further protests, written or oral. The City Clerk
replied there were no further written protests and there were no oral comments or
protests.
It was moved by Councilman Morton, seconded by Councilman Corbin and so ordered
that the hearing be closed.
It was moved by Councilman Dunnum, seconded by Councilman Corbin and passed by
the following vote to overrule all protests concerning AD #106, Meadow Road.

RESOLUTION NO. 1709

DETERMINING THAT LIQUIDATED DAMAGES SHALL BE PAID

Mayor Temple announced the hearing on Stamps Avenue, AD #82. The City Clerk
reported that due to an error in publication, it would be necessary to continue ;
the hearing. The City Attorney advised the hearing may be opened as Resolution
No. 1695 determining the necessity of doing the work and waiving the Debt Limit
Act was proper.
Mayor inquired if the City Clerk had the affidavits of publication, mailing
and posting. The City Clerk replied she had the affidavits.
The Mayor then asked if there were any written protests received. There
were none.
It was moved by Councilman Morton, seconded by Councilman Dickerson and
passed by the following vote to continue the hearing on determining the necessity
for Assessment District #82, Stamps Avenue to 7:30 P.M., May 9, 1966, in the
Council Chamber of the Downey City Hall.

RESOLUTION NO. 1711

DECLARING ITS INTENTION TO IMPROVE STAMPS AVENUE AND OTHER
STREETS AND RIGHTS OF WAY IN THE CITY OF DOWNEY, DETERMINING
THAT BONDS SHALL BE ISSUED TO REPRESENT THE COST THEREFOR,
DECLARING THE WORK TO BE OF MORE THAN LOCAL OR ORDINARY
PUBLIC BENEFIT, AND THAT THE EXPENSE THEREOF SHALL BE ASSESSED
UPON A DISTRICT (AD #82)

Mayor Temple announced the hearing on the vacation of the alley north of Fifth
Street between Paramount Boulevard and Parrot Street and asked if the City Clerk
had the affidavits of posting and publication. The City Clerk replied she had the affidavits
There being no written and no oral comments or protests, it was moved by
Councilman Corbin, seconded by Councilman Dickerson and so ordered that the hearing be
closed.
RESOLUTION NO. 1713

AND PARROT AVENUE NORTH OF FIFTH STREET AS SHOWN ON
TRACT MAP NO. 20206, RECORDED IN BOOK 659, PAGE 23 OF
OFFICIAL RECORDS

The Mayor announced the hearing on Downey Improvement Project #525, Imperial
Highway, and asked the City Clerk if proper notification had been given the property
owners. The City Clerk replied there had been proper notice.
Mr. Spindel reviewed the improvements to be included in the assessments.
Mayor Temple asked if there were any written protests. The City Clerk reported
there were protests from the following:
Walter G. Kreuter, 8639 Imperial Highway
Edward DiLoreto, 8605 Imperial Highway (requested matching funds)

The Mayor then asked for oral comments or protests. First to protest was
Charles Connor, 8339 E. Imperial Highway, who was interrupted by the Mayor at 8:00 P.M.
in order to consider bids on the Stewart and Gray Hospital Site property.
There was one bid received, from William W. Taylor, with accompanying check in
the amount of $1,000. Total bid was for $740,000.00 for entire parcel. Stipulation
was made to deposit another $9,000 upon entering into escrow with various conditions,
as set forth as follows:
A. The approval of the City of Downey of a zone change to the zone
required for a "Planned -Unit Development with a Homes Association."
B. Certificate of Insurability from the Federal Housing Administration
under the existing Title X section for the purchase and development
of Urban land.
C. Certificate of Insurability from the Federal Housing Administration
under the existing Section 203-B of the Housing Act for a Planned
Unit Development.
D. The Three above mentioned conditions will be obtained by me and I
shall bear all costs connected with obtaining them.
E. The period of time for the escrow or the purchase option agreement
shall be limited to 270 days, however, I do agree to pursue the matter
with diligence in an effort to close the matter in less time.
The bidder agreed to leave $1,000 deposit with the City for fourteen days.
It was moved by Councilman Dunnum, seconded by Councilman Morton and so ordered
that the bid be referred to the City Attorney and Finance Director for report.
Further oral protests at this time on DIP #525 were made by the following:
Walter G. Kreuter, 8639 Imperial Highway.
Speaking in favor of the improvements was Mr. Earl Mouton, property owner of
8345 Imperial Highway.
It was moved by Councilman Corbin, seconded by Councilman Dickerson and so
ordered that the hearing on DIP #525 be closed.
It was moved by Councilman Morton, seconded by Councilman Dunnum and passed by
the following vote to approve request of Mr. DiLoreto as contained in his letter
dated April 9, 1966, allowing matching funds for sidewalks due to the fact that the
property had changed owners since the project was begun.

