MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
JANUARY 10, 1966
The City Council of the City of Downey held a regular meeting at 7:30 P.M.,
January 10, 1966, in the Council Chamber of the Downey City Hall, Mayor Scott E.
Temple presiding.

Reverend Wade Armstrong of the Trinity Baptist Church delivered the invocation.
Fire Chief Robert W. Gain commended nurse Lottie Carroll from Rancho Los Amigos
Hospital, crediting her with saving the life of one -of the patients who became
involved in a fire, through her quick thinking. Mayor Temple presented nurse
Carroll with a plaque of commendation. Mrs. Carroll thanked Council for the co*c-
mendation and also the Fire Department for its instructions in the handling of just
such type of emergency.
Ervin Spindel, Director of Public Works, was called upon to participate in the
presentation by the Mayor of certificates for completion of a course for Public.
Works Construction Inspectors given at California State College in Los Angeles by
the American Public Works Association. Certificates were presented to Robert Brace,
William Solo, Fred Sanchez and William Huyck.
Mayor Temple announced the time and place for the hearing on Planning Commission
Resolution.No. 100 on residential parking and inquired if the City Clerk had the
Affidavit of Publication. The City Clerk replied she had the affidavit and it
was ordered received and filed.
Mayor Temple asked if there were any written protests. The City Clerk replied
there were none.
Mr. Sherman Griselle, Director of Planning, gave a resume of the circumstances
leading up to the Planning Commission's recommendation for requirement of two
parking spaces for each residential unit.
Speaking in favor of the Planning Commission Resolution No. 100 was Mr. Wendell Wiser,
11215 Woodruff Avenue, who requested that the ordinance amending the Downey Municipal
Code to require the two parking spaces per each residential unit be adopted as an
emergency ordinance.
There being no further oral comments and no oral protests to the hearing, it was
moved by Councilman Morton, seconded by Councilman Dunnum and so ordered that the
hearing be closed.

The City Attorney amended the ordinance, changing section two to section #3,
and added the following emergency clause as Section 2:
That the City Council hereby finds, determines and declares that this
ordinance is necessary for the preservation of the public peace, health,
safety and general welfare and shall be adopted as an emergency ordinance
to become effective immediately. A statement of the facts constituting
the necessity for this ordinance being adopted as an emergency ordinance
is as follows:
There exists in the City of Downey a large number of properties adaptable
to and subject to development with large multiple residential units:
that further, there exists in the City of Downey a shortage of off-street
parking facilities in the generally multiple residential areas; that the
present off-street parking requirements for multiple residential units
in particular, of 1'k to 1, is not sufficient to provide adequate off-street
parking for the multiple dwelling units; that in the absence of adequate
off-street parking, the public streets are overburdened with the parking of
automobiles, thus hampering adequate traffic movement upon the streets and
providing opportunity for misdemeanor activities and felony activities
relating to car thefts and the like; that there now are on file with the
City and there are proposed to be placed on file with the City within the
near future, many plans for approval relative to the development of
multiple family dwelling units and that unless this ordinance becomes
effective immediately to require two parking spaces for each dwelling unit:
the present on -street parking problems will be multiplied and the problems
created thereby will be greatly enhanced.
It was moved by Councilman Morton, seconded by Councilman Dickerson and passed by
the following vote to adopt the emergency clause as stated above by the City
Attorney.

ORDINANCE NO. 293
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING
SECTIONS 9114.8, 9115.8, 9116.8 AND 9127.1 OF THE DOWNEY
MUNICIPAL CODE WHICH SAID SECTIONS RELATE TO OFF-STREET PARKING
(PLANNING RESOLUTION NO. 100)
The ordinance as amended was read in full by the City Clerk. It was moved by
Councilman Dunnum, seconded by Councilman Morton and passed by the following vote
that Ordinance No. 293 be adopted.

The following policy was stated by the City Attorney for consideration by the
City Council.
WHEREAS, the City Council has adopted as an emergency ordinance, Ordinance
No. 293, to be effective immediately, and which said ordinance requires that all
multiple dwelling units and all other units with the. City except certain hotels,
rooming houses and clubs and motels, provide two parking spaces for each individual
dwelling unit; and
WHEREAS, there are on file with the City of Downey, a number of plans for
development of multiple family dwelling units providing for 1k parking spaces to
each dwelling unit, in accordance with the previously existing zoning code
requirements; and

WHEREAS, the City finds that those persons who have acquired a vested right
to construct under the old ordinance may do so without giving effect to the pro-
visions of said Ordinance No. 293;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS
FOLLOWS:
That the Building Department, Zoning Department and the other Administrative
officials of the City give full and fair consideration to what may constitute a
vested right entitling a person to construct a multiple dwelling unit or other
unit providing for 1k parking spaces per dwelling unit; that it is suggested they
be considered as having established a vested right; that there be filed with the
Building Department of the City of Downey prior to January ll, 1966, sufficient
and adequate plans complying with the Building Code and Zoning Code requirements
of the City; that such plans be approved in substantially the form submitted; that
a building permit be issued not later than February 10, 1966; that the work be
commenced under such a building permit not later than 45 days from the date of
issuance and in no event later than March 25, 1966.

by the following vote to adopt the above policy as stated by the City Attorney.