RESOLUTION NO. 1714

PROJECT NO. 525, IMPERIAL HIGHWAY

Mayor Temple announced that the hearing on DIP #529, Florence Avenue was now
open. Proper no had been given, according to the City Clerk. Mr. Spindel
gave a resume of the improvements proposed. There were no written and no oral
comments or protests.

RESOLUTION NO. 1715
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
CONFIRMING THE ASSESSMENTS FOR CHAPTER 27 PROCEEDINGS FOR
DOWNEY IMPROVEMENT PROJECT NO. 529, FLORENCE AVENUE

City Attorney Sorensen reported on the bid upon the Stewart and Gray property
and suggested that it be taken under submission for 2 weeks, reserving the right to
reject or waive any irregularities or nor. -compliance with the call for bids, or
review the bid in its entirety.

by the following vote that the bid from William W. Taylor be taken under submission
for 15 days.

The City Clerk presented the following correspondence:
Letter from Mary R. Stauffer, M.D. relative to the name of the new hospital.

Letter from the Beverly Hills Sister City Assn., Inc. and the Van Nuys Sister
City Committee in appreciation of services of Al Lopez and congratulations. Ordered
received and filed.
Financial report and budget request from the Downey Symphonic Society which was
referred for budget study.
Letter from the Downey City Youth Band relative to their participation in the
1967 Tournament of Roses Parade. Received and filed.
March report from the Downey Chamber of Commerce. Received and filed.
Letter of commendation on the Lakewood Boulevard center divider landscaping -from
the City of Pico Rivera was ordered received and filed.
Report from Junior Chamber of Commerce Presidlent, Paul Thomas Hodiak, was
ordered received and filed.

A letter from the Downey Unified School District authorizing the Superintendent
to proceed with a staff study relative to the need for a Joint Powers Agreement
with the City of Downey on the. use of recreation and park facilities.
Letter was ordered received and filed with Councilman Morton stating for the
record that this was to be strictly a feasibility study.
A proposed insert for water bills sent in April relative to the Park District
dissolution which is to be Proposition G on the June 7 Primary ballot was approved by
Council, after approval of City Attorney Sorensen upon his examination of the form.
Letter from Assemblyman Carley V. Porter relative to freeways constructed
through a City was ordered received and filed.

Mayor Temple reported receipt of a letter from the H#storical Society requesting
expenditure of funds of $150 for a tape recorder and tapes and $100 for a.filing_
cabinet, for which funds have been budgeted. A request was made for next year.for.
^ financial assistance up to $600 and was referred for budget study.
The Mayor reported that the Downey Live Wires from 1924 to the present are
being bound by Mr. Weiss, former owner, and they are to be presented to the City..

The City Clerk reported receipt of a petition in protest to removal of
the barricades at Alameda Street and Lakewood Boulevard, with 22 signatures
representing approximately 15 properties; a letter from the Alameda P.T.A.
protesting removal of the barrier. The following persons spoke in protest
to the removal of such barrier and installation of a traffic signal:

Speaking in Favor: Harold Proven, 9767 Downey -Sanford Bridge Road presented a plot
plan for development of the area on Lakewood Boulevard near Alameda Street
Mr. Spindel outlined the plans for the location in question.
Both Fire and Police Chiefs recommended installation of the traffic signal at
the intersection of Alameda Street and Lakewood Boulevard and the opening of Alameda
Street which both felt would result in improvement in services rendered by their re-
spective departments.
It was moved by Councilman Dunnum, seconded by Councilman Dickerson that the
traffic signal at the intersection of Lakewood Boulevard and Alameda Street be
approved and the opening of Alameda Street with the following three conditions being
in existence prior to or at the time the signal is activated:
1. That a pedestrian pushbutton type control be installed at Patton Road and
Alameda Street similar to the one on Imperial for Imperial School.
2. That a regular 3 -light type signal be installed at Brookshire Avenue and
Alameda Street.
3. That sidewalks be installed along both sides of Alameda Street from
Lakewood Boulevard to Piramdunt Boulevard and all sidewalks should be
.-� under the matching funds program where the property owner would be able
to be granted matching funds from the City.
After discussion, Councilman Dunnum stated her motion intended that the traffic flow
will not change until these three conditions are met. Mayor called for the vote on
the motion:

RESOLUTION NO. 1722

AGREEMENT BETWEEN THE STATE DIVISION OF HIGHWAYS AND THE CITY OF
DOWNEY FOR THE INSTALLATION OF A TRAFFIC SIGNAL AT THE INTERSECTION
OF ALAMEDA STREET AND LAKEWOOD BOULEVARD

After summation of bids for Cash Contract #SS -140, Rives Avenue and Imperial
Highway, it was moved by Councilman Morton, seconded by Councilman Corbin and
passed by the following vote to award the bid to the lowest and best bidder,
Silveri Construction Company in the amount of the unit prices submitted in the bid
proposal, and authorize an additional appropriation of $1,030 for the project.

Mr. Spindel reported that the property owners on Everest Street, between
Brookshire Avenue and Birchdale Avenue, had requestedmatching funds for curbside
sidewalks at the regular Council Meeting held March 22nd at which time the matter was held
under submission. The Director of Public Works and Planning Department recommended
that matching funds should not be authorized for curbside sidewalks in a residential
area.
Councilman Corbin stated the request should be denied for matching funds unless
standard sidewalks are installed.
Robert F. Durkee, 8563 Everest Street, reminded Council that curbside sidewalks
had previously been approved and stated that he is willing to deed right of way to
install 4' sidewalks around the corner at Everest and Birchdale Streets.

the following vote, with Councilman Morton qualifying his motion with the statement
that he is not in accordance with curbside sidewalks in areas such as Phlox --that
deviations should be few and far between, but based upon prior action and motion,

corner from Everest to Birchdale Street in view of the fact that the sidewalk

by the following vote to receive the report of the Planning Commission on Zone
Exception #639 and uphold action of the City Council.

Mr. Robert Armstrong, attorney for the Lancer Lounge, 716 Pacific, reported
results of an investigation for cushioning bandstand which had been requested by
Councilman Dunnum.
A motion was made by Councilwoman Dunnum that live entertainment permit be
granted the Lancer Lounge for this year on three conditions:
1. Week ends only.
2. No musical amplification except vocal.
3. Automatic door closer be attached to the back door to keep it closed at
all times.
Clifford D. Moore, 8328 Albia Street, property owner who had complainted of
the noise from the Lancer Lounge, wished to make further protest.
It was moved by Councilman Morton, seconded by Councilman Dickerson and so
ordered that the hearing be reopened.
After Mr. Moore's comments in protest, the attorney for the Lancer Lounge
gave his rebuttal.
It was then moved by Councilman Dunnum, seconded by Councilman Corbin and so
ordered that the hearing be closed.
Councilman Dunnum requested Chief Ivan Robinson of the Police Department to
read the report of Detective George Snyder.
Councilman Corbin stated he would second Mrs. Dunnum's motion if, as part of
the conditions, there would be no amplification or microphones. Councilman Dunnum
amended her motion to include no amplification of any kind. Mayor Temple called
for the vote on the motion as amended.

Mr. King outlined plans for enlargement and remodeling the City Hall which
include additional facilities for the Police Department and City Hall Maintenance

Councilman Morton suggested that the City Council consider meeting with the
Police and Fire Committees and consider appointment immediately in order that the
Police Committee can be established to assist in a review of the budget requests,
designating someone as temporary chairman.
It was moved by Councilman Corbin, seconded by Councilman Temple and so
ordered that Harold Cummins be designated as temporary chairman of the Police
Committee.
It was moved by Councilman Dunnum, seconded by Councilman Morton and passed
by the following vote that there be a formal policy adopted that all members of
the citizens committees be residents of the City of Downey, and that this policy
should apply for all committees and commissions.

It was moved by Councilman Corbin, seconded by Councilman Dickerson and so
ordered that no councilman other than District 5 shall appoint anyone in any
district other than his own specific district.
Councilman Morton recommended that the manner of appointing the Parking Place
Commissioners be reviewed. Mr. King stated that the ordinance by which the Parking
Place Commissioners were appointed will be reviewed, as well as all other boards
and commissions, to determine if they are appointed on a district basis and report
the results at the next Council Meeting.

The City Manager reported that in relation to the construction of the heliport
site, L.A. Airways has requested the deletion of a portion of their agreement with
the City.

Mr. Spindel reporte8 that informal bids are to be received April 15 for
grading of the heliport site and that the results will be reported to Council.

occupancy for the month of April, including those extending into May, but not

It was moved by Councilman Corbin, seconded by Councilman Dunnum and so
ordered to authorize notification to renters by letter from City Attorney, in
substance as contained in letter proposed by the City Manager.
Chief Robinson wished clarification of the term "week end" for hours of
operation under live entertainment permit for the Lancer Lounge and it was
interpreted to mean Friday, Saturday, and Sunday until 12:00 o'clock.
Councilman Morton requested an investigation of fly abatement in his
district, particularly in the farming area, as well as the Rockview Dairy, and
of weed abatement at the Rio San Gabriel area, of property which may have been
sold by the school district. Also, it was requested by him that there be a
review of the closing of the service road at Songfest and Telegraph Road.
Councilman Morton gave a detailed report on the recent meeting in
Washington, D.C.
Councilman Corbin requested investigation of the street conditions at Marbel
and Alameda Streets.
Mr. Spindel, upon inquiry, stated that the widening of Brookshire Avenue at
Eucalyptus is tentatively set to start in August 1966.
After making several announcements, Mayot Temple declared the meeting
adjourned at 11:35 P.M. in the memory of Mrs. Fannie iss and Mrs Edward R. Maginn.