It was moved by Councilman Dunnum, seconded by Councilman Morton and so
ordered that a traffic study be initiated studying the limiting of parking in
critical areas in the City, to start with a study of Downey Avenue south of
Stewart and Gray Road.
Mayor Temple announced the hearing on the confirmation of assessments for
Margaret Street, Assessment District No. 40 and inquired if the Affidavits of
posting, publication and mailing were received. The City Clerk replied she had
the affidavits.
It was moved by Councilman Morton, seconded by Councilman Corbin and so
ordered that the Affidavits of posting, publication and mailing be received and
filed.
Mayor Temple asked if there were any written protests. The City Clerk replied
there were no written protests.
Ervin Spindel, Director of Public Works, reported on the assessments to be
established for Margaret Street, AD #40.
There being no written and no oral comments or protests, it was moved by
Councilman Corbin, seconded by Councilman Dickerson and so ordered that the hearing
on the confirmation of assessments for Margaret Street, AD ,140 be closed.
It was moved by Councilman Corbin, seconded.by Councilman Dunnum and passed
by the following vote to authorize the following transfer of funds relative to
AD #40, Margaret Street:

RESOLUTION NO. 1666
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
CONFIRMING THE ASSESSMENT FOR THE IMPROVEMENT OF MARGARET
STREET (AD NO. 40)
The resolution was read by title only. It was moved by Councilman Corbin,
seconded by Councilman Dickerson and so ordered that further reading be waived.
It was moved„by Councilman Corbin, seconded by Councilman Dickerson and
passed by the following vote that Resolution No. 1666'abe adopted.

Mayor Temple announced the hearing to be held on Downey Improvement Project
#534, Cherokee Drive, under Chapter 27, and inquired if the proper notices had
been sent. It was reported the notices were sent.
Mayor Temple asked if any written protests had been received. The City Clerk
replied there were none.
Speaking against the improvements in DIP #534 were:
Tweedy Nash, 8327 Cherokee Drive
Charles Miller, 10456 Downey Avenue
In his protest, Mr. Nash also reported a drainage problem. Councilman Morton
recommended that a field trip be set up by the City Manager to view the area
reported by Mr. Nash to have a drainage problem.
It was moved by Councilman Corbin, seconded by Councilman Morton and passed by the
following vote, inasmuch as the right of way was dedicated on 8327 Cherokee Drive
and 10456 -Dawney Avenue ., to approve the City's doing the paveout on the street and
approve matching funds for the sidewalks; and that DIP #534 be so modified.

Mayor Temple announced the public hearing to be held on Downey Improvement
Project #542 and asked if the proper notices had been sent. It was reported
they had.
Mayor Temple inquired if there were any written protests received and City
Clerk Della Doyle replied there were none.
The City Clerk reported receipt of a letter containing 24 names requesting
installation of sidewalks in DIP #542. Ordered received and filed.
Mr. Moore asked that further consideration be given to the parking problem
at his property which would result from this improvement. A field trip was
suggested by Councilman Morton to establish the width of sidewalks required.
It was moved by Councilman Morton, seconded by Councilman Dickerson and
so ordered that the hearing on DIP #542 (Parmount Boulevard and Imperial Highway)
be continued to 8:00 A.M., January 25, 1966, in the Council Chamber of the Downe}
City Hall.
Mr. C. Froelich, 12542 Paramount Boulevard, requested that the sidewalks be
10' in width to conform with the existing sidewalks in the area. He was advised
to return to the continued hearing set for January 25.

ordered that the minutes of the Council Meeting of December 28, 1965, be approved
as corrected.

The City Clerk reviewed the following correspondence:
A letter of commendation to the Fire Department from John D. Abbey, M.D.
was ordered filed.
Letter of commendation to the Police Department from Jordan M. Phillips
was ordered filed.
Letter of resignation from L. H. Paul from the Police Committee was reported
received. It was moved by Councilman Corbin, seconded by Councilman Morton and
so ordered that the resignation from the Police Committee of L. H. Paul be
accepted with a letter of commendation send to him and preparation of plaque
ordered for presentation to Mr. Paul.
A request for hearing on the revocation of an entertainment permit was
received from Gunderson, Golden & DeWeese on behalf of the Wa-Tootsie Tavern.
It was moved by Councilman Corbin, seconded by Councilman Dickerson and so ordered
that the request be taken under submission until an entertainment permit is applied
for.
Quarterly report from the Downey Civic Chorus was ordered filed.
A letter proposing the appointment of a member to serve on the Home Rule
Committee of the League of California Cities was reported received. It was moved
by Councilman Corbin, seconded by Councilman Dickerson and so paste e?d that Council-
man Morton be approved as member to the Home Rule Committee, and that Councilman
Temple be approved as member to the Sister City Committee of the League of
California Cities, with reasonable expenses allowed to attend meetings of these
committees.

It was recommended that the City Council authorize an appropriation from
gas tax funds for the cost of curb and gutter on Century Boulevard, which was
installed uqder Assessment District #73, Bixler Avenue, which complies with
the policy of'installing curb and gutter in right-of-way acquired on streets
of major importance. The City Attorney asked if the assessments had not al-
ready been confirmed and stated, if so, a question was raised in his mind as
to the legality of the City's participating after the assessments had been
confirmed.

that the matter of an appropriation from the City to AD #73, Bixler Avenue, be
taken under submission until the next Council Meeting.

by the following vote to authorize attendance of the Planning Director, Sherman
Griselle, to the Annual Conference in Fresno, February 9-12, 1966, and any

The City Manager reviewed the minutes of the City Park Commission and recommen-
dation made by them.
It was moved by Councilman Corbin, seconded by Councilman Dunnum and so ordered
to approve use of the Guadalajara Room in the City Hall as temporary office for
the Park Superintendent.
It was moved by Councilman Corbin, seconded by Councilman Dickerson and passed
by the following vote to authorize proceeding with Phase #2 of the Golden Park
improvement in the estimated amount of $28,941.00, which eliminates $13,000 for
patio cover, and the following transfer of funds:

The City Manager reviewed bids for an automobile for the Park Superintendent,
recommending the middle bid of $2,348.77 for a Fairlane Sedan; however, Councilman
Morton moved, it was seconded by Councilman Dunnum to take this under submission
to check the possibility of use of other City vehicles which might be available
and approve standard allowance for the interim.

Mr. J. A. Johnson, Chairman. of the Park Commission, 7627 Fontana Street,
stated as newly elected chairman he could report the Commission is still formu-
lating plans and are very interested in parks and recreation and in doing a good
job for the City. The Commission is hopeful that they can come up with a
long-range plan that will insure adequate coverage of all ranges of citizenry

in the City of Downey to participate in such a recreation program. He appreci-
ates the opportunity, he stated, to serve the City of Downey and knows the
Commission is going to enjoy working on the parks and recreation, program.

passed by the following vote to approve payment of the invoice from funds of
the Hospital Account in the amount of $12,178.53, covering architectural and
engineering services of A. C. Martin and Associates for the municipal hospital.

It was moved by Councilman Morton, seconded by Councilman Dickerson and
passed by the following vote to authorize the attendance by Fire Chief Robert W.
Gain to the First Fire Chiefs' Management Seminar to be held at the U.S.C. Civic
Center Campus each Wednesday from 2:00 P.M. to 6:00 P.M. from March 2 to May 25,
1966, with reasonable expenses allowed.

Police Chief Robinson reported he has been appointed to the Law Enforcement
Problems Committee of the League of California Cities which would entail one major
meeting per year, which is paid by the League; and approval was requested that he
attend that meeting.

by the following vote to approve attendance by Chief Ivan A. Robinson to the Law
Enforcement Problems Committee meeting in 1966.

It was moved by Councilman Dunnum, seconded by Councilman Dickerson and
passed by the following vote to authorize the Mayor and the City Manager to enter
into escrow for the sale of the Stewart and Gray property, acceptance of property
at the close of escrow, and that appraisal of the property be made by
Mr. Les Barnwell with the listing of the property for sale to be for an amount
not less than the maximum appraisal.

The City Manager requested authority for printing and distribution of an
annual report at an approximate cost of $2700. The report would be mailed to all
registered voters within the City.

by the following vote to authorize proceeding with proofs for printing of an
Annual Report to be printed on 8k x 14 paper by City equipment.

Councilman Morton commended the Fire Department and the Department of Public
Works for their quick action in response to an urgent call for assistance by a
citizen during the heavy rains.
It was moved by Councilman Dunnum that approval be granted for the installa-
tion of a traffic signal at the intersection of Woodruff Avenue and Everest Street,
at an estimated cost of $11,000.00.
Mrs. Cora Rowe, 9435 Borson, thanked Council for its action taken toward
the installation of the traffic signal which she had requested some time ago;
also, fhe removal of the pump in the area was requested as soon as possible.
Mrs. Rowe was informed by the Director of Public Works that the latter item is
being worked on at the present time.
Councilman Dunnum's motion was seconded by Councilman Morton, who wished to
add that the appropriation be made for the signal from gas tax funds.

Councilman Dunnum requested that a study be made of the right turn bay south
on Brookshire Avenue onto Stewart and Gray Rodd.
Councilman Corbin submitted a brief report on the last League meeting which he
had attended, advising he would submit copies of certain items to the other council --
members.
Mayor Temple requested the City Manager to set up a night meeting for the
purpose of interviewing park board applicants to fill by February 2, an existing
vacancy.

It was moved by Councilman Morton, seconded by Councilman Dickerson and
passed by the following vote to authorize the Chairman of the. Youth Advisory
Committee to attend the Governor's Conference on Youth, February 8-10 in Long
Beach, with necessary and reasonable expenses and also any councilman who
could attend, as well as`the Deputy Chief of Police because Council has asked
the Police Department to be the supervisory agency for the Youth Committee and
also because of all the work being done with the youth at the schools.
